मंत्रिमंडल सचिवालय (राजभाषा) विभाग ------- अधिसूचनाएं 9 जुलाई 2014 -402/रा0—भारत के संविधान के अनुच्छेद 309 द्वारा प्रदत्त शक्तियों का प्रयोग भारत के संविधान के अनुच्छेद 309 द्वारा प्रदत्त शक्तियों का प्रयोग राज्यपाल एतद्द्वारा मंत्रिमंडल सचिवालय (राजभाषा) विभाग, बिहार के राजभाषा प्रकाशन संवर्ग में भर्ती करते हुए बिहार-राज्यपाल एतद्द्वारा मंत्रिमंडल सचिवालय (राजभाषा) विभाग, बिहार के राजभाषा प्रकाशन संवर्ग में भर्ती राज्यपाल एतद्द्वारा मंत्रिमंडल सचिवालय (राजभाषा) विभाग, बिहार के राजभाषा प्रकाशन संवर्ग में भर्ती की पद्धति को विनियमित करने हेतु निम्नलिखित नियमावली बनाते हैं -
हेतु निम्नलिखित नियमावली बनाते हैं -
1. संक्षिप्त नाम, विस्तार और प्रारंभ -
संक्षिप्त नाम, विस्तार और प्रारंभ - यह नियमावली "बिहार राजभाषा प्रकाशन संवर्ग नियमावली, 2014" कही जा सकेगी। यह नियमावली "बिहार राजभाषा प्रकाशन संवर्ग नियमावली, 2014" कही जा सकेगी। (1) यह नियमावली "बिहार राजभाषा प्रकाशन संवर्ग नियमावली, 2014" कही जा सकेगी। इसका विस्तार राजभाषा (मुख्यालय) तक होगा। (2) इसका विस्तार राजभाषा (मुख्यालय) तक होगा। यह नियमावली अधिसूचना निर्गत होने की तिथि से प्रवृत्त होगी। (3) यह नियमावली अधिसूचना निर्गत होने की तिथि से प्रवृत्त हा

2. सेवा संवर्ग का गठन -
"विभाग" से अभिप्रेत है मंत्रिमंडल सचिवालय (राजभाषा) विभाग; (क) "विभाग" से अभिप्रेत है मंत्रिमंडल सचिवालय (राजभाषा) विभाग; (ख) ''संवर्ग'' से अभिप्रेत है, बिहार राजभाषा प्रकाशन संवर्ग; ''संवर्ग'' से अभिप्रेत है, बिहार राजभाषा प्रकाशन संवर्ग; ''कोटि'' से अभिप्रेत है नियम-3 में विनिर्दिष्ट पद; (ग) ''कोटि'' से अभिप्रेत है नियम- ''विभागाध्यक्ष'' से अभिप्रेत है निदेशक, राजभाषा (घ) ''विभागाध्यक्ष'' से अभिप्रेत है निदेशक, राजभाषा "नियंत्री प्राधिकारी" से अभिप्रेत है सचिव/प्रधान सचिव, मंत्रिमंडल सचिवालय (राजभाषा) विभाग; "नियंत्री प्राधिकारी" से अभिप्रेत है सचिव/प्रधान सचिव, मंत्रिमंडल सचिवालय (राजभाषा) विभाग; (ड.) "नियंत्री प्राधिकारी" से अभिप्रेत है सचिव/प्रधान सचिव, मंत्रिमंडल सचिवालय (राजभाषा) विभाग; "आयोग" से अभिप्रेत है, बिहार कर्मचारी चयन आयोग; (च) "आयोग" से अभिप्रेत है, बिहार कर्मचारी चयन आयोग; "सरकार" से अभिप्रेत है बिहार सरकार; (छ)"सरकार" से अभिप्रेत है बिहार "राज्यपाल" से अभिप्रेत है बिहार के राज्यपाल; (ज)"राज्यपाल" से अभिप्रेत है बिहार के राज्यपाल; सेवा संवर्ग का गठन - इस संवर्ग में निम्नलिखित पद होंगे - इस संवर्ग में निम्नलिखित पद होंगे - (क) सम्पादक; (ख) प्रूफवाचक-सह-प्रकाशन सहायक; (ख) प्रूफवाचक-सह-प्रकाशन सहायक; दोनों पदों का वेतनमान वही होगा जो सरकार द्वारा समय-समय पर अवधारित किया जाय। दोनों पदों का वेतनमान वही होगा जो सरकार द्वारा समय-समय पर अवधारित किया जाय। दोनों पदों का वेतनमान वही होगा जो सरकार द्वारा समय-समय पर अवधारित किया जाय।2 (cid:1)बहार गजट (असाधारण), 1111 अगःतअगःतअगःतअगःत 2014201420142014 4. भर्त्ती - संवर्ग के दोनों पदों पर नियुक्ति, विभाग की अधियाचना के आलोक में, बिहार कर्मचारी चयन आयोग द्वारा की जाएगी। 5. अर्हताएँ -
