मंत्रिमंडल सचिवालय (राजभाषा) विभाग ------- अधिसूचनाएं 9 जुलाई 2014 -403/रा0—भारत के संविधान के अनुच्छेद 309 द्वारा प्रदत्त शक्तियों का प्रयोग भारत के संविधान के अनुच्छेद 309 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्यपाल एतद्‌द्वारा मंत्रिमंडल सचिवालय (राजभाषा) विभाग, बिहार सरकार के राजभाषा संवर्ग में भर्ती करते हुए बिहार राज्यपाल एतद्‌द्वारा मंत्रिमंडल सचिवालय (राजभाषा) विभाग, बिहार सरकार के राजभाषा संवर्ग में भर्ती करते हुए बिहार राज्यपाल एतद्‌द्वारा मंत्रिमंडल सचिवालय (राजभाषा) विभाग, बिहार सरकार के राजभाषा संवर्ग में भर्ती की पद्धति को विनियमित करने हेतु निम्नलिखित नियमावली बनाते हैं :-

हेतु निम्नलिखित नियमावली बनाते हैं :-

1. संक्षिप्त नाम, विस्तार और प्रारंभ - (1) यह नियमावली "बिहार राजभाषा संवर्ग नियमावली, 2014" संक्षिप्त नाम, विस्तार और प्रारंभ - (1) यह नियमावली "बिहार राजभाषा संवर्ग नियमावली, 2014" कही जा सकेगी।

ँ - जब तक प्रसंग से अन्यथा अपेक्षित न हो, इस नियमावली में -

"विभाग"से अभिप्रेत है मंत्रिमंडल सचिवालय (राजभाषा) विभाग;

इसका विस्तार राजभाषा (मुख्यालय) तथा सभी प्रमंडलीय राजभाषा कार्यालयों तक होगा। इसका विस्तार राजभाषा (मुख्यालय) तथा सभी प्रमंडलीय राजभाषा कार्यालयों तक होगा। (2) इसका विस्तार राजभाषा (मुख्यालय) तथा सभी प्रमंडलीय राजभाषा कार्यालयों तक होगा। यह नियमावली अधिसूचना निर्गत होने की तिथि से प्रवृत्त होगी। (3) यह नियमावली अधिसूचना निर्गत होने की तिथि से प्रवृत्त होगी। 2. परिभाषाएँ - जब तक प्रसंग से अन्यथा अपेक्षित न हो, इस नियमावली में - (क) "विभाग"से अभिप्रेत है मंत्रिमंडल सचिवालय (राजभाषा) विभाग; (ख) "संवर्ग"से अभिप्रेत है राजभाषा सहायक,वरीय राजभाषा

ायोग अथवा बिहार कर्मचारी चयन आयोग;

