सं0 सं0प्र1/ल0ज0स0/स्था0-45/2012-5289—भारत के संविधान के अनुच्छेद-309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल एतद्‌ द्वारा राज्य के लघु जल संसाधन विभाग के शोध सम्वर्ग के कर्मियों के सुव्यवस्थित प्रबंधन, नियुक्ति, प्रोन्नति तथा सेवा शर्ते के विनियमन हेतु निम्नलिखित ''शोध संवर्ग (लघु जल संसाधन विभाग) नियमावली, 2013'' बनाते हैंः-

1. स्ांक्षिप्त नाम, प्रारम्भ एवं विस्तारस्ांक्षिप्त नाम, प्रारम्भ एवं विस्तारस्ांक्षिप्त नाम, प्रारम्भ एवं विस्तारस्ांक्षिप्त नाम, प्रारम्भ एवं विस्तारः-(1) यह नियमावली शोध संवर्ग (लघु जल संसाधन विभाग) नियमावली, 2013'' कही जा सकेगी ।

(2) यह तुरंत प्रवृत्त होगी । (3) इसका विस्तार राज्य सरकार, बिहार के लघु जल संसाधन विभाग में शोध संवर्ग के कर्मचारियों/पदाधिकारियों तक होगा ।

(4) इसका प्रभाव सम्पूर्ण राज्य में होगा । 2. परिभाषाएँ-परिभाषाएँ-परिभाषाएँ-परिभाषाएँ- इस नियमावली में जब तक सन्दर्भ में अन्यथा अपेक्षित न होः- (क) ''शोध संवर्ग'' से अभिप्रेत हैं राज्य सरकार के लघु जल संसाधन विभाग के कर्मचारियों/पदाधिकारियों का शोध संवर्ग;

(ख) ''सरकार'' से अभिप्रेत है बिहार राज्य सरकार; (ग) '' विभाग'' से अभिप्रेत है लघु जल संसाधन विभाग; (घ) ''कर्मी'' से अभिप्रेत है राज्य के लघु जल संसाधन विभाग के शोध संवर्ग के शोध सहायक, सहायक शोध पदाधिकारी, शोध पदाधिकारी, उप निदेशक(शोध), अपर निदेशक(शोध);

(ड़) ''नियमावली'' से अभिप्रेत है ''शोध संवर्ग (लघु जल संसाधन विभाग) नियमावली, 2013'';

(च) ''संवर्ग बल'' से अभिप्रेत है संवर्ग के कुल कर्मियों की संख्या; (छ) '' कर्मचारी चयन आयोग'' से अभिप्रेत है, बिहार कर्मचारी चयन आयोग;

(ज) ''लोक सेवा आयोग '' से अभिप्रेत है बिहार लोक सेवा आयोग ।

3. संवर्ग की संरचनासंवर्ग की संरचनासंवर्ग की संरचनासंवर्ग की संरचना- यह संवर्ग राज्य के लघु जल संसाधन विभाग के प्रशासनिक नियंत्रण के अधीन रहेगा तथा शोध सहायक से लेकर अपर निदेशक तक के कर्मचारियों/पदाधिकारियों के संवर्ग को राज्य के लघु जल संसाधन विभाग के स्तर पर कोटिकृत किया जायेगा ।

4. पद संरचना, वेतनमान्‌ तथा कोटि-1 - पद संरचना, वेतनमान्‌ तथा कोटि-1 - पद संरचना, वेतनमान्‌ तथा कोटि-1 - पद संरचना, वेतनमान्‌ तथा कोटि-1 - संवर्ग के विभिन्न कोटि के पद तथा नियुक्ति

6. नियुक्ति हेतु अधियाचना नियुक्ति हेतु अधियाचना नियुक्ति हेतु अधियाचना नियुक्ति हेतु अधियाचना - प्रत्येक वर्ष 1 ली अप्रील तक विभिन पदों पर सीधी भर्त्ती तथा प्रोन्नति से भरी जाने वाली रिक्तियों की संख्या नियुक्ति प्राधिकार द्वारा विनिश्चित की जायेगी तथा जिन मामलों में बिहार लोक सेवा आयोग/ बिहार कर्मचारी चयन आयोग की अनुशंसा पर नियुक्ति की जानी हो, उनके संबंध में क्रमशः उक्त आयोगों को 30 अप्रील तक संबंधित विभाग द्वारा अधियाचना भेज दी जायेगी ।

