सं0 1/प.5-01/2010-790—भारत का संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल एतद्‌ द्वारा बिहार खेल एवं युवा सेवा में भर्त्ती की पद्धति एवं सेवा शर्त्तों को विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैं -

बिहार खेल एवं युवा सेवा नियमावली-2014

अध्याय : 1

प्रारंभिक

1. संक्षिप्त नाम, विस्तार एवं प्रारंभ - (1) यह नियमावली बिहार खेल एवं युवा सेवा नियमावली 2014 कही जा सकेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरंत प्रवृत्त होगी। 2. परिभाषाएँ - इस नियमावली में जब तक संदर्भ से अन्यथा अपेक्षित न हो - (i) 'राज्य सरकार' से अभिप्रेत है बिहार सरकार तथा (ii) 'राज्यपाल' से अभिप्रेत है बिहार के राज्यपाल;

(iii) 'अधीनस्थ सेवा' से अभिप्रेत है विभाग के छात्र एवं युवा कल्याण निदेशालय नियंत्रणाधीन कार्यरत जिला एवं क्षेत्रीय खेल कार्यालयों में नियुक्त क्रीड़ा प्रशिक्षक एवं अन्य समकक्ष पद (सम्परिवर्तित अवर शिक्षा सेवा)। (iv) 'नियुक्ति प्राधिकार' से अभिप्रेत है बिहार सरकार; (v) 'नियंत्री विभाग' से अभिप्रेत है कला, संस्कृति एवं युवा विभाग; (vi) 'सदस्य' से अभिप्रेत है बिहार खेल एवं युवा सेवा में नियुक्त व्यक्ति; (vii) 'विभाग' से अभिप्रेत है बिहार लोक सेवा आयोग; (viii) 'सेवा' से अभिप्रेत है बिहार खेल एवं युवा सेवा। 3. सेवा की संरचना -2 (cid:18)बहार गजट (असाधारण), 16161616 जुलाई जुलाई जुलाई जुलाई 2014201420142014 (i) यह सेवा कला, संस्कृति एवं युवा विभाग के प्रशासी नियंत्रण में राज्य सेवा होगी।

(ii) इस सेवा की विभिन्न कोटि के पदों की विवरणी अनुसूची 1 के अनुसार होंगे।

(iii) राज्य सरकार समय-समय पर इस सेवा की विभिन्न कोटियों के बल, पदनाम एवं वेतनमान का निर्धारण अधिसूचना द्वारा कर सकेगी। (iv) इस नियमावली के प्रवृत्त होने की तिथि से अनुसूची में उल्लिखित पदों पर पूर्व से नियुक्त एवं कार्यरत पदाधिकारी स्वतः इस सेवा के सदस्य समझे जायेंगे।

अध्याय :- 2

भर्त्ती

4. भर्त्ती का स्रोत - सेवा में भर्त्ती निम्न प्रकार से की जायेगी :- (क) इस नियमावली के अध्याय-3 के अनुसार सीधी भर्त्ती द्वारा। (ख) इस नियमावली के अध्याय-4 के अनुसार प्रोन्नति के द्वारा। 5. आरक्षण - सेवा में नियुक्ति एवं प्रोन्नति के लिए राज्य सरकार द्वारा समय-समय पर विहित आरक्षण अधिनियम के प्रावधान लागू होंगे।

6. रिक्तियों का निर्धारण एवं आयोग को सूचित करना - प्रशासी विभाग प्रत्येक वर्ष 1ली अप्रैल को उस वर्ष में इस सेवा में सीधी नियुक्ति द्वारा भरी जाने वाली रिक्तियों की संख्या निर्धारित करेगा तथा इस प्रकार निर्धारित रिक्तियों की सूचना 30 अप्रैल तक आयोग को देगा। परन्तु यदि किसी वर्ष में अधियाचना देने या सीधी नियुक्ति द्वारा पद भरने की कार्रवाई नहीं की जाती, तब भी सीधी नियुक्ति द्वारा भरे जाने वाले पदों की गणना वर्षवार की जाएगी और उसे अगले वर्ष के लिए, पिछले वर्ष की रिक्ति मानते हुए, अग्रगणित किया जायेगा।

