सं0 11/फि0(स्था0)-03/2013-211(II)—भारत का संविधान के अनुच्छेद-309 के परन्तुक द्वारा प्रदा शक्तियों का प्रयोग करते हुए, बिहार के राज्यपाल, स्वास्थ्य विभाग के अधीन, फिजियोथेरापिस्ट एवं अकुपेशनलथेरापिस्ट की नियुक्ति एवं उनकी सेवा शर्तो को विनियमित करने हेतु निम्नलिखित नियमावली बनाते हैंः-

अध्याय - 1 : प्रारम्भिक

1. संक्षिप्त नाम, विस्तार एवं प्रारंभ।- (1) यह नियमावली ''बिहार फिजियोथेरापिस्ट/ अकुपेशनलथेरापिस्ट संवर्ग नियमावली, 2014'' कही जा सकेगी।

(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरन्त प्रवृा होगी। 2. परिभाषाएँ ।- इस नियमावली में, जब तक विषय या संदर्भ से अन्यथा अपेक्षित न हो :- (i) "सरकार" से अभिप्रेत है बिहार राज्य सरकार; (ii) "विभाग" से अभिप्रेत है स्वास्थ्य विभाग; (iii) "आयोग" से अभिप्रेत है बिहार लोक सेवा आयोग; (iv) ''संवर्ग' से अभिप्रेत है फिजियोथेरापिस्ट/अकुपेशनलथेरापिस्ट संवर्ग;

(v) ''नियुक्ति प्राधिकार' से अभिप्रेत है मूल कोटि के संदर्भ में निदेशक प्रमुख, स्वास्थ्य सेवाएँ, बिहार और उच्चतर कोटियों के संदर्भ में सरकार; तथा

(vi) ''परिशिष्ट' से अभिप्रेत है इस नियमावली के साथ संलग्न परिशिष्ट।

3. संवर्ग का गठन ।- (1) बिहार फिजियोथेरापिस्ट/अकुपेशनलथेरापिस्ट संवर्ग राज्य स्तरीय होगी। इस संवर्ग में प्रत्येक कोटि के पदों की संख्या तथा संवर्ग के कुल पदों की संख्या उतनी होगी जितनी सरकार द्वारा, समय-समय पर, स्वीकृत की जाय।

(2) इस संवर्ग में निम्नलिखित दो उप-संवर्ग होंगे :-

(क) बिहार फिजियोथेरापिस्ट/अकुपेशनलथेरापिस्ट सामान्य र्काव्य उप-संवर्ग, तथा (ख) बिहार फिजियोथेरापिस्ट/ अकुपेशनलथेरापिस्ट विशेषज्ञ उप-संवर्ग ।

(3) सामान्य र्काव्य उप-संवर्ग के पदाधिकारी सरकार के अधीन कहीं भी पदस्थापित एवं स्थानांतरित किये जा सकेंगे। विशेषज्ञ उप-संवर्ग के पदाधिकारी, चिकित्सा महाविद्यालय अस्पतालों एवं सुपरस्पेशलिटी अस्पतालों में पदस्थापित/ स्थानांतरित किये जा सकेंगे।

4. संवर्ग का पदसोपान ।- इस संवर्ग की विभिन्न कोटियाँ एवं पदसोपान परिशिष्ट-1 के अनुसार होंगे।

अध्याय-2 : भर्ती 5. भर्ती ।- (1) सामान्य र्काव्य उप-संवर्ग में नियुक्ति मूल कोटि (फिजियोथेरापिस्ट /अकुपेशनलथेरापिस्ट) के पद पर, सीधी भर्ती से, आयोग की अनुशंसा के आधार पर, की जायेगी। विशेषज्ञ उप-संवर्ग में भी नियुक्ति मूल कोटि (विशेषज्ञ फिजियोथेरापिस्ट/ अकुपेशनलथेरापिस्ट) के पद पर, सीधी भर्ती से, आयोग की अनुशंसा के आधार पर होगी।

