अध्याय-1 : प्रारम्भिक

1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ ।- (1) यह नियमावली "बिहार कॉलेज ऑफ फिजियोथेरापी ऐंड अकुपेशनलथेरापी शिक्षण संवर्ग नियमावली, 2014" कही जा सकेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरंत प्रवृत्त होगी। 2. परिभाषाएँ ।- जब तक विषय या संदर्भ में अन्यथा अपेक्षित न हो, इस नियमावली में :-

( i) 'सरकार' से अभिप्रेत है बिहार राज्य सरकार; (ii) 'विभाग' से अभिप्रेत है स्वास्थ्य विभाग; (iii) 'आयोग' से अभिप्रेत है बिहार लोक सेवा आयोग; (iv) 'नियुक्ति प्राधिकार' से अभिप्रेत है मूल कोटि के संदर्भ में निदेशक प्रमुख, स्वास्थ्य सेवाएँ, बिहार और उच्चतर कोटियों के संदर्भ में सरकार;

(v) 'संवर्ग' से अभिप्रेत है बिहार कॉलेज ऑफ फिजियोथेरापी ऐंड अकुपेशनलथेरापी शिक्षण संवर्ग; तथा (vi) 'परिशिष्ट' से अभिप्रेत है इस नियमावली के साथ संलग्न परिशिष्ट।

3. संवर्ग का गठन । - (1) बिहार कॉलेज ऑफ फिजियोथेरापी ऐंड अकुपेशनलथेरापी शिक्षण संवर्ग राज्य स्तरीय होगा। इस संवर्ग में निम्नलिखित दो उप-संंवर्ग होंगे :-

(i) फिजियोथेरापी शिक्षण उप-संवर्ग; तथा (ii) अकुपेशनलथेरापी शिक्षण उप-संवर्ग।2 (cid:18)बहार गजट (असाधारण), 16 मई 2014 (2) इस संवर्ग में प्रत्येक उप-संवर्ग में कोटिवार पदों की संख्या उतनी होगी जितनी सरकार द्वारा समय-समय पर स्वीकृत की जाय।

4. संवर्ग का पदसोपान ।- इस संवर्ग के प्रत्येक उप-संवर्ग में विभिन्न कोटियाँ एवं पद-सोपान परिशिष्ट-1 के अनुसार होंगे।

अध्याय-2 : भर्ती

5. भर्ती ।- (1) इस संवर्ग में नियुक्ति मूल कोटि (सहायक प्राध्यापक) के पद पर, सीधी भर्ती से, आयोग की अनुशंसा के आधार पर, होगी।

(2) नियुक्ति हेतु योग्य अभ्यर्थियों की अनुपलब्धता की दशा में, आवश्यकतानुसार, लोकहित में, सरकार द्वारा, संविदा के आधार पर, सीमित अवधि के लिए, बाह्‌य ोतों से नियुक्ति की जा सकेगी, जिसके लिए नियुक्ति प्रक्रिया सरकार द्वारा अवधारित की जा सकेगी।

6. अर्हताएँ ।- (1) इस संवर्ग में दोनों उप-संवर्गों में मूल कोटि के पदों पर सीधी भर्ती के लिए न्यूनतम शैक्षणिक अर्हता परिशिष्ट-1 में यथाविनिर्दिष्ट होंगी;

परन्तु पूर्व से कार्यरत शिक्षकों के संबंध में परिशिष्ट-1 में विनिर्दिष्ट अर्हता लागू नहीं होगी।

(2) इस संवर्ग में सीधी भर्ती के लिए न्यूनतम आयु सीमा 21 वर्ष होगी और अधिकतम आयु-सीमा वही होगी जो सरकार द्वारा, समय-समय पर, आरक्षण कोटिवार, विनिश्चित की जाय। संबंधित वर्ष की 1 ली अगस्त को, उम्र के अवधारण के लिए, कट ऑफ डेट माना जायेगा।

7. भर्ती की प्रक्रिया ।- (1) नियुक्ति प्राधिकार, वर्ष की 1ली अप्रैल की स्थिति के आधार पर रिक्तियों की गणना कर एवं रोस्टर क्लीयरेन्स कराकर, आरक्षण कोटिवार अधियाचना आयोग को 30 अप्रैल तक भेजेगा। (2) अधियाचना के आलोक में आयोग रिक्तियों को विज्ञापित कर आवेदन-पत्र आमंत्रित करेगा और निम्नलिखित आधार पर मेघासूची तैयार करेगा :- फिजियोथेरापी शिक्षण उप-संवर्ग :-

