सं0 7/स्था0(स0अ0नि0)02-01/2013-889—भारत के संविधान के अनुच्छोद 309 के परन्तुक द्वारा प्रदत्त भारत के संविधान के अनुच्छोद 309 के परन्तुक द्वारा प्रदत्त राज्यपाल, राज्य के उत्पाद सिपाही के पदों पर भर्ती एवं सेवा शर्त्तों के विनियमन क्तयों का प्रयोग करते हुए बिहार-राज्यपाल, राज्य के उत्पाद सिपाही के पदों पर भर्ती एवं सेवा शर्त्तों के विनियमन सं0 7/स्था0(स0अ0नि0)02-01/2013-889 शक्तियों का प्रयोग करते हुए बिहार- हेतु निम्नलिखित नियमावली बनाते हैः- हेतु निम्नलिखित नियमावली बनाते हैः- ''बिहार उत्पाद सिपाही संवर्ग (भर्त्ती एवं संक्षिप्त नाम, विस्तार एवं प्रारंभ ।- (1) यह नियमावली ''बिहार उत्पाद सिपाही संवर्ग (भर्त्ती एवं 1. संक्षिप्त नाम, विस्तार एवं प्रारंभ ।- (1) सेवाशर्त्त) नियमावली, 2014'' कही जा सकेगी। सेवाशर्त्त) नियमावली, 2014'' इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। यह तुरंत के प्रभाव से प्रवृत होगी।
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरंत के प्रभाव से प्रवृत होगी।
2. परिभाषाएँ ।- जब तक कोई बात संदर्भ में विरूद्ध न हो, इस नियमावली में-
जब तक कोई बात संदर्भ में विरूद्ध न हो, इस नियमावली में-
र'' से अभिप्रेत है बिहार सरकार;
(vii) अनुसूची से अभिप्रेत है इस नियमावली से संलग्न अनुसूची (viii) ''संवर्गीय प्रोन्नति के पद'' से अभिप्रेत है उत्पाद
(i) ''सरकार'' से अभिप्रेत है बिहार सरकार (ii) ''नियुक्ति प्राधिकार'' से अभिप्रेत है आयुक्त उत्पाद, बिहार; ''नियुक्ति प्राधिकार'' से अभिप्रेत है आयुक्त उत्पाद, बिहार; (iii) ''विभाग'' से अभिपे्रत है कार्यपालिका नियमावली में यथाविनिर्दिष्ट निबंधन, उत्पाद एवं मद्य निषेध ''विभाग'' से अभिपे्रत है कार्यपालिका नियमावली में यथाविनिर्दिष्ट निबंधन, उत्पाद एवं मद्य निषेध ''विभाग'' से अभिपे्रत है कार्यपालिका नियमावली में यथाविनिर्दिष्ट निबंधन, उत्पाद एवं मद्य निषेध विभाग; (iv) संवर्ग से अभिप्रेत है बिहार उत्पाद सिपाही संवर्ग संवर्ग से अभिप्रेत है बिहार उत्पाद सिपाही संवर्ग; (v) आयुक्त से अभिप्रेत है आयुक्त उत्पाद, बिहार आयुक्त से अभिप्रेत है आयुक्त उत्पाद, बिहार; (vi) ''भर्ती एजेंसी'' से अभिप्रेत है बिहार कर्मचारी चयन आयोग अथवा निबंधन, उत्पाद एवं मद्य निषेध ''भर्ती एजेंसी'' से अभिप्रेत है बिहार कर्मचारी चयन आयोग अथवा निबंधन, उत्पाद एवं मद्य निषेध ''भर्ती एजेंसी'' से अभिप्रेत है बिहार कर्मचारी चयन आयोग अथवा निबंधन, उत्पाद एवं मद्य निषेध विभाग द्वारा चयनित कोई अन्य एजेन्सी; विभाग द्वारा चयनित कोई अन्य एजेन्सी; अनुसूची से अभिप्रेत है इस नियमावली से संलग्न अनुसूची; सिपाही संवर्ग में सरकार द्वारा, समय-समय पर ''संवर्गीय प्रोन्नति के पद'' से अभिप्रेत है उत्पाद सिपाही संवर्ग में सरकार द्वारा, समय-समय पर नियत प्रतिशत के आधार पर एवं इस नियामवली में समुचित स्थान पर यथोल्लिखित वरीयता सह नियत प्रतिशत