अध्याय : 3

सीधी भर्त्ती

7. सीधी भर्त्ती का स्रोत - इस सेवा की मूल कोटि के 75 प्रतिशत पद सीधी भर्त्ती से भरे जायेंगे। 8. सीधी भर्त्ती हेतु अहर्त्ता -

(i) अभ्यर्थी की आयु : न्यूनतम 21 वर्ष तथा अधिकतम वही होगी जो राज्य सरकार के सामान्य प्रशासन विभाग के द्वारा समय-समय पर निर्धारित किया जाए। (ii) अभ्यर्थी की न्यूनतम शैक्षणिक योग्यता ः किसी मान्यता प्राप्त विश्वविद्यालय से कला/विज्ञान/वाणिज्य/शारीरिक शिक्षा में स्नातक डिग्री के साथ साथ नेशनल इन्सटीट्‌यूट ऑफ स्पोर्ट्‌स (स्पोर्ट्‌स ऑथोरिटी ऑफ इण्डिया) अथवा राज्य सरकार से इस प्रयोजनार्थ मान्यता प्राप्त संस्थान/महाविद्यालय से डिप्लोमा इन कोचिंग/मास्टर इन स्पोर्ट्‌स अनिवार्य होगा। (iii) खेल उपलब्धि ः मान्यता प्राप्त प्रतियोगिताओं में देश का प्रतिनिधित्व किया हो या मान्यता प्राप्त राष्ट्रीय चैम्पियनशिप में राज्य का प्रतिनिधित्व या अखिल भारतीय अंतरविश्वविद्यालय/मान्यता प्राप्त जूनियर चैम्पियनशिप/राष्ट्रीय युवा चैम्पियनशिप में कम से कम दो बार प्रतिभागिता या इंटर सर्विसेज प्रतियोगिता/ऑल इण्डिया पुलिस गेम्स/इंटर रेलवे चैम्पियनशिप में तीन बार प्रतिभागिता।

9. चयन का आधार - इस सेवा की मूल कोटि के पद आयोग के द्वारा विभाग की अधियाचना के आलोक में परीक्षा/साक्षात्कार के माध्यम से भरे जायेंगे।

10. परीक्षा के विषय एवं पाठ्‌यक्रम - आयोग द्वारा ली जाने वाली परीक्षा/साक्षात्कार के विषय एवं पाठ्‌यक्रम का निर्धारण शैक्षणिक योग्यतानुसार विभाग द्वारा आयोग के परामर्श से किया जायेगा।

11. चिकित्सा-परीक्षा - नियुक्ति के लिए चुने गये प्रत्येक अभ्यर्थी को राज्य सरकार के द्वारा गठित चिकित्सा बोर्ड के समक्ष चिकित्सा परीक्षा के लिए जाना होगा। पदीय कर्त्तव्यों का दक्षतापूर्वक निष्पादित करने की दृष्टि से जो अभ्यर्थी अपनी अपेक्षित शारीरिक योग्यता के संबंध में चिकित्सा बोर्ड को संतुष्ट करने में असफल होगा उसे नियुक्त नहीं किया जायेगा। चिकित्सा बोर्ड स्वयं इसके लिए वस्तुनिष्ठ मापदण्ड निर्धारित करेगा।