सहायक, राजभाषा पदाधिकारी, "संवर्ग"से अभिप्रेत है राजभाषा सहायक,वरीय राजभाषा सहायक, राजभाषा पदाधिकारी, उप निदेशक एवं समकक्ष पदों का संवर्ग; उप निदेशक एवं समकक्ष पदों का संवर्ग; "सदस्य" से अभिप्रेत है राजभाषा संवर्ग का सदस्य; (ग) "सदस्य" से अभिप्रेत है राजभाषा संवर्ग का सदस्य; "नियमावली" से अभिप्रेत है बिहार राजभाषा संवर्ग नियमावली, 2014; (घ) "नियमावली" से अभिप्रेत है बिहार राजभाषा संवर्ग नियमावली, 2014; "आयोग" से अभिप्रेत है, यथास्थिति, बिहार लोक सेवा आयोग अथवा बिहार कर्मचारी चयन आयोग; (ड.)"आयोग" से अभिप्रेत है, यथास्थिति, बिहार लोक सेवा अ "सरकार" से अभिप्रेत है बिहार सरकार; (च)"सरकार" से अभिप्रेत है बिहार सरकार; "राज्यपाल" से अभिप्रेत है बिहार के राज्यपाल; (छ)"राज्यपाल" से अभिप्रेत है बिहार के राज्यपाल; (ज)"नियुक्ति प्राधिकार" से अभिप्रेत है राजभाषा सहायक, वरीय राजभाषा सहायक, तथा राजभाषा "नियुक्ति प्राधिकार" से अभिप्रेत है राजभाषा सहायक, वरीय राजभाषा सहायक, तथा राजभाषा "नियुक्ति प्राधिकार" से अभिप्रेत है राजभाषा सहायक, वरीय राजभाषा सहायक, तथा राजभाषा धान सचिव/सचिव तथा उप निदेशक के संदर्भ में बिहार के पदाधिकारी के संदर्भ मेें विभाग के प्रधान सचिव/सचिव तथा उप निदेशक के संदर्भ में बिहार के पदाधिकारी के संदर्भ मेें विभाग के प्र राज्यपाल; विभागीय प्रोन्नति समिति'' से अभिप्रेत है विभाग द्वारा गठित विभागीय प्रोन्नति समिति। विभागीय प्रोन्नति समिति'' से अभिप्रेत है विभाग द्वारा गठित विभागीय प्रोन्नति समिति। (झ) ''विभागीय प्रोन्नति समिति'' से अभिप्रेत है विभाग द्वारा गठित विभागीय प्रोन्नति समिति। सेवा संवर्ग में विभिन्न श्रेणियों के पद, उनका वर्गीकरण और नियुक्ति प्राधिकारी - सेवा संवर्ग में विभिन्न श्रेणियों के पद, उनका वर्गीकरण और नियुक्ति प्राधिकारी 3. सेवा संवर्ग में विभिन्न श्रेणियों के पद, उनका वर्गीकरण और नियुक्ति प्राधिकारी संवर्ग में नियुक्ति निम्न कोटि के पद पर होगी :-

निम्न कोटि के पद पर होगी :-

उपर्युक्त पदों का वेतनमान वही होगा जो सरकार द्वारा समय-समय पर अवधारित किया जायेगा। 4. संवर्ग सदस्य-संख्या - संवर्ग के प्रत्येक श्रेणी के पदों की संख्या तथा उनकी कुल संख्या उतनी ही होगी, जितनी इस नियमावली के प्रवृत्त होने की तारीख को राज्य सरकार द्वारा स्वीकृत/अवधारित की गई हो अथवा राज्य सरकार द्वारा समय-समय पर स्वीकृत/अवधारित की जाय ।

5. पद-सृजन - संवर्ग की किसी कोटि में पहले से स्वीकृत पदों के अतिरिक्त जब कभी अपेक्षित हो, सरकार स्थायी अथवा अस्थायी पद सृजित कर सकेगी ।

6. आरक्षण - संवर्ग के विभिन्न कोटियों में नियुक्ति में राज्य सरकार द्वारा समय-समय पर निर्धारित आरक्षण/रोस्टर के प्रावधान लागू होंगे।

7. संवर्ग के विभिन्न पदों पर भर्त्ती, सम्पुष्टि एवं प्रोन्नति की प्रक्रिया -

(1) राजभाषा सहायक - राजभाषा सहायक का पद संवर्ग का मूल पद होगा जो कर्मचारी चयन आयोग, बिहार द्वारा आयोजित प्रतियोगिता परीक्षा के आधार पर भरा जायेगा। भर्त्ती की प्रक्रिया निम्नरूपेण होगी-

(क) राजभाषा सहायक के पदों पर नियुक्ति हेतु मंत्रिमंडल सचिवालय (राजभाषा) विभाग की अधियाचना के आधार पर बिहार कर्मचारी चयन आयोग प्रतियोगिता परीक्षा आयोजित करेगा।

(ख) प्रतियोगिता परीक्षा हेतु पाठयक्रम निम्नवत्‌ होगा -

(ग) न्यूनतम शैक्षिक योग्यता - राजभाषा सहायक के पदों पर भर्त्ती हेतु न्यूनतम शैक्षिक योग्यता निम्नवत्‌ होगी -

