सं0 7/एम0ई0-401-70/2009-2982—भारत के संविधान के अनुच्छेद 309 के परन्तुक में प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल, बिहार वाणिज्य-कर विभाग क्षेत्रीय लिपिकीय सेवा भर्त्ती/प्रोन्नति एवं सेवा शर्त्त नियमावली 2011 का संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैं :-
1. संक्षिप्त नाम एवं प्रारम्भ :-
(1) यह नियमावली "बिहार वाणिज्य-कर विभाग क्षेत्रीय लिपिकीय सेवा भर्त्ती/प्रोन्नति एवं सेवा शर्त (संशोधन) नियमावली 2014'' कही जा सकेगी।
(2) इसका विस्तार पूरे बिहार राज्य में होगा। (3) यह तुरंत प्रवृत होगी।
2. उक्त नियमावली, 2011 के नियम 8 के उप-नियम (1) का प्रतिस्थापन :-
उक्त नियमावली, 2011 के नियम 8 का उप-नियम (1) निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः- (1) "निम्नवर्गीय लिपिक के पद पर नियुक्ति हेतु न्यूनतम शैक्षणिक अहर्त्ता कम्प्यूटर संचालन एवं कम्प्यूटर टंकण ज्ञान के साथ इन्टरमीडिएट (102) उत्तीर्ण अथवा समकक्ष होगी।"
3. उक्त नियमावली, 2011 के नियम 9 के उप-नियम (2) में संशोधन :-
उक्त नियमावली, 2011के नियम -9 के उप-नियम (2) परन्तुक में अंकित शब्द पॉच प्रतिशत (5%) को शब्द दस प्रतिशत (10%) द्वारा प्रतिस्थापित किया जायगा। 4. उक्त नियमावली 2011 के नियम-9 के उप-नियम (4) का प्रतिस्थापन :-
2 (cid:18)बहार गजट (असाधारण), 14141414 जुलाई जुलाई जुलाई जुलाई 2014201420142014 (4) " अधिकृत बल का शेष पन्द्रह प्रतिशत (15%) पद वाणिज्य-कर विभाग के क्षेत्रीय कार्यालयों की नियमित स्थापना में कार्यरत लिपिक के पद पर नियुक्ति के लिए अर्हत्ता रखने वाले समूह 'घ' के कर्मियों की वरीयता के आधार पर प्रोन्नति से नियुक्ति प्राधिकार द्वारा भरे जायंगे।"बिहार-राज्यपाल के आदेश से, रामेश्वर सिंह, वाणिज्य-कर आयुक्त-सह-प्रधान सचिव।

No.7/ME-401-70/2009-2982—In exercise of the power conferred by the proviso to Article 309 of the Constitution of India, the Governor of Bihar is pleased to make the following rules to amend the Bihar Commercial Taxes Department Regional Clerical Service recruitment /promotion and service conditions Rules, 2011 :- 1. SHORT TITLE, EXTENT AND DATE OF COMMENCEMENT:-
(1) These rules shall be called "The Bihar Commercial Taxes Department Regional Clerical Service Condition (amendment) Rules, 2014".
(2) It shall extend to the whole of "The State of Bihar".
(3) It shall come into force at once.
2. Substitution of Sub-rule (1) of Rule 8 of the said Rules,2011 :-
Sub rule (1) of Rule-8 of the said Rules-2011 shall be substituted by the following:- (1) " The Minimum educational qualification for the appointment to the post of Lower Division Clerk shall be Intermediate (10+2) pass or equivalent with knowledge of Computer Operation and Computer Typing"
3. Amendment in Sub-rule (2) of Rule 9 of the said Rules, 2011 :-
The word "five precent (5%)" used in proviso of the sub Rule (2) of Rule 9 shall be substituted by the words "ten precent (10%)"
4. Substitution of sub-rule (4) of Rule-9 of the said Rules 2011 :-
Sub-rule (4) of Rule-9 of the said Rules 2011 shall be substituted by the following:- "(4) Remaining fifteen percent (15%) posts of the authorized strength shall be filled by promotion of Group 'D' employees having qualifications for clerks working in the regular establishment of Regional offices of Commercial Taxes Department on the basis of seniority by the Appointing Authority."
