सं0 4/प्रा0-12-13/2013-142(4)—भारत का संविधान के अनुच्छेद-309 के परन्तुक द्वारा प्रदत्त शक्तियों भारत का संविधान के अनुच्छेद-309 के परन्तुक द्वारा प्रदत्त शक्तियों प्रयोगशाला प्रावैधिक संवर्ग में नियुक्ति एवं अन्य ज्यपाल, स्वास्थ्य विभाग के अंतर्गत, प्रयोगशाला प्रावैधिक संवर्ग में नियुक्ति एवं अन्य सं0 4/प्रा0-12-13/2013 का प्रयोग करते हुए, बिहार के राज्यपाल, स्वास्थ्य विभाग के अंतर्गत, सेवा शर्तों के विनियमन हेतु निम्नलिखित नियमावली बनाते हैं।- सेवा शर्तों के विनियमन हेतु निम्नलिखित नियमा

अध्याय-1 : प्रारम्भिक

संक्षिप्त नाम, विस्तार एवं प्रारम्भ। - (1) यह नियमावली "बिहार प्रयोगशाला प्रावैधिक संवर्ग नियमावली, ) यह नियमावली "बिहार प्रयोगशाला प्रावैधिक संवर्ग नियमावली, जब तक विषय या संदर्भ में अन्यथा अपेक्षित न हो, इस नियमावली में :-

1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ। 2014" कही जा सकेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरत प्रवृत होगी। यह तुरत प्रवृत होगी। 2. परिभाषाएँ। - जब तक ( i) 'सरकार' से अभिप्रेत है बिहार राज्य सरकार; (ii) 'विभाग' से अभिप्रेत है स्वास्थ्य विभाग; (iii) 'आयोग' से अभिप्रेत है बिहार कर्मचारी चयन आयोग; ( iv) 'नियुक्ति प्राधिकार' से अभिप्रेत है संबंि असैनिक शल्य चिकित्सक-सह-मुख्य चिकित्सा 'सरकार' से अभिप्रेत है बिहार राज्य सरकार; 'विभाग' से अभिप्रेत है स्वास्थ्य विभाग; 'आयोग' से अभिप्रेत है बिहार कर्मचारी चयन आयोग; 'नियुक्ति प्राधिकार' से अभिप्रेत है संबंधित असैनिक शल्य चिकित्सक-सह-मुख्य पदाधिकारी; 'संवर्ग' से अभिप्रेत है बिहार प्रयोगशाला प्रावैधिक संवर्ग; तथा 'परिशिष्ट' से अभिप्रेत है इस नियमावली के साथ संलग्न परिशिष्ट।

की पदस्थापना की जायेगी।

(v) 'संवर्ग' से अभिप्रेत है बिहार प्रयोगशाला प्रावैधिक संवर्ग; तथा (vi) 'परिशिष्ट' से अभिप्रेत है इस नियमावली के साथ संलग्न परिशिष्ट। 3. संवर्ग का गठन। -प्रयोगशाला प्रावैधिक का संवर्ग जिला स्तरीय होगा। इस संवर्ग में प्रत्येक कोटि के पदों प्रयोगशाला प्रावैधिक का संवर्ग जिला स्तरीय होगा। इस संवर्ग में प्रत्येक कोटि के पदों की संख्या तथा संवर्ग के कुल पदों की संख्या उतनी होगी जितनी सरकार द्वारा समय-समय पर स्वीकृत की जाय। की संख्या तथा संवर्ग के कुल पदों की संख्या उतनी होगी जितनी सरकार द्वारा समय-समय पर स्वीकृत की जाय। की संख्या तथा संवर्ग के कुल पदों की संख्या उतनी होगी जितनी सरकार द्वारा समय-समय पर स्वीकृत की जाय। जिला संवर्ग से ही संबंधित जिला में अवस्थित चिकित्सा महाविद्यालय अस्पतालों एवं सुपरस्पेलिटी अस्पतालों में जिला संवर्ग से ही संबंधित जिला में अवस्थित चिकित्सा महाविद्यालय अस्पतालों एवं सुपरस्पेलिटी अस्पतालों में जिला संवर्ग से ही संबंधित जिला में अवस्थित चिकित्सा महाविद्यालय अस्पतालों एवं सुपरस्पेलिटी अस्पतालों में प्रयोगशाला प्रावैधिकों की पदस्थापना की जायेगी। इस संवर्ग की विभिन्न कोटियाँ अर्थात पदसोपान परिशिष्ट-1 के अनुसार होंगे। इस संवर्ग की विभिन्न कोटियाँ अर्थात पदसोपान परिशिष्ट-1 के अनुसार होंगे। 4. संवर्ग का पदसोपान। -इस संवर्ग की विभिन्न कोटियाँ अर्थात पदसोपान परिशिष्ट-1 के अनुसार होंगे।2 (cid:1)बहार गजट (असाधारण), 26 फरवर) 2014 अध्याय-2 : भर्ती