(i) अनिवार्य - स्नातक स्तर पर वैकल्पिक विषय के रूप में अंग्रेजी के साथ हिन्दी में स्नातकोत्तर डिग्री अथवा स्नातक स्तर पर वैकल्पिक विषय के रूप में हिन्दी के साथ अंग्रेजी में स्नातकोत्तर डिग्री अथवा स्नातक स्तर पर वैकल्पिक विषय के रूप में हिन्दी या अंग्रेजी के साथ संस्कृत में स्नातकोत्तर डिग्री;

(ii) वांछनीय - अंग्रेजी से हिन्दी और हिन्दी से अंग्रेजी में अनुवाद का अनुभव। (घ) आयु-सीमा - राजभाषा सहायक के लिए आयु-सीमा वही होगी जो सरकार द्वारा समय-समय पर अवधारित की जाय।

(ड.) नियुक्ति हेतु आयोग की अनुशंसा - आयोग प्रतियोगिता परीक्षा के आधार पर योग्यता-क्रम में सफल उम्मीदवारों की नियुक्ति की अनुशंसा करेगा। मेधा-सूची में उनकी वरीयता के आधार पर आयोग द्वारा अनुशंसित सफल उम्मीदवारों की सूची से नियुक्ति की जाएगी। अभ्यर्थी का चयन राज्य सरकार/आयोग द्वारा अवधारित मानदंडों के आधार पर होगा।

(च)परिवीक्षा-अवधि - राजभाषा सहायक के पद पर नियुक्त किये गये अभ्यर्थियों को दो वर्षों की परिवीक्षा अवधि में रहना होगा। परिवीक्षा-अवधि में उनकी सेवा एवं आचरण संतोषजनक रहने पर वे राजभाषा सहायक के पद पर संपुष्टि के पात्र होंगे।

(2) वरीय राजभाषा सहायक - वरीय राजभाषा सहायक के पद पर नियुक्ति, राजभाषा सहायक से प्रोन्नति द्वारा की जायगी।

(3) राजभाषा पदाधिकारी - राजभाषा पदाधिकारी के पद पर नियुक्ति, वरीय राजभाषा सहायक से प्रोन्नति द्वारा की जायगी।

(4) उपनिदेशक - उपनिदेशक के पद पर नियुक्ति राजभाषा पदाधिकारी से प्रोन्नति द्वारा की जाएगी।

8. प्रोन्नति हेतु चयन का मानदंड - सेवा संवर्ग के अधीन प्रोन्नति के लिए अभ्यर्थियों की उपयुक्तता का मापदंड ''वरीयता-सह-योग्यता'' का सिद्धांत होगा तथा एक पद से दूसरे पद पर प्रोन्नति हेतु न्यूनतम अर्हता कालावधि वही होगी जो राज्य सरकार द्वारा समय-समय पर अवधारित की जाय।3 (cid:1)बहार गजट (असाधारण), 1111 अगःतअगःतअगःतअगःत 2014201420142014 9. प्रोन्नति की प्रक्रिया - संवर्ग के सभी पदों पर प्रोन्नति हेतु चयन इस प्रयोजनार्थ विभाग द्वारा गठित ''विभागीय प्रोन्नति समिति'' द्वारा किया जायगा।

10. वरीयता का निर्धारण -

(क) राजभाषा सहायक के पद पर नियुक्त सदस्यों की पारस्परिक वरीयता का अवधारण कर्मचारी चयन आयोग द्वारा आयोजित प्रतियोगिता परीक्षा के आधार पर तैयार की गई एवं अनुशंसित योग्यता सूची में उनके स्थान के अनुसार किया जायेगा।

(ख) प्रोन्नति वाली सभी कोटि के पदों पर प्रोन्नति द्वारा नियुक्त होनेवाले सदस्यों की वरीयता, कोटि विशेष में नियुक्ति की तारीख से अवधारित की जायेगी। यदि एक ही तारीख को कई व्यक्तियों को प्रोन्नति द्वारा नियुक्त किया गया हो तो ठीक उससे नीचे के पद की उनकी वरीयता के अनुसार उनकी वरीयता निर्धारित की जायगी।