(क) मास्टर्स-इन-फिजियोथेरापी डिग्री कोर्स परीक्षा में प्राप्तांक के लिए - 50 अंक (ख) उच्चतर डिग्री के लिए - 10 अंक (ग) शैक्षणिक अनुभव के लिए (प्रत्येक पूर्ण वर्ष के लिए 5 अंक,

अधिकतम 25 अंक) - 25 अंक

(घ) साक्षात्कार के लिए - 15 अंक ---------------- कुल - 100 अंक ---------------- अकुपेशनल थेरापी शिक्षण उप-संवर्गः- (क) मास्टर्स-इन-अकुपेशनलथेरापी डिग्री कोर्स परीक्षा में प्राप्तांक के लिए - 50 अंक (ख) उच्चतर डिग्री के लिए - 10 अंक

(ग) शैक्षणिक अनुभव के लिए (प्रत्येक पूर्ण वर्ष के लिए 5 अंक, अधिकतम 25 अंक) - 25 अंक (घ) साक्षात्कार के लिए - 15 अंक ---------------- कुल - 100 अंक ---------------- टिप्पणी ।-(i) मास्टर्स-इन-फिजियोथेरापी/मास्टर्स-इन-अकुपेशनलथेरापी डिग्री कोर्स परीक्षा में प्राप्तांक के लिए किसी अभ्यर्थी को प्रदान किये जाने वाले अंकों का अवधारण उक्त कोर्स की परीक्षा में प्राप्त कुल अंकों के प्रतिशत को 0.5 के गुणक से गुणा करके होगा। अर्थात्‌ किसी अभ्यर्थी द्वारा 50% अंक प्राप्त किया गया हो तो उसे 50% x 0.5 = 25 अंक दिये जायेंगे। (ii) न्यूनतम अर्हतांक 30 होगी।

(3) साक्षात्कार की प्रक्रिया अवधारण आयोग के द्वारा अवधारित की जायेगी। (4) उपनियम (2) के आधार पर मेधासूची तैयार करने के पश्चात्‌, आयोग के द्वारा, नियुक्ति प्राधिकार के सहयोग से, प्रमाणपत्र की प्रारम्भिक जाँच एवं स्वास्थ्य जाँच करायी जायेगी और तत्पश्चात्‌ अंतिम अनुशंसा नियुक्ति प्राधिकार को भेजी जायेगी। नियुक्ति प्राधिकार के स्तर पर भी, प्रमाण पत्रों की प्रारंभिक जाँच के पश्चात्‌ अनुशंसित अभ्यर्थियों के पूर्ववृत्त का सत्यापन करा लिया जायेगा।

(5) आयोग की अनुशंसा के उपरान्त नियुक्ति की प्रक्रिया के संबंध में सरकार द्वारा समय-समय पर निर्गत अनुदेशों का अनुपालन आवश्यक होगा।

अध्याय 3 : परिवीक्षा/विभागीय परीक्षा/सम्पुष्टि

8. परिवीक्षा अवधि ।-नियुक्ति के उपरान्त अभ्यर्थी परिवीक्षाधीन रहेंगे। परिवीक्षा अवधि दो वर्षों की होगी। परिवीक्षा अवधि में सेवा संतोषजनक नहीं पाये जाने की दशा में परिवीक्षा अवधि का विस्तार एक वर्ष के लिए किया जा3 (cid:18)बहार गजट (असाधारण), 16 मइ. 2014 सकेगा। यदि विस्तारित अवधि में भी सेवा संतोषजनक नहीं पायी जायेगी तो नियुक्ति प्राधिकार ऐसे सहायक प्राध्यापक को सेवामुक्त कर सकेगा।

9. प्रशिक्षण ।-परिवीक्षा अवधि में सहायक प्राध्यापक को ऐसे प्रशिक्षण को सफलतापूर्वक पूरा करना होगा, जो विभाग द्वारा विहित किया जाय।

10. विभागीय परीक्षा ।-परिवीक्षा अवधि के संतोषजनक ढंग से पूरा करने और प्रशिक्षण (कोषागार, प्रशिक्षण सहित) के सफलतापूर्वक पूरा करने के अतिरिक्त विभागीय परीक्षा भी उत्तीर्ण करना आवश्यक होगा। विभागीय परीक्षा का पाठ्‌यक्रम विभाग द्वारा, केन्द्रीय परीक्षा समिति के परामर्श से, निर्धारित किया जायेगा।

11. सम्पुष्टि ।-परिवीक्षा अवधि में सेवा संतोषजनक होनेे, प्रशिक्षण को सफलतापूर्वक पूरा करने और विभागीय परीक्षा उतीर्ण करने के उपरान्त सहायक प्राध्यापक को सेवा में संपुष्ट किया जा सकेगा।

