सं0 1/रा॰स्था॰ (2) नियमावली-07/2008 -सह॰-3744—भारत के संविधान के अनुच्छेद 309 के परन्तुक के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल बिहार सहकारिता अंकेक्षण सेवा संवर्ग में भर्त्ती एवं सेवा शर्त्तों को विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैं-

अध्याय-I

प्रारम्भिक

1. संक्षिप्त नाम, विस्तार एवं प्रारंभ। - (1) यह नियमावली बिहार सहकारिता अंकेक्षण सेवा संवर्ग (भर्त्ती एवं सेवा शर्त्तें) नियमावली, 2012 कही जा सकेगी।

(2) इसका विस्तार बिहार राज्य में होगा ।

(3) यह तुरत प्रवृत होगी।

2. परिभाषाएॅं। - इस नियमावली में जब तक कोई बात विषय संदर्भ में विरुद्ध न हो-

(1)''आयोग'' से अभिपे्रत है, बिहार लोक सेवा आयोग;

(2) ''कोटि'' से अभिपे्रत है, वेतनमान के अनुरुप पदों का वर्गीकरण जो सेवा में सम्पुष्ट हो;

(3)''निबंधक, सहयोग समितियाँ'' से अभिपे्रत है, बिहार सहकारी सोसाइटी अधिनियम, 1935 की धारा-6 के अधीन बिहार-राज्यपाल द्वारा निबंधक, सहयोग समितियाँ, बिहार के पद पर नियुक्त व्यक्ति या/तथा बिहार स्वावलम्बी सहकारी समिति अधिनियम, 1996 की धारा-8 के अधीन स्वावलम्बी सहकारी समिति का निबंधक।

(4) ''परिशिष्ट'' से अभिपे्रत है, नियमावली का ''परिशिष्ट'';

(5) ''बिहार सहकारिता अंकेक्षण सेवा संवर्ग'' से अभिप्रेत है, राज्य की सहकारिता अंकेक्षण सेवा संवर्ग;

(6) ''राज्य'' से अभिपे्रत है, बिहार -राज्य;

(7) ''राज्यपाल'' से अभिपे्रत है, बिहार के राज्यपाल;

(8) ''वर्ष'' से अभिपे्रत है, वित्तीय वर्ष;

(9) ''विभाग'' से अभिपे्रत है, बिहार सरकार का सहकारिता विभाग;

(10) ''सदस्य'' से अभिपे्रत है बिहार सहकारिता अंकेक्षण सेवा संवर्ग में नियुक्त व्यक्ति;

(11) ''संवर्गीय पद बल'' से अभिपे्रत है, इस सेवा के लिए सरकार के अधीन स्वीकृत पदों की संख्या, जिसमें नवसृजित सरकारी पद स्वतः पद सृजन की तिथि से शामिल हो जायेंगे और कोई संवर्गीय पद समर्पण या सुसुप्तावस्था की तिथि से अपवर्जित।

(12) ''सरकार'' से अभिपे्रत है, बिहार सरकार ;

(13) 'सेवा' से अभिप्रेत है, बिहार सहकारिता अंकेक्षण सेवा;

3॰ सेवा एवं संवर्ग का गठन। - 'क' संवर्ग परिशिष्ट 'क' (1) में चिन्हित और अनुचित पदों की कोटि को मिलाकर होगा। 4॰ यह सेवा एक राज्य सेवा होगी तथा सहकरिता विभाग इस संवर्ग का नियंत्राी विभाग होगा। इस नियमावली के प्रवृत्त होने की तिथि के पूर्व से नियुक्त एवं कार्यरत बिहार सहकारिता सेवा (अंकेक्षण प्रभाग) के सदस्य स्वतः इस सेवा में शामिल समझे जायेंगे।

5॰ पदाधिकारियों की प्रतिनियुक्ति। - सेवा के सदस्यों को राज्य या केन्द्र सरकार के पूर्णतः या अंशतः स्वामित्व या नियंत्राण वाली सहकारी समिति या बोर्ड या परियोजना में प्रतिनियुक्ति, बिहार सेवा संहिता के प्रावधानों के अधीन बाह्य सेवा शर्त्तों पर, सरकार द्वारा की जा सकेगी ।