के आधार पर एवं इस नियामवली में समुचित स्थान पर यथोल्लिखित वरीयता सह नियत प्रतिशत के आधार पर एवं इस नियामवली में समुचित स्थान पर यथोल्लिखित वरीयता सह योग्यता के आधार पर, ''सहायक अवर निरीक्षक उत्पाद'' एवं ''अवर निरीक्षक उत्पाद'' के पद पर दी योग्यता के आधार पर, ''सहायक अवर निरीक्षक उत्पाद'' एवं ''अवर निरीक्षक उत्पाद'' के पद पर दी योग्यता के आधार पर, ''सहायक अवर निरीक्षक उत्पाद'' एवं ''अवर निरीक्षक उत्पाद'' के पद पर दी जाने वाली प्रोन्नति। जाने वाली प्रोन्नति।2 (cid:1)बहार गजट (असाधारण), 25 फरवर) 2014 3. संवर्ग का गठन ।- (1) इस संवर्ग में प्रत्येक सोपान के पदों की संख्या तथा उनकी कुल संख्या उतनी होगी जितनी सरकार द्वारा मंजूर/अवधारित की जाय तथा भविष्य में भी सरकार द्वारा, समय-समय पर, मंजूर अथवा अधिसूचित की जाय। (2) इस संवर्ग का पद सोपान निम्नवत् होगाः- (i) उत्पाद सिपाही; (ii) सहायक अवर निरीक्षक उत्पाद; (iii) अवर निरीक्षक उत्पाद (संवर्ग के कुल पदों का 30 प्रतिशत)
(3) सहायक अवर निरीक्षक उत्पाद एवं अवर निरीक्षक उत्पाद के प्रोन्नति आधारित पद कुल स्वीकृत संवर्गीय पदबल की सीमा के अधीन होंगे अथवा वही होंगे जो समय-समय पर, सरकार द्वारा विहित किया जाए अथवा स्वीकृत किया जाए या स्वीकृत किया गया हो।
(4) उत्पाद सिपाही से सहायक अवर निरीक्षक उत्पाद एवं सहायक अवर निरीक्षक उत्पाद से अवर निरीक्षक उत्पाद के पद पर प्रोन्नति की प्रक्रिया वही होगी, जो सामान्य प्रशासन विभाग/उत्पाद हस्तक द्वारा विहित प्रावधानों के आलोक में आयुक्त उत्पाद, बिहार द्वारा, समय-समय पर, नियत किया जाए। 4. भर्ती ।- (1) राज्य अवस्थित विभिन्न कार्यालयों में, समय-समय पर, विहित वेतनमान पर उत्पाद सिपाही के नियमित पद पर नियुक्ति की जाएगी।
(2) सीधी नियुक्ति वाले पदों के लिये उत्पाद सिपाही के कुल पदबल के विरूद्ध 50 प्रतिशत पद सीधी भर्ती एवं 25 प्रतिशत पद बिहार राज्य के प्रशिक्षित गृह रक्षकों से एवं शेष 25 प्रतिशत पद भूतपूर्व सैनिकों से भरा जायेगा।
5. शैक्षणिक अर्हता-किसी भी राज्य शासन/केन्द्रीय शासन द्वारा मान्यता प्राप्त बोर्ड/पर्षद से इंटरमीडिएट (102) अथवा समकक्ष परीक्षा उतीर्ण।
6. आयु सीमा- (1) सीधी भर्ती हेतु आयु सीमा, निम्नवत् (अथवा समय-समय पर जो राज्य सरकार द्वारा विहित की जाय) होगीः-
(क) सामान्य कोटि - 18 से 23 वर्ष (ख) पिछड़ा वर्ग/अत्यंत पिछड़ा वर्ग - 18 से 25 वर्ष (ग) महिला (अनारक्षित, पिछड़ा वर्ग
एवं अत्यंत पिछड़ा वर्ग) - 18 से 26 वर्ष
(घ) अनुसूचित जाति/अनुसूचित जनजाति (पुरुष एवं महिला) - 18 से 28 वर्ष
(2) गृह रक्षकों से भरी जानेवाले रिक्तियों के लिए निर्धारित अधिकतम उम्र सीमा एवं उसमें छूट का मानदंड वही होगा जो बिहार पुलिस में ''सिपाही'' पद के लिए समय-समय पर विहित किया जाए। (3) भूतपूर्व सैनिकों के लिए अधिकतम उम्र सीमा 45 वर्ष होगी। (4) अर्हता प्राप्त गृह रक्षकों एवं भूतपूर्व सैनिकों की अनुपलब्धता की दशा में रिक्तियाँ उसी आरक्षण कोटि के गैर गृह रक्षक/गैर भूतपूर्व सैनिकों के उम्मीदवारों से सीधी भर्ती द्वारा भरी जा सकेगी।
