सं0 6/एन-7-35/10-468(6)—भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बिहार के राज्यपाल, स्वास्थ्य विभाग के अंतर्गत, परिचारिका संवर्ग में नियुक्ति, प्रोन्नति एवं सेवा शर्तोंं को अवधारित करने के लिए निम्नलिखित नियमावली बनाते हैं।-

1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ। - (1) यह नियमावली ''बिहार परिचारिका संवर्ग नियमावली, 2013'' कही जा सकेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरंत प्रवृत्त होगी।

2. परिभाषाएँ। - जब तक विषय या संदर्भ में अन्यथा अपेक्षित न हो, इस नियमावली में :-

(1) 'सरकार' से अभिप्रेत है बिहार राज्य सरकार ; (2) 'विभाग' से अभिप्रेत है स्वास्थ्य विभाग ;

(3) 'नियुक्ति प्राधिकार' से अभिप्रेत है जिला स्तरीय उप-संवर्ग के संबंध में संबंधित जिला के असैनिक शल्य चिकित्सक - सह मुख्य चिकित्सा पदाधिकारी, चिकित्सा महाविद्यालय अस्पताल स्तरीय उप-संवर्ग के संबंध में संबंधित चिकित्सा महाविद्यालय अस्पताल के अधीक्षक, और सुपर स्पेशलिटी अस्पताल स्तरीय उप-संवर्ग के संबंध में संबंधित सुपर स्पेशलिटी अस्पताल के निदेशक;

(4) 'जी0 एन0 एम0' से अभिप्रेत है जेनरल नर्सिंग एण्ड मिडवाईफरी ; (5) 'आयोग' से अभिप्रेत है बिहार कर्मचारी चयन आयोग; (6) 'संवर्ग' से अभिप्रेत है बिहार परिचारिका संवर्ग; (7) 'परिशिष्ट' से अभिप्रेत है इस नियमावली के साथ संलग्न परिशिष्ट;

(8) 'सुपरस्पेशलिटी अस्पताल' से अभिप्रेत है विभाग द्वारा सुपरस्पेशलिटी अस्पताल के रूप में समय-समय पर अधिसूचित अस्पताल; तथा

(9) 'मान्यता प्राप्त संस्थान' से अभिप्रेत है भारतीय नर्सिंग परिषद से जी0 एन0 एम0 कोर्स के लिए मान्यता प्राप्त संस्थान।

3. संवर्ग का गठन।-बिहार परिचारिका का संवर्ग जिला स्तरीय, संबंधित चिकित्सा महाविद्यालय अस्पताल स्तरीय और संबंधित सुपर स्पेशलिटी अस्पतालों के पृथक उप-संवर्गों में गठित होगा। प्रत्येक उप-संवर्गों में प्रत्येक2 (cid:18)बहार गजट (असाधारण), 12 नव+बर 2013 कोटि के पदों की संख्या तथा उप-संवर्गों के कुल पदों की संख्या उतनी होगी जितनी सरकार द्वारा स्वीकृत की गई हो।

4. संवर्ग का पदसोपान।- इस संवर्ग के उप-संवर्गों की विभिन्न कोटियाँ एवं पदसोपान परिशिष्ट-1 के अनुसार होंगे।

5. भर्ती। - इस संवर्ग में नियुक्ति मूल कोटि के पद पर आयोग की अनुशंसा के आधार पर सीधी भर्ती से होगी।

6. अर्हताएँ। - (1) मूल कोटि के पद पर सीधी भर्ती द्वारा नियुक्ति के लिए न्यूनतम शैक्षणिक अर्हता मान्यता प्राप्त संस्थान से भारतीय नर्सिंग परिषद द्वारा समय - समय पर निर्धारित अवधि का जी0 एन0 एम0 में प्रशिक्षण कोर्स में उत्तीर्णता होगी एवं तत्संबंधी प्रमाण पत्र प्राप्त रहना आवश्यक होगा।

(2) सीधी भर्ती के लिए न्यूनतम आयु सीमा 21 वर्ष होगी और अधिकतम आयु सीमा वही होगी जो सरकार द्वारा, समय - समय पर, आरक्षण कोटिवार, विनिश्चित की जाय। संबंधित वर्ष की 1 ली अगस्त को, उम्र के अवधारण के लिए, कट ऑॅफ डेट मानी जायेगी।