(2) नियुक्ति हेतु योग्य फिजियोथेरापिस्ट/ अकुपेशनलथेरापिस्ट की अनुपलब्धता की दशा में, आवश्यकतानुसार, लोकहित में, सरकार द्वारा, संविदा के आधार पर, सीमित अवधि के लिए, बाह्‌य स्त्रोतों से नियुक्ति की जा सकेगी जिसके लिए नियुक्ति प्रक्रिया सरकार द्वारा अवधारित की जा सकेगी।

6. अर्हताएँ ।- (1) सामान्य र्काव्य उप-संवर्ग में फिजियोथेरापिस्ट/ अकुपेशनल थेरापिस्ट के पद पर सीधी भर्ती द्वारा नियुक्ति के लिए, न्यूनतम शैक्षणिक अर्हता सरकार द्वारा मान्यता प्राप्त विश्वविद्यालय/ संस्थान से बैचलर-इन-फिजियोथेरापी /बैचलर-इन-अकुपेशनलथेरापी होगी।

(2) विशेषज्ञ उपसंवर्ग में विशेषज्ञ फिजियोथेरापिस्ट/ अकुपेशनलथेरापिस्ट के पद पर सीधी भर्ती द्वारा नियुक्ति के लिए, न्यूनतम शैक्षणिक अर्हता सरकार द्वारा मान्यता प्राप्त विश्वविद्यालय से मास्टर्स-इन-फिजियोथेपी / मास्टर्स-इन-अकुपेशनलथेरापी डिग्री होगी।

(3) बिहार फिजियोथेरापिस्ट/अकुपेशनलथेरापिस्ट संवर्ग में सीधी भर्ती के लिए न्यूनतम आयु सीमा 21 वर्ष होगी और अधिकतम आयु सीमा वही होगी जो सरकार द्वारा, समय-समय पर आरक्षण कोटिवार, विनिश्चित की जाय। संबंधित वर्ष की 1 ली अगस्त को, उम्र के निर्धारणार्थ, 'कट ऑफ डेट' माना जायेगा।

7. भर्ती की प्रक्रिया। - (1) नियुक्ति प्राधिकार, वर्ष की 1ली अपै्रल की स्थिति के आधार पर रिक्तियों की गणना कर एवं रोस्टर क्लीयरेन्स कराकर, आरक्षण कोटिवार अधियाचना आयोग को 30 अप्रैल तक भेजेगा। (2) सामान्य र्काव्य उप-संवर्ग (फिजियोथेरापिस्ट/अकुपेशनलथेरापिस्ट) :-

अधियाचना के आलोक में आयोग रिक्तियों को विज्ञापित कर आवेदन-पत्र आमंत्रित करेगा और निम्नलिखित आधार पर मेघासूची तैयार करेगाः-

(क) बैचलर-इन-फिजियोथेरापी/बैचलर-इन-अकुपेशनलथेरापी

कोर्स में प्राप्तांक के लिए - 50 अंक (ख) उच्चतर डिग्री के लिए - 10 अंक (ग) राज्य के सरकारी अस्पतालों में कार्यानुभव के लिए

(प्रत्येक पूर्ण वर्ष के लिए 5 अंक, अधिकतम 25 अंक) - 25 अंक

(घ) साक्षात्कार के लिए- - 15 अंक ---------

कुल 100 अंक ----------

टिप्पणी।- (i) बैचलर-इन-फिजियोथेरापी/बैचलर-इन-अकुपेशनलथेरापी डिग्री की परीक्षा में प्राप्तांक के लिए किसी अभ्यर्थी को प्रदान किये जाने वाले अंकों का अवधारण उक्त कोर्स की परीक्षा में प्राप्त कुल अंकों के प्रतिशत को 0.5 के गुणक से गुणा करके होगा। यथा, यदि किसी अभ्यर्थी द्वारा 50% अंक प्राप्त किया गया हो तो उसे 50% × 0.5 = 25 अंक दिये जायेंगे। (ii) न्यूनतम अर्हतांक 30 होगी।