अध्याय-II

नियुक्ति

6॰ नियुक्ति। -

(1) सरकार प्रति वर्ष 1ली अप्रैल को विभिन्न कोटियों में रिक्ति का नियत करेगी।

(2) (क) उप नियम -(1) के अधीन मूल कोटि की रिक्तियों का 50% पद विभागीय अराजपत्रिात अंकेक्षण संवर्ग के सदस्यों की प्रोन्नति से नियुक्ति के माध्यम से भरे जायेंगे तथा 50% पद संयुक्त प्रतियोगिता परीक्षा के आधार पर आयोग द्वारा अनुशंसित अभ्यार्थियों की सीधी भर्ती के माध्यम से भरे जा सकेगें।

परन्तु मूल कोटि के अधिकतम 50% पद प्रोन्नति द्वारा नियुक्ति हेतु एक ही समय उपलब्ध कराये जायेगें।

(ख) बिहार सहकारिता सेवा नियमावली, 1975 के नियम-26 के अधीन मूल कोटि के 25% रिक्तियों पर सीमित प्रतियोगिता परीक्षा के आधार पर की जानेवाली नियुक्ति के लिये रखे गये रिक्त पदों को इस नियमावली के प्रावधानों के तहत प्रोन्नति द्वारा भरा जायेगा और पूर्व नियमावली के अधीन सीधी भर्ती हेतु आयोग को भेजी गयी अधियाचनाएँ इस नियमावली से प्रभावित नहीं होंगी।

(ग) नियम 6 (2) (क) तथा (ख) के अधीन प्रोन्नति द्वारा नियुक्ति बिहार लोक सेवा आयोग के अध्यक्ष या सदस्य की अध्यक्षता में गठित विभागीय प्रोन्नति समिति की अनुशंसा पर की जायेगी।

(3) उच्चतर कोटि के सभी पद अध्याय-VII में स्पष्टीकृत नियमों के अधीन निम्नवत्‌ प्रोन्नति द्वारा भरे जायेंगे - (i) उप मुख्य अंकेक्षक, सहयोग समितियाँ कोटि में जिला अंकेक्षण पदाधिकारी, सहयोग समितियाँ की मूल कोटि से,

(ii) संयुक्त निबंधक, सहयोग समितियाँ (अंकेक्षण) कोटि में उप मुख्य अंकेक्षक, सहयोग समितियाँ कोटि से।3 (cid:18)बहार गजट (असाधारण), 10 *दस,बर 2013 (4) किसी गैर संवर्गीय पद को किसी कतिपय अवधि के लिए सुषुप्तावस्था में रखने तथा पदों को रिक्त रखने का निर्णय लेने का अधिकार सरकार का होगा ।

7॰ सीधी भर्त्ती। - इस नियमावली में, जबतक कोई विरुद्ध प्रावधान न हो बिहार प्रशासनिक सेवा में सीधी नियुक्ति के लिए संबंधित प्रावधान इस सेवा में भी सीधी नियुक्ति पर लागू रहेंगे।

अध्याय-III

परिवीक्षा

8॰ परिवीक्षा अवधि - (1) सेवा में सीधे नियुक्त प्रत्येक सदस्य के लिए नियुक्ति की तिथि से दो वर्षो की परिवीक्षा अवधि होगी परन्तु, विशेष परिस्थितियों, यथा नियंत्राी पदाधिकारी/निबंधक, सहयोग समितियाँ द्वारा कार्यकलाप पर प्रतिकूल टिप्पणी प्रतिवेदित करने अथवा सांस्थिक एवं व्यावाहारिक प्रशिक्षण संतोषप्रद रुप से पूरा नहीं करने पर यह अवधि एक वर्ष तक बढ़ाई जा सकेगी, और उनमें जो कमी हो उससे परवीक्षाधीन को अवगत कराया जाएगा।