7. भर्ती की प्रक्रिया। - (1) नियुक्ति प्राधिकार वर्ष की 1 ली अप्रैल की स्थिति के आधार पर रिक्ति की गणना कर और रोस्टर क्लीयरेन्स कराकर, आरक्षण कोटिवार अधियाचना आयोग को 30 अप्रैल तक भेजेगा। (2) अधियाचना के आलोक में आयोग रिक्तियों को विज्ञापित कर आवेदन पत्र आमंत्रित करेगा और निम्नलिखित के आधार पर मेधासूची तैयार करेगा :- (क) जी0 एन0 एम0 कोर्स की परीक्षा में प्राप्तांक के लिए - 50 अंक (ख) उच्चतर डिग्री के लिए - 10 अंक (ग) बिहार राज्य के सरकारी अस्पतालों में कार्य का अनुभव (प्रति वर्ष के लिए 5 अंक, अधिकतम 25 अंक) - 25 अंक (घ) साक्षात्कार के लिए - 15 अंक कुल - 100 अंक टिप्पणी :- जी0 एन0 एम0 कोर्स के लिए किसी अभ्यर्थी को प्रदान किये जाने वाले अंकों का अवधारण उक्त कोर्स की परीक्षा में प्राप्त कुल अंकों के प्रतिशत को 0.5 के गुणक से गुणा कर करना होगा। यथा, यदि किसी अभ्यर्थी द्वारा 50 % अंक प्राप्त किया गया हो तो उसे 50 % x 0.5 = 25 अंक दिये जायेंगे।

(3) आयोग, उपर्युक्त उप-नियम (2) के आधार पर तैयार मेधासूची और अधियाचित रिक्तियों के अनुरूप, आरक्षण कोटिवार, अनुशंसा नियुक्ति प्राधिकार को भेजेगा। (4) साक्षात्कार के लिए प्रक्रिया आयोग के द्वारा अवधारित की जाएगी।

8. परिवीक्षा अवधि। - नियुक्ति के उपरान्त परिवीक्षा अवधि दो वर्षों की होगी। परिवीक्षा अवधि में सेवा संतोषजनक नहीं पाये जाने की दशा में परिवीक्षा अवधि का विस्तार एक वर्ष के लिए किया जा सकेगा। यदि विस्तारित अवधि में भी सेवा संतोषजनक नहीं पायी जायेगी तो नियुक्ति प्राधिकार ऐसी परिचारिका को सेवामुक्त कर सकेगा। 9. विभागीय परीक्षा। - ग्रेड 'ए' नर्स को विभाग द्वारा आयोजित विभागीय परीक्षा उत्तीर्ण करनी होगी। विभागीय परीक्षा का पाठ्‌यक्रम विभाग द्वारा अवधारित किया जायेगा।

10. सम्पुष्टि। - परिवीक्षा अवधि में संतोषजनक सेवा होने और विभागीय परीक्षा उत्तीर्ण करने पर ग्रेड 'ए' नर्स को सेवा में सम्पुष्ट किया जा सकेगा।

11. वरीयता। - ग्रेड 'ए' नर्स की आपसी वरीयता आयोग के द्वारा तैयार मेधासूची के अनुसार अवधारित की जायेगी।

12. परिशिष्ट - 1 में उल्लेखित इस संवर्ग के पदों पर, इस नियमावली के प्रवृत्त होने के पूर्व से नियुक्त/प्रोन्नत एवं कार्यरत कर्मी इस संवर्ग में स्वतः शामिल समझे जायेंगे।