(3) विशेषज्ञ उप-संवर्ग (विशेषज्ञ फिजियोथेरापिस्ट/अकुपेशनलथेरापिस्ट ) :-

अधियाचना के आलोक में आयोग रिक्तियों को विज्ञापित कर आवेदन-पत्र आमंत्रित करेगा और निम्नलिखत आधार पर मेघासूची तैयार करेगाः-

(क) मास्टर्स-इन-फिजियोथेपी/मास्टर्स-इन-

अकुपेशनलथेरापी डिग्री की परीक्षा में प्राप्तांक के लिए - 50 अंक (ख) उच्चतर डिग्री के लिए - 10 अंक (ग) राज्य के सरकारी अस्पतालों में स्नातकोार डिग्री धारकों

द्वारा कार्यानुभव के लिए -25 अंक (प्रत्येक पूर्ण वर्ष के लिए 5 अंक, अधिकतम 25 अंक)3 (cid:18)बहार गजट (असाधारण), 20 मइ- 2014 (घ) साक्षात्कार के लिए- - 15 अंक ----------

कुल 100 अंक ----------

टिप्पणी।- (i) मास्टर्स-इन-फिजियोथेरापी/मास्टर्स-इन-अकुपेशनलथेरापी डिग्री की परीक्षा में प्राप्तांक के लिए किसी अभ्यर्थी को प्रदान किये जाने वाले अंकों का अवधारण उक्त कोर्स की परीक्षा में प्राप्त कुल अंकों के प्रतिशत को 0.5 के गुणक से गुणा करके होगा। यथा, यदि किसी अभ्यर्थी द्वारा 50% अंक प्राप्त किया गया हो तो उसे 50% × 0.5 = 25 अंक दिये जायेंगे। (ii) न्यूनतम अर्हतांक 30 होगी। (4) साक्षात्कार की प्रक्रिया आयोग द्वारा अवधारित की जायेगी।

(5) उप-नियम (2) एवं उप-नियम (3)के आधार पर मेधासूची तैयार करने के पश्चात्‌, आयोग के द्वारा, नियुक्ति प्राधिकार के सहयोग से, प्रमाणपत्र की प्रारम्भिक जाँच एवं स्वास्थ्य जाँच करायी जायेगी और तत्पश्चात्‌ अंतिम अनुशंसा नियुक्ति प्राधिकार को भेजी जायेगी। नियुक्ति प्राधिकार के स्तर पर भी प्रमाण पत्रों की प्रारंम्भिक जाँच के पश्चात्‌ अनुशंसित अभ्यर्थियों के पूर्ववृा का सत्यापन करा लिया जायेगा।

(6) आयोग की अनुशंसा के उपरान्त नियुक्ति की प्रक्रिया के संबंध में सरकार द्वारा, समय-समय पर, निर्गत अनुदेशों का अनुपालन आवश्यक होगा।

अध्याय - 3ः परिवीक्षा/विभागीय परीक्षा/सम्पुष्टि 8. परिवीक्षा अवधि।- नियुक्ति के उपरान्त अभ्यर्थी परिवीक्षाधीन रहेंगे। परिवीक्षा अवधि दो वर्षों की होगी। परिवीक्षा अवधि में सेवा संतोषजनक नहीं पाये जाने की दशा में परिवीक्षा अवधि का विस्तार एक वर्ष के लिए किया जायेगा। यदि विस्तारित अवधि में भी सेवा संतोषजनक नहीं पायी जायेगी तो नियुक्ति प्राधिकार ऐसे फिजियोथेरापिस्ट/अकुपेशनलथेरापिस्ट को सेवामुक्त कर सकेगा।

9. प्रशिक्षण।- परिवीक्षा अवधि में परिवीक्षाधीन पदाधिकारी को ऐसे प्रशिक्षण को सफलतापूर्वक पूर्ण करना होगा जो विभाग द्वारा निर्धारित किया जाय।

10. विभागीय परीक्षा।- परिवीक्षा अवधि को संतोषजनक ढंग से पूरा करने और प्रशिक्षण (कोषागार प्रशिक्षण सहित) के सफलतापूर्वक पूरा करने के अतिरिक्त विभागीय परीक्षा में भी उाीर्ण करना आवश्यक होगा। विभागीय परीक्षा का पाठ्‌यक्रम विभाग द्वारा, केन्द्रीय परीक्षा समिति के परामर्श से, निर्धारित किया जायेगा।

