la0 01@fu0¼fofo/k½&194@2013&6732—दी रोड ट्रान्सपोर्ट एक्ट, 1950 की धारा-38 (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्र सरकार के पूर्व अनुमोदन से राज्य सरकार अधिसूचना संख्या-4609 दिनांक 12.10.1999 द्वारा अधिसूचना की तिथि 12.10.1999 से चार वर्षो के लिए, बिहार राज्य पथ परिवहन निगम को अधिक्रांत किया था । अधिक्रमण अवधि दिनांक 11.10.2003 को समाप्त हो चुकी है; इस अवधि के समाप्ति के उपरांत निगम के बोर्ड का गठन नहीं किया गया; तथा राज्य सररकार द्वारा प्रशासक की सम्यकरूप से नियुक्ति कर निगम के कार्याें का संचालन किया जा रहा है । राज्य सरकार का समाधान हो गया है कि निगम को अधिक्रांत स्थिति में रखा जाना अत्यावश्यक है; और, चूंकि अधिक्रमण अवधि की वैधता के लिए दिनांक 12.10.2003 से अधिक्रमण-अवधि कोविस्तारित करना आवश्यक है; अतः दी रोड ट्रान्सपोर्ट एक्ट, 1950 की धारा 38-(1)-सह-पठित धारा-38(3)(a) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्य पथ परिवहन निगम के अधिक्रमण अवधि को दिनांक 12.10.2003 से दिनांक 31.03.2014 तक के लिए विस्तारित किया जाता है। बिहार-राज्यपाल के आदेश से, आर0 के0 महाजन, सरकार के प्रधान सचिव। 2 (cid:18)बहार गजट (असाधारण), 6 जनवर(cid:15) 2014 The 31st December 2013 No. 01/Ni.(Vividh)-194/2013-6732—In exercise of the powers conferred by Section- 38(1) of The Road Transport Act, 1950, State Government had superseded the Bihar State Road Transport Corporation vide Notification No.4609 dated 12-10-1999 for four years from the date of Notification i.e. from 12.10.1999 with prior approval of the Central Government. The supersession period has already expired on 11-10-2003. After expiry of that period, Board of the Corporation has not been constituted and affairs of the Corporation are being conducted by the Administrator duly appointed by the State Government. The State Government is satisfied that it is necessary to keep the corporation in superseded stage. And whereas, it is necessary to extend the supersession period from 12-10-2003 itself for legalising the supersession period; So, in exercise of the powers conferred by section 38(1) read with section 38(3) (a) of The Road Transport Act, 1950, the supersession period of the Bihar State Road Transport Corporation is being extended from the date 12-10-2003 to 31-03-2014
