सं0 5/स्था.-109/2010, परि.-6430—भारत-संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल एतद्द्वारा बिहार राज्य के परिवहन विभाग के लिपिक संवर्ग में व्यक्तियों की भर्ती, प्रोन्नति एवं अन्य सेवा-शर्तों को विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैं :-
बिहार परिवहन क्षेत्रीय लिपिक संवर्ग(भर्ती एवं सेवा-शर्त्त) नियमावली, 2013
अध्याय-1
प्रारम्भिक
1. संक्षिप्त नाम, विस्तार एवं प्रारंभ ः- (1) यह नियमावली बिहार परिवहन क्षेत्रीय लिपिक संवर्ग (भर्ती एवं सेवा शर्त) नियमावली, 2013 कही जा सकेगी ।
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा ।
(3) यह तुरंत प्रवृत होगी । 2. परिभाषा- इस नियमावली में जब तक कोई बात संदर्भ में अन्यथा अपेक्षित न होे,
(क) ''राज्य'' से अभिप्रेत है बिहार राज्य;
(ख) ''विभाग'' से अभिप्रेत है परिवहन विभाग;
(ग) ''राज्य परिवहन आयुक्त'' से अभिप्रेत है मोटर यान अधिनियम-1988 की धारा-213 एवं बिहार मोटर गाड़ी नियमावली, 1992 के नियम 2() के अधीन राज्य सरकार द्वारा नियुक्त पदाधिकारी;
(घ) ''संवर्ग'' से अभिप्रेत है राज्य सरकार के क्षेत्रीय परिवहन कार्यालयों में विभिन्न प्रकार के लिपिकीय संवर्ग;
(ड.) ''नियुक्ति प्राधिकारी'' से अभिप्रेत है राज्य परिवहन आयुक्त;
2 (cid:18)बहार गजट (असाधारण), 3 जनवर(cid:15) 2014(च) ''आयोग'' से अभिप्रेत है बिहार कर्मचारी चयन आयोग; (छ) "राज्य सरकार" से अभिप्रेत है बिहार-सरकार; (ज) "केन्द्रीय सरकार" से अभिप्रेत है भारत-सरकार ।
3. संवर्ग का गठन एवं बल - (1) संवर्ग राज्य परिवहन आयुक्त के प्रशासी नियंत्रण में होगा । (2) संवर्ग में निम्नलिखित पद सम्मिलित होंगे-
पदनाम - पदों की संख्या (i) निम्नवर्गीय लिपिक - 88 (ii) उच्चवर्गीय लिपिक - 59 (iii) प्रधान लिपिक - 29 (iv) कार्यालय अधीक्षक - 14 उक्त पदबलों की कुल संख्या, राज्य सरकार द्वारा मंजूर की गयी संख्या के अनुसार होगी । राज्य सरकार मंजूर पदों की संख्या में, आवश्यकतानुसार, समय-समय पर वृद्धि अथवा कमी कर सकेगी।
अध्याय-2
भर्ती 4. अन्यथा उपबंधित के सिवाय इस संवर्ग में भर्ती इस नियमावली के अध्याय- 3 के अधीन किये गए प्रावधानों के अनुसार, सीधी भर्ती द्वारा, की जायेगी । प्रथम नियुक्ति संवर्ग में निम्नवर्गीय लिपिक की कोटि में होगी ।
5. संवर्ग के लिपिकों के नियुक्ति पदाधिकारी राज्य परिवहन आयुक्त हाेंगे । 6. रिक्तियों का निर्धारण -प्रत्येक पंचांग वर्ष की 1ली अप्रील की स्थिति के आधार पर, सीधी भर्ती के साथ-साथ प्रोन्नति से भरी जाने वाली रिक्तियों का आकलन राज्य परिवहन आयुक्त द्वारा किया जाएगा। 7. रिक्तियों में आरक्षण -संवर्ग में भर्ती हेतु, अनुसूचित जाति, अनुसूचित जन-जाति, अत्यन्त पिछड़े वर्गाें एवं पिछड़े वर्गों के सदस्यों तथा पिछड़े वर्गों की महिलाओं के लिए, आरक्षण संबंधी अधिनियम/नियमावली के प्रावधान एवं केन्द्रीय एवं राज्य सरकार द्वारा, समय-समय पर, निर्गत संकल्प/अनुदेश में विहित प्रक्रिया लागू होगी ।
अध्याय-3
8. सीधी भर्ती द्वारा नियुक्तिः- संवर्ग में सीधी भर्ती निम्नवर्गीय लिपिक के पद पर की जाएगी । किसी कलेन्डर वर्ष में इस पद की कुल रिक्तियों के 85% पदों पर सीधी भर्ती द्वारा तथा 15% पदों पर विभाग के क्षेत्रीय कार्यालयों के चतुर्थवर्गीय कर्मचारियों से, सिवाय अधिकतम उम्र सीमा को छोड़कर, जो अपेक्षित अर्हता धारण करते हों सीमित जाँच द्वारा प्रोन्नति के माध्यम से नियुक्ति द्वारा भरे जायेेंगे। पूर्व से विभिन्न क्षेत्रीय कार्यालयों में निम्नवर्गीय लिपिक के रूप में नियमित आधार पर नियुक्त एवं कार्यरत और अनुकम्पा के आधार पर निम्नवर्गीय लिपिक के रूप में नियुक्त एवं कार्यरत व्यक्ति इस कोटि में स्वतः आमेलित समझे जायेेंगे।
