सं0 3/सी5 नीति (FMFL)-09/2010-7552—बिहार उत्पाद अधिनियम 1915 की धारा-90 के साथ पठित धारा-38 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राजस्व पर्षद की अधिसूचना सं0 23-137-2 दिनांक 29 अप्रैल 1919 में प्रकाशित तथा समय-समय पर यथा संशोधित नियमों में निम्नप्रकार संशोधन किया जाता हैः-
संषोधन
1. नियम-41ए में नये नियमों का जोड़ा जाना। पूर्व के नियम 41ए के बाद निम्नलिखित नियम जोड़े जायेंगे। 2. नियम-41बी में बोतल में शराब और वाईन जो भारत से बाहर बनाये जाते हैं तथा बिहार राज्य में बिक्री के लिए आयातित किये जाने पर लेबल लगे रहना चाहिए जिसमें गुणवाा एवं अल्कोहल की मात्रा अंकित रहेगा। उसमें बोतलबंदी किये जाने वाले देश का नाम, बैच नं0 अनुज्ञाधारी द्वारा अलग से गोंद लगे स्टीकर से चिपकाया जायेगा जिसमें लाल स्याही से वैधानिक चेतावनी ''षराब पीना स्वास्थ्य के लिए हानिकारक है'' एवं अधिकतम खुदरा मूल्य अंकित करना होगा।
3. विदेश में निर्मित्त विदेशी शराब एवं वाईन बिहार राज्य में बिक्री के लिए तबतक नहीं आयात किये जायेंगे जबतक आयुक्त उत्पाद द्वारा लेबल का निबंधन एवं नवीकरण नहीं किया गया हो तथा अग्रिम मासिक/नवीकरण शुल्क जैसा कि नियम 42बी में उल्लेखित है, नहीं जमा कर दिया गया हो।
4. उपर्युक्त नियम-106ई के बाद निम्नांकित नियम को जोड़ा जाता हैः- (नियम-106ईई में उत्पाद प्रपत्र 19ई में वितरकता अनुज्ञप्ति के लिए प्रति बोतल 3.00(तीन) रू0 विदेश में निर्मित विदेशी शराब (FMFL) एवं 2.00 (दो) रू0 प्रति बोतल विदेश में निर्मित वाईन (FMFW) पर अग्रिम देय होगा)।
5. नियम-106 एफएफ- विदेष में निर्मित्त विदेशी शराब एवं वाईन जो भारत के बाहर निर्मित हैं का आयात बिहार राज्य में किया जा सकेगा इसके लिए राज्य सरकार को निम्न दर से लिटरेज फी का भुगतान किया जायेगा। पूर्व कस्टम बंध मूल्य लिटरेज फी की दर 2 (cid:18)बहार गजट (असाधारण), 3 -दस/बर 2013 कस्टम बांड मूल्य वाईन के लिए। 70 रू0 प्रति बी0एल0 या MRP का
30 प्रतिशत, जो भी अधिक हो।
6. अधिसूचना संख्या-1538 दिनांक 07.12.2012 में संशोधन करते हुए नियम 42 बी. की कंडिका (i) को

सं0 3/सी5 नीति (FMFL)-09/2010-7552—इस अधिसूचना का अंग्रेजी में निम्नलिखित अनुवाद राजस्व पर्षद के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जो भारत के संविधान के अनुच्छेद 348 के खण्ड-3 अंग्रेजी भाषा में उसका प्राधिकृत पाठ समझा जायेगा।

No. 3/सी5 नीति (FMFL)-09/2010-7552—In exercise of the power conferred by section 90, read with Section 38 of the Bihar Excise Act 1915, (Bihar Act II of 1915) the Board of revenue is please to make the following amendments in the rules published by notification No. 23-137-2, dated the 29th April, 1919 as subsequently amended from time to time.

AMENDMENT
1. Addition of new rules after 41A. After rule 41A of the aforesaid rules the following new rules be added namely:-
2. 41'B'-Bottles containing liquor and wine manufactured outside India and imported to Bihar for sale must bear labels specifying the quality and alcoholic content of liquor contained. Therein, the country of origin, batch number shall be pasted by the licensees with a separate adhesive sticker in which Statutory warning "Drinking Liquor is injurious to health" in red ink and its MRP shall be printed.
3. No. Brand of FMFL/FMFW shall be imported and Sold in Bihar unless it has label as approved and registered by the Excise Commissioner and prepayment of annual registration and renewal fee as prescribed under rule 42B.
4. After rule 106E the following rules added be :-
(106EE per bottle Rs. 3.00 (Three) license fee Foreign Made Foreign Liquor and Rs.2.00 (Two) Per bottle for Foreign Made Foreign Wine fee payable for a distributors license granted in Excise Form 19 E.)3 (cid:18)बहार गजट (असाधारण), 3 -दस/बर 2013 5. 106FF- Foreign liquor manufactured outside India may be imported in to any place of Bihar provided that a literage fee at the following rates have been levied and realized in the State of Bihar. Ex Custom Bond price Rate of Literage fee Ex bond price upto Rs 500 Rs. 600 /- Per L.P.L Ex bond price above Rs 500 Rs. 620 /- Per L.P.L Ex bond price of Wine Rs.70 /- Per B.L or 30% of MRP, Whichever is higher