13. प्रोन्नति के सोपान। - (1) सेवा में सम्पुष्ट ग्रेड 'ए' नर्स को रिक्ति की उपलब्धता के अधीन रहते हुए एवं वरीयता सह-योग्यता के अनुसार परिशिष्ट - 1 में उल्लिखित वार्ड बहन के पदों पर प्रोन्नति दिये जाने पर विचार किया जायेगा। (2) वार्ड बहन (वार्ड सिस्टर) से सहायक मैट्रोन/सहायक परिचारिका अधीक्षक की कोटि में प्रोन्नति पर विचार के लिए पोस्ट बेसिक - बी0 एस0 सी0 नर्सिंग में 2 वर्षों का प्रशिक्षण पूर्ण करना अनिवार्य होगा। (3) पोस्ट बेसिक - बी0 एस0 सी0 नर्सिंग में दो वर्षो का प्रशिक्षण प्राप्त नहीं करने की स्थिति में वार्ड बहन की प्रोन्नति रिक्ति की उपलब्धता के अधीन रहते हुए वरीय वार्ड बहन के पद पर वरीयता-सह-योग्यता के आधार पर की जायेगी। (4) सहायक मेट्रोन/ सहायक परिचारिका अधीक्षक की प्रोन्नति रिक्ति की उपलब्धता के अधीन रहते हुए वरीयता-सह-योग्यता के आधार पर वरीय मेट्रोन/ उप परिचारिका अधीक्षक के पद पर की जायेगी। (5) वरीय मेट्रोन/उप परिचारिका अधीक्षक की प्रोन्नति रिक्ति की उपलब्धता के अधीन रहते हुए वरीयता-सह-योग्यता के आधार पर परिचारिका अधीक्षक/सहायक निदेशक (नर्सिग) के पद पर की जायेगी। (6) वरीय वार्ड बहन की प्रोन्नति रिक्ति की उपलब्घता के अधीन रहते हुए वरीयता-सह-योग्यता के आधार पर वार्ड बहन पर्यवेक्षिका के पद पर की जायेगी।3 (cid:18)बहार गजट (असाधारण), 12 नव+बर 2013 (7) प्रोन्नति पर विचारार्थ, सामान्य प्रशासन विभाग द्वारा, समय - समय पर, अवधारित कालावधि का पूरा होना आवश्यक होगा। प्रोन्नति संबंधी और चारित्री या पी0 ए0 आर0 आरोप / विभागीय कार्यवाही/ आपराधिक कार्यवाही आदि संबंधी सामान्य प्रशासन विभाग द्वारा समय - समय पर निर्गत अनुदेशों का अनुपालन, प्रोन्नति पर विचार करते समय, आवश्यक होगा।

14. विभागीय प्रोन्नति समिति। - (1) प्रोन्नतियाँ विभागीय प्रोन्नति समिति की अनुशंसा के आधार पर होंगी। (2) विभागीय प्रोन्नति समिति का गठन विभाग द्वारा किया जायेगा।

15. आरक्षण। - सरकार के आरक्षण अधिनियम के प्रावधानों और सरकार द्वारा समय - समय पर सीधी भर्ती एवं प्रोन्नति हेतु निर्गत आरक्षण रोस्टर का अनुपालन करना अनिवार्य होगा।

16. प्रशासनिक नियंत्रण। - तीनों उप-संवर्गों के लिए अलग-अलग नियुक्ति प्राधिकार होते हुए भी उप-संवर्गों पर समग्र प्रशासनिक नियंत्रण एवं उनके बीच समन्वय की शक्तियाँ निदेशक प्रमुख, स्वास्थ्य सेवाएँ, बिहार में निहित रहेंगी; परन्तु यह कि नर्सिंग निदेशालय के कार्यरत हो जाने एवं निदेशक (नर्सिंग) के पद पर पदस्थापन हो जाने पर उप-संवर्गों पर समग्र प्रशासनिक नियंत्रण एवं उनके बीच समन्वय की शक्तियाँ निदेशक (नर्सिंग) में स्वतः निहित हो जायेंगी।

17. परिधान (यूनिफार्म)। - परिचारिकाओं के लिए कत्र्तव्य के दौरान विभाग द्वारा कोटिवार निर्धारित परिधान (यूनिफार्म) पहनना अनिवार्य होगा।

18. इस नियमावली में जिन विषयों का प्रावधान नहीं हो सका है, उनके लिए सरकार की प्रासंगिक संहिता/नियमावली/संकल्प/अनुदेश के प्रावधान लागू होंगे।

19. शंकाओं का निराकरण। - यदि इस नियमावली के किसी उपबंध के निर्वचन में कोई संशय हो तो विभाग को निर्देशित किया जायेगा और इस संबंध में विभाग का विनिश्चय अन्तिम होगा।

20. कठिनाई का निराकरण। - यदि इस नियमावली के उपबंधों के कार्यान्वयन में कोई कठिनाई उत्पन्न हो तो विभाग को ऐसी किसी कठिनाई का निराकरण करने की शक्ति होगी।