(5) अन्य राज्यों के आरक्षण कोटि के उम्मीदवारों की गणना सामान्य कोटि के उम्मीदवार के रूप में की जायेगी एवं तदनुरूप उनके लिये आयु सीमा वही होगी जो सामान्य कोटि के उम्मीदवारों के लिए लागू होगी।
7. नियुक्ति के आधार एवं प्रक्रिया ।- (1) उत्पाद सिपाही के पदों पर सीधी भर्ती, भर्ती एजेंसी द्वारा आयोजित की गयी परीक्षा एवं अनुशंसा के आधार पर, की जायेगी।
(2) सीधी भर्ती हेतु प्रक्रिया- सीधी भर्ती हेतु प्रक्रिया के निम्नलिखित चरण होंगेः-
(i) प्रथम चरण- प्राप्त आवेदनों के आधार पर अभ्यर्थियों की लिखित परीक्षा, भर्ती एजेंसी द्वारा आयोजित की जायेगी।
(ii) द्वितीय चरण- भर्ती एजेंसी द्वारा लिखित परीक्षा के गुणागुण के आधार पर प्रतिवेदित रिक्ति के पाँच गुणा अभ्यर्थियों की एक सूची तैयार की जाएगी। शारीरिक जाँच हेतु अर्हता प्राप्त अभ्यर्थियों की पर्याप्त संख्या में अनुपलब्धता की दशा में अभ्यर्थियों का अनुपात उपयुक्त रुप से कम किया जा सकेगा। इन सभी अभ्यर्थियों की दौड़ जाँच कराई जाएगी।
(iii) तृतीय चरण- दौड, ऊँची कूद, लंबी कूद, सीना माप़-जाँच में उतीर्ण होनेवाले अभ्यर्थियों की शारीरिक माप एवं जाँच कराई जायेगी जो इस नियमावली की अनुसूची "क" में विहित है। शारीरिक माप एवं जाँच में योग्य पाये जाने वाले अभ्यर्थियों की सूची के आधार पर भर्ती एजेंसी द्वारा इन योग्य अभ्यर्थियों में मेधावार एवं आरक्षण कोटिवार रिक्तियों के बराबर अभ्यर्थियों का चयन कर उसकी सूची नियुक्ति प्राधिकार को सौंप दी जाएगी।3 (cid:1)बहार गजट (असाधारण), 25 फरवर) 2014 (iv) चतुर्थ चरण- भर्ती एजेंसी से योग्य अभ्यर्थियों की सूची प्राप्त होने के पश्चात विहित प्रावधान के अधीन गठित मेडिकल बोर्ड द्वारा चिकित्सकीय परीक्षण संचालित किया जायेगा। नियुक्ति के लिए अभ्यर्थियों का चिकित्सकीय परीक्षण में योग्य पाया जाना अनिवार्य होगा।
(3) सीधी भर्ती हेतु चयन के लिए विहित मानदंड ।-
(i) लिखित परीक्षा।- लिखित परीक्षा का स्तर एवं मानदंड वही होगा, जो बिहार पुलिस में सिपाही हेतु विहित है। साथ ही लिखित परीक्षा हेतु न्यूनतम अंक एवं मेधा सूची तैयार करने की प्रक्रिया एवं प्रावधान वही होगें, जो बिहार पुलिस में सिपाही की भर्ती हेतु लागू होंगे।
(ii) दौड़ जाँच परीक्षा।- दौड़ जाँच परीक्षा का स्तर एवं मापदंड वही होगा, जो अनुसूची में विहित हैं।
(iii) शारीरिक माप एवं जाँच।- शारीरिक माप एवं जाँच का स्तर एवं मापदंड वही होगा, जो अनुसूची में विहित हैं।
8. भूतपूर्व सैनिको के लिए आरक्षित 25 प्रतिशत पदों तथा बिहार राज्य के गृह रक्षकों के लिए आरक्षित 25 प्रतिशत पदों पर भर्ती हेतु प्रक्रिया ।-