11. सम्पुष्टि।- परिवीक्षा अवधि के संतोषजनक ढंग से पूरा होने, प्रशिक्षण को सफलतापूर्वक पूरा करने और विभागीय परीक्षा उाीर्ण करने के उपरान्त पदाधिकारी को सेवा में सम्पुष्ट किया जा सकेगा।

12. वरीयता।- पदाधिकारियों की आपसी वरीयता आयोग द्वारा अंतिम रूप से तैयार की गयी मेधासूची के अनुसार विनिश्चित की जायेगी।

अध्याय-4ः प्रोन्नति 13. प्रोन्नति ।- (1) सेवा में सम्पुष्ट पदाधिकारियों को रिक्ति की उपलब्धता के अधीन रहते हुए, योग्यता-सह-वरीयता के अनुसार, परिशिष्ट-1 में उल्लिखित प्रोन्नति के पद सोपान के अनुसार प्रोन्नति दिये जाने पर विचार किया जा सकेगा। (2) प्रोन्नति के लिए सरकार द्वारा समय-समय पर, निर्गत 'कालावधि' संबंधी अनुदेश का अनुपालन आवश्यक होगा। (3) सरकार द्वारा, समय-समय पर, निर्गत प्रोन्नति संबंधी और चारित्री/ पी0ए0आर0 संबंधी, आरोप/विभागीय कार्यवाही/ अपराधिक कार्यवाही आदि संबंधी अनुदेशों का अनुपालन करना प्रोन्नति पर विचारण के समय, अपेक्षित होगा।

14. विभागीय प्रोन्नति समिति ।- प्रोन्नतियॉं विभागीय प्रोन्नति समिति की अनुशंसा के आधार पर विचारणीय होंगी। विभागीय प्रोन्नति समिति का गठन विभाग द्वारा किया जायेगा।

अध्याय 5 : प्रकीर्ण 15. आरक्षण ।- सरकार के आरक्षण अधिनियम और सरकार द्वारा समय-समय पर सीधी भर्ती एवं प्रोन्नति हेतु निर्गत आरक्षण रोस्टर का अनुपालन करना अनिवार्य होगा।

16. परिशिष्ट-1 में अंकित पद-सोपान सरकार के अनुमोदन के पश्चात ही प्रभावी होगा। यदि अनुमोदन पर विचार के क्रम में सरकार द्वारा परिशिष्ट-1 में अंकित पदसोपान में कोई परिवर्तन या संशोधन किया जाता है तो परिशिष्ट-1 तदनुसार परिवर्तित या संशोधित समझा जायेगा और ऐसा परिवर्तित/संशोधित पद-सोपान इस नियमावली का अंग माना जायेगा।

17. परिशिष्ट-1 में उल्लिखित इस संवर्ग के पदों पर, इस नियमावली के प्रवृा होने के पूर्व से नियुक्त/प्रोन्नत एवं कार्यरत ऐसे कर्मी, जिन्हें नियम -6 के अधीन अवधारित शैक्षणिक अर्हता प्राप्त है, इस संवर्ग में स्वतः शामिल एवं समायोजित समझे जायेंगे।4 (cid:18)बहार गजट (असाधारण), 20 मई 2014 परन्तु पूर्व से नियुक्त/प्रोन्नत ऐसे कर्मी, जो नियम-6 मेें अवधारित शैक्षणिक अर्हता प्राप्त नहीं हैं वे पूर्ववत अपने पदों पर मरणशील संवर्ग के सदस्य के रूप में बने रहेंगे और पूर्ववत उन्हें रिक्ति की उपलब्धता के अनुसार प्रोन्नति भी अनुमान्य होगी, किन्तु उनके द्वारा धारित पद उनकी प्रोन्नति, त्यागपत्र, मृत्यु, सेवानिवृति आदि कारणों से रिक्त होने पर स्वतः समाप्त होते जायेंगे।