(2) यदि सीधी नियुक्त का कोई सदस्य परिवीक्षा अवधि की शर्त्तो को पूरा नहीं करता हो या किसी अन्य प्रकार से यथा विस्तारित परिवीक्षा अवधि में यदि प्रतिकूल गोपनीय वार्षिक अभ्युक्ति, या सेवा संतोषप्रद नहीं पाया जाता है, तो ऐसे सदस्यों की सेवा, बिना कारण-पृच्छा के, समाप्त करने का निर्णय राज्यपाल द्वारा लिया जा सकेगा ।

(3) (क) विभागीय अराजपत्रिात अंकेक्षण संवर्ग से प्रोन्नति द्वारा मूल कोटि में नियुक्त सदस्य की एक वर्ष की परिवीक्षा अवधि होगी और इस अवधि में असंतोषप्रद सेवा या विभागीय कार्यकलाप के आधार पर नियंत्राी पदाधिकारी/निबंधक, सहयोग समितियाँ द्वारा प्रतिकूल टिप्पणी प्रतिवेदित किये जाने पर परिवीक्षा अवधि छः माह के लिए बढ़ायी जा सकेगी और परिवीक्षाधीन को उसमें कमी से उसे अवगत कराया जाएगा।

(ख) फिर भी सेवा असंतोषप्रद रहने पर या विभागीय कार्यकलाप पर प्रतिकूल टिप्पणी निबंधक, सहयोग समितियाँ द्वारा प्रतिवेदित किये जाने पर समीक्षोपरान्त बिना कारण पृच्छा के पूर्व धारित पद पर, राज्यपाल द्वारा पदावनत कर दिया जायेगा।

(4) परिवीक्षा में बिताई गई अवधि की गणना सदस्य की नियमित सेवा के साथ की जायेगी।

अध्याय-IV

विभागीय परीक्षा

9॰ विभागीय परीक्षा।-(1) सम्पुष्टि के लिए सदस्यों से सरकार द्वारा नियत विभागीय परीक्षा अनिवार्य रुप से उत्तीर्ण होने की अपेक्षा की जायगी, जिसका आयोजन केन्द्रीय परीक्षा समिति (राजस्व पर्षद्‌), बिहार द्वारा किया जायेगा :

परन्तु दिनांक 01/01/1996 के पूर्व सेवा में नियुक्त सदस्य विभागीय परीक्षा से विमुक्त रहेगा।

(2) दिनांक 31/12/1995 के बाद में नियुक्त सदस्य 50 वर्ष की आयु पूरा करने के पश्चात्‌ अनिवार्य रुप से विभागीय परीक्षा उत्तीर्ण करने से विमुक्त सामान्य प्रशासन विभाग द्वारा विहित शर्त्तो के अधीन विमुक्त किये जा सकेंगे। (3) सदस्य को दो विशेष प्रकार के क्रियाशील सहकारी समितियों का अंकेक्षण प्रतिवेदन तैयार करना होगा, जिस पर सेवा संपुष्टि के पूर्व लेखा नियंत्राक, वित्त (अंकेक्षण) विभाग का अनुमोदन प्राप्त करना होगा।

(4) दिनांक 31/12/95 के पश्चात्‌ नियुक्त सदस्यों को द्वितीय या अगली वेतनवृद्धि विभागीय परीक्षा उर्त्तीण होने पर अनुमान्य होगी।

(5) तृतीय या अगली वेतनवृद्धि उप-नियम (3) के अधीन सदस्यों द्वारा तैयार अंकेक्षण प्रतिवेदन पर सक्षम प्राधिकार की सहमति के पश्चात्‌ विभाग द्वारा विभागीय परीक्षा में उत्तीर्ण परीक्षा संयुक्त रुप से घोषित किये जाने पर अनुमान्य होगी। (6) इन उप-नियमों के अधीन वेतनवृद्धि में रोक असंचयात्मक होगी और परीक्षा में उत्तीर्णता की तिथि से आर्थिक लाभ भुगतेय होगा ।4 (cid:18)बहार गजट (असाधारण), 10 *दस,बर 2013