(1) लिखित परीक्षा- भूतपूर्व सैनिको के लिए आरक्षित 25 प्रतिशत पदों तथा बिहार राज्य के गृह रक्षकों के लिए आरक्षित 25 प्रतिशत उत्पाद सिपाही के पदों पर नियुक्ति हेतु आवेदन भर्ती एजेंसी द्वारा आमंत्रित किये जायेंगे। आवेदन पत्रों के आधार पर अभ्यर्थियों की लिखित परीक्षा ली जायेगी। लिखित परीक्षा हेतु न्यूनतम अंक एवं मेधा सूची तैयार करने की प्रक्रिया एवं प्रावधान वही होगें, जो बिहार पुलिस में सिपाही की भर्ती हेतु लागू होंगे। (2) भर्ती एजेंसी सीधी भर्ती के लिए अथवा भूतपूर्व सैनिको के लिए आरक्षित 25 प्रतिशत पदों तथा बिहार राज्य के गृह रक्षकों के लिए आरक्षित 25 प्रतिशत पदों पर भर्ती हेतु अलग-अलग अथवा एक साथ विज्ञापन निकालकर लिखित परीक्षा आयोजित कर सकेगा। (3) लिखित परीक्षा के परिणाम के पश्चात परीक्षा एजेंसी द्वारा रिक्तियों के अनुसार आरक्षण कोटिवार सफल अभ्यर्थियों की सूची आयुक्त उत्पाद, बिहार, पटना को प्रेषित कर देगा। (4) लिखित परीक्षा में सफल होनेवाले अभ्यर्थियों का चिकित्सकीय परीक्षण कराया जाएगा तथा चिकित्सकीय परीक्षण में योग्य पाए जानेवाले अभ्यर्थियों की नियुक्ति हेतु समुचित कार्रवाई की जाएगी।
9. चिकित्सकीय परीक्षण ।- चिकित्सकीय परीक्षा निम्नलिखित मानक के आधार पर करायी जायेगी :-
(i) उम्मीदवार को घुटने जुड़ना (नॉकिंग नी) एवं चपटे तलवे (फ्लैट फुट) की लक्षण नहीं होनी चाहिए। (ii) उम्मीदवार सामान्य रुप से सुन सके एवं श्रवण यंत्र (हियरिंग एड) का प्रयोग करने की बाध्यता न हो।
(iii) यदि किसी उम्मीदवार को हर्निया/हाईड्रोसिल हो तो शल्य चिकित्सा के पश्चात ही उनकी उम्मीदवारी योग्य समझी जाएगी।
(iv) उम्मीदवारों को आँखों की कोई गंभीर बीमारी न हो। नेत्रों की दृष्टि चश्मा सहित या चश्मा रहित 6/6 होनी चाहिए रात्रि अंधता या वर्णाध (कलर ब्लाईन्डनेस) नहीं होनी चाहिए।''
10. आरक्षण ।- बिहार राज्य आरक्षण अधिनियम के समय-समय पर लागू प्रावधान इन सभी भर्तियों एवं प्रोन्नतियों में लागू होंगे और इसका लाभ केवल बिहार राज्य के स्थायी निवासी को ही अनुज्ञेय होगा। 11. प्रशिक्षण ।- नव नियुक्त उत्पाद सिपाही के लिए चार माह का उत्पाद अधिनियम के अन्तर्गत बने नियमों का प्रशिक्षण अनिवार्य होगा। यह प्रशिक्षण आरक्षी प्रशिक्षण विद्यालय, नाथनगर, भागलपुर अथवा अन्य स्थान जिसे नियुक्ति प्राधिकार विहित करें, प्राप्त करना होगा। उत्पाद सिपाही सी0टी0एस0 परीक्षा में उत्तीर्णता प्राप्त करने के बाद ही प्रशिक्षित माने जायेगे।
12. परिवीक्षा अवधि ।- इस पद पर प्रथम नियुक्ति की तिथि से नवनियुक्त कर्मियों के लिये परिवीक्षा अवधि 6 माह की होगी। परिवीक्षा अवधि में सेवा संतोषजनक नहीं पाये जाने पर परिवीक्षा अवधि 6 माह के लिए बढ़ायी जा सकेगी। विस्तारित अवधि में भी सेवा संतोषजनक नहीं पाये जाने पर ऐसे पदधारियों को बिना सूचना के सेवोन्मोचित किया जा सकेगा। फिर भी, कदाचार के आधार पर यदि सेवोन्मोचन यदि कोई हो तो कर्मी को शो काउज नोटिस दिया जायगा।
13. सम्पुष्टि ।- आयुक्त उत्पाद, बिहार द्वारा परिवीक्षा अवधि संतोषप्रद रूप में पूर्ण होने एवं विभागीय परीक्षा सी0टी0एस0 में सफल होने के उपरांत सेवा संपुष्ट की जायेगी।