7. उम्र सीमा- उम्र सीमा- उम्र सीमा- उम्र सीमा- भर्त्ती हेतु न्यूनतम उम्र सीमा 21 वर्ष होगी एवं अधिकतम उम्र सीमा वही होगी जो सामान्य प्रशासन विभाग, बिहार, पटना द्वारा समय-समय पर निश्चित की जाय। 8. नियुक्ति की प्रक्रिया (1) नियुक्ति की प्रक्रिया (1) नियुक्ति की प्रक्रिया (1) नियुक्ति की प्रक्रिया (1) शोध सहायक ।-शोध सहायक ।-शोध सहायक ।-शोध सहायक ।- शोध सहायक के स्वीकृत शतप्रतिशत पदों पर बिहार कर्मचारी चयन आयोग द्वारा आयोजित प्रतियोगिता परीक्षा के आधार पर, सीधी भर्त्ती की जायेगी। सीधी भर्त्ती हेतु अभ्यर्थी की न्यूनतम शैक्षणिक अर्हता किसी मान्यता प्राप्त विश्वविधालय या इससे सम्बद्ध संस्थान से रसायन शास्त्र/भू-गर्भ शास्त्र/ जियोटेक्नोलॉजी(Geo Technology )/ गणित/ भौतिक शास्त्र में स्नातक की डिग्री होगी । परीक्षा के विषय परिशिष्ट-1 के अनुसार होगें।

(2) सहायक शोध पदाधिकारी 1- (2) सहायक शोध पदाधिकारी 1- (2) सहायक शोध पदाधिकारी 1- (2) सहायक शोध पदाधिकारी 1- सहायक शोध पदाधिकारी के स्वीकृत शतप्रतिशत पदों को शोध सहायक की प्रोन्नति से भरा जायेगा । शोध सहायक से सहायक शोध पदाधिकारी के पदों पर प्रोन्नति के लिए चयन का मानदण्ड वरीयता -सह-योग्यता होगा ।

(3) शोध (3) शोध (3) शोध (3) शोध पदाधिकारीपदाधिकारीपदाधिकारीपदाधिकारी—((((i) शोध पदाधिकारी के सृजित पदों का 50% पद बिहार लोक सेवा आयोग की अनुशंसा पर सीधी भर्त्ती द्वारा भरे जायेगें । सीधी भर्त्ती हेतु अभ्यर्थी की न्यूनतम शैक्षणिक अर्हता किसी मान्यता प्राप्त विश्वविधालय या इससे सम्बद्ध संस्थान से रसायन शास्त्र/भू-गर्भ शास्त्र/ जियोटेक्नोलॉजी(Geo Technology)/ गणित/ भौतिक शास्त्र में स्नातकोत्तर की डिग्री होगी । बिहार लोक सेवा आयोग द्वारा संचालित प्रतियोगिता परीक्षा के विषय एवं अंक परिशिष्ट-।। में यथोल्लिखित होंगें।

बिहार लोक सेवा आयोग लिखित परीक्षा के आधार पर अभ्यर्थियों का साक्षात्कार लेगा जो 100 अंकों का होगा । नियुक्ति, बिहार लोक सेवा आयोग द्वारा लिखित परीक्षा तथा साक्षात्कार में अलग-अलग प्राप्त अंकों के योग के आधार पर चयनित अभ्यर्थियों में से की जायेगी। पैनेल की वैधता एक वर्ष तक रहेगी ।