12. वरीयता ।-सहायक प्राध्यापकों की आपसी वरीयता आयोग द्वारा अन्तिम रूप से तैयार की गयी मेधासूची के अनुसार विनिश्चित की जायेगी।

अध्याय-4 : प्रोन्नति

13. प्रोन्नति ।-(1) सेवा में सम्पुष्ट सहायक प्राध्यापकों, को रिक्ति की उपलब्धता के अधीन रहते हुए, योग्यता एवं वरीयता के अनुसार, परिशिष्ट-1 में उल्लिखित प्रोन्नति के सोपान के अनुसार प्रोन्नति दिए जाने पर विचार किया जा सकेगा।

(2) प्रोन्नति के लिए सरकार द्वारा, समय-समय पर, निर्गत कालावधि संबंधी अनुदेश का अनुपालन आवश्यक होगा।

(3) सरकार द्वारा समय-समय पर निर्गत प्रोन्नति संबंधी और चारित्री या पी0ए0आर0, आरोप/विभागीय कार्यवाही/आपराधिक कार्यवाही आदि संबंधी अनुदेशों का, अनुपालन करना प्रोन्नति पर विचारण के समय, अपेक्षित होगा।

14. विभागीय प्रोन्नति समिति ।- प्रोन्नतियाँ विभागीय प्रोन्नति समिति की अनुशंसा के आधार पर विचारणीय होंगी। विभागीय प्रोन्नति समिति का गठन विभाग द्वारा किया जायेगा।

अध्याय 5ः प्रकीर्ण

15. आरक्षण।- सरकार के आरक्षण अधिनियम और सरकार द्वारा समय-समय पर सीधी भर्ती एवं प्रोन्नति हेतु निर्गत आरक्षण रोस्टर का अनुपालन करना अनिवार्य होगा।

16. परिशिष्ट- 1 में अंकित पद-सोपान सरकार के अनुमोदन के पश्चात ही प्रभावी होगा। यदि अनुमोदन पर विचार के क्रम में सरकार द्वारा परिशिष्ट-1 में अंकित पद-सोपान में कोई परिवर्तन या संशोधन किया जाता है तो परिशिष्ट-1 तदनुसार परिवर्तित या संशोधित समझा जायेगा और ऐसा परिवर्तित/संशोधित पद-सोपान इस नियमावली का अंग माना जायेगा।

17. परिशिष्ट - 1 में उल्लेखित इस संवर्ग के पदों पर, इस नियमावली के प्रवृत्त होने के पूर्व से, नियुक्त/प्रतिनियुक्त/प्रोन्नत एवं कार्यरत ऐसे कर्मी जिन्हें परिशिष्ट-1 में अवधारित शैक्षणिक अर्हता प्राप्त है, इस संवर्ग में स्वतः शामिल एवं समायोजित समझे जायेंगेः

परन्तु पूर्व से नियुक्त/प्रतिनियुक्त/प्रोन्नत एवं कार्यरत ऐसे कर्मी, जो परिशिष्ट-1 में अवधारित शैक्षणिक अर्हता प्राप्त नहीं है वे पूर्ववत्‌ अपने पदों पर मरणशील संवर्ग के सदस्य के रूप में बने रहेंगे और पूर्ववत्‌ उन्हें रिक्ति की उपलब्धता के अनुसार प्रोन्नति भी अनुमान्य होगी, किन्तु उनके द्वारा धारित पद उनकी प्रोन्नति, त्यागपत्र, मृत्यु, सेवानिवृति आदि कारणों से रिक्त होने पर स्वतः समाप्त हो जायेंगे।

18. अवशिष्ट मामले।-इस नियमावली में जिन विषयों का प्रावधान नहीं हो सका है उनके लिए सरकार की प्रासंगिक संहिताएॅं/नियमावली/संकल्प/अनुदेश के प्रावधान लागू होंगे।

19. निर्वचन ।- यदि इस नियमावली के किसी उपबंध के निर्वचन के संबंध में कोई संशय हो तो विभाग को निर्देशित किया जायेगा और इस संबंध में विभाग का विनिश्चय अन्तिम होगा।

20. कठिनाई का निराकरण।- यदि इस नियमावली के उपबंधों के कार्यान्वयन में कोई कठिनाई उत्पन्न हो तो विभाग को ऐसी किसी कठिनाई का निराकरण करने की शक्ति होगी।