5. भर्ती। - इस संवर्ग में नियुक्ति मूल कोटि (प्रयोगशाला प्रावैधिक) के पद पर सीधी भर्ती से, आयोग की अनुशंसा के आधार पर, होगी। 6. अर्हताएँ।-(1) मूल कोटि के पद पर सीधी भर्ती के लिए न्यूनतम शैक्षणिक अर्हता आई0एस-सी0/102 (जीव विज्ञान) में उत्तीर्णता होगी। इसके अतिरिक्त, सरकार द्वारा मान्यता प्राप्त संस्थान से प्रयोगशाला प्रावैधिक के डिप्लोमा कोर्स में उत्तीर्णता एवं तत्संबंधी प्रमाण पत्र प्राप्त रहना आवश्यक होगा। (2) प्रयोगशाला प्रावैधिक संवर्ग में सीधी भर्ती के लिए न्यूनतम आयु-सीमा 21 वर्ष होगी और अधिकतम आयु-सीमा वही होगी जो सरकार द्वारा समय-समय पर, आरक्षण कोटिवार, विनिश्चित की जाय। संबंधित वर्ष की 1ली अगस्त को, उम्र के निर्धारणार्थ, कट ऑफ डेट माना जायेगा। 7. भर्ती की प्रक्रिया। - (1) नियुक्ति प्राधिकार, वर्ष की 1ली अपै्रल की स्थिति के आधार पर रिक्ति की गणना कर एवं रोस्टर क्लीयरेन्स कराकर, आरक्षण कोटिवार अधियाचना आयोग को 30 अपै्रल तक भेजेगा। (2) अधियाचना के आलोक में आयोग रिक्तियों को विज्ञापित कर आवेदन-पत्र आमंत्रित करेगा और निम्नलिखित आधार पर मेधा सूची तैयार करेगाः- (क) इन्टरमीडियेट/102 परीक्षा में प्राप्तांक के लिए- 25 अंक (ख) उच्चतर शिक्षा (बी0एस-सी0/एम0एस-सी0) के प्राप्तांक के लिए- 10 अंक (ग) प्रयोगशाला प्रावैधिक के डिप्लोमा कोर्स की परीक्षा में प्राप्तांक के लिए- 25 अंक (घ) बिहार राज्य के सरकारी अस्पतालों में कार्य का अनुभव के लिए (प्रति वर्ष के लिए 5 अंक, अधिकतम 25 अंक)- 25 अंक (ड़) साक्षात्कार के लिए- 15 अंक

कुल 100 अंक टिप्पणी। - इंटर/102, एवं प्रयोगशाला प्रावैधिक के डिप्लोमा कोर्स की परीक्षा में प्राप्तांक के लिए किसी अभ्यर्थी को प्रदान किये जानेवाले अंकों का निर्धारण उक्त कोर्स की परीक्षा में प्राप्त कुल अंकों के प्रतिशत को 0.25 के गुणक से गुणा करके होगा। यथा, यदि किसी अभ्यर्थी द्वारा 50% अंक प्राप्त किया गया हो तो उसे 50% X 0.25 =12½ अंक दिये जायेंगे। (3) साक्षात्कार की प्रक्रिया का निर्धारण आयोग के द्वारा किया जायेगा। (4) उप-नियम(2) के आधार पर मेधासूची तैयार करने के पश्चात्‌, आयोग के द्वारा, नियुक्ति प्राधिकार के सहयोग से, प्रमाणपत्र की प्रारम्भिक जाँच एवं स्वास्थ्य जाँच करायी जायेगी और तत्पश्चात्‌ अंतिम अनुशंसा नियुक्ति प्राधिकार को भेजी जायेगी। नियुक्ति प्राधिकार के स्तर पर भी, प्रमाणपत्रों की जॉच के पश्चात्‌ अनुशंसित अभ्यर्थियों के पूर्ववृत्त का सत्यापन करा लिया जायेगा। (5) आयोग की अनुशंसा के उपरान्त नियुक्ति की प्रक्रिया के संबंध में सरकार द्वारा समय-समय पर निर्गत अनुुदेश का अनुपालन आवश्यक होगा।

