सं0 2/नि0 स्था0 स0प्र0पदा0-06/2005-3545354535453545—भारतीय संविधान के अनुच्छेद-309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल, सहकारिता विभाग के अधीन सहकारिता प्रसार पदाधिकारी सम्वर्ग में भर्त्ती, प्रोन्नति एवं अन्य सेवा शर्त्तों को विनियमित करने के लिए निम्नलिखित नियमावली गठित करते हैं :-

1॰ ॰ ॰ ॰ संक्षिप्त नाम, सिंक्षिप्त नाम, सिंक्षिप्त नाम, सिंक्षिप्त नाम, विस्तार एवं प्रारम्भ। - वस्तार एवं प्रारम्भ। - वस्तार एवं प्रारम्भ। - वस्तार एवं प्रारम्भ। - (1) यह नियमावली ''सहकारिता प्रसार पदाधिकारी सम्वर्ग नियमावली-2014'' कही जा सकेगी।

(2) यह पूरे बिहार राज्य में लागू होगी। (3) यह तुरंत प्रवृत्त होगा। 2॰ परिभाषा। - ॰ परिभाषा। - ॰ परिभाषा। - ॰ परिभाषा। - इस नियमावली में, जब तक सन्दर्भ से अन्यथा अपेक्षित न हो - (क) 'विभाग' से अभिप्रेत है सहकारिता विभाग; (ख) 'सम्वर्ग' से अभिप्रेत है नियम-3 के उप-नियम (1) में विनिर्दिष्ट पदों पर नियुक्त एवं कार्यरत्‌ व्यक्ति समूह;

(ग) 'नियुक्ति पदाधिकारी' से अभिप्रेत है निबंधक, सहयोग समितियाँ, बिहार; (घ) 'निबंधक, सहयोग समितियाँ' से अभिप्रेत है निबंधक, सहयोग समितियाँ के पद पर राज्य सरकार द्वारा नियुक्त एवं कार्यरत व्यक्ति;

(ङ) 'आयोग' से अभिप्रेत है बिहार राज्य कर्मचारी चयन आयोग; (च) 'राज्य सरकार' से अभिप्रेत है बिहार राज्य सरकार; (छ) 'विभागीय प्रोन्नति समिति' से अभिप्रेत है विभाग द्वारा गठित विभागीय प्रोन्नति समिति। 3॰ सम्वर्ग-गठन। - ॰ सम्वर्ग-गठन। - ॰ सम्वर्ग-गठन। - ॰ सम्वर्ग-गठन। - (1) इस सम्वर्ग में निम्न कोटि के पद होंगे :-

(2) उक्त पदों का वेतनमान वही होगा, जो राज्य सरकार द्वारा, समय-समय पर अवधारित किया जाए। (3) यह सम्वर्ग राज्यस्तरीय, अराजपत्रित एवं पर्यवेक्षकीय होगा। (4) उपर्युक्त खंड-(1) के अुनसार विभिन्न कोटि के स्वीकृत पदबल का निर्धारण एवं चिह्नितीकरण, समय-समय पर, विभाग द्वारा किया जाएगा।

4॰ नियुक्ति की प्रक्रि4॰ नियुक्ति की प्रक्रि4॰ नियुक्ति की प्रक्रि4॰ नियुक्ति की प्रक्रिया। - या। - या। - या। - (1)(i) निबंधक, सहयोग समितियाँ द्वारा प्रति वर्ष 1ली अप्रैल को मूल कोटि में रिक्तियों का निर्धारण किया जाएगा।

(ii) उपर्युक्त उप-नियम 4(1)(i) के अधीन संवर्ग के मूल कोटि में निर्धारित रिक्तियों के 10% पद सहकारिता विभाग के अधीन क्षेत्रीय लिपिक संवर्ग के वैसे सदस्यों, जो सहकारिता प्रसार पदाधिकारी के पद पर नियुक्ति हेतु निर्धारित अर्हता रखते हों, की वरीयता-सह-मेधा के आधार पर प्रोन्नति से नियुक्ति द्वारा भरा जाएगा तथा शेष 90% पद आयोग की अनुशंसा पर सीधी भर्त्ती द्वारा भरा जा सकेगा। परंतु, सहकारिता प्रसार पदाधिकारी संवर्ग के मूल कोटि में स्वीकृत पदबल के 10% पदों की अधिसीमा तक ही विभागीय क्षेत्रीय लिपिक संवर्ग के सदस्यों, जो सहकारिता प्रसार पदाधिकारी के पद पर नियुक्ति हेतु निर्धारित योग्यता धारित करते हों, की प्रोन्नति से नियुक्ति हो सकेगी।

