बिहार विद्यालय परीक्षा समिति,

सम्बद्धता (संशोधन) विनियमावली, 2013

बिहार विद्यालय परीक्षा समिति अधिनियम, 1952 (समय-समय पर यथासंशोधित) की धारा-17 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए, बिहार विद्यालय परीक्षा समिति, पटना एतद्‌ द्वारा प्रशासी विभाग द्वारा संपुष्टिकरण के अधीन रहते हुए, बिहार विद्यालय परीक्षा समिति (उच्च माध्यमिक) उपविधि का संशोधन करने के लिए निम्नलिखित विनियमावली बनाती है जिसका पूर्व प्रकाशन अधिनियम की धारा-17 के अधीन किया जा चुका है और इसके प्रकाशन की तिथि से तीस दिनों के भीतर कोई आपत्ति प्राप्त नहीं हुई हैः-

1. संक्षिप्त नाम, विस्तार और आरंभ :-

(i) यह विनियमावली बिहार विद्यालय परीक्षा समिति सम्बद्धता (उच्च माध्यमिक) (संशोधन) विनियमावली, 2013 कही जायेगी।

(ii) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा । (iii) यह अधिसूचना की तिथि के प्रभाव से प्रवृत होगी ।

2. (1) बिहार विद्यालय परीक्षा समिति (उच्च माध्यमिक) सम्बद्धता उपविधि तद्‌नुसार संक्षिप्त नाम में प्रयुक्त शब्द ''उपविधि'' शब्द एवं अंक ''विनियमावली, 2011'' द्वारा प्रतिस्थापित किया जायेगा तथा संक्षिप्त नाम उपशीर्षक के2 (cid:18)बहार गजट (असाधारण), 14 नव+बर 2013 अधीन शब्द ''परीक्षा समिति'' के बाद और शब्द ''सम्बद्धता'' के पूर्व शब्द एवं कोष्ठक ''(उच्च माध्यमिक)'' अंतस्थापित किया जायेगा।

(2) बिहार विद्यालय परीक्षा समिति (उच्च माध्यमिक) उपविधि, अध्याय-I का क्रमांक संक्षिप्त नाम के अधीन खण्ड-(ii) निम्नलिखित द्वारा प्रतिस्थापित किया जायेगा :-

''(ii) यह अधिसूचना की तिथि से प्रवृत होगी'' (3) दिनांक 14 जुलाई 2011 को अधिसूचित बिहार विद्यालय परीक्षा समिति (उच्च माध्यमिक) संबद्धता उपविधि में शब्द ''उपविधि'' जहाँ कहीं भी प्रयुक्त किया गया हो, शब्द एवं अंक ''विनियमावली, 2011'' द्वारा प्रतिस्थापित किया जायेगा।

3. उक्त विनियमावली, 2011 के विनियम-2 के उपविनियम(XXIII)का संशोधन :- (1) उक्त विनियामवली, 2011 के विनियम-2 का उपविनियम(XXIII) निम्नलिखितद्वारा प्रतिस्थापित कियाजायगा।

(XXIII) माध्यमिक विद्यालय/उच्च माध्यमिक विद्यालय से अभिप्रेत है; ''स्थापना अनुमति प्राप्त कोई माध्यमिक विद्यालय या प्रस्वीकृति प्राप्त माध्यमिक विद्यालय या माध्यमिक शिक्षा में शिक्षण देने वाला या इस रूप में मान्यता प्राप्त विद्यालय एवं उच्च माध्यमिक विद्यालय से अभिपे्रत है बिहार विद्यालय परीक्षा समिति (उच्च माध्यमिक प्रभाग) से संबद्ध।''

(2) उक्त विनियमावली 2011 के विनियम-2 के उपविनियम (XXVIII)के बाद निम्नलिखित नये उपविनियम(XXIX),(XXX), (XXXI), (XXXII),(XXXIII), (XXXIV), (XXXV),(XXXVI)जोड़े जायेगें :-

(XXIX)''तदर्थ प्रबंध समिति'' से अभिपे्रत है;उक्त विनियम 2011 के विनियम 16, 17 एवं 17 क के अनुसार सोसाईटी/न्यास/शासी निकाय के अधीन विद्यालयों के लिए प्रबंधन समिति के गठित होने तक अस्थाई रूप में विद्यालयों के प्रबंधन के लिए गठित तदर्थ समिति;