((((ii) शोध पदाधिकारी के शेष 50% पद, स्नातोकोत्तर डिग्रीधारी सहायक शोध पदाधिकारियों से वरीयता -सह-योग्यता के आधार पर प्रोन्नति द्वारा भरे जायेंगे ।3 (cid:18)बहार गजट (असाधारण), 19 नव+बर 2013 (4) उप-(4) उप-(4) उप-(4) उप-निदेशक (शोध) - निदेशक (शोध) - निदेशक (शोध) - निदेशक (शोध) - उप-निदेशक (शोध) के स्वीकृत पदों में से 50 % पद को शोध पदाधिकारियों से वरीयता -सह -योग्यता के आधार पर प्रोन्नति द्वारा भरा जायेगा तथा शेष 50 % पद भू-गर्भ शास्त्र/जियोटेक्नोलॉजी में स्नातकोत्तर उपाधि प्राप्त शोध पदाधिकारी की प्रोन्नति से भरा जायेगा। (5)(5)(5)(5) अपर निदेशक (शोध)-अपर निदेशक (शोध)-अपर निदेशक (शोध)-अपर निदेशक (शोध)- अपर निदेशक (शोध) का पद, उप-निदेशक (शोध) से, वरीयता-सह-योग्यता के आधार पर, प्रोन्नति द्वारा, भरा जायेगा ।

वैसे कर्मचारी एवं पदाधिकारी उपर्युक्त पदों पर प्रोन्नति हेतु पात्र समझे जायेंगें, जो सेवा में सम्पुष्ट हों और सामान्य प्रशासन विभाग द्वारा, समय-समय पर निर्धारित कालावधि पूरा कर चुके हो । 9. विभागीय प्रविभागीय प्रविभागीय प्रविभागीय प्रोन्नति समिति-ोन्नति समिति-ोन्नति समिति-ोन्नति समिति-(1) अराजपत्रित से अराजपत्रित पदों पर प्रोन्नति हेतु आयुक्त एवं सचिव/सचिव, लघु जल संसाधन विभाग की अध्यक्षता में गठित विभागीय प्रोन्नति समिति द्वारा विचार किया जायेगा ।

(2) अराजपत्रित से राजपत्रित एवं राजपत्रित से राजपत्रित पदों पर प्रोन्नति हेतु बिहार लोक सेवा आयोग के अध्यक्ष/अध्यक्ष द्वारा मनोनीत सदस्य की अध्यक्षता में गठित प्रोन्नति समिति द्वारा विचार किया जायेगा ।

10. वरीयता- (1) वरीयता- (1) वरीयता- (1) वरीयता- (1) इस नियमावली के अधीन, इस संवर्ग में सीधी भर्त्ती द्वारा नियुक्त कर्मियों की आपसी वरीयता बिहार कर्मचारी चयन आयोग/बिहार लोक सेवा आयोग द्वारा अनुशंसित मेघा सूची के क्रमानुसार नियत की जायेगी ।

(2) इस संवर्ग में प्रोन्नति के आधार पर नियुक्त कर्मी उस वर्ष सीधी भर्त्ती से नियुक्त किसी व्यक्ति से वरीय होंगें, भले ही सीधी भर्ती से नियुक्ति की प्रक्रिया पहले ही पूर्ण हो गयी हो । (3) इस संवर्ग के सभी कोटि के कर्मियों की वरीयता राज्य के स्तर पर विनिश्चित की जायेगी ।

11. परिवीक्षा (प्रोवेशन) एवं प्रशिक्षण-।- परिवीक्षा (प्रोवेशन) एवं प्रशिक्षण-।- परिवीक्षा (प्रोवेशन) एवं प्रशिक्षण-।- परिवीक्षा (प्रोवेशन) एवं प्रशिक्षण-।- सीधी भर्ती से नियुक्त कर्मी/ पदाधिकारी पदग्रहण की तिथि से दो वर्ष की अवधि तक परीविक्षा पर रहेंगे। परीविक्षा अवधि में सेवा संतोषजनक नहीं पाये जाने पर इसे 6-6 माह के लिए अधिकतम दो बार विस्तारित किया जा सकेगा । प्रशिक्षण राज्य के लघु जल संसाधन विभाग के शोध एवं प्रशिक्षण संस्थान में लेना होगा। विभाग द्वारा आवश्यकतानुसार सम्बन्धित सरकारी सेवकों/ पदाधिकारियों को राज्य के बाहर भी किसी संस्थान में प्रशिक्षण हेतु भेजा जा सकेगा ।