अध्याय- V

प्रशिक्षण

10॰ प्रशिक्षण। - (1) सीधी भर्ती से नियुक्त सदस्यों को राज्य सरकार द्वारा नियत प्रशिक्षण पूरा करना होगा।

(2) नियम -6 (2)(क) एवं (ख) के अधीन प्रोन्नति द्वारा सेवा में नियुक्त पदाधिकारियों को व्यवहारिक प्रशिक्षण की आवश्यकता नहीं होगी, परन्तु कार्य निष्पादन के क्रम में नियंत्राी पदाधिकारी द्वारा प्रतिकूल टिप्पणी प्रतिवेदित किये जाने पर निबंधक, सहयोग समितियॉ छः सप्ताह की अल्पावधि का व्यवहारिक प्रशिक्षण की व्यवस्था करेंगे और ऐसा प्रशिक्षण पूरा होने के पश्चात्‌ प्रतिकूल मूल्यांकन का सम्पुष्टि पर प्रभाव पड़ेगा और कर्त्तव्य में ऐसे अदक्षता पाये जाने पर सदस्य पूर्व पद पर पदावनत किए जायेंगे।

(3) चार सप्ताह का कोषागार प्रशिक्षण का कार्यक्रम की व्यवस्था परिविक्षाधीन सदस्य या नियंत्राी पदाधिकारी के अनुरोध पर, पदस्थापन जिला के जिला पदाधिकारी करेंगे।

(4) सफलता पूर्ण सांस्थिक एवं व्यवहरिक प्रशिक्षण पूर्ण करने पर, निबंधक, सहयोग समितियाँ की अनुशंसा पर सीधी भर्त्ती द्वारा नियुक्त सदस्यों को स्वतंत्रा कार्यालय कार्य निपटारा हेतु अधिसूचित किया जायेगा । इसके पूर्व ये सदस्य अपने नियंत्राी पदाधिकारी के पर्यवेक्षण में कार्यों का निपटारा करेंगे ।

अध्याय- VI

संपुष्टि

11॰ संपुष्टि। - (1) परिवीक्षा अवधि की संतोषप्रद समाप्ति, अध्याय- IV के अधीन विभागीय परीक्षा में उत्तीर्ण होने, अध्याय- V के अधीन प्रशिक्षण संतोषप्रद रुप मेें पूर्ण करने तथा सेवा अभिलेख स्वच्छ पाये जाने के बाद सीधी भर्त्ती द्वारा नियुक्ति के सदस्यों की सेवा स्थायी पदों की उपलब्धता या लगातार 5 वर्षों से अधिक अवधि के लिए अवधि विस्तारित एवं आगे इन पदो ंके बने रहने की संभावना वाले संवर्गीय पदों पर सम्पुष्ट किया जा सकेगा।

(2) प्रोन्नति से मूल कोटि में नियुक्त सदस्यों की सेवा परिवीक्षा अवधि की समाप्ति विभागीय परीक्षा में उर्त्तीण होने एवं सेवा अभिलेख स्वच्छ रहने के बाद उप-नियम (1) में विहित शर्त्तों के अधीन सम्पुष्ट कीा जा सकेगी, परन्तु सीधी भर्त्ती वाले सदस्यों की वरीयता एवं अगली प्रोन्नति पर इस सम्पुष्टि का प्रभाव नहीं पड़ेगा ।

अध्याय- VII

प्रोन्नति

12॰ प्रोन्नति के लिए चयन प्रक्रिया। - (1) संवर्ग में मूल तथा उच्चतर कोटि में प्रोन्नति मेरिट एवं वरीयता के आधार पर होगी।

(2) प्रोन्नति की अनुशंसा के लिए सरकार द्वारा गठित विभागीय प्रोन्नति समिति सक्षम प्राधिकार होगी।