(1) 'सम्पादक' पद हेतु योग्यता - (क) स्नातक ऑनर्स (हिन्दी) या स्नातकोत्तर (हिन्दी)
(ख) पत्रकारिता का कम-से-कम 5 वर्षों का अनुभव अथवा राजभाषा/अनुवाद/शब्दावली संबंधी कार्यों का कम से कम 5 वर्षों का अनुभव। (ग) वांछनीय योग्यताः- मुद्रण, प्रकाशन तथा प्रूफ संशोधन का अनुभव (2) प्रूफवाचक-सह-प्रकाशन सहायक पद हेतु योग्यता - (क) इंटरमीडियट या समकक्ष उत्तीर्ण
(ख) प्रूफवाचन एवं प्रकाशन का कम से कम 5 (पाँच)
वर्षाें का अनुभव।
(ग) वांछनीयः-उच्चतर शैक्षिक योग्यता वाले
उम्मीदवारों को प्राथमिकता दी जाएगी। 6. नियुक्ति की प्रक्रिया - (1) संवर्ग के पदों पर नियुक्ति हेतु विभाग, रिक्तियों के आधार पर, आयोग को सूचना उपलब्ध कराते हुए अधियाचना भेजेगा।
(2) आयोग अधियाचना के अनुरूप शैक्षणिक अंकों एवं साक्षात्कार के आधार पर चयनित उम्मीदवारों की अनुशंसा विभाग को उपलब्ध करायेगा।
(3) नियुक्ति हेतु अभ्यर्थी की आयु सीमा वही होगी जो राज्य सरकार द्वारा समय-समय पर निर्धारित की जायेगी।
7. पद-सृजन - संवर्ग की किसी कोटि में पहले से स्वीकृत पद के अतिरिक्त जब कभी अपेक्षित हो, सरकार स्थायी अथवा अस्थायी पद सृजित कर सकेगी ।
8. परिवीक्षा-अवधि - संवर्ग के विभिन्न पदों पर नियुक्त किये गये अभ्यर्थियों को दो वर्षों की परिवीक्षा अवधि में रहना होगा। परिवीक्षा-अवधि में उनकी सेवा एवं आचरण संतोषजनक रहने पर वे पद पर सम्पुष्टि के पात्र होंगे।
9. प्रकीर्ण - इस नियमावली द्वारा उपबंधित के सिवाय सेवा की किसी कोटि में नियुक्त व्यक्ति का वेतन (जिसके अंतर्गत वेतन-निर्धारण भी है), भत्ते, छुट्टी, सेवानिवृत्ति-लाभ तथा सेवा की अन्य शर्तें तत्समय इस प्रयोजनार्थ सरकार के प्रवृत्त सामान्य नियमों या आदेशों द्वारा विनियमित होंगी।
10. कठिनाईयों का निराकरण करने की शक्ति - यदि राज्य सरकार का समाधान हो जाय कि इस नियमावली के किसी उपबंध के कार्यान्वित करने में कोई कठिनाई उत्पन्न हुई है और उसका निराकरण अनिवार्य एवं समीचीन हे तो वह, अधिसूचना द्वारा, जो इस नियमावली के प्रावधानों से असंगत न हो तो वह उसका निराकरण कर सकेगी।
11. निरसन एवं व्यावृति - (1) संवर्ग के लिए पूर्व से निर्गत सभी आदेश/संकल्प/अधिसूचना आदि एतद् द्वारा निरसित किये जाते हैं।
(2) ऐसे निरसन होते हुए भी उक्त आदेशों/संकल्पों/अधिसूचनाओं आदि के अधीन किया गया कुछ भी या की गयी कोई कार्रवाई इस नियमावली के अधीन किया गया या की गयी समझी जायेगी, मानों यह नियमावली उस समय प्रवृत्त थी।

No. Stha 1-14/2013-402/Ra.—In exercise of the power conferred by Article-309 of the Constitution of India, the Governor of Bihar hereby makes the following Rules to regulate the method of recruitment to the Rajbhasha Publication Cadre of Cabinet Secretariat (Rajbhasha) Department, Bihar -
1. Short title & Commencement -
(a) These Rules may be called "Bihar Rajbhasha Publication Cadre Rules, 2014."