21. निरसन एवं व्यावृति। - (1) इस संवर्ग के संबंध में विभाग द्वारा पूर्व में समय - समय पर निर्गत नियमावली और सभी संकल्प, आदेश, अनुदेश आदि इस नियमावली के प्रवृत्त होने की तिथि के प्रभाव से निरसित समझे जायेंगे। (2) ऐसा निरसन के होते हुए भी, उपर्युक्त नियमावली, संकल्प, आदेश, अनुदेश आदि के अधीन शक्तियों का प्रयोग करते हुए किया गया कोई कार्य या की गयी कोई कार्रवाई इस नियमावली के अधीन किया गया या की गयी समझी जायेगी, मानो यह नियमावली उस तिथि को प्रवृत्त थी जिस तिथि को ऐसा कोई कार्य किया गया था या ऐसी कोई कार्रवाई की गयी थी।

परिशिष्ट - 1 [नियम 2 (7), 4, 12, 13 द्रष्टव्य] बिहार परिचारिका संवर्ग का पदसोपान

1. जिला स्तरीय उपसंवर्ग। -

नोट :- उपर्युक्त सभी कोटियों का वेतन बैंड एवं ग्रेड-पे वही होगा जो सरकार द्वारा समय-समय पर निर्धारित की जाय।

No. 6/N-7-35/10-468(6)—In exercise of powers conferred by proviso to Article 309 of the Constitution of India, the Governor of Bihar is pleased to make the following Rules to determine appointment, promotion and service conditions in the Nurse cadre under the Health Department. -

1. Short title, extent & commencement.—(1) These Rules may be called as the " Bihar Nurse Cadre Rules, 2013." (2) It will extend to the whole State of Bihar. (3) It will come into force at once. 2. Definitions.—In these Rules, unless otherwise requires in the subject or context - (1) ' Government' means Bihar State Government ; (2) ' Department' means Health Department ; (3) 'Appointing Authority' means Civil Surgeon-cum-Chief Medical Officer of the concerned district with respect to district level Sub cadre; Superintendant of5 (cid:18)बहार गजट (असाधारण), 12 नव+बर 2013 concerned Medical College Hospital with respect to Medical College Hospital level sub-cadre; and Director of concerned Super Speciality Hospital with respect to Super Speciality Hospital level sub-cadre;

(4) 'G.N.M.' means General Nursing and Midwifery ; (5) 'Commission ' means Bihar Staff Selection Commission; (6) 'Cadre' means Bihar Nurse Cadre; (7)` 'Appendix' means appendix appended to these Rules ;

(8) 'Super Speciality Hospital' means a Hospital notified by the Department as Super Speciality Hospital from time to time ; and

(9) 'Recognized Institution' means an Institution recognized by Indian Nursing Council for G.N.M. Course.

3. Constitution of cadre. - Bihar Nurse Cadre shall be constituted in separate sub- cadres of District level, concerned Medical College Hospital level and concerned Super Speciality Hospital level. In each sub-cadre, number of posts in every grade and total number of posts in the sub-cadres shall be as many as are sanctioned by the government from time to time.

4. Chain Posts of cadre. - Different grade and chain posts of sub-cadres of this cadre shall be according to appendix-1.

5. Recruitment. - The appointment in this cadre shall be, on the basis of recommendation of the Commission, by direct recruitment to the basic grade post.

6. Qualifications. - (1) For appointment by direct recruitment to the basic grade posts, minimum educational qualification shall be pass in G.N.M. training course of the period as determined by Indian Nursing Council from, time to time, from a recognized institution and a certificate related thereto shall be necessary. (2) For direct recruitment, minimum age limit shall be 21 years and maximum age limit shall be the same which may be determined reservation categorywise from time to time by the Government. 1st August of the concerned year shall be deemed to be the cut off date for determination of age.

7. Procedure of Recruitment. - (1) The appointing authority, after calculating vacancy on the basis of position on 1st April of the year and getting roster cleared, shall send reservation categorywise requisition to the Commission latest by 30th April. (2) In view of the requisition, the Commission shall invite applications by advertising vacancies and shall prepare merit list on basis of the following :- (a) For marks obtained in G.N.M. course examination - 50 marks (b) For higher degree - 10 marks (c) For experience in Government Hospitals of Bihar State (5 marks per year, maximum 25 marks) - 25 marks - 15 marks (d) For Interview Total - 100 marks Explanation :—The marks to be given to a candidate for G.N.M. course examination shall be determined by multiplying the percentage of total marks obtained in the aforesaid examination by multiple of 0.5. For example, if a candidate has obtained 50% marks, then he will be given 50% x 0.5 = 25 marks.