(XXX)''अपीलीय प्राधिकार'' से अभिप्रेत है; सम्बद्धता/अनुदानित माध्यमिक एवं उच्च माध्यमिक विद्यालयों में शिक्षकों की सेवा शर्त्तों एवं अनुदान संबंधी शिकायतें सुनकर विनिश्चय करने हेतु प्रमंडलीय स्तर पर गठित अपीलीय प्राधिकार;

(XXXI)''सोसाईटी/न्यास'' से अभिप्रेत है;सुसंगत अधिनियम के अधीन गठित सोसाईटी या न्यास; (XXXII)''शासी निकाय/विद्यालय प्रबंधन समिति'' से अभिप्रेत है;विनियमावली 2011 के विनियम 17 क (1) एवं (2)के अधीन गठित विद्यालयों के लिए गठित शासी निकाय/प्रबंध समिति;

(XXXIII) ''निबंधन'' से अभिप्रेत है; इस विनियमावली के 17 क के अधीन गठित शासी निकाय/प्रबंध समिति का बिहार विद्यालय परीक्षा समिति द्वारा निबंधन;

(XXXIV)''निबंधन संख्या'' से अभिप्रेत है; इस उपविधि के 17 क के अधीन गठित शासी निकायी/प्रबंध समिति को बिहार विद्यालय परीक्षा समिति द्वारा दी गयी निबंधन संख्या;

(XXXV)''विभाग'' से अभिप्रेत है; शिक्षा विभाग, बिहार, पटना; (XXXVI)''राज्य सरकार'' से अभिप्रेत है; बिहार राज्य सरकार; 4. उक्त विनियमावली, 2011 के विनियम 3 के उपविनियम (4)के खंड (ख) एवं (ग) निम्नलिखित द्वारा प्रतिस्थापन किये जायेगें :-

(ख) माध्यमिक विद्यालयों में वर्ग 09वीं एवं 10वीं में उपवर्ग कक्ष एवं प्रत्येक उपवर्ग कक्ष में छात्रों की संख्या का निर्धारण, बिहार विद्यालय परीक्षा समिति द्वारा विभाग की अनुमति से किया जायेगा।

(ग) उच्च माध्यमिक विद्यालयों (2 महाविद्यालय) में वर्ग 11वीं एवं 12वीं में उपवर्ग कक्ष एवं प्रत्येक उपवर्ग कक्ष में छात्रों की संख्या का निर्धारण बिहार विद्यालय परीक्षा समिति द्वारा विभाग के अनुमति से किया जायेगा। परन्तुक बिहार विद्यालय परीक्षा समिति से संबद्ध माध्यमिक/उच्च माध्यमिक (2 महाविद्यालय) को उपरोक्त नियम 3 में निर्दिष्ट माप-दण्ड पूर्ण नहीं करने की स्थिति में अनिवार्य रूप से 3 वर्ष के भीतर निर्दिष्ट माप-दण्ड को पूर्ण करना होगा।

5. उक्त विनियमावली 2011 के विनियम-5 के उपविनियम(1) का संशोधनः- उक्त विनियमावली, 2011 के विनियम 5 के उपविनियम (1) की प्रथम पंक्ति में प्रयुक्त शब्द, अंक एवं कोष्ठक ''कोटि 3(1) ख'' शब्द, अंक एवं कोष्ठक''कोटि 3(i) (iv)'' द्वारा प्रतिस्थापित किये जायगें।

6. उक्त विनियमावली, 2011 के विनियम 12 का संशोधन :- उक्त विनियमावली, 2011 के विनियम 12 अंत में निम्नलिखित पंक्ति जोड़ी जायेगी। ''बिहार विद्यालय परीक्षा समिति द्वारा विहित फीस, समय-समय पर, परिवर्तितकी जा सकेगी'' । 7. उक्त विनियमावली 2011 के विनियम 14 के उपविनियम (4) का संशोधनः- उक्त विनियमावली 2011 के विनियम 14 का उपविनियम (4) निम्नलिखित प्रतिस्थापित किया जायेगा :-

''आवेदन के संवीक्षोपरान्त यदि यह पाया जाय कि विद्यालय न्यूनतम शर्तों को पूरा नहीं करता है तो निरीक्षण समिति की नियुक्ति के पूर्व, सम्बद्धता समिति के समक्ष समुचित निर्णयार्थ रखा जायगा।''