18. अवशिष्ट मामले ।- इस नियमावली में जिन विषयों का प्रावधान नहीं हो सका है उनके लिए सरकार की प्रासंगिक संहिताएँ/नियमावली/संकल्प/अनुदेश के प्रावधान लागू होंगे।

19. निर्वचन ।- यदि इस नियमावली के किसी उपबंध के निर्वचन के संबंध में कोई संशय उत्पन्न हो तो विभाग को निर्देशित किया जायेगा और इस संबंध में विभाग का विनिश्चय अंतिम होगा।

20. कठिनाई का निराकरण ।- यदि इस नियमावली के उपबंधाें के कार्यान्वयन में कोई कठिनाई उत्पन्न हो तो विभाग को ऐसी किसी कठिनाई का निराकरण करने की शक्ति होगी।

21. निरसन एवं व्यावृाि ।-(1) इस संवर्ग के संबंध में विभाग द्वारा पूर्व में समय-समय पर, निर्गत नियमावली और सभी संकल्प, आदेश, अनुदेश आदि इस नियमावली के प्रवृा होने की तिथि के प्रभाव से निरसित समझे जायेंगे। (2) ऐसा निरसन के होते हुए भी, ऐसी नियमावली, संकल्प, आदेश, अनुदेश आदि के अधीन शक्तियों का प्रयोग करते हुए किया गया कोई कार्य या की गयी कोई कार्रवाई इस नियमावली द्वारा किया गया या की गयी समझी जायेगी, मानो यह नियमावली उस तिथि को प्रवृा थी जिस तिथि को ऐसा कोई कार्य किया गया था या ऐसी कोई कार्रवाई की गयी थी।

परिशिष्ट - 1 (नियम - 2(vi), 4, 13, 16, 17, द्रष्टव्य)

फिजियोथेरापिस्ट/अकुपेशनल थेरापिस्ट संवर्ग का पद-सोपान

नोट :- उपर्युक्त सभी कोटियों का वेतन बैंड एवं ग्रेड-पे वही होगा जो सरकार द्वारा समय-समय पर अवधारित की जाय।

सं0 11/फि0(स्था0)-03/2013-212(II)/अधिसूचना संख्या 211(II) दिनांक 19 मई 2014 का निम्नलिखित अंग्रेजी अनुवाद, बिहार-राज्यपाल के प्राधिकार से, एतदद्वारा प्रकाशित किया जाता है जो भारत का संविधान के अनुच्छेद 348 के खंड (3) के अंतर्गत अंग्रेजी भाषा में उक्त अधिसूचना का प्राधिकृत पाठ समझा जायेगा।

The 19th May 2014 No. 11/फि0(स्था0)-03/2013-211(II)—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor of Bihar is pleased to make following Rules to regulate appointment and service conditions of Physiotherapists and Occupational therapists under the Health Department.

Chapter-I Preliminary 1. Short title, extent & Commencement .- (1) These Rules may be called as the "Bihar Physiotherapist/ Occupational therapist Cadre Rules ,2014." (2) It will extend to the whole of State of Bihar. (3) It will come into force at once. 2. Definitions.-In these Rules, unless the subject of context otherwise requires: (i) "Government" means Bihar State Government;

(ii) "Department" means Health Department;

(iii) "Commission" means Bihar Public Service Commission;

(iv) "Cadre" means Physiotherapist/ Occupational therapist Cadre/; (v) "Appointing Authority" means Director in Chief, Health Services, Bihar with respect to basic grade and government with respect to higher grades; and

(vi) "Appendix" means appendix appended to these Rules.