12. (1) आयोग द्वारा अभ्यर्थियाें की अनुशंसा - आयोग लिखित तथा साक्षात्कार में प्राप्त अंकों के आधार पर एक मेधा सूची तैयार करेगा। ऐसी तैयार की गयी सूची में से आयोग अभ्यर्थियों की उतनी संख्या की अनुशंसा राज्य सरकार को करेगा जितनी संख्या में रिक्तियाँ प्रतिवेदित की गयी हो। किसी अभ्यर्थी के योगदान न करने की स्थिति में रिक्तियाँ अग्रगणित की जायेंगी। (2) आयोग से प्राप्त मेधा सूची विभाग में प्राप्ति की तिथि से आगामी एक वर्ष तक के लिए ही वैध होगी। 13. परीक्ष्यमान अवधि एवं सम्पुष्टि -

(1) किसी मौलिक पद के विरुद्ध नियुक्त प्रत्येक पदाधिकारी पदग्रहण की तिथि से दो वर्षों की अवधि तक परिवीक्षा पर रहेंगे। संतोषजनक सेवा नहीं रहने पर परीक्ष्यमान अवधि अधिकतम एक वर्ष बढ़ जायेगी। (2) सरकार परिवीक्षा अवधि के दौरान या उसकी समाप्ति के समय इस सेवा में भर्त्ती किये गये ऐसे किसी पदाधिकारी की नियुक्ति समाप्त कर सकते हैं यदि उक्त पदाधिकारी अन्य कारणों से इस सेवा में नियुक्ति के योग्य न हो। संतोषजनक नहीं होने पर परिक्ष्यमान अवधि अधिकतम 1 वर्ष तक बढ़ाई जा सकती है।3 (cid:18)बहार गजट (असाधारण), 16161616 जुलाईजुलाईजुलाईजुलाई 2014201420142014 (3) प्रशिक्षण के लिए पाठ्‌यक्रम का निर्धारण विभाग द्वारा किया जा सकेगा। प्रत्येक प्रशिक्षु को विहित अनिवार्य प्रशिक्षण प्राप्त करना होगा। (4) विभागीय परीक्षा रुल्स फॉर डिपार्टमेंटल एक्जामिनेशन ऑफ गजेटेड आफिसर्स, 1961 के अनुसार केन्द्रीय परीक्षा समिति (राजस्व पर्षद्‌) द्वारा ली जायेगी।

(5) सम्पुष्टि, वार्षिक वेतन वृद्धि एवं प्रोन्नति, परीक्ष्यमान अवधि में निर्धारित प्रशिक्षण पूरा करने एवं विभागीय परीक्षा में उत्तीर्ण होने के पश्चात्‌ ही देय होगी।

अध्याय : 4

प्रोन्नति द्वारा भर्ती

14. प्रोन्नति द्वारा भर्ती के स्रोत - इस सेवा के मूल कोटि के 25 प्रतिशत पद कला, संस्कृति एवं युवा विभाग के छात्र एवं युवा कल्याण निदेशालय के प्रशासनिक नियंत्रणाधीन मुख्यालय एवं क्षेत्रीय कार्यालयों में क्रीड़ा प्रशिक्षक/शारीरिक शिक्षा अनुदेशक/उपाधीक्षक, शारीरिक शिक्षा के पदों पर कार्यरत कर्मियों से बिहार लोक सेवा आयोग के अध्यक्ष/सदस्य की अध्यक्षता में गठित विभागीय प्रोन्नति समिति के द्वारा वरीय-सह-मेधा के आधार पर की गयी अनुशंसा के आलोक में प्रोन्नति द्वारा भरे जायेंगे।

अध्याय : 5 प्रोन्नति 15. उच्चतर पदो पर प्रोन्नति - मूल कोटि के उच्चतर पदो पर प्रोन्नति हेतु विभागीय प्रोन्नति समिति की अनुशंसा पर विचार किया जा सकेगा। विभागीय प्रोन्नति समिति अलग से सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्गत संकल्पों/अनुदेशों के आलोक में गठित की जायेगी। अधिकतम वेतनमान के पदों पर प्रोन्नति हेतु विभागीय प्रोन्नति समिति का गठन बिहार लोक सेवा आयोग के अध्यक्ष या उनके द्वारा मनोनीत आयोग के सदस्य की अध्यक्षता में होगा। 16. कालावधि - मूल कोटि से उच्चतर कोटि/कोटियों में प्रोन्नति के प्रयोजनार्थ सामान्य प्रशासन विभाग द्वारा कालावधि निर्धारण के संबंध में समय-समय पर निर्गत निदेशों का अनुपालन आवश्यक होगा।