9. नियुक्ति के लिए, न्यूनतम आयु 18 वर्ष होगी एवं अधिकतम आयु सीमा वही होगी जो सरकार द्वारा सरकारी सेवा में प्रवेश के लिए, समय-समय पर, विनिश्चित की जाय।
10. न्यूनतम शैक्षणिक योग्यता -नियुक्ति हेतु न्यूनतम शैक्षणिक अर्हता इन्टरमीडीएट 10 + 2 अथवा (समकक्ष)तथा कम्प्यूटर संचालन का ज्ञान की होगी ।
11. रिक्तियों का संसूचन -(1) प्रत्येक वर्ष 30 अप्रील तक सीधी भर्ती द्वारा नियुक्ति के लिए होने वाली आरक्षण कोटिवार कुल रिक्तियाँ राज्य परिवहन आयुक्त द्वारा आयोग को संसूचित की जाएगी । (2) प्रतियोगिता परीक्षा के विषय, पूर्णांक एवं प्रक्रिया आयोग द्वारा विनिश्चित की जाएगी । (3) चयन परीक्षा का आयोजन, परीक्षा के लिए आवेदन करने हेतु प्रक्रिया, परीक्षा फीस, फॉरमैट एवं अन्य सुसंगत विषय आयोग द्वारा इस प्रयोजनार्थ समय-समय पर निर्गत निर्देश के अनुसार विनिश्चित किये जायेंगे।3 (cid:18)बहार गजट (असाधारण), 3 जनवर(cid:15) 2014 12. आयोग द्वारा अभ्यर्थियों की अनुशंसा -आयोग लिखित परीक्षा में प्राप्त अंकों के अनुसार आरक्षण कोटिवार एक अंतिम मेधा-सूची तैयार करेगा । आयोग ऐसी तैयार की गयी सूची में से उतनी संख्या में अभ्यर्थियों की अनुशंसा राज्य परिवहन आयुक्त को करेगा, जितनी संख्या में रिक्तियां प्रतिवेदित की गयी हों।
13. वरीयता- सीधी भर्ती द्वारा नियुक्त लिपिकों की आपसी वरीयता आयोग द्वारा तैयार की गयी क्रमानुसार मेधा सूची के आधार पर विनिश्चित की जाएगी ।
अध्याय - 4
प्रोन्नति
14. बिहार क्षेत्रीय परिवहन कार्यालय के लिपिकीय संवर्ग के प्रोन्नति के पद निम्नवत् में होंगे :- (i) प्रथम प्रोन्नति का पद - उच्चवर्गीय लिपिक (ii) द्वितीय प्रोन्नति का पद - प्रधान लिपिक (iii) तृतीय प्रोन्नति का पद - कार्यालय अधीक्षक। 15. राज्य सरकार द्वारा, समय-समय पर समान संवर्ग के लिए प्रोन्नति देने हेतु निर्गत नियम तथा परिपत्र इस संवर्ग पर भी लागू होंगे ।
16. संवर्ग के विभिन्न पदों पर प्रोन्नति राज्य परिवहन आयुक्त की अध्यक्षता में गठित विभागीय प्रोन्नति समिति द्वारा दी जाएगी
17. मूल पद से उच्च्तर पद पर प्रोन्नति एवं कोई ए0सी0पी0 देने के लिए, विभागीय लेखा एवं हिन्दी टिप्पण तथा प्रारूपण परीक्षाओं में उत्तीर्ण होना आवश्यक होगा। अध्याय - 5 विविध 18. (i)राज्य सरकार परिवहन विभाग में प्रधान लिपिक एवं कार्यालय अधीक्षक के आवश्यकता आधारित पदों का सृजन करेगी तथा भविष्य में, परिवहन विभाग के लिपिक के पद निम्नवर्गीय लिपिक एवं उच्च वर्गीय लिपिक के रूप में विहित प्रतिशत के अनुसार परिवहन विभाग द्वारा सरकारी मार्ग दर्शन के अनुसार सृजित एवं कर्णांकित किये जायेंगे ।
19. परिवीक्षा अवधि- निम्नवर्गीय लिपिक पद की परिवीक्षा अवधि नियुक्ति की तिथि से दो वर्ष होगी । 20. सेवा की सम्पुष्टि- परिवीक्षा अवधि की संतोषजनक समाप्ति एवं विभागीय परीक्षा उत्तीर्ण करने के बाद, संवर्ग के निम्नवर्गीय लिपिक की सेवा राज्य परिवहन आयुक्त द्वारा संपुष्ट की जा सकेगी।
परन्तु सेवा की संपुष्टि से पूर्व लिपिक को विभागीय लेखा परीक्षा एवं हिन्दी टिप्पण-प्रारूपण परीक्षा में उत्तीर्ण होना अनिवार्य होगा । परीक्ष्यमान अवधि में सेवा संतोषजनक नहीं पाये जाने पर परीक्ष्यमान लिपिकों की सेवा समाप्त की जा सकेगी ।
21. वार्षिक वेतन-वृद्धि - हिन्दी टिप्प्णी एवं प्रारूपण परीक्षा में उत्तीर्ण होने के बाद ही वार्षिक वेतन-वृद्धि अनुुमान्य होगी ।