3. Constitution of Cadre.- (1) The Bihar Physiotherapist/Occupational therapist Cadre shall be State level. In this cadre, number of posts in every category and total number of posts in the cadre shall be as many as are sanctioned by the government, from time to time. (2) There shall be following two sub-cadres in this cadre – (a) Bihar Physiotherapist/Occupational therapist General Duty sub-cadre, and, (b) Bihar Physiotherapist/Occupational therapist specialists sub-cadre. (3) The officers of the General Duty sub-cadre may be posted and transferred any where under the Government. The officers of the Specialists Sub cadre may be posted/transferred in Medical College Hospitals and Superspeciality Hospitals. 4. Chain of posts of cadre.- Different categories and chain of posts of this cadre shall be according to Appendex-1

Chapter-2: RECRUITMENT 5. Recruitment.- (1) Appointment in General Duty Sub-cadre shall be by direct recruitment, to the basic grade post (Physiotherapist/Occupational therapist) on the basis of recommendation of the Commission. In Specialist Sub-cadre also appointment shall be, by direct recruitment, to the posts basic categories (Specialists physiotherapists/ Occupational therapist) on the basis of recommendation of the Commission. (2) In case of non-availability of eligible Physiotherapist/Occupational therapist for the appointment, appointment may be made by the Government on contract basis out sources according to necessity and in public interest, for a limited period, for which procedure for appointment may be determined by the Government. 6. Qualifications.-(1) For appointment by direct recruitment to the post of Physiotherapist/Occupational therapist in General Duty Sub-cadre, minimum educational qualification shall be Bachelor in Physiotherapist/Bachelor in Occupational therapy from the recognized university/Institution. (2) For appointment by direct recruitment to the post of Specialist Physiotherapist/Occupational therapist in Specialist Sub-cadre, minimum educational qualification shall be Masters in Physiotherapy/Master in Occupational Therapist from the recognized university/Institution. (3) For direct recruitment in the Bihar Physiotherapist/Occupational Therrapist cadre, minimum age limit shall be 21 years and maximum age limit shall be the same as may be detetmined reservation categorieswise, from time to time, by the Government. 1st August of the concerned year shall be deemed to be the cut off date for determination of age.

Procedure of Recruitment.- (1) The appointing authority, after calculating vacancy on the basis of position as on 1st April of the year and getting roster cleared, shall send reservation categorywise requisition to the Commission latest by 30th April. (2) General Duty Sub-cadre (Physiotherapist/Occupational Therapist)-

In the light of requisition, the Commission shall invite applications after advertising vacancies and prepare merit list on following basis:-

(a) For marks obtained in Bachelor in

Physiotherapy/Bachelor in Occupational Therapy examination 50 marks (b) For higher degree 10 marks (c) For work experience in Government Hospitals of Bihar State

(5 marks per year, maximum 25 marks) 25 marks (d) For interview 15 marks —————

Total 100 marks —————

Note:— (i) The determination of marks to be given to a candidate for marks obtained in the Bachelor in Physiotherapy /Bachelor in Occupatioal therapy course examination shall be made by multiplying percentage of total marks obtained in the aforesaid courses examination by multiple of 0.5. For example, if a candidate has obtained 50% marks, he will be given 50%×0.5= 25 marks.

(ii) Minimum qualifying marks will be 30.

(3) Specialist Sub-cadre (Specialist Physiotherapist/Occupational Therapist)- (i) In the light of requisition, the Commission shall invite applications after advertising vacancies and prepare merit list on following basis-

a) For marks obtained in Masters in Physiotherapy/Masters in

Occupational therapy Course Examination 50 marks b) For higher degree 10 marks c) For work experience by Postgraduate degree holders

in Government hospitals of the state (5 marks per year, maximum 25 marks) 25 marks d) For interview 15 marks

Note: (i) The determination of marks to be given to a candidate for marks obtained in the Masters in Physiotherapy /Masters in Occupatioal therapy course examination shall be determined by multiplying percentage of total marks obtained in the aforesaid courses. (4) Procedure for interview shall be determined by the Commission.

(5) After prepatation of merit list on the basis of sub-rule (2) and sub-rule (3) preliminary scrutiny of the certificates and medical check up shall be conducted by the commission with the cooperation of the Appointing Authority, and thereafter reservation categories wise final recommendation in accordance with the requisitioned vacancies shall be sent to the Appointing Authority. At the level of the Appointing Authority also, antecedents of candidates shall be caused to be verified after scrutiny of certificates.

