सं॰ एम-4-12/2013(खंड-I)-6487/वि॰—भारतीय संविधान के अनुच्छेद 283 (2) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल बिहार कोषागार संहिता, 2011 का संशोधन करने हेतु निम्नलिखित संहिता बनाते हैं :-
1. संक्षिप्त नाम, विस्तार और आरंभ —
(1) यह संहिता बिहार कोषागार (संशोधन) संहिता, 2014 कही जा सकेगी । (2) इसका विस्तार संपूर्ण बिहार राज्य में होगा । (3) यह तुरत प्रवृत होगी ।
2. बिहार कोषागार संहिता, 2011 के नियम 344 एवं उसकी टिप्पणी-2 में प्रयुक्त शब्द ''दो क्रमिक वित्तीय वर्षों'' शब्द ''तीन क्रमिक वित्तीय वर्षों'' द्वारा प्रतिस्थापित किये जायेंगे ।
3. बिहार कोषागार संहिता के नियम-349 का विद्यमान प्रावधान नियम-349 के उप-नियम (1) के रूप में संख्यांकित किया जायेगा और तत्पश्चात् निम्नलिखित उप-नियम (2) जोड़ा जायेगाः- (2) ((((i)))) ''राज्य सरकार द्वारा गठित Special Purpose Vehicles, Non Profitable Organisations, बोर्ड, प्राधिकार, एजेन्सी एवं सोसाईटी आदि का, जो राज्य सरकार से किसी भी रूप में (यथा अनुदान, ऋण, सेंटेज पर कार्य कराने आदि) धन प्राप्त करती हैं, व्यक्तिगत लेखा खाता(पी0एल0 खाता) कोषागार में खोला जायेगा । इस तरह का व्यक्तिगत लेखा खाता(पी0एल0 खाता) नियम 349(क) के अधीन स्थानीय निकायों के खाता से भिन्न होंगें । राज्य सरकार किसी संस्था को या किसी विनिर्दिष्ट योजना की राशि को व्यक्तिगत लेखा खाता(पी0एल0 खाता) में रखने से छूट दे सकेगी । टिप्पणी-टिप्पणी-टिप्पणी-टिप्पणी- राज्य के वाणिज्यिक निगम, बोर्ड, प्राधिकार, एजेन्सी एवं अन्य संस्थानों, जिनका पी0एल0 खाता खोला जाना है, की सूची परिशिष्ट-14(क) में दी गई है लेकिन यह सूची अंतिम नहीं है ।2 (cid:18)बहार गजट (असाधारण), 21212121 जुलाई जुलाई जुलाई जुलाई 2014201420142014 राज्य सरकार किसी संस्था को या किसी विनिर्दिष्ट योजना की राशि को व्यक्तिगत लेखा खाता(पी0एल0 खाता) में रखने से छूट दे सकेगी ।'' ((((ii)))) ''व्यक्तिगत लेखा खाता(पी0एल0 खाता) का संचालन संस्थान के प्राधिकृत पदाधिकारी(जमा प्रशासक) द्वारा गैर सरकारी चेक के माध्यम से किया जायेगा जो महालेखाकार(अंकेक्षण) द्वारा कोषागार पदाधिकारी के माध्यम से उपलब्ध कराया जायेगा । प्रत्येक वितीय वर्ष में चेक निर्गत करने हेतु महालेखाकार(अंकेक्षण) से प्राधिकार पत्र की आवश्यकता नहीं होगी ।''
((((iii)))) ''राज्य सरकार द्वारा Special Purpose Vehicles, Non Profitable Organisations, बोर्ड, प्राधिकार, एजेन्सी एवं सोसाईटी आदि को चेक/ड्राफ्ट/खाता बही अंतरण द्वारा उनके व्यक्तिगत लेखा खाता(पी0एल0 खाता) में धन उपलब्ध करायी जायेगी । राज्य सरकार बाजार से सेंटेंज पर कार्य करने हेतु प्राप्त होने वाली राशि को व्यक्तिगत लेखा खाता(पी0एल0 खाता) में रखने से छूट दे सकती है । राज्य सरकार, इन संस्थानों की मौद्रिक तरलता बनाये रखने हेतु, व्यक्तिगत लेखा खाता(पी0एल0 खाता) में, जमा राशि में से किस्तों में राशि की निकासी कर, राशि को बैंक खाता में रखने का आदेश दे सकेगी ।''
((((iv)))) ''कोषागार पदाधिकारी द्वारा प्रत्येक माह मासिक लेखा के साथ व्यक्तिगत लेखा खाता(पी0एल0 खाता) का धन-ऋण ज्ञापन महालेखाकार को प्रेषित किया जायेगा । वितीय वर्ष के अंत में प्रत्येक वर्ष के लिए व्यक्तिगत लेखा खातों में जमा शेषों के सत्यापन के बाद उन्हें सत्यापन सहित महालेखाकार को भेजने के लिए जमा प्रशासक द्वारा 30 अप्रैल तक कोषागार पदाधिकारी को उपलब्ध कराया जाएगा ।''
((((v)))) ''व्यक्तिगत लेखा खाता(पी0एल0 खाता) में जमा अप्रयुक्त राशि जमा या अंतरण वाले वर्ष सहित तीन क्रमिक वितीय वर्ष के अंत में व्ययगत हो जायेगी तथा वह राशि संबंधित सेवा शीर्ष में व्यय में कमी के रूप में अंतरित कर दी जायेगी । वित विभाग, विशेष परिस्थिति में, व्ययगत राशि की निकासी करने की अनुमति दे सकेगा ।''
((((vi)))) ''वित विभाग विशेष परिस्थिति में व्यक्तिगत लेखा खाता(पी0एल0 खाता) में राशि जमा करने एवं निकासी करने हेतु प्रक्रिया विहित कर सकेगा ।''
((((vii)))) ''महालेखाकार(अंकेक्षण) द्वारा व्यक्तिगत लेखा खाता(पी0एल0 खाता) का लेखा परीक्षण किया जा सकेगा । वे जमा प्रशासक से उन अभिलेखों की मॉग कर सकेंगे जिसके आधार पर सरकारी धन के बेहतर उपयोग एवं प्रबंधन का परीक्षण किया जा सके ।''