11. प्रकीर्ण विषय - इस नियमावली द्वारा उपबंधित सिवाय, सेवा की किसी कोटि में नियुक्त व्यक्ति का वेतन (जिसके अंतर्गत वेतन-निर्धारण भी है), भत्ते, छुट्टी, सेवानिवृत्ति-लाभ तथा सेवा की अन्य शर्तें तत्समय इस प्रयोजनार्थ प्रवृत्त सामान्य नियमों या आदेशों द्वारा विनियमित होंगी।

12. कठिनाइयों के निराकरण करने की शक्ति - यदि राज्य सरकार का समाधान हो जाय कि इस नियमावली के किसी उपबंध के कार्यान्वित करने में कोई कठिनाई उत्पन्न हुई है और उसका निराकरण अनिवार्य एवं समीचीन है तो वह, अधिसूचना द्वारा, जो इस नियमावली से असंगत हो, उस कठिनाई का निराकरण कर सकेगी। 13. निरसन एवं व्यावृति -(1) संवर्ग के लिए पूर्व से निर्गत सभी आदेश/संकल्प/अधिसूचना आदि एतद्‌ द्वारा निरसित किये जाते हैं।

(2) ऐसे निरसन होते हुए भी उक्त आदेशों/संकल्पों/अधिसूचनाओं आदि के अधीन किया गया कुछ भी या की गयी कार्रवाई इस नियमावली के अधीन किया गया कार्य या की गयी कार्रवाई समझी जायेगी, मानों यह नियमावली उस समय प्रवृत्त थी।

No. Stha-1-37/2002-403/Ra.—In exercise of the power conferred by Article-309 of the Constitution of India, the Governor of Bihar hereby makes the following Rules to regulate the method of recruitment to the Rajbhasha Cadre in the Department of Cabinet Secretariat (Rajbhasha), Government of Bihar -

1. Short title & Commencement -

(a) These Rules may be called "Bihar Rajbhasha Cadre Rules, 2014." (b) It shall extend to Rajbhasha (Headquarter) and all divisional Rajbhasha offices.

(c) These Rules shall come into force from the date of issue of the notification.

2. Definition - In these Rules unless otherwise requires in the context -

(a) "Department" means Cabinet Secretariat (Rajbhasha) Department. (b) "Cadre" means the cadre of Rajbhasha Assistant and Senior Rajbhasha Assistant, Rajbhasha Officer, Deputy Director and equivalent posts;

(c) "Member" means the member of Rajbhasha cadre; (d) "Rules" mean the Bihar Rajbhasha Cadre Rules, 2014; (e) "Commission" means, Bihar Public Service Commission or Bihar Staff Selection Commission as the case may be; (f) "Government" means the Government of Bihar; (g) "Governor" means the Governor of Bihar; (h) "Appointing Authority" means Principal Secretary, Department of Cabinet Secretariat (Rajbhasha) with reference to Rajbhasha Sahayak, Variya Rajbhasha Sahayak, Rajbhasha Padadhikari and the Governor of Bihar with reference to Deputy Director.

(i) ''Departmental Promotion Committee'' means Departmental Promotion Committee constituted by the department.

(cid:1)बहार गजट (असाधारण), 1111 अगःतअगःतअगःतअगःत 2014201420142014 3. Posts of different categories in the service cadre, their classification and Appointing Authority:- The appointment in the cadre shall be to the posts of lower category –

The pay scale of the above posts shall be the same as may be determined by the Government from time to time.

4. Strength of the Cadre -The number of posts in each category of the cadre and their total number shall be the same as has been sanctioned/determined by the State Government on the date on which these Rules come into force or as may be sanctioned/determined by the State Government from time to time.

5. Creation of Posts - In addition to the posts already sanctioned in any category of the Cadre, the Government may create permanent or temporary posts as and when required.