अध्याय 3 : परिवीक्षा/विभागीय परीक्षा/सम्पुष्टि 8. परिवीक्षा अवधि। -नियुक्ति के उपरान्त अभ्यर्थी परिवीक्षाधीन रहेंगे। परिवीक्षा अवधि दो वर्षों की होगी। परिवीक्षा अवधि में सेवा संतोषजनक नहीं पाये जाने की दशा में परिवीक्षा अवधि का विस्तार एक वर्ष के लिए किया जायेगा। यदि विस्तारित अवधि में भी सेवा संतोषजनक नहीं पायी जायेगी तो नियुक्ति प्राधिकार ऐसे प्रयोगशाला प्रावैधिक को सेवामुक्त कर सकेगा। 9. प्रशिक्षण। -परिवीक्षा अवधि में प्रयोगशाला प्रावैधिक को ऐसे प्रशिक्षण को सफलतापूर्वक पूर्ण करना होगा, जो विभाग द्वारा निर्धारित किया जाय। 10. विभागीय परीक्षा। -प्रयोगशाला प्रावैधिक को विभाग द्वारा आयोजित विभागीय परीक्षा उत्तीर्ण करनी होगी। विभागीय परीक्षा का पाठ्‌यक्रम विभाग द्वारा निर्धारित किया जायेगा। 11. सम्पुष्टि। -परिवीक्षा अवधि में संतोषजनक सेवा होने, प्रशिक्षण सफलतापूर्वक पूरा करने और विभागीय परीक्षा उत्तीर्ण करने पर प्रयोगशाला प्रावैधिक को सेवा में सम्पुष्ट किया जा सकेगा। 12. वरीयता। -प्रयोगशाला प्रावैधिक की आपसी वरीयता आयोग के द्वारा निर्धारित मेधासूची के अनुसार अवधारित की जायेगी।

अध्याय-4 : प्रोन्नति 13. प्रोन्नति के सोपान। -(1) सेवा में सम्पुष्ट प्रयोगशाला प्रावैधिक को रिक्ति की उपलब्धता के अधीन रहते हुए, योग्यता-सह-वरीयता के अनुसार, परिशिष्ट-1 में उल्लिखित प्रोन्नति के सोपान के पदों पर प्रोन्नति दिये जाने पर विचार किया जा सकेगा।3 (cid:1)बहार गजट (असाधारण), 26 फरवर) 2014 (2) प्रोन्नति के लिए सरकार द्वारा समय-समय पर निर्गत 'कालावधि' संबंधी अनुदेश का अनुपालन आवश्यक होगा। (3) सरकार द्वारा समय-समय पर निर्गत प्रोन्नति संबंधी और चारित्री या पी0ए0आर0 संबंधी, आरोप, विभागीय कार्यवाही/आपराधिक कार्यवाही आदि संबंधी अनुदेशों का, प्रोन्नति पर विचार के समय, अनुपालन करना अपेक्षित होगा। 14. विभागीय प्रोन्नति समिति। -प्रोन्नतियाँ विभागीय प्रोन्नति समिति की अनुशंसा के आधार पर हाेंगी। विभागीय प्रोन्नति समिति का गठन विभाग द्वारा किया जायेगा।

