सं0 1/रा॰स्था॰(7)मुकदमा-18/2011सह॰-4449—सहकारिता प्रसार पदाधिकारी के पद से सहायक निबंधक, सहयोग समितियाँ के पद पर प्रोन्नति हेतु बिहार लोक सेवा आयोग की अध्यक्षता में दिनांक 20.05.93 को हुई विभागीय प्रोन्नति समिति की बैठक में श्री लखन चौधरी, तत्कालीन सहकारिता प्रसार पदाधिकारी का नाम प्रोन्नति हेतु योग्य की अनुषंसा की गयी, परन्तु कतिपय कारण से इनके प्रोन्नति संबंधी अधिसूचना निर्गत नहीं किया जा सका। श्री चौधरी के द्वारा एक समादेष याचिका यथा सी॰डब्लू॰जे॰सी॰ संख्या-8721/2010 लखन चौधरी बनाम राज्य सरकार एवं अन्य, माननीय उच्च न्यायालय, पटना में दायर किया गया। उच्च न्यायालय पटना द्वारा दिनांक 14.10.2011 को न्यायादेष पारित किया गया कि-"Prima-facie the Court is satisfied that if the original petitioner superannuated on 31.11.1995, and as it appears from the pleadings in the writ petition, took no legal steps during his service tenure to enforce his right to be considered for promotion. The writ petition may have been barred by gross delay. But if what the petitioner contends is correct and the respondents, as it appears from their letters dated 23.11.2007 and 22.5.2009, are still in the process of considering retrospective promotion to persons like the petitioner quite naturally the respondents are required to act expeditiously as they appear to have already denied timely consideration to the petitioner. Let such consideration be done by the respondents within a maximum period of four months from the date of receipt and/or production of a copy of this order before respondent no. 5." 2 (cid:18)बहार गजट (असाधारण), 23 +दस-बर 2013 (वेतनमान 2200-4000) के पद पर दी गयी प्रोन्नति की तिथि अर्थात् दिनांक 03.03.94 से सहायक निबंधक, सहयोग समितियाँ के पद पर प्रोन्नति दी जाती है। श्री चौधरी को प्रोन्नति दिये जाने के प्रस्ताव में वित्त विभाग की सहमति प्राप्त है। बिहार-राज्यपाल के आदेश से, मधुरानी ठाकुरमधुरानी ठाकुरमधुरानी ठाकुरमधुरानी ठाकुर, सरकार के उप-सचिव।