8. उक्त विनियमावली 2011 के विनियम 14 के उपविनियम (7) का संशोधन :- उक्त विनियमावली 2011 के विनियम 14 के उपविनियम (7)निम्नलिखित प्रतिस्थापित किया जायेगा :- ''बोर्ड से नवसम्बद्धता प्राप्त संस्था न तो सरकार से अनुदान प्राप्ति का दावा कर सकेगा और न ही सरकार द्वारा विद्यालय के अधिग्रहण का दावा कर सकेगा ।''

9. उक्त विनियमावली 2011 के विनियम 14 में उपविनियम(13) जोड़ा जाना :- उक्त विनियमावली 2011 के विनियम 12 के बाद निम्नलिखित एक नया विनियम 13 जोड़ा जायेगा :- ''किसी संस्था के सोसाईटी/ट्रस्ट के मान्यता संबंधी विवाद होने पर सक्षम न्यायालय/प्राधिकार के द्वारा पारित निर्णय विधि मान्य होगा''।

10. उक्त विनियमावली 2011 के विनियम 17 के उपविनियम (2) के खण्ड (vii) के बाद निम्नलिखित एक परंतुक जोड़ा जायगा :- ''परन्तु उपर्युक्त प्रावधान तुरंत के प्रभाव से लागू किये जायेंगे और जो पूर्व में सम्बद्ध है और उपर्युक्त प्रावधानों को पूरा नहीं करते हैं उनसे 03 वर्ष के भीतर सुयोग्य अर्हता प्राप्त प्रतिस्थानियों द्वारा सुधारात्मक उपाय करने की अपेक्षा की जायेगी।''

11. उक्त विनियमावली 2011 के अध्याय 5 के बाद निम्नलिखित एक नया अध्याय 5 क जोड़ा जायगाः-

''अध्याय- 5 क'' 17. क(1) शासी निकाय —निम्नलिखित को मिलाकर शासी निकाय गठित किया जायगा :-

उपरोक्त नियम 17 ''क'' में यथा प्रावधानित शासी निकाय एवं प्रबंध समिति के संबंध में सूचना प्राप्ति के उपरान्त, निबंधित करवा कर, निबंधन संख्या/प्रमाण-पत्र बिहार विद्यालय परीक्षा समिति से संबंधित संस्था द्वारा संसूचित के उपरान्त गठित शासी निकाय एवं प्रबंध समिति क्रियाशील होगी। 17. ख तदर्थ प्रबंध समिति—उपरोक्त 17 एवं 17 क में क्रमशः प्रावधानित सोसाईटी/न्यास/विद्यालय प्रबंधन समिति एवं शासी निकाय/प्रबंध समिति का गठन न होने की स्थिति में, माध्यमिक/उच्च माध्यमिक विद्यालय (2 महाविद्यालयों) में अध्यक्ष, बिहार विद्यालय परीक्षा समिति की अनुमति से निम्नलिखित को मिलाकार तदर्थ समिति गठित की जायेगी।

विनियमावली 2011 के अध्याय-5 के विनियमावली 17 एवं अध्याय-5(क) के 17 ''क'' में क्रमशः प्रावधानित सोसाईटी/न्यास/विद्यालय प्रबंधन समिति अथवा शासी निकाय/प्रबंध समिति का गठन संबंधित संस्था द्वारा स्वेच्छा से किया जायेगा।

11. उक्त विनियमावली 2011 की विनियम 22 में संशोधन :-उक्त विनियमावली, 2011 के विनियम 22 के वर्त्तमान प्रावधान को उपविनियम (1) के रूप में संख्यांकित करते हुए उसके बाद निम्नलिखित उपविनियम (2) जोड़ा जायगा :-

''(2) अनुदानित माध्यमिक/उच्च माध्यमिक विद्यालय (2 महाविद्यालय) के शिक्षकों एवं शिक्षकेत्तर कर्मियों को उनकी सेवा संबंधित शिकायतें, अनुदान वितरण में विवाद एवं संबंधित संस्था के सोसाईटी/ट्रस्ट/प्रबंधन समिति/शासी निकाय/प्रबंध समिति एवं तदर्थ समिति के विवाद का निपटारा, राज्य सरकार द्वारा, प्रमण्डल स्तर पर, अधिसूचित अपीलीय प्राधिकार द्वारा की जायेगी। कार्यालय संचालन के संबंध में, अलग से विभाग द्वारा आदेश निर्गत किया जायेगा। बिहार विद्यालय परीक्षा समिति द्वारा अपीलीय प्राधिकार की स्थापना का वित्तीय निर्वह्‌न किया जायेगा।''