(b) It shall extend to The Rajbhasha (Headquarter). (c) These rules shall come into force from the date of issue of the notification.
2. Definition - In these Rules, unless otherwise requires in the context -
(a) "Department" means Cabinet Secretariat (Rajbhasha) Department. (b) "Cadre" means Bihar Rajbhasha Publication cadre.
3 (cid:1)बहार गजट (असाधारण), 1111 अगःतअगःतअगःतअगःत 2014201420142014(c) "Category" means the posts specified in rule-3 (d) "Head of the Department" means the Director, Rajbhasha. (e) "Controlling Authority" means the Secretary/Principal Secretary, Cabinet Secretariat (Rajbhasha) Department.
(f) "Commission" means the Bihar Staff Selection Commission; (g) "Government" means the Government of Bihar; (h) "Governor" means the Governor of Bihar;
3. Constitution of Service cadre – There shall be following posts in this cadre :-
(a) Editor (b) Proof reader-cum-Publication Assistant The pay scale of both the posts shall be the same as may be determined by the Government from time to time.
4. Recruitment – Appointment to both the posts of the cadre shall be made by the Bihar Staff Selection Commission in view of the requisition of the department.
5. Qualifications- (1) Qualification for the post of 'Editor' - (a) Graduate with Honours (Hindi) or Post
Graduate (Hindi);
(b) At least 5 (five) years experience of journalism or at least 5 (five) years experience of works related to Rajbhasha/Translation/Shabdavali; (c) Desirable Qualification – Experience of printing, publication and proof amendment.
(2) Qualification for the post of ' Proof reader-cum-Publication Assistant' - (a) Intermediate or equivalent pass.
(b) At least 5 (five) years experience of
proof reading and publication.
(c) Desirable Qualification – Preference will be given to the candidates having higher educational qualifications.
6. Procedure of Appointment – (1) The department shall send a requisition for appointment to the posts of the cadre providing information to the commission as per vacancies.
(2) The commission shall provide recommendation of the selected candidates on the basis of educational marks and interview in conformity with the requisition.
(3) The age limit of the candidate for appointment shall be the same as may be determined by the state government, from time to time. 7. Creation of posts - In addition to the posts already sanctioned in any category in the cadre, the Government may create permanent or temporary posts as and when required. 8. Probation Period - Candidates appointed to the different posts of the cadre shall have to remain on probation period of two years. They will be eligible for confirmation, on their satisfactory service and conduct during probation.
9. Miscellaneous matters- Except as provided by these Rules, salary (which includes pay fixation also), allowances, leave, retirement benefits and other service conditions of the person appointed in any category shall be regulated by general rules or orders for the time being in force for the purpose.

Power to remove difficulty- If the State Government is satisfied that if any difficulty has arisen and its removal is essential and expedient it may, by notification, which is not in consistent with the provisions of these rules, remove such difficulty.
11. Saving and Repeal- (1) All orders/resolutions/Notifications etc. issued previously for the cadre are hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under the said orders/resolutions/notifications etc. shall be deemed to be done or taken under these rules as if it were enforced.