22. अनुशासनिक, नियंत्रण एवं अपील -"बिहार राज्य सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005" के विभिन्न प्रावधान इस संवर्ग के कर्मचारियों के संबंध में लागू होंगे। 23. अन्य सेवा शर्ते- समकक्ष सरकारी सेवकों के मामले में लागू नियम एवं विनियम, यथावश्यक परिवर्तनों सहित, इस संवर्ग के कर्मचारियों पर भी लागू होंगे।
24. निरसन एवं व्यावृतिः- (1)इस संदर्भ में वर्तमान नियमावली/विनियामवली को एतद् द्वारा निरस्त किया जाता है। (2) ऐसे निरसन के होते हुए भी, निरसित नियमों/विनियमों के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए किया गया कुछ भी अथवा की गयी कार्रवाई इस नियमावली के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए किया गया कुछ भी या की गयी कार्रवाई मानी जायेगी।

सं0 5/स्था.-109/2010, परि.-6430—बिहार परिवहन लिपिक संवर्ग नियमावली, 2013 का निम्नलिखित अंग्रेजी अनुवाद बिहार-राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जिसे भारतीय संविधान के अनुच्छेद 348 के खंड (3) के अधीन उक्त नियमावली का अंगे्रजी भाषा में प्राधिकृत पाठ समझा जाएगा।

The 12th December 2013 No. 05/Stha-109/2010, Pari.-6430—In exercise of the powers conferred by proviso of Article 309 of the Constitution of India, the Governor of Bihar is hereby pleased to make the following Rules to regulate the recruitment, promotion and other service conditions in the clerical cadre of Transport Department, State of Bihar, Bihar Transport, Regional Clerk (Recruitment and Service Condition) Rules, 2013.
Chapter-1 1- Short title, extent and Commencement – 1. These rules may be called the Bihar Transport Clerical (Recruitment and Service Condition) Rules,2013
2. It shall be extended to the whole state of Bihar, 3. It shall come into force immediately.
2- Definitions - In the rules, unless, the context and subject otherwise requires:-
(a) State means 'Bihar State'. (b) Department means the Transport Department of the Govt. of Bihar. (c) State Transport Commissioner means an officer appointed by State Government under provision of Section-213 of Motor Vehicle Act, 1988 and Rule 2(J) of the Bihar Rules, 1992.
(d) "Cadre" means different type of Clerical Cadre of the Regional Transport Offices of the State Government.
(e) "Appointing Authority" means State Transport Commissioner. (f) "Commission" means Bihar Staff Selection Commission. (g) State Govt. means the Govt. of Bihar. (h) Central Govt. means the Govt. of India.
2 Constitution of Cadre and strength- (1) Cadre shall be under Administrative Control of State Transport Commissioner.
2. The following posts shall be included in the cadre :- Name of Post Number of Posts
(i) Lower Division Clerk - 88 (ii) Upper Division Clerk - 59 (iii) Head clerk - 29 (iv) Office Superintendent - 14
The total number of the said post strength shall be according to number sanctioned by the State Government. The State Government from time to time may increase or reduce the number of sanctioned posts as required.
Chapter-2
Recruitment
4. Recruitment shall be made directly for this Cadre according to the provisions made under Chapter-3 of this Rule except otherwise provided. First5 (cid:18)बहार गजट (असाधारण), 3 जनवर(cid:15) 2014 appointment shall be in the category of Lower Division Clerk in the Cadre.