आदेश से, (ह0) अस्पष्ट, सचिव, बिहार विद्यालय परीक्षा समिति।5 (cid:18)बहार गजट (असाधारण), 14 नव+बर 2013 Bihar School Examination Board, Affiliation (High Secondary) (Amendment) Regulation, 2013 In exercise of power conferred under Section 17 of the Bihar School Examination Board Act, 1952 (as amended from time to time) The Bihar School Examination Board, Patna is hereby make the following Regulations to amend The Bihar School Examination Board (Senior Secondary) affiliated By laws subjet to the confirmation of the Administration Department, the previous publication of which has been made under Section 17 of the Act and any objection has not been received within thirty days from the date of its publication :-

1. Short title extent and commencement :— (i) These Regulation shall be called Bihar School Examination Board Affiliation (High Secondary) (Amendment) Regulation, 2013.

(ii) It shall extend to the whole of the State of Bihar. (iii) These Regulation shall come into force from the date of notification. 2. (1) The word 'Bye-law' used in the heading 'short title' in Bihar School Examination Board (Senior Secondary) Affiliation Bye-laws shall be replaced by "Regulation, 2011" and the words bracket "(Senior Secondary)" shall be inserted in between the words "Examination Board" and the word "Affiliation" in the Subheading in the Short Title of the Bihar School Examination Board (Senior Secondary) Affiliation Bye-laws.

(2) Clause (ii) under the heading 'Short Title' of Chapter- I of the Bihar School Examination Board (Senior Secondary) By-laws shall be substituted by following:-

"(ii) It will come into force from the date of notification." (3) Where ever the word 'Bye-laws' is used in the Bihar School Examination Board (Senior Secondary) Affiliation Bye-laws, notified on 14th July 2011, shall be substituted by the word and number 'Regulation, 2011'.

3. Amendment in Regulation-2 of the said Regulation, 2011:— (1) Subregulation (XXIII) of Regulation 2 of the said Regulation, 2011 shall be substituted by the following :-

"(XXIII)" Secondary School means a secondary schools received establish permission or received reconition or teaching in secondary education or school received recognition as such and "High Secondary School" means school affiliated with Bihar School Examination Board (Senior Secondary Division).

(2) The following new subregulation (XXIX), (XXX), (XXXI), (XXXII), (XXXIII), (XXXIV), (XXXV), (XXXVI) shall be added after Subregulation (XXVIII) of Regulation- 2 of the said Regulation, 2011.

(XXIX) "Ad hoc Managing Committee" means the Ad hoc Committee constituted temporarily for the management of schools till the constitution of the Managing Committee of schools under Society/trust/governing body according to subregulation 16, 17 and 17 A of the said Regulation, 2011.

(XXX) "Appellate Authority" means Appellate Authority constituted at the Divisional level to decide complaints regarding service-condititon of the teachers and aid in Affiliated/aided secondary and High secondary schools.

(XXXI) "Society/Trust" means Society or Trust constituted under relevant Act. (XXXII) "Governing Body/School Managing Committee" means Governing Body/Managing Committee constituted under subregulation 17A (1) and (2); of the Regulations, 2011 for the schools;

(cid:18)बहार गजट (असाधारण), 14 नव+बर 2013 (XXXIII) "Registration" means Registration of Governing Body/Managing Committee under constituted Regulation 17 (1) of these Regulations, 2011 by the Bihar School Examination Board;

(XXXIV) "Registration Number" means Registration number given by the Bihar School Examination Board to the Governing Body/Managing Committee constituted under Regulation 17A of these Regulations, 2011;

(XXXV) "Department" means Education Department, Bihar, Patna; (XXXVI) "State Government" means State Government of Bihar; 4. Clause (b) and (c) of Sub-Regulation (4) of Regulation 3 of the said Regulations, 2011 shall be substituted by following:-

(b) The section and the number of students in each section of Class IXth and Xth in secondary schools shall be determined by the Bihar School Examination Board with the permission of the Department.