17. वरीयता - (i) सीधी भर्त्ती द्वारा नियुक्त कर्मचारियों की आपसी वरीयता का निर्धारण आयोग द्वारा तैयार की गयी क्रमानुसार मेधा सूची के आधार पर किया जायेगा।

(ii) मूल कोटि (बेसिक ग्रेड) में प्रोन्नति के आधार पर नियुक्त इस सेवा का कोई भी सदस्य उसी वर्ष सीधी भर्त्ती द्वारा नियुक्त किसी व्यक्ति से वरीय होगा भले ही सीधी भर्त्ती द्वारा नियुक्ति की प्रक्रिया पहले ही पूर्ण हो गई हो।

अध्याय : 6

सामान्य/प्रकीर्ण

18. कार्यक्षेत्र संबंधी अनुबन्ध -

(i) इस सेवा के सदस्य को बिहार राज्य के अंदर किसी भी स्थान पर, पदस्थापित किया जा सकेगा। (ii) राज्य सरकार को यह अधिकार होगा कि वह इस सेवा के किसी भी सदस्य को किसी गैर-संवर्गीय पद पर भी जो उसकी योग्यता के अनुरुप हो, पदस्थापित या प्रतिनियुक्त कर सके।

19. प्रशिक्षण - इस सेवा के सदस्य को प्रशिक्षण के लिए राज्य में अथवा राज्य से बाहर राज्य सरकार द्वारा निर्धारित अवधि के लिए भेजा जा सकेगा। प्रशिक्षण की समाप्ति पर किये गये मूल्यांकन को विभागीय प्रोन्नति समिति द्वारा ध्यान में रखा जा सकेगा।

20. अन्य सेवा शर्त्तें - इस सेवा के लिए अन्य शर्त्तें यथा अनुशासनात्मक कार्रवाई, छुट्टी, देय सेवानिवृत्ति लाभ इत्यादि, जो इस नियमावली से आच्छादित नहीं है या जो इस सेवा के लिए अलग से अधिसूचित नहीं है, राज्य सरकार के पदाधिकारियों के लिए प्रासंगिक नियमावली में किये गये संबंधित प्रावधानों से नियंत्रित होंगी। 21. कला, संस्कृति एवं युवा विभाग में पूर्व सृजित मूल कोटि के पद इस नियमावली के प्रवृत्त होने की तिथि से अनुसूची-2 में अंकित सम्परिवर्तित पदनाम से जाने जायेंगे।

22. निरसन एवं व्यावृति :

(1) इस नियमावली के प्रवृत होने की तिथि से पूर्व निर्गत सभी संबंधित एवं प्रासंगिक परिपत्र/निर्णय निरसित समझे जायेंगे। (2) ऐसे निरसन के बावजूद उक्त नियमावली के अधीन किया गया कोई कार्य या की गयी कोई कार्रवाई इस नियमावली द्वारा या इसके अधीन किया गया कोई कार्य या की गयी कोई कार्रवाई ऐसी समझी जायेगी; मानो, यह नियमावली उस तिथि को प्रवृत्त थी जिस तिथि को ऐसा कोई कार्य किया गया था या कोई कार्रवाई की गयी थी। 23. राज्य सरकार कला, संस्कृति एवं युवा विभाग के माध्यम से इस नियमावली के किसी प्रावधान को संशोधित करने की शक्ति रखती है तथा किसी भी प्रकार के शंका के निवारण हेतु निर्देश/परिपत्र निर्गत कर सकती है और उसका विनिश्चय अंतिम होगा। प्रशासी विभाग इस नियमावली के प्रावधानों को कार्यरुप देने के लिए वैसी प्रक्रिया निर्धारित कर सकेगा जो इस नियमावली के किसी प्रावधान के प्रतिकूल न हों ।4 (cid:18)बहार गजट (असाधारण), 16161616 जुलाई जुलाई जुलाई जुलाई 2014201420142014 अनुसूची - 1