21. निरसन एवं व्यावृति।- (1) इस संवर्ग के संबंध में विभाग द्वारा पूर्व में समय-समय पर निर्गत नियमावली और सभी संकल्प, आदेश, अनुदेश आदि इस नियमावली के प्रवृत्त होने की तिथि के प्रभाव से निरसित समझे जायेंगे।

(2) ऐसा निरसन के होते हुए भी, ऐसी नियमावली, संकल्प, आदेश, अनुदेश आदि के अधीन शक्तियों का प्रयोग करते हुए किया गया कोई कार्य या की गयी कोई कार्रवाई इस नियमावली द्वारा किया गया या की गयी समझी जायेगी, मानो यह नियमावली उस तिथि को प्रवृा थी जिस तिथि को ऐसा कोई कार्य किया गया था या ऐसी कोई कार्रवाई की गयी थी।4 (cid:18)बहार गजट (असाधारण), 16 मई 2014

The 15th May 2014 No. 11/फि0अ0(स्था0)-09/2013-208(II)—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor of Bihar is pleased to make5 (cid:18)बहार गजट (असाधारण), 16 मइ. 2014 following Rules to regulate appointment and service conditions in the Bihar College of Physiotherapy and Occupational therapy Teaching Cadre under the Health Department.

Chapter-I

Preliminary

1. Short title, extent & Commencement .- (1) These Rules may be called as the "Bihar College of Physiotherapy and Occupational therapy Teaching Cadre Rules ,2014." (2) It will extend to the whole of State of Bihar. (3) It will come into force at once. 2. Definitions.-In these Rules, unless otherwise requires in the subject of context.- (i) "Government" means Bihar state Government; (ii) "Department" means Health Department; (iii) "Commission" means Bihar Public Service Commission; (iv) "Appointing Authority" means Director in Chief, Health Services, Bihar in respect of basic category and government in respect of higher categories. (v) "Cadre" means Bihar College of Physiotherapy and Occupational therapy Teaching Cadre and,

(vi) "Appendix" means appendix appended to these Rules.

3. Constitution of Cadre.- The Bihar College of Physiotherapy and Occupational therapy Teaching Cadre shall be State level. There shall be following two sub-cadres in this cadre:-

(i) Physiotheraphy Teaching Sub-cadre; and (ii) Occupational therapy Teaching Sub-cadre.

(2) In this cadre, the number of categorywise posts in each sub-cadre shall be as many as are sanctioned by the Government, from time to time.

4. Chain of posts of the cadre.- Different categories and chain of posts in each sub- cadre of this cadre shall be according to Appendex-1.

Chapter-2 RECRUITMENT

5. Recruitment.- (1) In this cadre appointment shall be, by direct recruitment, to the posts (Assistant Professor) of basic category on the basis of recommendation of the Commission.

(2) In case of non-availability of eligible candidates for appointment, according to necessity and in the public interest, appointment may be made by the Government on contract basis from out sources for a limited period, for which procedure for appointment may be determined by the Government.

6. Qualification.-(1) For direct recruitment to the posts of basic category in both the sub-cadres, minimum educational qualification shall be as specified in Appendix-1: Provided that the qualification specified in Appendix-1 shall not apply to the teachers already working .

(2) For direct recruitment in this cadre, minimum age limit shall be 21 years and maximum age limit shall be the same as may be detetmined reservation categorieswise, from time to time, by the Government. 1st August of the concerned year shall be deemed to be the cut off date for determination of age.

7. Procedure of Recruitment.- (1) The appointing authority, after calculating vacancy on the basis of position as on 1st April of the year and getting roster cleared, shall send reservation categorywise requisition to the Commission latest by 30th April.

(2) In the light of requisition, the Commission shall invite applications after advertising vacancies and prepare merit list on following basis:-

Physlotherapy Teaching Sub-cadre:-

a) For marks obtained in Masters in

Physiotherapy Degree Course Examination 50 marks b) For higher degree 10 marks c) For teaching experience (5 marks per complete year, maximum 25 marks) 25 marks d) For interview 15 marks

Total 100 marks

Occupational therapy Teaching Sub-cadre:-

a) For marks obtained in Masters in

Occupational therapy Degree Course Examination 50 marks b) For higher degree 10 marks c) For teaching experience

(5 marks per complete year, maximum 25 marks) 25 marks d) For interview 15 marks

Total 100 marks Note: —(i) The determination of marks to be givern to a candidate for marks obtained in the Masters in Physiotherapy /Masters in Occupatioal therapy degree course examination shall be made by multiplying percentage of total marks obtained in the aforesaid courses examination by multiple of 0.5. For example, if a candidate has obtained 50% marks, he will be given 50%×0.5= 25 marks.