परंतु और कि, मूल कोटि में क्षेत्रीय लिपिकों की प्रोन्नति से नियुक्ति के क्रम में अर्हता रखने वाले अभ्यर्थियों की अनुपलब्धता के कारण बची रिक्ति सीधी भर्त्ती से भी भरी जा सकेगी।

(2) सहकारिता प्रसार पदाधिकारी के पद पर नियुक्ति हेतु न्यूनतम शैक्षणिक योग्यता स्नातक अथवा समकक्ष परीक्षा में उत्तीर्णता होगी।

(3) सीधी नियुक्ति हेतु न्यूनतम एवं अधिकतम आयु सीमा वही होगी जो राज्य सरकार द्वारा समय-समय पर अवधारित की जाए।

(4) नियुक्ति पदाधिकारी द्वारा प्रत्येक वित्तीय वर्ष की सीधी नियुक्ति हेतु उपलब्ध रिक्तियों के आधार पर सहकारिता प्रसार पदाधिकारी के पद पर सीधी नियुक्ति हेतु आयोग को अधियाचना भेजी जाएगी एवं प्रोन्नति से नियुक्ति हेतु उपलब्ध पदों पर विभागीय प्रोन्नति समिति की अनुषंसा प्राप्त कर नियुक्ति की जा सकेगी।

(5) आयोग द्वारा आयोजित स्नातक स्तर पर्यवेक्षकीय संयुक्त प्रतियोगिता परीक्षा के आधार पर अनुषंसित उम्मीदवारों की सीधी नियुक्ति की जा सकेगी।

(6) उपर्युक्त खण्ड-4(5) के अनुसार परीक्षा हेतु आयोग द्वारा समय-समय पर निर्धारित पाठ्‌यक्रम, प्राप्तांक एवं अन्य निदेष लागू होंगे।

5॰ 5॰ 5॰ 5॰ परिवीक्षा अवधि। - परिवीक्षा अवधि। - परिवीक्षा अवधि। - परिवीक्षा अवधि। - नियुक्ति के पश्चात परिवीक्षा अवधि दो वर्ष के लिए होगी। उक्त अवधि में सेवा एवं आचार सन्तोषप्रद नहीं होने पर तथा यदि नियुक्ति पदाधिकारी की राय में विस्तारित अवधि के दौरान मानक तक सुधार की उम्मीद होने पर परिवीक्षा अवधि एक वर्ष के लिए बढ़ायी जा सकती है। परिवीक्षा अवधि का विस्तार नहीं होने की दशा में नियुक्ति समाप्त हो जाएगी।

6॰6॰6॰6॰ प्रषिक्षण। - प्रषिक्षण। - प्रषिक्षण। - प्रषिक्षण। - (1) सम्वर्ग के नवनियुक्त कर्मियों के लिए परीक्ष्यमान अवधि में विभाग द्वारा यथा निर्धारित उच्चतर डिप्लोमा पाठ्‌यक्रम अथवा अन्य प्रषिक्षण की व्यवस्था की जा सकेगी। प्रशिक्षण प्राप्त सदस्यों को विभाग में कम-से-कम तीन वर्षों की सेवा करना अनिवार्य होगा एवं इस अवधि के अंदर विभाग छोड़ने की स्थिति में प्रशिक्षण पर हुए व्यय की पूरी राशि सरकार को वापस की जा सकेगी।

(2) सहकारिता प्रसार पदाधिकारी के मूल कोटि से वरीय सहकारिता प्रसार पदाधिकारी के पद पर प्रोन्नति होने अथवा वरीय सहकारिता प्रसार पदाधिकारी से मुख्य सहकारिता प्रसार पदाधिकारी के पद पर प्रोन्नति होने पर उच्चतर कोटि में सेवा संपुष्टि के लिए न्यूनतम 04 सप्ताह का प्रशिक्षण प्राप्त करना अनिवार्य होगा।