14. प्रोन्नति ।- उत्पाद सिपाही सम्वर्ग को वरीयता सह योग्यता के आधार पर उच्चतर पद यथा सहायक अवर निरीक्षक उत्पाद और अवर निरीक्षक उत्पाद के 30 प्रतिशत के पद पर प्रोन्नति दी जा सकेगी बशर्ते कि सामान्य प्रशासन विभाग द्वारा समय-समय पर, अवधारित यथा पुनरीक्षित कालावधि पूरी हो गई हों।4 (cid:1)बहार गजट (असाधारण), 25 फरवर) 2014 संबंधित विभागों द्वारा इस प्रयोजनार्थ गठित विभागीय प्रोन्नति समिति की अनुशंसा पर इस कोटि में प्रोन्नति की जा सकेगी।
15. वेतनमान ।- राज्य सरकार द्वारा, समय-समय पर, संवर्ग के अनुरूप यथा अधिसूचित विहित वेतनमान एवं तदनुसार अन्य भत्ते अनुमान्य होंगे।
16. वरीयता ।- (1) वरीयता भर्ती एजेंसी द्वारा निर्गत मेधा सूची के आधार पर नियत की जायेगी। (2) एक कैलेण्डर वर्ष में सीधी भर्त्ती से नियुक्त उत्पाद सिपाही से उसी वर्ष में बिहार के गृह रक्षकों एवं भूतपूर्व सैनिको की कोटि से नियुक्त उत्पाद सिपाही वरीय माने जायेंगे। उत्पाद सिपाही की वरीयता के संबंध में आयुक्त उत्पाद, बिहार द्वारा सामान्य प्रशासन विभाग द्वारा विहित किये गये प्रावधानों के अन्तर्गत नियमानुसार निर्णय लिया जा सकेगा।
17. अनुशासन, अपील एवं शास्तियाँ ।-इस संवर्ग के सभी सदस्यों पर बिहार उत्पाद हस्तक एवं बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 के प्रावधान लागू होंगे। 18. निरसन एवं व्यावृति ।- (1) इस नियमावली के प्रवृत होने की तिथि के प्रभाव से उत्पाद सिपाही/सहायक अवर निरीक्षक उत्पाद संवर्ग/इस नियमावली में प्रावधानित अवर निरीक्षक उत्पाद संवर्ग के नियम एवं संगत पद हेतु पूर्व में अधिसूचित एवं लागू सभी नियम/संकल्प/परिपत्र/ आदेश निरसित समझे जायेंगे।
(2) ऐसे निरसन के होते हुए भी उक्त नियमावलियों/संकल्प/परिपत्र एवं आदेश द्वारा प्रदत्त अथवा के अधीन शक्तियों के प्रयोग में किया गया कोई कार्य या की गई कार्रवाई इस नियमावली के अधीन किया गया या की गयी समझी जायेगी मानों जब कार्य किया गया था या कार्रवाई की गयी थी उस दिन यह नियमावली प्रवर्तन में थी।
19. कठिनाई दूर करने की शक्ति ।- इस नियमावली के किसी भी प्रावधान या नियम को लागू करने के संबंध में उद्भूत किसी कठिनाई को दूर करने की शक्ति सरकार के अनुमोदन से निबंधन, उत्पाद एवं मद्य निषेध विभाग को होगी।

(नियम- 7 (3) (III) द्रष्ट्रव्य)
1. उॅचाईः- 1. पुरूषों के लिए - न्यूनतम 165 सेन्टीमीटर 2. सभी वर्गो की महिला के लिए - न्यूनतम 155 सेन्टीमीटर 3. भारतीय मूल के गोरखा को सिर्फ - न्यूनतम 160 सेन्टीमीटर 4. अनु0 जाति एवं अनु0 जनजाति के पुरूषों के लिए - न्यूनतम 162 सेन्टीमीटर 2. सीनाः-
1. सामान्य/पिछड़ा वर्ग/अत्यंत पिछड़ा वर्ग के पुरूषों के लिए
बिना फुलाए - 81 से0 मी0 (न्यूनतम) फुलाकर - 86 से0 मी0 (न्यूनतम) (फुलाने के बाद सीना में कम से कम 5 से0 मी0 अन्तर होना अनिवार्य होगा)