12. सम्पुष्टि - सम्पुष्टि - सम्पुष्टि - सम्पुष्टि - परिवीक्ष्यमान कर्मचारी/पदाधिकारी को परीवीक्षा अवधि सफलतापूर्वक पूर्ण करने पर संपुष्ट किया जायेगा बशर्ते कि :-

(क) परीवीक्षा अवधि में उनकी सेवा संतोषजनक हो , (ख) वे नियम-11 के अधीन विहित अवधि में प्रशिक्षण एवं परीवीक्षा सफलतापूर्वक पूर्ण कर चुके हों ।

(ग) सभी पदों पर नियुक्त कर्मचारी/पदाधिकारी को सेवा के प्रथम वर्ष में बिहार सरकार के हिन्दी टिप्पण एवं प्रारूपण परीक्षा में उर्त्तीण होना अनिवार्य होगा। इसके बाद ही वे प्रथम वेतन वृद्धि के हकदार होंगें ।

(घ) सीघी नियुक्ति से नियुक्त शोध सहायक एवं शोध पदाधिकारी को प्रथम दो वर्षो में विभागीय हिन्दी एवं विभागीय परीक्षा तथा तीन वर्षो में व्यवसायिक परीक्षा में उत्तीर्ण होना अनिवार्य होगा। यदि विभागीय हिन्दी परीक्षा प्रथम वर्ष में ही पास कर लिया जाता है तो विभागीय टिप्पण एवं प्रारूपण परीक्षा उत्तीर्ण होना अनिवार्य नहीं होगा । द्वितीय वेतन वृद्धि एवं तृतीय वेतन वृद्धि क्रमशः विभागीय परीक्षा एवं व्यवसायिक परीक्षा करने पर ही अनुमान्य होगी ।

विभागीय एवं व्यवसायिक परीक्षा का विषय/ अंक परिशिष्ट- ।।। एवं IV के अनुसार होंगें और परीक्षा में प्रश्नों का स्तर शोध सहायक एवं शोध पदाधिकारी के लिये अलग-अलग निर्धारित किये जायेंगें। 13. आरक्षणआरक्षणआरक्षणआरक्षण- संवर्ग के पदों पर नियुक्ति/प्रोन्नति में राज्य सरकार के आरक्षण अधिनियम एवं समय-समय पर अवधारित आरक्षण के प्रावधान लागू होंगे ।

14. इस नियमावली में उपबंधित नियमों को छोड़कर इस संवर्ग में नियुक्त कर्मियों की सेवा- शर्ते सरकार द्वारा सरकारी सेवकों के लिए उस समय यथा विहित नियमों के अधीन विनियमित की जायेंगी ।

15. कठिनाई का निराकरण-कठिनाई का निराकरण-कठिनाई का निराकरण-कठिनाई का निराकरण- यदि सरकार को यह समाधान हो जाये कि इस संवर्ग में नियुक्त कर्मियों की सेवा-शर्त से संबंधित किसी नियम को किसी विशेष मामले में लागू करने में कठिनाई 4 (cid:18)बहार गजट (असाधारण), 19 नव+बर 2013 है तो इस मामले में अनतर्विष्ट किसी प्रावधान पर कोई प्रतिकूल प्रभाव डाले बिना, सरकार राजपत्र में प्रकाशित अधिसूचना द्वारा ऐसी कठिनाई का निराकरण कर सकेगी ।

16. निरसन एवं व्यावृत्ति-निरसन एवं व्यावृत्ति-निरसन एवं व्यावृत्ति-निरसन एवं व्यावृत्ति- राज्य के लघु जल संसाधन विभाग में इस संवर्ग के लिए निर्गत सभी संकल्प/परिपत्र एवं अनुदेश इस नियमावली के लागू होने की तिथि के प्रभाव से निरस्त समझे जायेंगे, परन्तु ऐसे संकल्प/परिपत्र एवं अनुदेश के अधीन की गई कार्रवाई की विधि मान्य रहेगी मानो ऐसी कार्रवाई इसी नियमावली के तहत्‌ की गई हो ।

No.sec-1/mwrd/Estb.-45/2012-5289—In exercise of power conferred by proviso to Article 309 of the Constitution of India, the Governor of Bihar, hereby, makes the following " Research Cadre (Minor Water Resources Department) Rules, 2013", to regulate the systematic management, appointment, promotion and service conditions of the Staff of Research cadre of Minor Water Resources Department of the State Government. 1. Short title, commencement and extent—(1) These rules may be called " Research Cadre (Minor Water Resources Department) Rules, 2013".

