सं0 1/नियुक्त-004/06-205/एम0—भारतीय संविधान के अनुच्छेद 309 के परन्तुक के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल, बिहार खान एवं भूतत्व निरीक्षक सेवा नियमावली, 2009 में निम्नलिखित संशोधन करते हैं :-

1. बिहार खान एवं भूतत्व निरीक्षक सेवा नियमावली, 2009 के नियम 11(i), 11(ii) एवं 11(iii) को निम्न द्वारा प्रतिस्थापित किया जाता है :-
''नियम-11 लिखित परीक्षा
अभ्यर्थियों को निम्नलिखित विषयों की लिखित परीक्षा में सम्मिलित होना होगा।
(i) सामान्य अध्ययन - 100 अंक
(ii) (क) खनन एवं खान सर्वेक्षण अथवा भूतत्व - 100 अंक
(ख) भारत के खनन विधान तथा नीतियाँ - 100 अंक''
2. बिहार खान एवं भूतत्व निरीक्षक सेवा नियमावली, 2009 के नियम-12 में निम्न द्वारा प्रतिस्थापित किया जाता है :-
''नियम-12 - आयोग द्वारा अभ्यर्थियाें की अनुशंसा :-
2 (cid:18)बहार गजट (असाधारण), 23 जनवर(cid:15) 2014आयोग लिखित परीक्षा में प्राप्त अंकों के आधार पर क्रमानुसार मेधा सूची तैयार करेगी। इस प्रकार तैयार की गई मेधा सूची से आयोग अभ्यर्थियों की ऐसी संख्या की अनुशंसा करेगी जैसा कि सरकार द्वारा अधियाचित हो। किसी अभ्यर्थी के योगदान नहीं करने पर रिक्तियाँ अगले वर्ष के लिए अग्रणीत की जायेगी। दो या दो से अधिक अभ्यर्थियों को समान अंक प्राप्त होने की स्थिति में उच्चतर शैक्षणिक योग्यताधारी अभ्यर्थी को प्राथमिकता दी जायेगी और शैक्षणिक योग्यता भी समान रहने की स्थिति में जन्म तिथि को प्राथमिकता दी जायेगी, अर्थात उम्र में वरीय को प्राथमिकता दी जायेगी''।
3. यह तुरत के प्रभाव से प्रवृत होगा।

सं0 1/नियुक्त-004/06-205/एम0 दिनांक 22 जनवरी 2014 के तहत निर्गत बिहार खान एवं भूतत्व निरीक्षक सेवा नियमावली, 2009 में संशोधन का निम्नलिखित अंग्रेजी अनुवाद बिहार-राज्यपाल के प्राधिकार से एतद् द्वारा प्रकाशित किया जाता है जिसे भारत संविधान के अनुच्छेद 348 के खण्ड (3) के अधीन उक्त संशोधन का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा।

No. 1/Niyukta-004/06-205/M—In exercise of the Powers conferred by proviso to Article 309 of the Constitution of India, the Governor of Bihar hereby makes the following amendments in BIHAR MINES & GEOLOGY INSPECTOR SERVICE RULES, 2009.
AMENDMENTS
1. The Rule 11 (i), 11(ii) & 11(iii) of Bihar Mines & Geology Inspector Service Rules, 2009 is substituted by the following:—
"Rule 11 – Written Examination – The candidates shall have to appear in a written examination of the following subjects:
(i) General Studies - 100 marks
(ii) (a) Mining & Mines Survey or Geology - 100 marks
(b) Mining legislation and policies of India - 100 marks"
2. The Rule 12 of Bihar Mines & Geology Inspector Service Rules, 2009 is substituted by the following:-
"Rule 12 – Recommendation of candidates by the Commission:
3 (cid:18)बहार गजट (असाधारण), 23 जनवर(cid:15) 2014The Commission shall prepare a merit list on the basis of the marks obtained in the written examination. From the merit list so prepared the Commission shall recommend such number of candidates as requisitioned by the Government. In case of non-joining of any candidate, the vacancies shall be carried forward in the next year. In case two or more candidates obtain equal marks, the candidate having higher educational qualification shall be given priority and in case of equal qualification the date of birth shall be given priority i.e. senior in age shall be given priority."
2. It shall come into force with immediate effect.