5. State Transport Commissioner shall be the Appointing Authority for all the clerks of the Cadre.
Fixation of Vacancies:-
6. On the basis of status as on 1st April of every calendar year, the State Transport Commissioner shall determine the vacancies to be filled up by direct recruitment along with promotion.
7. Reservation in vacancies:-
For recruitment in the cadre, the provisions of the Act/Rules and the procedure prescribed in resolution/instructions relating to reservations in vacancies, from time to time, and issued by the Central and State Government for members of Scheduled Caste, Scheduled Tribe, Extremely Backward, Backward and women of backward classes shall be strictly adhered to.
Chapter-3 Appointment through direct recruitment- (8). Direct recruitment in the Cadre shall be made on the post of Lower Division clerk. In a Calendar Year, 85% of the total vacancies of this post shall be filled by direct recruitment and 15% shall be filled by appointment through promotion by limited test from the fourth grade employees of the Regional Transport Offices of the department who holds the requisite qualification (except the upper age limit).
Persons appointed and working as Lower Division Clerk on regular basis and those who are appointed and working as Lower Division Clerk on the basis of compassionate ground in different regional offices previously shall deemed to be absorbed automatically in this cadre.
9- For appointment, minimum age shall be 18 years and maximum age shall be the same as may be decided by the State Government, from time to time, for entrance in the government service.
10- Minimum educational qualification- For appointment, minimum educational qualification shall be intermediate (10+2) (or similar) and knowledge of computer operation.
11- Intimation of vacancies:-
(a) Total vacancies as per reservation roster to be for appointment by direct recruitment shall be intimated by the State Transport Commissioner to the Staff Selection Commission by 30th April every year.
(b) Subjects, total marks and procedure of Competitive Examination shall be determined by the Commission.
(c) Holding of selection examination, procedure for applying for the examination, examination fee format and other relevant matters shall be determined by the Commission for this purpose from time to time.
12- Recommendation of Candidates by the Commission:-
The Commission shall prepare a final merit list according to reservation roster of candidates as per marks obtained in written examination. Out of such prepared list in descending order in number shall forward recommendation of such candidates to the State Transport Commissioner for which number of vacancies have been reported.
13- Seniority:-
6(cid:18)बहार गजट (असाधारण), 3 जनवर(cid:15) 2014 Inter-se seniority of the appointed clerks by direct recruitment shall be determined on basis of merit list prepared in order of serial number by the Commission.
Chapter-4 Promotion 14- Promotional post of the Clerical Cadre of the Bihar Regional Transport Offices shall be as follows :-
(i) First promotional Post - Upper Division Clerk; (ii) Second promotional post - Head Clerk; (iii) Third Promotional post - Office Superintendent.
15- Rules and circular for grant of promotions issued by the State Govt. from time to time for similar Cadre shall be applicable for this cadre also. The Rules and guidelines for ACP issued by the State Govt. from time to time shall also be applicable.
16- The promotion will be given to different posts of the Cadre by the Departmental Promotion Committee constituted under the chairmanship of the State Transport Commissioner.
17- For promotion from original post to a higher post and for grant of any ACP, it shall be necessary to pass in the departmental accounts and Hindi noting and drafting examination.
Chapter-5 Miscellaneous 18- (i) The State Government shall create need based posts for Head Clerk and Office Superintendents in the Transport Department.
(ii) In future the posts of clerks in the Transport Department shall be created and earmarked to prescribed percentage as lower Division Clerks & Upper Division Clerks by the Transport Deptt. as per the Govt. guidelines.
19- Probation period:- The probation period of Lower Division Clerk will be of two years from the date of appointment. 20- Confirmation of Service:- The service of lower Division Clerk of the Cadre may be confirmed by the State Transport Commissioner after the satisfactory completion and passing of departmental examination.
Provided that it shall be mandatory for the clerk to pass in the Departmental Account Examination and Hindi Noting and drafting Examination before the confirmation of service. On not found satisfactory service in probation period, the service of the clerk may be terminated.
21- Annual Increment Annual increment shall be admissible only after passing Hindi noting and drafting examination.
22- Disciplinary control and Appeal :- The provisions of Bihar Government Servants (Classification, Control and Appeal) Rule, 2005 shall be applicable in relation to the employees of this cadre. 23- Other Service Conditions:- The rules and regulations applicable in case of similar govt. servants shall mutandis apply to employees of this Cadre also. 24- Repeal and Saving :-
(1) In this context, the present rules/regulations are hereby repealed.
7 (cid:18)बहार गजट (असाधारण), 3 जनवर(cid:15) 2014(2) Notwithstanding such repeal, anything done or any action taken in exercise of any power conferred by or under the repealed regulations/rules shall be deemed to have been done or taken in exercise of the powers conferred under these rules.