6. Reservation – The provisions of reservation/roster determined by the state Government, from time to time shall be applicable to the appointment in different categories of the cadre.

7. Procedure of recruitment, confirmation and promotion on different posts of

the cadre-

(1) Rajbhasha Assistant - The post of Rajbhasha Assistant will be the basic post of the cadre which will be filled up on the basis of competitive examination conducted by the Bihar Staff Selection Commission. The Procedure of recruitment shall be as follows:-

(a) The Bihar Staff Selection Commission will conduct competitive examination for the appointment to the posts of Rajbhasha Assistant on the basis of requisition made by the Cabinet Secretariat (Rajbhasha) Department.

(b) Syllabus for competitive examination shall be as follows:- First Paper:- Hindi Grammar, language skills and composition, Précis Writing & Essay Writing-100 Marks

Second Paper- (i) Translation from English to Hindi - 50 Marks (ii) Translation from Hindi to English - 50 Marks (c) Minimum Educational qualification - For recruitment to the post of Rajbhasha Assistant, minimum Educational Qualification shall be as follows:-

(i) Essential - Post graduate degree in Hindi with English as an optional subject at the Graduate level, or Post Graduate degree in English with Hindi as an optional subject at the graduate level, or Post Graduate degree in Sanskrit with Hindi or English as optional subjects at the Graduate level;

(ii) Desirable - Experience of translation from English to Hindi and Hindi to English.

(d) Age limit – The age limit for the Rajbhasha Assistant will be the same as may be determined by the Government, from time to time.

(e) Recommendation of the Commission for appointment - The Commission will make recommendations in order of merit of the candidates selected on the basis of competitive examination. Appointment will be made from the list of successful candidates recommended by the Commission on the basis of their seniority in the merit list. Candidates will be selected on the basis of criteria determined by the State Government/Commission:

Provided that any candidate who secures less than 30% marks in any subject shall not be eligible for selection.

(f) Probation Period - Candidates appointed to the posts of Rajbhasha Assistant shall have to remain on probation period of two years. They will be eligible for confirmation on the post of Rajbhasha Assistant, on their satisfactory service and conduct during probation.

(2) Senior Rajbhasha Assistant - Appointment to the posts of Senior Rajbhasha Assistant shall be made by promotion from Rajbhasha Assistant.

(3) Rajbhasha Officer- Appointment to the posts of Rajbhasha Officer shall be made by promotion from Senior Rajbhasha Assistant.

(4) Deputy Director- Appointment to the posts of Deputy Director shall be filled up by promotion from Rajbhasha Officer.

8. Criteria of selection for promotion- Criterion of eligibility of candidates for promotion under the Cadre shall be the principal of seniority-cum-merit; and the minimum qualifying period for promotion from one post to another will be the same as may be determined by the State Government, from time to time.

9. Procedure for Promotion- Selection for promotion to all posts in the cadre shall be made by the "Departmental Promotion Committee" constituted by the Department for this purposes.

10. Determination of Seniority:- (1) Inter-se-Seniority of the members appointed to the post of Rajbhasha Assistant shall be determined according to their places in the merit-list prepared and recommended by the Staff Selection Commission on the basis of competitive examination held by it.

(2) Seniority of the members to be appointed by promotion to all categories of promotional posts shall be determined from the date of appointment in a particular category. If several candidates have been appointed by promotion on the same date, their seniority shall be determined according to their seniority of the post just below.

11 Miscellaneous matters- Except as provided by these Rules, salary (which includes pay fixation also), allowances, leaves, retirement benefits and other service conditions of the person appointed in any category shall be regulated by general rules or orders for the time being in force for this purposes.

12. Power to remove difficulty- If the State Government is satisfied that if any difficulty has arisen and its removal is essential and expedient it may, by notification which is not in consistent with the provisions of these rules, remove such difficulty.

13. Saving and Repeal- (1) All orders/resolutions/Notifications etc. issued previously for the cadre are hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under the said orders/resolutions/notifications etc. shall be deemed to be done or taken under these rules as if it were enforced.