2. अनु0 जाति /अनु0 जनजाति के पुरूषों के लिए
बिना फुलाए - 79 से0 मी0 (न्यूनतम) फुलाकर - 84 से0 मी0 (न्यूनतम) (फुलाने के बाद सीना में कम से कम 5 से0 मी0 अन्तर होना अनिवार्य होगा)
3. महिलाओं के लिए सीना का माप नहीं होगा। 4. भारतीय मूल के गोरखा के लिए

The 21st February 2014 No. 7/स्था0(स0अ0नि0)02-01/2013-889—In exercise of powers conferred by proviso of Article 309 of the Constitution of India the Governor of Bihar is pleased to make the following Rules to regulate recruitment and service-conditions for the posts of Excise Constables of the state:- 1. Short title, Extent and commencement- (1) These Rules may be called "Bihar Excise Constables Cadre (Recruitment and service-conditions) Rules, 2014" (2) It shall extend to the whole of the state of Bihar. (3) It shall come into force with immediate effect.
2. Definitions:- In the Rules, unless anything repugnant in the context-
(i) "Government" means the Government of Bihar; (ii) "Appointing Authority" means the Excise Commissioner, Bihar. (iii) "Department" means Registration, Excise and Prohibition Department as specified in the Executive Rules;
(iv) "Cadre" means Bihar Excise Constables Cadre; (v) "Commissioner" means the Excise Commissioner, Bihar; (vi) "Recruitment Agency" means Bihar Staff Selection Commission or any other agency selected by Registration, Excise and Prohibition Department;
(vii) "Schedule" means the schedule appended to these Rules; (viii) "Cadre Promotional Post" means the promotion to be granted on the post of "Assistant Sub-Inspector, Excise" and "Sub-Inspector, Excise" on ground of the percentage such as the government may from time to time fix in the Excise Constables Cadre and on ground of seniority-cum-ability as mentioned at appropriate place in these Rules.
3. Constitution of Cadre- (1) The number of posts for each gradation in this cadre and their total number shall be the same as the government may grant/determine and as the government may from time to time, grant or notify also in future.
(2) The post gradation of this cadre shall be as follows:-
(i) Excise Constable (ii) Assistant Sub-Inspector, Excise (iii) Sub-Inspector Excise Cadre (30 percent of the total posts)
(3) Promotion based posts for Assistant Sub-Inspector, Excise and Sub-Inspector, Excise shall be under limit of total sanctioned cadre strength or such as the6 (cid:1)बहार गजट (असाधारण), 25 फरवर) 2014 government may, from time to time, prescribe or sanction, or such as the government has already sanctioned.