(6) After recommendation of the Commission, compliance of instructions issued with respect to procedure of appointment by the Government from time to time, shall be necessary.

Chapter-3 PROBATION/DEPARTMENTAL EXAMINATION/CONFIRMATION 8. Probation Period.-After appointment the candidates will remain on probation. Probation period will be of two years. In case, the sevice during probation period is not found satisfactory, the probation period will be extended for one year.if the service is not found satisfactory in extended period also, then the Appointing Authority may terminate sevice of such Physiotherapist/Occupational therapist. 9. Training.- During probation period, the Probationer officer shall have to successfully complete such training as may be preseribed by the Department. 10. Departmental Examination.- In addition to completing probation period satisfactorily and completing training(including treasury training) successfully, passing of Departmental Examination shall also be necessary. The syllabus of Departmental Examination will be determined by the Department, in consultation with the Central Examination Committee. 11. Confirmation.- After satisfactory completion of probation period, after successful completion of training, and passing of departmental examination, an officer may be confirmed in the service. 12. Seniority.- The inter-se seniority of the officers shall be determined according to the merit list prepared finally by the Commission.

Chapter- 4 : PROMOTION 13. Promotions.- (1) Subject to availability of vacancy, confirmed officers in the serice may be considered to be promoted according to the chain of posts for promotion mentioned in Appendix-1, according to merit-cum-seniority. (2) For promotion, compliance of instruction with respect to "KALAWADHI" issued by the Government, from time to time, shall be necessary. (3) It will be essential to Comply the instructions issued by the Government, from time to time, with respect to promotion and character Roll/P.A.R. allegation/ departmental proceedings/ criminal proceedings etc, at the time of consideration for promotion. 14. Departmental Promotion Committee.- Promotions may be considered on the basis of reconmmendations of the Departmental Promotion Committee. The Departmental Promotion Committee shall be constituted by the Department.

Chapter-5: MISCELLANEOUS 15. Reservation.-- Compliance of Reservation Act of the Government and reservation roster for direct recruitment and promotion, issued by the Government from time to time, shall be necessary. 16. The chain of posts mentioned in Appendix-1 shall be effective only after approval of the Government. If, in course of consideration of approval, any modification or amendment is made by the Government in the chain of posts mentioned in Appendix-1, then the Appendix-1 shall be deemed to be modified or amended accordingly and such modified/amended chain of posts shall be deemed to be the part of these Rules. 17. Such personnels already appointed/deputed/promoted and working on the posts of this cadre mentioned in Appendix-1, before coming into force of these Rules, who possess educational qualification determined under rule-6, shall be deemed to be automatically included and absorbed in this cadre:

(cid:18)बहार गजट (असाधारण), 20 मई 2014 Provided that such personnels already appointed/ promoted and working from before, who do not possess educational qualification as determined under rule-6, shall remain on their posts as earlier as member of Dying cadre and promotion will also be admissible to them as earlier subject to availability of vacancy,but the posts held by them shall automatically cease to exist gradually after being vacant due to their promotion, resignation, death, retirement, etc.

18. Residue matters.- Subjects for which the provisions have not been made in these Rules, provisions of relevant Codes/Rules/Resolutions/Instructions of the Government shall apply to them.

19. Interpretation.—if any doubt arises with respect to interpretation of any provision of these Rules, it shall be referred to the Department and in this respect decision of Department shall be final.

20. Removal of difficulties.—If any difficulty arises in implementation of provisions of these Rules, the Department shall have powers to remove such difficulty.

21. Repeal & Savings.—(1) The Rules and all resolutions, orders, instructions etc. issued earlier, from time to time, by the Department, with respect to this cadre, shall be deemed to be repealed with effect from the date of coming into force of these Rules.

(2) Notwithstanding such repeal, any work done or any action taken in exercise of powers conferred by aforesaid Rules, resolutions, orders, instructions etc shall be deemed to be done or taken under these Rules, as it these Rules were in force on the day on which such a work was done or such an action was taken.

Note:—The pay band and grade pay of all the Categories of the aforesaid sub-cadres shall be the same as may be determined by the Government, from time to time.