No. M-4-12/2013(Part-I)-6487/F.—In exercise of powers conferred under Article 283 (2) of the Constitution of India, the Governor of Bihar is pleased to make the following code to amendment The Bihar Treasury Code, 2011 :- 1. Short title, extent and commencent -
(1) This code may be called The Bihar Treasury (Amendment) Code, 2014. (2) It shall extend to the whole of the State of Bihar. (3) It shall come into force at once.
2. The words "two consecutive years" used in Rule 344 of Bihar Treasury Code, 2011 and its note-2 shall be substituted by the words "Three consecutive financial years." 3. The existing provision of Rule 9 of The Bihar Treasury Code, 2011 shall be numbered as sub-rule (1) and after that the following sub-rule (2) (i) (ii) (iii) (iv) (v) (vi) & (vii) shall be added :-
(2) (i) "Personal Ledger Account of Special Purpose vehicles, Board, Authority, Agency and Society etc. constituted by the State Government who receive money in any form (eg. Grant, loan, work to be done on centage etc.) shall be opened in the Treasury. Such type of Personal Ledger Account (P.L. Account) shall be different from that of Local3 (cid:18)बहार गजट (असाधारण), 21212121 जुलाईजुलाईजुलाईजुलाई 2014201420142014 bodies under Rule 349(a). The State Government may exempt any institution or any specific scheme amount to keep in Personal Ledger Account. Note :- The list of The Commercial Corporations, Boards, Authority, Agency and other institutions of the State Government, whose P.L. Account have to be opened, is given in Appendix-14 (a) but this list is not final. The State Government may exempt any institution or any specific scheme amount to keep in Personal Ledger Account." (ii) "Personal Ledger Account (P.L. Account) will be operated by the authorised officer through Non-Government cheque which will be provided by Accountant General through Treasury Officer. Note of authority from Accountant General (Audit) to issue cheque will not be necessary."
(iii) "Money will be provided to Personal Ledger Account of Special Purpose vehicles, Board, Authority, Agency and Society etc. by Cheque/Draft/Book transfer. The State Government may exempt the amount to be received to work on Centage from market to keep in Personal Ledger Account. The State Government may order to keep the amount in the Bank Account with drawing from Personal Ledger Account in installment to maintain the monetary liquidity of these institutions."
(iv) Plus-Minus memorandum of Personal Ledger Account (P.L. Account) shall be sent to Accountant General every month along with monthly account by the Treasury Officer. At the end of financial year, after verification of the deposit balance of Personal Ledger Account for the every year shall be provided with verification to The Treasury Officer by 30th April by the Deposit Administrator to send them to the Accountant General. (v) The unutilized amount lying in Personal Deposit Account shall lapse at the last of three consecutive financial years including year of transfer or deposit and the such amount will be transferred to the concerned service Head as reduction in expenditure. The Finance Department may permit to withdraw the lapsed amount in special circumstances.
(vi) The Finance Department may in secial circumstances, prescribe procedure of deposit and withdrawal of the amount from P.L. Account.
(vii) The Personal Ledger Account (P.L. Account) may be audited by The Accountant General (Audit). He may ask for such records form Deposit Administrator on the basis of which examination of better use and management of public money may be made.