अध्याय 5 : प्रकीर्ण 15. आरक्षण। -सरकार के आरक्षण अधिनियम और सरकार द्वारा समय-समय पर सीधी भर्ती एवं प्रोन्नति हेतु निर्गत आरक्षण रोस्टर का अनुपालन करना अनिवार्य होगा। 16. परिशिष्ट-1 में अंकित पदसोपान सरकार के अनुमोदन के पश्चात्‌ ही प्रभावी होगा। यदि अनुमोदन पर विचार के क्रम में सरकार द्वारा परिशिष्ट-1 में अंकित पद-सोपान में कोई परिवर्तन या संशोधन किया जाता है तो परिशिष्ट-1 तदनुसार परिवर्तित या संशोधित समझा जायेगा और ऐसा परिवर्तित/संशोधित पद-सोपान इस नियमावली का अंग माना जायेगा। 17. परिशिष्ट-1 में उल्लिखित इस संवर्ग के पदों पर, इस नियमावली के प्रवृत्त होने के पूर्व से, नियुक्त/प्रोन्नत एवं कार्यरत कर्मी इस संवर्ग में स्वतः शामिल समझे जायेंगे। 18. अवशिष्ट मामले। -इस नियमावली में जिन विषयों का प्रावधान नहीं हो सका है उनके लिए सरकार की प्रासंगिक संहिताएँ/नियमावली/संकल्प/अनुदेश के प्रावधान लागू होंगे। 19. निर्वचन। -यदि इस नियमावली के किसी उपबंध के निर्वचन में कोई कठिनाई उत्पन्न हो तो विभाग को निर्देशित किया जायेगा और इस संबंध में विभाग का विनिश्चय अंतिम होगा। 20. कठिनाई का निराकरण। -यदि इस नियमावली के उपबंधों के कार्यान्वयन में कोई कठिनाई उत्पन्न हो तो विभाग को ऐसी किसी कठिनाई का निराकरण करने की शक्ति होगी। 21. निरसन एवं व्यावृत्ति। - (1) इस संवर्ग के संबंध में विभाग द्वारा पूर्व में समय-समय पर निर्गत नियमावली और सभी संकल्प, आदेश, अनुदेश आदि इस नियमावली के प्रवृत्त होने की तिथि के प्रभाव से निरसित समझे जायेंगे। (2) ऐसा निरसन के होते हुए भी ऐसी नियमावली, संकल्प, आदेश, अनुदेश आदि के अधीन शक्तियों का प्रयोग करते हुए किया गया कोई कार्य या की गई कोई कार्रवाई इस नियमावली द्वारा किया गया या की गयी समझी जायेगी, मानो यह नियमावली उस तिथि को प्रवृत्त थी जिस तिथि को ऐसा कोई कार्य किया गया था या ऐसी कोई कार्रवाई की गयी थी।

परिशिष्ट-1 [नियम- 2(vi), 4, 13, 16,17 द्रष्टव्य] प्रयोगशाला प्रावैधिक संवर्ग का पदसोपान

नोट :-उपर्युक्त सभी कोटियों का वेतन बैंड एवं ग्रेड-पे वही होगा जो सरकार द्वारा समय-समय पर निर्धारित किया जाय।

No. 4/प्रा0-12-13/2013-142(4)—In exercise of powers conferred by proviso to article 309 of the Constitution of India, the Governor of Bihar is pleased to make following Rules to regulate appointment and service conditions in the Lab Technician Cadre under the Health Department.-

Chapter-1 : PRELIMINARY 1. Short title, extent & commencement.-(1) These Rules may be called as the "Bihar Lab Technician Cadre Rules, 2014". (2) It will extend to the whole State of Bihar. (3) It will come into force at once.

2. Definitions.- In these Rules, unless the subject or context otherwise requires:- (i) 'Government' means Bihar State Government; (ii) 'Department' means Health Department; (iii) 'Commission' means Bihar Staff Selection Commission; (iv) 'Appointing Authority' means Civil Surgeon-cum-Chief Medical Officer; (v) 'Cadre' means Bihar Lab Technician Cadre; and (vi) 'Appendix' means appendix appended to these Rules. 3. Constitution of Cadre.-The cadre of Lab Technicians shall be at District level. In this cadre, number of posts in every grades and total number of posts in the cadre shall be as many as are sanctioned by the government, from time to time. The Lab Technicians of a district cadre will also be posted in the Medical college Hospitals and super speciality hospitals located in the concerned district.

4. Chain of posts of cadre.- Different grades and chain of posts of this cadre shall be according to Appendix-1.

Chapter-2 : RECRUITMENT

5. Recruitment.- The appointment in this cadre shall be by direct recruitment to the basic grade (Lab Technician) posts, on the basis of recommendation of the Commission.

6. Qualification.-(1) For appointment by direct recruitment to the basic grade posts, minimum educational qualification shall be I.Sc./10+2 (Biology) pass. In addition to this, it shall be necessary to have passed the Diploma course of Lab Technician from a government recognised institution. (2) For direct recruitment in the Lab Technician Cadre, minimum age limit shall be 21 years and maximum age limit shall be the same as may be determined reservation categorywise, from time to time, by the government. 1st August of the concerned year shall be deemed to be the cut off date for determination of age. 7. Procedure of recruitment.-(1) The appointing authority, after calculating vacancy on the basis of position as on 1st April of the year and getting roster cleared, shall send reservation categorywise requisition to the Commission latest by 30th April.