(2) It shall come into force at once.

(3) It shall extend to the employees/officers of the Research Cadre in the Minor Water Resources Department of the State Government of Bihar.

2. Definitions- In these Rules, unless the context otherwise requires-

(a) " Research Cadre" means the Research Cadre of employees/officers of Minor Water Resources Department of the State Government;

(b) " Government" means The Government of Bihar; (c) " Department" means Minor Water Resources Department;

(cid:18)बहार गजट (असाधारण), 19 नव+बर 2013 (d) "Employee" means Research Assistant, Assistant Reseach officer, Research officer, Deputy Director, Additional Director of the Research Cadre of Minor Water Resources Department of the state;

(e) "Rules" means Research Cadre (Minor Water Resources Department) Rules, 2013;

(f) "Cadre strength" means the number of the total employees of the cadre; (g) "Staff Selection Commission" means Bihar Staff Selection Commission; (h) " Public Service Commission" means Bihr public Service Commission. 3. Cadre Structures:- This cadre shall remain under the administrative control of Minor Water Resources Department of the State, and the cadre of employees /officers right from Research Assistant to Additional Director shall be categorised at the level of Minor Water Resources Department of the State.

4. Post Structure, pay-Scales and Category- The posts of different categories of the cadre and the Appointiong Authority shall be as below as per the norms prescribed by the state Government from time to time-

The pay scale sanctioned by the Finance Department, from time to time, shall be payable to the above mentioned posts.

5555.... Number of Post of Research cadre will be decided by the Deptt. from time to time. 6. Requisition for Appointment- By 1st April of every calendar year, the number of vacancies to be filled up through direct recruitment and by promotion shall be determined by the appointing Authority and, the requisition regarding the case in which appointment has to be made on the recommendation of Bihar public Service Commission/ Bihar Staff Selection Commission, shall be sent to the above commissions respectively by the department concerned latest by 30 th April. 7. Age limit- The minimum age-limit for recruitment shall be 21 years and maximum age limit shall be the same as decided by General Administration Deptt, Bihar, Patna from time to time.

8. Procedure of Appointment- (1) Research Assistant- Direct appointment shall be made to the centpercent sanctioned posts of Research Assistant on basis of Competitive Examination held by Bihar Staff Selection Commission. Minimum qualification for direct Recruitment of the the candidate will be Graduate degree in Chemistry/ Geology/Mathematics/Geo Technology/ Physics/ from any recognized university. (2) Assistant Research officer- The cent percent sanctioned posts of Assistant Research officer shall be filled up by promotion of Research Assistant. Criteria of selection7 (cid:18)बहार गजट (असाधारण), 19 नव+बर 2013 for promotion to the posts of Assistant Research officer form the Research Assistant shall be seniority cum eligibility.

(3) Research officer- (i) On recommendation of Bihar publice Service Commission, 50 % posts of Research officer shall be filled up by direct recruitment, Minimum educational qualification of the candidate for direct recruitment must be post Graduate degree in Chemistry/ Geology/ Mathematics/ Physics/Geo Teconology educational qualification from any recognized university or from any Institution affiliated to it. The subjects and the marks of the competitive Examinations conducted by Bihar Public Service Commission shall be as per mentioned in Appendix-11.

On basis of Written Examination, Bihar Public Service commission shall conduct an interview of the candidates, which shall be of 100 marks. The appointment shall be made from amongst the candidates selected on the basis of the total marks obtained in the written Examination and in the interview separately conducted by Bihar Public Selection Comminssion. The panel shall remain valid up to one year.

(ii) The remaining 50% post of the Research Officer shall be filled up by promotion on the basis of the seniority-cum-eligibility only from amongst those Assistant Research officer having Post Graduate degree.

(4) Deputy Director (Research):- 50% Sanctioned posts of Deputy Director(Research) Shall be filled up by Research officers on the basis of Seniority Cum- eligibility and the remaining posts shall be filled up by promotion of the Research Officer having Post Graduate degree in Geology/ Geo-Technology.