(3) संवर्ग के उच्चतर कोटि के पदों पर प्रोन्नति के लिए सदस्यों का मूल कोटि के पद पर सम्पुष्ट होना अनिवार्य होगा तथा सरकार (सामान्य प्रशासन विभाग) द्वारा, समय-समय पर, नियत अपेक्षित कालावधि पूरा करना होगा।

(4) विभागीय प्रोन्नति समिति की अनुशंसा के आधार पर उच्चतर कोटि के पदों पर चयन का अंतिम निर्णय राज्यपाल द्वारा लिया जायेगा । अधिकतम वेतनमान में प्रोन्नति के लिए विभागीय प्रोन्नति समिति का गठन आयोग के अध्यक्ष या सदस्य की अध्यक्षता में होगा।

अध्याय- VIII

प्रकीर्ण

13॰ सरकार सेवा के चिन्हित्‌ पदों के रिक्त पद पर अपवादस्वरुप विशेष परिस्थितियों में अन्य सेवा के पदाधिकारियों को सीमित अवधि तक पदास्थापित कर सकेगी।

14॰ निरसन और व्यावृति। - (1) बिहार सहकारिता सेवा नियमावली, 1975 एतद द्वारा निरसित की जाती है।5 (cid:18)बहार गजट (असाधारण), 10 *दस,बर 2013 (2) इस निरसन के होते हुए भी पूर्व नियमावली के अधीन निर्गत आदेश या कुछ भी किया गया कार्य मानो इस नियमावली के अधीन किये गए थे मानो उस दिन जब आदेश निर्गत या कुछ भी किया गया था, यह नियमावली प्रवृत थी। 15॰ कठिनाई का निराकरण। - इस नियमावली के किसी भी नियम को लागू करने में कठिनाई हो तो राज्य सरकार ऐसी कठिनाई का निराकरण राजपत्रा में प्रकाशित समुचित आदेश से कर सकेगी।

16॰ इस नियमावली के नियमों की व्याख्या करने के लिये विभाग सक्षम होगा और यदि आवश्यक हो तो वित्त/सामान्य प्रशासन विभाग का परामर्श प्राप्त कर सकेगा ।

17॰ जिन विषयों या बिंदुओं के संबंध में प्रावधान इस नियमावली में नहीं है, उसके संबंध में राज्य सरकार के कर्मियों के लिए सुसंगत प्रावधान प्रभावी किये जायेंगे।

No. 1/Ra. Astha.(2) Niyamawali-07/2008-Sah - 3744—In exercise of the power conferred by proviso to Article 309 of The Constitution of India, the Governor of Bihar is pleased to make the following rules for regulation of recruitment and conditions of service in the Bihar Cooperative Audit Service-

CHAPTER- I

GENERAL

1. Short title, Extent and Commencement.- (1) This rule may be called the "Bihar Cooperative Audit Service Cadre (Recruitment and service conditions) Rule, 2012."6 (cid:18)बहार गजट (असाधारण), 10 *दस,बर 2013 (2) It shall extend to the whole State of Bihar.

(3) It shall come into force at once.

2. Definitions.-

In these rules, unless there is any thing repugnant in the subject or context- (1) 'Commission' means, the Bihar Public Service commission; (2) 'Grade' means', Classification of posts in conformity with pay scales confirmed in the service;

(3) 'Registrar Cooperative Societies' means, person appointed to the post of the Registrar, Cooperative Societies, Bihar by the Governor of Bihar under Section- 6 of the Bihar Cooperative Societies Act, 1935 or/ and under section – 8 of Bihar Self-Supporting Cooperative Societies Act,1996.