(c) The section and the number of students in each section of Class 11th and 12th in High Secondary schools shall be determined by the Bihar School Examination Board with the permission of the Department.

Provided that those Secondary/High Secondary (+2 College) affiliated with Bihar School Examination Board in case of not fulfilling the standards specified in Regulation 3 of these Regulations, 2011 shall have to fulfill the specified standerds within 3 years essentially.

5. Amendment of Sub-Rregulation (1) of Regulation 5 of aforesaid Regulation, 2011:-

The words, figures and brackets "category 3(1)(b)" used in the first line of the sub- regulation (1) of Regulation 5 of the said Regulations, 2011 shall be substituted by the words, figures and bracket "category 3(1)(iv)".

6. Amendment of regulation 12 of the said Regulations, 2011:- The following line shall be added at the last of regulation 12 of the said Regulations, 2011:-

"The prescribed fee may be changed from time to time by the Bihar School Examination Board".

7. Amendment of sub-regulation (4) of Regulation 14 of the said Regulations, 2011. "The sub-regulation (4) of Regulation 14 of the said Regulation, 2011 shall be substituted by the following:-

"After scrutiny of the application, it is found that the school does not fulfill the minimum conditions, then before appointment of Enquiry Committee, it shall be place before the Affiliation Committee for appropriate decision."

8. Amendment of sub-regulation (7) of Regulation 14 of the said Regulation, 2011. The Sub-regulation (7) of Regulation of 14 of the said Regulation, 2011 shall be substituted by the following:—

"(7) The newly affiliated institution by the Board neither may claim any grant from the government nor claim for take over by the Government."

9. Addition of sub-regulation (13) in Regulation 14 of the said Regulation, 2011:- In Regulation 14 the following new subregulation (13) shall be added after subregulation 12 of the Rgulation, 2011.

"(13) on any dispute regarding recognition to society/trust of any institution, the decision passed by competent Court/Authority shall be valid."

10. The Following proviso shall be added after clause (VII) of subregulation (2) of the regulation 17of the said Regulations, 2011:-

"Provided that the above provisions shall be applied with immediate effect and those which are affiliated earlier and not complying with the above provisions, shall be required to take remedial measures by suitable qualified substitutes within 3 years positively." 11. The following new chapter 5A shall be added after chapter-V of the said Regulation, 2011:-

Chapter-5A 17. A (1) Governing Body.—The Governing Body will be constituted consisting of the following :- (i) 3 doner members of Secondary school/High secondary school (+2

8 Note:- 1. The Procedure of the constitution of the Governing Body will be initiated by the chairman. 2. In case of not being doner (President), principal or retired principal of nearest constituent college as the president and in case of secondary schools, the principal of government/nationalized/minority schools will be nominated as the president by the Bihar School Examination Board. 3. The tenure of guardian members and other members of the Governing Body. (except member secretary) shall be of the 02 years and 03 years respectively. The Governing Body and Managing Committee constituted by any society shall be operational after getting information from the concerned institution regarding the proposed Governing Body and Managing Committee as provided under aforesaid regulation 17A and getting the same registered and receiving the registration number/certificate from The Bihar School Examination Board. 17 B Ad hoc Managing Committee :- In case of non constitution of society/trust/school managing committee and governing body/managing committee as provided under aforementioned regulation 17 and 17 A respectively, the Ad hock committee shall be constituted with the permission of Chairman, Bihar School Examination Board in secondary/senior secondary schools consisting of the following :- (i) Member nominated by Bihar School Examination Board Convenor (ii) Head master/principal of secondary school/ High secondary school

Constitution of society/trust/school managing committee or governing body/managing committee as provided in regulation 17 of Chapter-5 and regulation 17A of Chapter-5A respectively of regulation, 2011 will be made by The Concerned institution voluntarily.

11. Addition of sub-regulation 22.1 in regulation 22 of aforesaid Regulation, 2011.

Sub-regulation 22.1 of regulation 22:-

Service related complaints of teaching and non teaching employees of aided secondary/senior secondary school (+2 College), dispute in distribution of aid and dispute in connection with society/trust/managing committee/ governing body/ managing committee and ad hoc committee of the concerned institution shall be resolved by notified Appellate Authority at Divisional level by the State Government.