7॰7॰7॰7॰ सम्पुष्टि। - सम्पुष्टि। - सम्पुष्टि। - सम्पुष्टि। - संवर्ग में नियुक्त कर्मी, संतोषप्रद रूप से परीक्ष्यमान अवधि एवं प्रशिक्षण पूरा करने पर निम्नलिखित शर्त्तों के अधीन संवर्ग में संपुष्ट किए जा सकेंगे -

केन्द्रीय परीक्षा समिति, राजस्व पर्षद्‌ द्वारा आयोजित यथा विनिश्चित विभागीय परीक्षा एवं कम्प्यूटर सक्षमता जाँच परीक्षा में उत्तीर्णता अनिवार्य होगी। विभागीय परीक्षा हेतु विषय एवं पाठ्‌यक्रम का अवधारण राजस्व पर्षद्‌ की सहमति से विभाग द्वारा किया जा सकेगा।

8॰8॰8॰8॰ वरीयता। - वरीयता। - वरीयता। - वरीयता। - संवर्ग के सदस्यों की वरीयता का निर्धारण राज्य सरकार के सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्धारित सिद्धांतों एवं प्रक्रिया के अनुसार होगा।

9॰9॰9॰9॰ आपसी वरीयता। - आपसी वरीयता। - आपसी वरीयता। - आपसी वरीयता। - सीधी भर्त्ती वालों की आपसी वरीयता आयोग द्वारा तैयार की गयी एवं अनुशंसित मेधा सूची के अनुसार होगी।3 (cid:18)बहार गजट (असाधारण), 8888 जुलाईजुलाईजुलाईजुलाई 2014201420142014 10॰10॰10॰10॰ प्रोन्नति। - प्रोन्नति। - प्रोन्नति। - प्रोन्नति। - (1) सम्वर्ग में सम्पुष्ट सहकारिता प्रसार पदाधिकारियों की, सहकारिता प्रसार पदाधिकारी से वरीय सहकारिता प्रसार पदाधिकारी एवं वरीय सहकारिता प्रसार पदाधिकारी के पद से मुख्य सहकारिता प्रसार पदाधिकारी के पद पर वरीयता-सह-योग्यता के आधार पर विभागीय प्रोन्नति समिति की अनुषंसा पर प्रोन्नति दी जा सकेगी।

(2) सहकारिता प्रसार पदाधिकारी से वरीय सहकारिता प्रसार पदाधिकारी के पद पर एवं वरीय सहकारिता प्रसार पदाधिकारी के पद से मुख्य सहकारिता प्रसार पदाधिकारी के पद पर प्रोन्नति हेतु राज्य सरकार द्वारा अवधारित कालावधि पूरा किया जाना अनिवार्य होगा एवं उक्त कालावधि में छूट भी राज्य सरकार द्वारा अवधारित मानदंड के अनुरूप अनुमान्य हो सकेगा;

परंतु प्रतिनियुक्ति के समय किसी उच्चतर पदस्थापन की दशा में वर्त्तमान संवर्ग में वह विभाग पर आबद्धकर नहीं होगा।

11॰11॰11॰11॰ प्रतिनियुक्ति। - प्रतिनियुक्ति। - प्रतिनियुक्ति। - प्रतिनियुक्ति। - सम्वर्ग के सदस्यों को राज्य सरकार के पूर्णतः या अंशतः स्वामित्व अथवा नियंत्रण वाली सहकारी समितियों, निकायों या परियोजनाओं में उनकी कोटि के लिए चिह्नित पदों के विरुद्ध प्रतिनियुक्त किया जा सकेगा।

12॰12॰12॰12॰ कठिनाई का निराकरण। -कठिनाई का निराकरण। -कठिनाई का निराकरण। -कठिनाई का निराकरण। -इस नियमावली के किसी भी नियम को लागू करने में कठिनाई हो तो राज्य सरकार ऐसी कठिनाई का निराकरण समुचित आदेष द्वारा, जो नियमावली के प्रावधानों से संगत हो, कर सकेगी।