बिहार-राज्यपाल के आदेश से, अषोक कुमार मल्लिक, सरकार के अपर सचिव।5 (cid:18)बहार गजट (असाधारण), 16161616 जुलाईजुलाईजुलाईजुलाई 2014201420142014 The 11th July 2014 No. 1/प.5-01/2010-790—In exercise of powers conferred by the proviso to the article 309 of the constitution of India, the Govt. of Bihar is pleased to make rules, regulations and system to regulate the recruitment in Bihar Sports and Youth services.

Bihar Sports and Youth Services Rules-2014 Chapter-1 Primary 1. Short title, Extent and commencement:- (I) These rules may be called the Bihar Sports and Youth Services Rules 2014. (ii) It shall extend to the whole of the state of Bihar. (iii) It shall come into force with immediate effect. 2. Definitions – For the purpose of these rules, unless there is anything repugnant in the subject or context :-

(i) "State Government" means the Government of Bihar; (ii) "Governor" means the Governor of Bihar; (iii) "Services under" means the posts of sports coaches or equivalent posts (Converted subordinate education services) working in district and regional sports offices under control of Directorate of Student and Youth Welfare of the Department;

(iv) "Appointing authority" means govt. of Bihar; (v) "Controlling Department" means Department of Art, Culture & Youth; (vi) "Member" means person appointed in Bihar Sports and Youth Services; (vii) "Department" means Bihar Public Service Commission; (viii) "Services" means Bihar Sports and Youth Services; 3. Service Structure :- (i) This services will be the state services under the administrative control of Art, Culture and Youth department.

(ii) The details of posts in different categories in this services will be as per schedule-1. (iii) In these services state government shall time to time decide strength, designation and payscale of different categories through notifications.

(i) The officers appointed and working on the post mentioned in the schedule will automatically be treated as member of the service from the day the regulation comes into force.

Chapter – 2

Recruitment

4. Sources for recruitment – Recruitment will be made as mentioned below :- (a) By direct recruitment as per chapter – 3 of this rules. (b) By promotion as per chapter – 4 of this rules. 5. Reservation – Provision in Reservation Act prescribed time to time by the State Govt. shall apply for the appointment & Promotion in these services.

6. Compiling of vacancies and intimation to the commission :- Every year on 1st April of concerned year the administrative department will decide the number of vacancies to be filled in the service by direct recruitment and by 30th April, the detail of vacancies shall be intimated to the commission. But if the process of appointment through direct recruitment on the post or intimation do not takes place in any year, even then the posts to be filled by direct recruitment shall be calculated annually and shall be treated as vacancies for the past year during the calculation for the next year.

Chapter – 3

Direct Recruitment 7. Sources for Direct recruitment – 75 percent post in these service shall be filled through direct recruitment.

8. Eligibility for Direct Recruitment :- (i) Age of applicant – Minimum 21 years and maximum shall be as fixed time to time by the general administration department of the state government.

(ii) Minimum educational qualification of applicant – With graduate degree in Art/Science/Commerce/Physical Education/Master in sports from national institute of sports (Sports Authority of India) or from similar institute recognised by the state government will be compulsory.

(iii) Sports Achievement :- Represented country in official championships or represented state in the recognised national championships or represented at least two time in the All India inter university/recognised national junior championship/National youth championship or represented three times in inter services competition/All India Police games/Inter railway championship.

9. Base of selection :- The commission will recruit on the basic posts of these services on the basis of examination/interview as per requisition of the examination/interview of department.

10. Subject and curriculum for examination :- The subject and curriculum will be decided as per the requisite education qualification in consultation with commission by the department.