(4) 'Appendix' means, appendix of these rules; (5) "Bihar Cooperative Audit Service Cadre" means, Cooperative Audit Service Cadre of the State;

(6) 'State' means, the State of Bihar; (7) 'Governor' means, the Governor of Bihar; (8) 'year' means, financial year; (9) 'Department' means, the Department of Cooperation, Government of Bihar; (10) "Member" means, person appointed in the Bihar Cooperative Audit Service Cadre;

(11) 'Cadre post strength' means, the number of sanctioned Government posts wherein newly created Government posts shall be included from the date of creation and the any cadre post shall be excluded from the date of surrender or kept as dormant;

(12) 'Government' means the Government of Bihar; (13) "Service" means, the Bihar Cooperative Audit Service;

3. Constitution of Service and Cadre.- The cadre shall be consisting of the grades of posts identified and scheduled in the Appendix-'(KH-I)'

4. This service shall be a State service and the Department of Cooperation shall be the cadre controlling department of this service. Members of Bihar Cooperative Service (Audit Wing) appointed and working on the date of commencement of this Rule shall be deemed to be included in this service automatically.

5. Deputation of Officers.-

The Government under the provisions of the Bihar Service code as per foreign service condition shall depute the member of the service in Cooperative Societies, Boards or projects partially or fully owned controlled by the State or Central Government.

CHAPTER- II

APPOINTMENT

6. Appointment.-

(1) The Government shall fix the vacancies in different grades on 1st April every year.

(2) (a) under sub-rule (1) the 50% of the vacancies in basic grade shall be filled up through appointment by promotion of member of Departmental Non Gazetted Audit Cadre and the 50 % posts shall be filled up through direct recruitment by the candidates recommended by the Commission on the basis of joint competitive examination.

Proviso, At one time the maximum 50% of the basic grade posts shall be made available for appointment by promotion.

(b) The Vacant posts kept for recruitment on 25% of Vacancies of the basic grade posts through limited competitive examination under Rule -26 of the Bihar Cooperative Service Rule 1975 shall be filled up through appointment by promotion under provision of these Rules and the requisition for direct recruitment sent earlier to the Commission under the previous rule shall not be affected by these Rules.

(c) The appointment by promotion under Sub-rule 6(2) (a) and (b) shall be based on the recommendation of the Departmental Promotion Committee constituted under the Chairmanship of the Chairman or the member of the Bihar Public Service Commission.

(3) All posts of the higher grade different from basic grade shall be filled up as follows by promotion under rules explained in Chapter-VII – (i) To the grade of the Deputy Chief Auditor, Cooperative Societies from basic grade of District Audit Officers, Cooperative Societies.

(ii) To the grade of the Joint Registrar, Cooperative Societies (Audit) from the grade of the Deputy Chief Auditor, Cooperative Societies;

(4) The Government shall have the right to decide to keep any post for vacant or dormant for certain limited period.

7. Direct recruitment.- In these rules, unless there is any provision repugnant, the related provision for direct recruitment in the Bihar Administrative Service shall remain effective for direct recruitment in this service too. CHAPTER-III PROBATION 8. Probation Period.- (1) The probation period for directly recruited members of the service shall be of two years from the date of appointment; but the probation period may be extended up to one year under special circumstances viz; adverse remarks on working is reported by the controlling officer/ Registrar, Cooperative Societies or the institutional and practical training is not completed satisfactorily and the probationer shall be communicated what is lacking in him.

(2) If any member directly recruited does not fulfill the conditions of the probation period or is reported of adverse remarks in annual confidential report continuously for extended Probation period the service is not found satisfactory, then the decision to terminate of such member without show cause from the service may be taken by the Governor.

(3) (a) The probation period for members appointed in the basic grade by promotion from the Non-Gazetted Cadre shall be of one year and the probation period may be extended up to six months if the services is not found satisfactory or adverse remarks on departmental working is reported by the controlling officer/ Registrar, Cooperative Societies and the probationer shall be communicated what is lacking in him.

(b) Such members shall be demoted to previous post held without show cause by the Governor if after reexamination of unsatisfactory or adverse remarks on departmental working as reported by the Registrar, Cooperative Societies during the extended period.

(4) The period spent on probation shall be counted towards regular service of the member.

CHAPTER-IV

DEPARTMENTAL EXAMINATION

9. Departmental Examination.-

(1) Members are required to pass the departmental examination fixed by the Government compulsorily for confirmation which shall be conducted by the Central Examination Committee (Board of Revenue), Bihar.