13॰13॰13॰13॰ इस नियमावली में जिन विषयों के लिए प्रावधान नहीं किए गए हों, उन विषयों पर राज्य सरकार की प्रासंगिक संहिता/नियमावली/संकल्प/अनुदेष लागू होंगे।

14॰14॰14॰14॰ निरसन एवं व्यावृत्ति। - निरसन एवं व्यावृत्ति। - निरसन एवं व्यावृत्ति। - निरसन एवं व्यावृत्ति। - (1) इस नियमावली के प्रभाव में आ जाने की तिथि से पूर्व के प्रासंगिक संकल्प/ परिपत्र/नियमावली/आदेश अथवा अनुदेश आदि निरसित समझे जायेंगे।

(2) ऐसे निरसन होते हुए भी, उपर्युक्त प्रासंगिक संकल्प/परिपत्र/नियमावली/आदेश अथवा अनुदेश आदि के अधीन किया गया कोई कार्य या की गई कार्रवाई इस नियमावली द्वारा किया गया कार्य या की गई कार्रवाई समझी जायेगी, मानों यह नियमावली उस तिथि को प्रवृत्त थी, जिस तिथि को ऐसा कार्य किया गया था या ऐसी कार्रवाई की गई थी।

सं0 02/नि॰ स्था॰ स॰ प्र॰ पदा॰-06/2005-3662—अधिसूचना संख्या 3545 दिनांक 03.07.14 के तहत्‌ निर्गत सहकारिता प्रसार पदाधिकारी संवर्ग नियमावली, 2014 का संलग्न अंग्रेजी पाठ बिहार-राज्यपाल के प्राधिकार से इसके द्वारा प्रकाषित किया जाता है, जिसे भारत संविधान के अनुच्छेद 348 के खण्ड (3) के अधीन उक्त नियमावली का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा।

No. 2/नि0 स्था0 स0प्र0पदा0-06/2005-3545—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor of Bihar is pleased to constitute the following rules to regulate the recruitment, promotion and other service conditions in the Cooperative Extension Officer Cadre under Cooperative Department: - 1. Short title, extent and commencement. - (a) These rules may be called the "Cooperative Extension Officer Cadre Rules, 2014;

(b) It shall extend to the whole State of Bihar; (c) It shall come into force at once. 2. Definition. - In these rules, unless otherwise requires in the context - (a) "Department" means the Cooperative Department; (b) "Cadre" means group of persons appointed and working on the posts specified in sub- rule (1) of Rule 3;

(c) "Appointing Officer" means the Registrar, Cooperative Societies, Bihar; (d) "Registrar, Cooperative Societies" means the person appointed by the State Government and working on the post of Registrar, Cooperative Societies;

(e) "Commission" means the Bihar Staff Selection Commission; (f) "State Government" means the State Government of Bihar; (g) "Departmental Promotion Committee" means the Departmental Promotion Committee constituted by the department.

3. Cadre-Constitution. - (1) The posts of the following categories shall be in this

Government, from time-to-time.

(3) This Cadre shall be state level, non-gazetted and supervisory. (4) Determination of sanctioned strength of the different categories of posts according to the provisions of sub-clause (1) as above shall be made by the department, from time to time.

4. Procedure of appointment. - (1)(i) Determination of the vacancies in basic category as on 1st April every year shall be made by the Registrar, Cooperative Societies

(2) 10% of the vacancies determined in the basic category under the above clause (i) of sub-rule (1) of Rule 4 shall be filled by appointment through promotion on the basis of seniority-cum-merit of the members of Field Clerk Cadre under Cooperative Department having qualifications determined for appointment to the post of Cooperative Extension Officer and the remaining 90% posts shall be filled by direct recruitment on the basis of recommendation of the Commission :

Provided that, the members of the Departmental Field Clerk Cadre having eligibility as determined for appointment to the post of Cooperative Extension Officer, shall be appointed, by promotion up to the post of maximum limit of 10% of the sanctioned strength of posts in basic category of the Cooperative Extension Officer cadre:

Provided further that, during the course of appointment by promotion in basic category of field clerks, the remaining vacancies due to unavailability of the candidates having qualifications may be filled by direct recruitment.