(2) In light of requisition, the Commission shall invite applications by advertising vacancies and prepare merit list on following basis:-

(a) For marks obtained in Intermediate/10+2----------------------------------25 marks (b) For marks obtained in higher degree(B.sc./M.Sc) --------------------------------10 marks (c) For marks obtained in Lab Technician Diploma Course examination-------------------25 marks5 (cid:1)बहार गजट (असाधारण), 26 फरवर) 2014 (d) For work experience in government hospitals of Bihar State (5 marks per year, maximum 25 marks)--------------------25 marks (e) For Interview----------------------------------------15 marks

Total 100 marks Explanation.- The marks to be given to a candidate for Inter/10+2 and Lab Technician Diploma course Examination shall be determined by multiplying the percentage of total marks obtained in the examination of the said course by multiple of 0.25. For example, if a candidate has obtained 50% marks, he will be given 50% x 0.25 = 12½ marks.

(3) Procedure for interview shall be determined by the Commission. (4) After preparation of merit list, on the basis of Sub-rule(2) preliminary scrutiny of certificates and medical tests will be caused to be conducted by the Commission with the cooperation of appointing authority and thereafter final recommendation will be sent to the Appointing Authority. At the level of Appointing Authority also, verification of antecedents of recommended candidates will be caused to be done after scrutiny of certificates. (5) Compliance of instructions issued by the government, from time to time, with respect to procedure of appointment, after recommendation of the Commission, shall be necessary.

Chapter-3 : Probation/Departmental Examination/Confirmation

8. Probation Period.- After appointment the candidates will be under probation.

Probation period will be of two years. In case, the service during probation period is not found satisfactory, the probation period will be extended for one year. If the service is not found satisfactory in extended period also, then the appointing authority may terminate service of such Lab Technician.

9. Training.- During probation period the probationer Lab Technician shall have to undergo such training as is prescribed by the Department.

10. Departmental Examination.- The Lab Technicians shall have to pass the departmental examination arranged by the Department. The syllabus of departmental examination will be determined by the Department.

11. Confirmation.-On service during probation period being satisfactory, successful completion of training and passing of departmental examination, a Lab Technician may be confirmed in the service.

12. Seniority.-The inter-se seniority of Lab Technicians shall be determined according to the merit list prepared by the Commission.

Chapter-4 : PROMOTION

13. Promotion.- (1) Subject to availability of vacancy and according to seniority, confirmed Lab Technicians may be considered to be promoted on the posts mentioned in Appendix-1. (2) For promotion, Compliance of instructions regarding 'KALAWADHI' determined by the Government, from time to time, shall be necessary. (3) Compliance of instructions issued by the Government, from time to time, with respect to promotion, and character Roll/PAR, allegation/ departmental proceedings/criminal proceedings, etc shall be necessary at the time of consideration of promotion. 14. Departmental Promotion Committee.-Promotion may be considered on the basis of recommendations of the Departmental Promotion Committee. The Departmental Promotion Committee shall be constituted by the Department. Chapter-5 : MISCELLANEOUS 15. Reservation.- Compliance of provision of Reservation Act of the Government and reservation roster for direct recruitment as well as promotion, issued from time to time, by the Government shall be necessary. 16. The chain of posts mentioned in Appendix-1 shall be effective only after approval of the Government. If, in course of consideration of approval, any modification or amendment is made by the Government in the chain of posts mentioned in Appendix-1, then the Appendix-1 shall be deemed to be modified or amended accordingly and such modified/amended chain of posts shall be deemed to be the part of these Rules. 17. The personnels appointed/promoted and working on the posts of this cadre mentioned in Appendix-1, from before coming into force of these Rules, shall be deemed to be automatically included in this cadre. 18. Residue Matters.- For the subjects which have not been provided in these Rules, provisions of concerned Codes/Rules/Resolutions/Instructions shall apply. 19. Removal of doubts.- If any doubt arises with respect to interpretation of any provision of these Rules, it shall be referred to the Department and in this respect decision of the Department shall be final. 20. Removal of difficulties.-If any difficulty arises in implementation of provisions of these Rules, the Department shall have powers to remove such difficulty. 21. Repeal & Savings.- (1) The Rules and all resolutions, orders, instructions etc. issued earlier, from time to time, by the Department with respect to this cadre, shall be deemed to be repealed effect from the date of coming into force of these Rules. (2) Notwithstanding such repeal, any work done or any action taken in exercise of powers conferred by aforesaid Rules, resolutions, orders, instructions etc shall be deemed to be done or taken under these Rules presuming that these Rules were in force on the date on which such a work was done or such an action was taken.