11. Medical examination :- Each and every selected candidate has to face a medical examination in front of the medical board constituted by the state government. These candidates will not be appointed if he fail to show their physical ability perfectly in respect of the work designed for the post. The medical board itself will decide the criteria and norms for this.

12. (i) Recommendation of candidates by commission :- The commission will prepare list of merit on the basis of marks obtained in written examination and interview. The commission will recommend the candidates from the prepared list equivalent to the number of vacancies requisitioned by the State Government. The vacancies will carry forward if any candidate fails to join.

(ii) The merit list recommended will be valid only for a year from the date of its receipt in the department. 13. Probation period and confirmation :- (i) Any officer appointed on a basic post will be on probation period for two years from the date of his joining. In case of unsatisfactory service the probation period shall extend for another one year.

(ii) Government will terminate the service of an officer of these services during period for probation or its completion, if the officer is not eligible to be recruited for this services due to other reasons. In case of unsatisfactory service the probation period shall be extended for maximum one more year.

(iii) The department will decide the curriculum for training. Every trainee has to obtain that compulsory training.

(iv) The departmental exam will be conducted by the central examination board (Revenue Board) according to the Rules of Departmental Examination of gazetted officers, 1961.

(v) Confirmation, Annual salary increment and promotion will be admissible only after the completion of training during probation period and passing the departmental examination.

Chapter – 4

14. Source of appointment by promotion :- 25 percent posts of basic category of this service shall be filled through recommendation by the promotional committee headed by Chairman/member of Bihar public service commission on the basis of seniority-cum-merit of employees working on the post of sports coaches/Physical education instructor/Deputy Suptt. Physical Education under the administrative control of Student & Youth Welfare Directorate of the Art, Culture & Youth department.

Chapter – 5 Promotion 15. Promotion on higher post :- On recommendation of the departmental promotion committee the promotion shall be considered on higher posts from the basic category. The departmental promotion committee shall be constituted separately on the memorandum/circulars issued by general administration department time to time. For promotion on the post of highest pay scale departmental promotion committee shall be constituted under the Chairmanship of BPSC Chairman or member of commission nominated.

16. Duration :- For the promotion from basic category to higher category/categories, the duration shall be applied as per the circular issued time to time by the General Administration department.

17. Seniority :- (i) The seniority of the employees appointed through the direct recruitment will be considered through their merit list prepared by the commission.

(ii) The employee recruited through promotion from basic grade shall always be considered senior to the person recruited directly during the same year, even the process of direct recruitment is completed before.

Chapter – 6

General

18. Agreement on Jurisdiction :- (i) The member of this service shall be posted at any place in the state of Bihar. (ii) State Govt. will have the power to post or depute the member of this service on the ex-cadre posts having the similar qualifications.

19. Training :- The member of this service shall be sent for training in the state or outside state by the state govt. for the prescribed period. Departmental promotion committee will apprise its evaluation on completion of the training.

20. Other service conditions :- Other conditions for these service i.e. disciplinary actions, leave, permissible retirement benefit etc, which are not incorporated in the rules or not notified separately for this service, the officers of State Govt. shall be controlled by the respective rules concerned.

21. The post of basic grade created earlier in Department of Art, Culture & Youth will be named as per converted designation mentioned in schedule-2 from the date the rules comes in force.

22. Repeal & Savings :- (i) All concerned & relevant circulars/decisions shall be repeal on the date on which these rules comes in force.

(ii) Beside such repeal any thing done or any action taken under those rules, any work or action done under this rule shall be deemed to have been done or taken in exercise of power conferred by or under those rules as if those rules were in force on the day on which such thing or action was done or taken.

23. The State govt. through department of Art, Culture & Youth have the power to amend the provisions in these rules and issue any instructions/circulars for the removal of doubts and the decision shall be final.

The administrative deptt. shall make such procedures for implementation of these rules, which shall not be adverse to the provisions.