(5) Additional Director (Research)- The Post of Additional Director (Research) shall be filled up by promotion from the Deputy Director (Research) on the basis of Seniority-cum eligibility.

Such employees and officers will be deemed to be eligible for promotion to the above mentioned post who are confirme in service and who have completed the Kalawadhi determined by the Department of General Administration from time to time. 9. Departmental Promotion Committee-(1) Consideration for Promotion from the post of Non Gazzetted to the Non Gazzetted shall be made by the Departmental Promotion Committee constituted under chairmanship of Commissioner and Secretary/Secretary, Minor Water Resources Department. (2) Consideretion for Promotion from the post of Non Gazzetted to the Gazzetted and Gazzetted to Gazzetted shall be made by the Promotion Committee Constituted under the chairmanship of the Chairman of Bihar public Service Commission or any other member nominated by the chairman of Bihar Public Service Commission.

10. Seniority-(1) Under these rules, inter seniority of the employees appointed by Direct Recruitment in this cadre shall be fixed as per the order of merit list recommended by Bihar Staff Selection Commission/ Bihar Public Service Commission. (2) The employees appointed on the basis of promotion in this cadre shall be senior to those appointed by Direct Recruitment in that very year even if the procedure of Direct Recruitment has already been completed. (3) Seniority of the employees of all the categories of this cadre shall be determined at the State level.

11. Probation and Training- The employees/officers appointed by Direct Recruitment shall remain on probation for a period of two years from the date of their joining. In the period of probation service is not found satisfactory, the probation period may be extended maximum two times for six months. The Training will have do obtained in8 (cid:18)बहार गजट (असाधारण), 19 नव+बर 2013 Research and Training Institute of Minor Water Resources Department of the state. The Government servants concerned may be sent for training to any institute even outside of the State by the Department as per necessary.

12. Confirmation- Employees/ officers on probation shall be confirmed after successful completion of probation-period only provided that- (a) In the probation period his /her service is satisfactory; (b) He/She has successfully completed training and probation in the period prescribed under Rule- 11; (c) It shall be compulsory for the employees/ officers appointed to all the posts to pass the Hindi Noting and Drafting Examination of the Bihar Government in the first year of service. Thereafter, only they shall be entitled for the first increment of the salary. (d) It shall be Compulsory for the Research Assistant and Research Officer appointed by Direct Recruitment to pass Departmental Hindi Examination and Departmental Examination in the first two years and Professional Examination in three years. On passing the Departmental Examination in the very first year, it shall not be compulsory to pass Departmental Hindi Noting & Drafting Examination . Second increment and third increment shall be admissible only after passing Departmental Examination and Professional Examination respectively.

The Subjects and Marks of Departmental Examination and Professional Examination shall be as per Appendix-III&IV and level of Questions for the post of Research Assistant and Research officer shall be determined separately.

13. Reservation- In appointment/ promotion to the cadre-posts, The Reservation Act and the provisions of reservation decided, from time to time, by the Government shall be applicable.

14. Except the rules as provided in these Rules, the service condition of the employees appointed in this cadre shall be regularized under the rules as prescribed at that time for the Government servants by the Government.

15. Removal of difficulties- If the Government is satisfied that any difficulty is in any particular matter in implementation of any rule related to the service conditions of the employees appointed in the cadre, the Government may remove such difficulty, by notification published in the official gazette, without prejudice to any provision contained this matter.

16. Repeal and Saving- All the resolutions/ circulars and instructions issued for this cadre in Minor Water Resources Department of the state shall be deemed to be repealed from the date of commencement of these Rules, but the action taken under such resolution/ circulars and instructions shall be valid as if such action was taken under these Rules.

Appendix-I

Syllabus of Examination for Direct Recruitment To the post of Research Assistant.

2. Optional subjects:-

The standard of the questions of the aforesaid syllabus shall be of graduate standard and the candidate shall have to take any 3(three) subjects out of optional subjects.

1. Compulsory subjects:-

(E) General Hindi - 100 Marks

(F) General Knowledge - 100 Marks

2. Optional subject:-