Provided that the members appointed in the service before 01.01.1996 shall be exempted from the departmental examination.

(2) Exemption from compulsorily passing in the departmental examination may be granted to the members appointed after 31.12.1995 and attaining 50 years of age under conditions provisioned by the Department of General Administration.

(3) Members shall prepare audit report of two special type working Cooperative Societies, on which approval of the Controller of Accounts, Finance Department, Bihar shall be obtained prior to the confirmation of the service.

(4) Being successful in the departmental examination, the second or following annual increment shall be admissible to the members appointed after 31.12.1995.

(5) The Third or following annual increment shall be admissible to the members after the approval of the Controller of Accounts, Finance Department, Bihar, audit report prepared under sub rule (3) is received and the successful passing of the departmental examination is declared as combined.

(6) With holding of annual increments under these sub rules shall be non-cumulative and the financial benefits shall be payable with effect from the date of passing in the examination.

CHAPTER-V

TRAINING

10. Training.-

(1) Members, directly recruited shall have to complete the training fixed by the State Government.

(2) Members appointed by promotion under Rule 6(2) (a) and (b) shall not require practical training; provided that in case adverse remark is reported by the Controlling Officer during disposal of works, the Registrar, Co-operative Societies shall arrange six weeks short term practical training and after completion of such training, reported adverse evaluation shall have effect on confirmation and finding such incompetency in duty, members shall be demoted to previous post.

(3) The District Magistrate of the posting district, on request of the member under probation or his controlling officer, shall arrange programme for four weeks treasury training.

(4) After successful completion of institutional and practical training, on the recommendation of the Registrar, Cooperative Societies, directly recruited members shall be notified in an independent office for independent disposal of works in the office. Prior to this, these members shall dispose of their works under the supervision of controlling officer.

CHAPTER-VI

CONFIRMATION

11. Confirmation.- (1) After satisfactory completion of probation period, passing in the departmental examination under chapter IV satisfactory completion of training under Chapter V9 (cid:18)बहार गजट (असाधारण), 10 *दस,बर 2013 and finding the service record clean, services of the directly recruited members shall be confirmed on available permanent cadre post or cadre posts having extension for more than 5 years and further possibilities to remain intact. (2) The services of the members appointed in the basic grade by promotion shall be confirmed under conditions prescribed in sub-rule(1) after completion of probation period, passing in the departmental examination and finding the service record clean. Provided the seniority of direct recruited members and next promotion shall not be affected by this confirmation.

CHAPTER- VII

PROMOTION

12 Selection Procedure for promotion.-

(1) Promotion in the basic and higher grades of posts in the cadre under these rules shall be granted on the basis of merit and seniority.

(2) The departmental promotion committee constituted by the Government shall be the competent authority for recommendation of promotions.

(3) It shall be compulsory for members to have confirmation on present grades of posts for promotion in higher grade of posts of the cadre and members shall have to complete the minimum required Kalawadhi as fixed by the Government (General Administration Department).

(4) The final decision of selection for promotion on higher grade of posts on the basis of recommendations of the departmental promotion committee shall be taken by the Governor. For promotion in maximum scale Departmental Promotion Committee will be constituted under the Chairmanship of the Chairman or the member of the Commission.

CHAPTER-VIII MISCELLINOUS 13. The Government may post officers of other services on vacant posts of the identified posts of the service till limited period in exceptional special circumstances.

14. Repeal and savings- The Bihar Cooperative service Rules, 1975 prior to it hereby repealed not with standing of this repeal any order issued or anything done under previous Rules shall be considered as issued or done under this Rules if it were come into force on the day when any order was issued or anything done.

15. Remedy of difficulty- The State Government may remove by proper order in official, any difficulty if any, to enforce any of the provisions of these Rules.

16. The department shall be competent to explain the provisions of these Rules and if necessary may seek advice from Finance/General Administration Department. 17. The relevant provisions of State Government for its employees shall be effective regarding subjects which have not been provisioned in this rule for employees.