(ii) Minimum qualifying marks will be 30.

(3) Procedure for interview shall be determined by the Commission. (4) After prepatation of merit list on the basis of sub-rule (2), preliminary scrutiny of the certificates and medical check up shall be conducted by the Commission with the cooperation of the Appointing Authority, and thereafter reservation categories wise final recommendation, in accordance with the requisitioned vacancies, shall be sent to the Appointing Authority. At the level of the Appointing Authority also, antecedents of candidates shall be caused to be verified after scrutiny of certificates.

(5) After recommendation of the Commission, compliance of instructions issued with respect to procedure of appointment by the Government, from time to time, shall be necessary.

Chapter-3 PROBATION/DEPARTMENTAL EXAMINATION/CONFIRMATION 8. Probation Period.-After appointment, the candidates will remain on probation. Probation period will be of two years. In case, the service during probation period is not found satisfactory, the probation period will be extended for one year. If the service is not found satisfactory in extended period also, then the Appointing Authority may terminate service of such Assistant Professor.

9. Training.- During probation period, the Assistant Professor shall have to successfully complete such training as may be preseribed by the Department.

10. Departmental Examination.- In addition to completing probation period satisfactorily and completing training(including treasury training) successfully, passing of Departmental Examination shall also be necessary. Syllabus of Departmental Examination will be determined by the Department in consultation with the Central Examination Committee.

11. Confirmation.- On service being satisfactory in the probation period, after successful completion of training, and passing of departmental examination, an Assistant Professor may be confirmed in the service.

12. Seniority.-The inter-se seniority of Assistant Professor shall be determined according to the merit list prepared finally by the Commission.

Chapter- 4 : PROMOTION

13. Promotion.-(1) Subject to availability of vacancy, confirmed Assistant Professors in the service may be considered to be promoted according to the chain of posts for promotion mentioned in Appendix-1, according to merit-cum-seniority.

(2) For promotion, compliance of instruction with respect to "KALAWADHI" issued by the Government, from time to time, shall be necessary.

(3) It will be required to Comply the instructions issued by the Government, from time to time, with respect to promotion and character and character Roll/P.A.R, allegation/ departmental proceedings/criminal proceedings etc, at the time of consideration for promotion.

14. Departmental Promotion Committee.-Promotions may be considered on the basis of reconmmendations of the Departmental Promotion Committee. The Departmental Promotion Committee shall be constituted by the Department.

Chapter-5: MISCELLANEOUS

15. Reservation.- It will be essential to comply the Reservation Act of the Government and reservation roster for direct recruitment and promotion, issued by the Government, from time to time.

16. The chain of posts mentioned in Appendix-1 shall be effective only after approval of the Government. If , in course of consideration of approval, any modification or amendment is made by the Government in the chain of posts mentioned in Appendix-1, then the Appendix-1 shall be deemed to be modified or amended accordingly and such modified/amended chain of posts shall be deemed to be the part of these Rules.

17. Such personnels already appointed/deputed/promoted and working to the posts of this cadre who have educational qualification as determined in Appendix-1, before coming into force of these Rules, shall be deemed to be automatically included and absorbed in this cadre:

Provided that such personnels already appointed/deputed/promoted and working who do not possess educational qualification as determined in Appendix-1, shall remain on their posts as earlier as member of Dying cadre and promotion will also be admissible to them as earlier subject to availability of vacancy, but the posts held by them shall automatically cease to exist gradually after being vacant due to their promotion, resignation, death, retirement, etc.

18. Residue matters.- The subjects for which provisions have not been made in these Rules, The provisions of relevant Codes/Rules/Resolutions/Instructions of the Government shall apply to them.

19. Interpretation.— If any doubt arises with respect to interpretation of any provision of these Rules, it shall be referred to the Department and in this respect decision of Department shall be final.

20. Removal of difficulties.—If any difficulty arises in implementation of the provisions of these Rules, the Department shall have powers to remove such difficulty.

21. Repeal & Savings.—(1) The Rules and all resolutions, orders, instructions etc. issued earlier, from time to time, by the Department, with respect to this cadre, shall be deemed to be repealed with effect from the date of coming into force of these Rules.

(2) Notwithstanding such repeal, any work done or any action taken in exercise of powers conferred by aforesaid Rules, resolutions, orders, instructions etc shall be deemed to8 (cid:18)बहार गजट (असाधारण), 16 मई 2014 be done or taken under these Rules, as it these Rules were in force on the day on which such work was done or such an action was taken.