(2) Minimum educational qualification for appointment to the posts of Cooperative Extension Officer shall be pass in graduate or equivalent examination.

(3) The minimum and maximum age limit for direct recruitment shall be the same as may be determined by the State Government from time-to-time.

(4) By 30th of April each year, the requisition for direct recruitment on the post of Cooperative Extension Officer shall be sent to the Commission by the appointing officer in every financial year on the basis of vacancies available for direct recruitment of Cooperative Extension Officer.

(5) The direct recruitment shall be made of the candidates recommended on the basis of graduate level supervisory joint competitive examination conducted by the Commission.

(6) The syllabus, marks and other directives determined by the Commission from time- to-time for examination under above sub-clause 4(5) shall remain in force.

5. Probation Period. - The probation period after appointment shall be for two years. The probation period may be extended for one year, if the service and conduct is not5 (cid:18)बहार गजट (असाधारण), 8888 जुलाईजुलाईजुलाईजुलाई 2014201420142014 found satisfactory and if in opinion of the appointing authority, there is chance of improvement and up to mark during the extended period. In the event of non- extension of the probation period, the appointment shall stand terminated.

6. Training. - (1) In the probation period, the arrangement for higher diploma course or other training as determined by the department may be made for the newly appointed personnel of the Cadre.

(2) On promotion of Cooperative Extension Officer of category to the post of Senior Cooperative Extension Officer or promotion from the post of Senior Cooperative Extension Officer to the post of Chief Cooperative Extension Officer, it shall be compulsory to get a minimum of 04 weeks training before the service confirmation on the higher category.

7. Confirmation. - The personnel appointed in the cadre may be confirmed after successful completion of probation period and training under the following conditions : It shall be compulsory to pass in the Departmental Examination as determined and conducted by the Central Examination Committee, The Board of Revenue and Computer Eligibility Test Examination. The subject and syllabus of the Departmental Examination may be determined by the department in concurrence with the Board of Revenue.

8. Seniority. - Determination of the seniority of the members of the cadre shall be in accordance with principles and procedures as determined by the State Government General Administrative Department from time-to-time.

9. Inter-se seniority. - The inter-se seniority of the direct recruits shall be as per the merit list prepared and recommended by the Commission.

10. Promotion. - (1) The Cooperative Extension Officers confirmed in the Cadre may be promoted from Cooperative Extension Officer to Senior Cooperative Extension Officer and from Senior Cooperative Extension Officer to Chief Cooperative Extension Officer post on the basis of seniority-cum-merit recommended by the Departmental Promotion Committee.

(2) It shall be compulsory to complete the 'KALAWADHI' as determined by the State Government for promotion from the post of Cooperative Extension Officer to the post of Senior Cooperative Extension Officer and from the post of Senior Cooperative Extension Officer to the post of Chief Cooperative Extension Officer and exemption in the said 'KALAWADHI' also may be admissible in conformity with the criterion determined by the State Government:

Provided that, in case of any higher posting given while on deputation, it shall not be binding on the department in the parent cadre.

11. Deputation. - The members of the cadre may be deputed against the posts identified for their categories in the State Government wholly owned or partially owned or controlled cooperative societies, bodies or projects.

12. Removal of difficulty. - The State Government may, by necessary order, which is consistent with the provisions of these Rules remove the difficulty arises while implementing any of the provisions of this rule.

13. The relevant code/rule/resolution/instruction of the State Government shall remain applicable such subjects for which provisions have not been made in these rules. 14. Repeal and Savings. - (1) The relevant resolution/circular/rule/order or instruction etc. prior to the commencement of these rules shall be deemed to be repealed.

(cid:18)बहार गजट (असाधारण), 8888 जुलाई जुलाई जुलाई जुलाई 2014201420142014 (2) Notwithstanding such repeal, anything done or any action taken under the above relevant resolutions/circulars/rules/orders or instructions etc. shall be deemed to be done or taken under these Rules as if these rules were in force on the day on which such thing or action was done or taken.