(3) The Commission shall send prepared merit list on the basis of aforesaid sub-Rule (2), and reservation categorywise recommendations in confirmity with requisitioned vacancies to the Appointing Authority.

(4) Procedure for interview shall be determined by the Commission.

8. Probation period. - After appointment, probation period will be of two years. In case, the service during probation period is not found satisfactory, the probation period will be extended for one year. If the service is not found satisfactory in extended period also, then the appointing authority may terminate service of such Nurse.

9. Departmental Examination. - Grade – A Nurse shall have to pass the departmental examination organised by the Department. The syllabus of departmental examination will be determined by the Department.

10. Confirmation. - On being satisfactory service during probation period and passing of departmental examination a Grade – A Nurse may be confirmed in the service.

11. Seniority. - The inter-se seniority of Grade – A Nurse shall be determined according to the merit list prepared by the Commission.

12. The personnel appointed/promoted and working on the posts of this cadre mentioned in appendix – 1 before the commencement of these Rules shall be deemed to be automatically included in this cadre.

13. Chain Posts of Promotion. - (1) Subject to availability of the vacancies and according to seniority-cum-merit, Grade - A Nurse shall be considered to be promoted on the posts of Ward Sister mentioned in Appendix – 1.

(2) For consideration of promotion from Ward Sisters to Assistant matron/ Assistant Nursing Superintendent, completion of two years Post Basic - B.Sc. Nursing training shall be essential.

(3) In case of not getting two years training in Post Basic B.Sc. Nursing, a Ward Sister will be promoted to the post of Senior Ward Sister on basis of seniority –cum-merit subject to the availability of the vacancy.

(4) An Assistant Matron/ Assistant Nursing Superintendent will be promoted to the post of Senior Matron/ Deputy Nursing Superintendent on the basis of seniority-cum-merit subject to availability of the vacancy.

(5) A Senior Matron/ Deputy Nursing Superintendent will be promoted to the post of Nursing Superintendent/ Assistant Director (Nursing) on the basis of seniority-cum-merit subject to availability of vacancy.

(6) A Senior Ward Sister will be promoted to the post of Ward Sister Supervisor on the basis of seniority-cum-merit subject to availability of vacancy.

(7) For consideration of promotion, completion of 'KALAWADHI' determined by the General Administration Department, from time to time, shall be necessary. Compliance of instructions issued by General Administration Department, from time to time, with respect to promotion and character Roll / P.A.R, allegations / departmental proceedings / criminal proceedings etc., shall be necessary at the time of consideration of promotion. 14. Departmental Promotion Committee. - (1) Promotions will be on the basis of recommendations of the Departmental Promotion Committee. (2) The Departmental Promotion Committee shall be constituted by the Department.

15. Reservation. - Compliance of provisions of Reservation Act of the Government and reservation roster for direct recruitment and promotion issued, from time to time, by the Government shall be essential.

16. Administrative Control. - Notwithstanding existence of separate Appointing Authorities for all the three sub-cadres the powers of overall administrative control on the7 (cid:18)बहार गजट (असाधारण), 12 नव+बर 2013 sub-cadres and coordination between them shall vest in the Director – in – Chief, Health Services, Bihar; Provided that the powers of overall administrative control on the sub-cadres and coordination between them shall automatically be vested in the Director (Nursing) after the Nursing Directrate becomes functional and Director (Nursing) is posted.

17. Uniform. - It shall be essential for Nurses to wear uniform during the duty as determined gradewise by the Department.

18. For the subjects which have not been provided in these Rules, provisions of concerned Codes / Rules / Resolutions / Instructions shall apply.

19. Removal of Doubt. - If any doubt arises in respect of interpretation of any provision of these Rules, it shall be referred to the Department and in this respect the decision of the Department shall be final.

20. Removal of difficulties. – If any difficulty arises in implementation of provisions of these Rules, the department shall have powers to remove such difficulty.

21. Repeal and Savings. - (1) The Rules and all resolutions, orders, instructions etc issued earlier, from time to time, by the Department with respect to this cadre, shall be deemed to be repealed with effect from the date of coming into force of these Rules. (2) Notwithstanding such repeal, any work done or any action taken in exercise of the powers conferred by aforesaid Rules, resolutions, orders, instructions etc shall be deemed to be done or taken under these Rules as if these Rules were in force on the date on which such a work was done or such an action was taken.
