सं0 बी1-3-44/2014-09—यतः, बिहार राज्य में, राज्य की विधान-सभा के सदस्यों द्‌वारा निर्वाचित राज्य की विधान परिशद के नौ सदस्यों के स्थान 6 मई, 2014 को उनकी पदावधि समाप्त होने तथा सेवानिवृत्त होने पर रिक्त होने हैं।

यतः, इस प्रकार उत्पन्न हुई रिक्ति को भरने के प्रयोजन से द्विवार्शिक निर्वाचन कराया जाना है;

अतः, अब लोक प्रतिनिधित्व अधिनियम्‌ 1951 (1951 का 43) की धारा-16 के अनुसरण में, जैसा कि निर्वाचन आयोग नें सिफारिष की है कि बिहार राज्य के राज्यपाल इसके द्‌वारा राज्य की विधान सभा के सदस्यों से यह अपेक्षा करते हैं कि उक्त अधिनियम्‌ के उपबन्धों और उसके अधीन बनाए नियमों और आदेषों के अनुसार उक्त रिक्तियों को भरने के प्रयोजन से राज्य की विधान परिशद्‌ के लिए नौ सदस्य निर्वाचित कर दें।

The 3rd March 2014

No. B1-3-44/2014-09—WHEREAS, the seats of nine members of the Legislative Council of the State of Bihar, elected by the members of Legislative Assembly of the State, are due of fall vacant on 6th May, 2014, on the retirement of those members, on the expiration of their term of office; and

WHEREAS, a biennial election has to be held for the purpose of filling the above vacancies so arising;

NOW, THEREFORE, as recommended by the Election Commission of India in pursuance of section 16 of the Representation of the People Act, 1951 (43 of 1951), the Governor of the State of Bihar is hereby pleased to call upon the members of the Legislative Assembly of the State, to elect nine members to the Legislative Council of the State, for the purpose of filling the above vacancies, in accordance with the provisions of the said Act and of the rules and orders made thereunder.

No. 322/BR-LC/2014 (1):—WHEREAS, the Governor of the State of Bihar has, by notification issued under section 16 of the Representation of the People Act, 1951 (43 of 1951) and published in the official Gazette of the State on 3rd March, 2014, been pleased to call upon the members of the Legislative Assembly of the State, to elect nine members to the Legislative Council of the State :- Now, therefore, in pursuance of sub-section (1) of section 39 and section 56 of the said Act, the Election Commission of India hereby – (A) appoints, with respect to the said election –

(a) the 10th March, 2014 (Monday), as the last date for making nominations; (b) the 11th March, 2014 (Tuesday), as the date for the scrutiny of the nominations; (c) the 13th March, 2014 (Thursday), as the last date for the withdrawal of candidatures;

(d) the 20th March, 2014 (Thursday), as the date on which a poll shall, if necessary, be taken; and

(e) the 22nd March, 2014 (Saturday), as the date before which the election shall be completed; and

(B) fixes the hours from 9:00 A.M. to 4:00 P.M., as the hours during which the poll shall, if necessary, be taken in all the above mentioned States, on the date specified above, for the election.

No.322/BR-LC/2014 (2) :—In pursuance of section 21, and in exercise of the powers conferred by sub-section (1) of section 22, of the Representation of the People Act, 1951 (43 of 1951), the Election Commission of India, in consultation with the Government of Bihar, hereby :–

(i) designates the officer, specified in column (1) of the TABLE below, to be the Returning Officer; and

(ii) appoints the officer, specified in column (2) of the said Table, to be the Assistant Returning Officer to assist the Returning officer in the performance of his functions;

in respect of the biennial election to the Legislative Council of the State of Bihar, by the members of Legislative Assembly of the State, to be held in pursuance of the Governor's notification published in the official Gazette of the State on 3th March, 2014:-