(4) The procedure for promotion from the post of Excise Constable to Assistant Sub-Inspector, Excise and from the post of Assistant Sub- Inspector, Excise to Sub-Inspector, Excise shall be such as Excise Commissioner, Bihar may fix in view of provisions prescribed by General Administration Department /Excise Manual from time to time.
4. Recruitment- (1) Appointment in the state situated different offices shall be made on regular posts of Excise Constable in the pay scale as prescribed from time to time.
(2) For the posts to be filled up by direct recruitment, 50% posts from amongst the candidates for direct recruitment and 25% posts from amongst the trained Home- guards of the Bihar state and the remaining 25 percent posts from amongst the Ex-Army men shall be filled up against total strength of the posts for Excise constables.
5. Educational Qualification- Intermediate (10+2) or any equivalent examination passed from any Board/Council recognized by Central Government/ any State Government.
6. Age-limit- (1) Age-limit for direct recruitment shall be as follows (or as the government may prescribe from time to time):-
(a) General Category - 18 to 23 years (b) O.B.C./E.B.C - 18 to 25 years (c) Women- (Unreserved, O.B.C and E.B.C.) 18 to 26 years (d) Scheduled Castes/Scheduled Tribes 18 to 28 years (Men and Women)
(2) The fixed age-limit and the criterion of relaxation in it for these vacancies to be filed in from amongst Home-guards shall be such as may be prescribed for post of constable in the Bihar police, from time to time.
(3) The maximum age-limit for Ex-Army men shall be 45 years. (4) In case of non-availability of Home-guards and Ex-Army men having the required qualification, the vacancies may be filled up by non-Home-guards/non- Ex-Army men of the same reservation category on basis of direct recruitment.
(5) The candidates of reservation category belonging to other states shall be treated as the candidates as General Category and accordingly the age limit for them shall be the same as it is applicable to the candidates of General Category.
7. Ground and procedure of appointment - (1) The direct recruitment to the posts of Excise constable shall be made on ground of the examination conducted by Recruitment Agency and on basis of recommendation made by the Agency.
(2) Procedure for direct recruitment- (1) The following stages of the procedure for direct recruitment:—
(i) First stage:- The written examination for the candidates on the basis of received applications, shall be held by the Recruitment Agency (ii) Second stage:- A list of the candidates five times more number than declared number of those vacancies shall be prepared on basis of merits of the written examination conducted by the Recruitment Agency. In case of non-availability of the candidates having qualification for physical fitness, in sufficient number, the ratio of the7 (cid:1)बहार गजट (असाधारण), 25 फरवर) 2014 candidates may appropriately be reduced. A running test shall be made for all these candidates.
(iii) Third Stage:- Such candidates, who have qualified in running test, long jump, high jump, chest measurement, shall have to pass through physical measurement and test as prescribed in the schedule "A" appended to these Rules. On basis of the list of these candidates found to be eligible in physical measurement and test, and after selecting the candidates equally in number merit wise and reservation wise from amongst those eligible candidates a list of such successful candidates shall be submitted by the Recruitment Agency to the Appointing Authority.
(iv) Fourth Stage:- After obtaining the list of such successful candidates from the Recruitment Agency, a Medical Examination shall be conducted by the medical Board constituted under the prescribed provisions to conduct medical examination of such candidates. The candidates to be appointed must be found to be fit in the medical examination
(3) Criterion prescribed for selection through direct recruitment.-
(i) Written Examination.- The level and criterion of the Written Examination shall be the same as prescribed for constables in the Bihar police and also the procedures and provisions deciding minimum marks for the written examination and preparing merit list shall be the same as are applicable in recruitment of constables in the Bihar police.
(ii) Running Test.- The level and criterion of the running test shall be same as it is prescribed in the schedule.
(iii) Physical measurement and test.- The level and criterion of the Physical measurement and test shall be same as are prescribed in the schedule.
8. Recruitment Procedure on the reserved 25% posts for Ex-Army men and on the reserved 25% posts for Home guards of the Bihar State.
(1) Written Examination.- Applications for appointment on the reserved 25% posts for Ex-Army men and on the reserved 25% posts for Home guards of the Bihar state shall be invited by the Recruitment Agency. A Written Examination shall be conducted on basis of obtained applications. The procedures and provisions deciding minimum marks for the Written Examination and preparing merit list shall be the same as are applicable in recruitment of constables in the Bihar Police.
(2) The Recruitment Agency may for direct recruitment or for recruitment on the reserved 25% posts for Ex-Army men and on the reserved 25% posts for Home guards of the Bihar state, by releasing single or separate advertisement (s) thereof, held a Written Examination.
(3) After the result of the Written Examination, the list of reservation category wise successful candidates shall be sent to the Excise Commissioner, Patna by the Examination Agency.
(4) Medical Examination shall be done of such successful candidates and appropriate action shall be taken for appointment of the candidates found to be fit in the medical examination.
(cid:1)बहार गजट (असाधारण), 25 फरवर) 20148 9. Medical Test.- Medical Test shall be done on base of the following norms:-
(i) A candidate should have no symptom of knocking knees and flat sole.
(ii) A candidate may hear easily and there may not be necessity of hearing-aid.
(iii) Such candidates having Hernia/Hydrocele shall be eligible only after surgery.
(iv) Candidates should not have any serious eye-disease. The eye-sight with or without glasses should be 6/6 and should not have colorblindness.
10. Reservation.- The provisions of the Bihar State Reservation Act as enforced from time to time shall be applicable on all these recruitments and promotions and the benefit of reservation shall be admissible only to the permanent dwellers of the Bihar state.
11. Training.:- The four Month's, training of the rules made under the Excise Act shall be compulsory for the newly appointed Excise constable. They shall have to go through the training at the Constable Training School, Nathnager, Bhagalpur or at any other place as prescribed by the Appointing Authority. They shall be treated as trained only after passing the Excise constable C.T.S. Examination.
12. Probation period.- The probation period for the newly appointed staff shall be of six months since the date of the first appointment on this post. In case of the service have not been found satisfactory during the probation period, the probation period may be extended to six months. Such official may be terminated from service only if his/her service is not found satisfactory even during the extended probation period without notice. However if any termination is made on ground of misconduct the employee will be given a show cause notice.
13. Confirmation.- The service shall be confirmed by the Excise Commissioner, Bihar only after satisfactorily completion of the probation period and after passing the departmental examination C.T.S.
14. Promotion.- The promotion on basis of seniority-cum-ability may be given to the Excise Constable Cadre on 30% posts of the higher scale, namely, Assistant Sub-Inspector, Excise and Sub-Inspector, Excise provided that the period fixed and as revised from time to time by Personnel and Administrative Reforms Department has been completed, The promotion in this grade may be given on recommendation made by the departmental promotion committee formed for this purpose by the departments concerned.
15. Pay scale.- The pay scale and accordingly other allowances shall be admissible as prescribed and notified in conformity with the cadre by the state government from time to time.
16. Seniority.- (1) Seniority shall be same as fixed on basis of the merit list issued by the Examination Agency.
(2) The Excise Constable appointed in the same year from Categories of Home- guards of Bihar and Ex-Army men shall deemed to be senior from the Excise constable appointed by the direct recruitment in that calendar year. The decision regarding seniority of the Excise constable may be taken by the Excise9 (cid:1)बहार गजट (असाधारण), 25 फरवर) 2014 Commissioner under the provisions prescribed by the General Administration Department as per rule.
17. Discipline, Appeal and Penalty.- The Bihar Excise Manual and the Bihar Government Servant (Classification, control and Appeal) Rules, 2005 shall with their provisions be applicable on all staff of this cadre.
18. Repeal and savings.- (1) The Excise Constable/Assistant Sub-inspector Excise Cadre Rules/Sub-inspector Excise Cadre Rules as provided in these Rules and all rules/resolutions/circulars/orders earlier notified and enforced for the corresponding posts shall be deemed to be repealed with effect of such date on which these Rules come into force.
(2) Notwithstanding such repeal, anything done or any action taken in exercise of the power conferred by or under the said Rules/resolutions/circulars and orders shall be deemed to have been done or taken under these rules assuming that these rules were in enforcement when such thing was done or such action was taken.
19. Power to remove difficulties.- Registration, Excise and Prohibition Department shall have power to remove any difficulty arising out as and when any provision or rule of these Rules is made enforceable.
