दिनांक 14 अगस्त, 2014 को अनुमति दे चुकें हैं, इसके द्वारा सर्व-साधारण की को अनुमति दे चुकें हैं, इसके द्वारा सर्व-साधारण की सूचना के लिये प्रकाशित किया जाता है। सूचना के लिये प्रकाशित किया जाता है।

सरकार के सचिव। सरकार के सचिव2 (cid:1)बहार गजट (असाधारण), 21212121 अगःतअगःतअगःतअगःत 2014201420142014 बिहार तकनीकी कर्मचारी चयन आयोग अधिनियम, 2014 [बिहार अधिनियम 13, 2014] प्रस्तावना।- राज्य सरकार बिहार के अधीन समूह ख' एवं 'ग' के तकनीकी पदों के लिए अभ्यर्थियों के चयन हेतु अधिनियम। भारत गणराज्य के पैसठवें वर्ष में बिहार राज्य विधानमंडल द्वारा निम्नलिखित रूप में यह अधिनियमित हो :-

अध्याय-I 1. संक्षिप्त नाम, विस्तार और प्रारम्भ।- (1) यह अधिनियम बिहार तकनीकी कर्मचारी चयन आयोग अधिनियम, 2014 कहा जा सकेगा। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरंत प्रवृत्त होगा। 2. परिभाषाएँ ।- इस अधिनियम में, जब तक कोई बात विषय या संदर्भ के विरूद्ध न हो - (i) ''अधिनियम '' से अभिप्रेत है - बिहार तकनीकी कर्मचारी चयन आयोग अधिनियम, 2014 ; (ii) '' आयोग '' से अभिप्रेत है, इस अधिनियम के अधीन गठित बिहार तकनीकी कर्मचारी चयन आयोग ; (iii) ''राज्य सरकार'' से अभिप्रेत है - बिहार राज्य सरकार ; (iv) ''अनुसूची ''से अभिप्रेत है इस अधिनियम के साथ संलग्न अनुसूची।

अध्याय-II 3. आयोग का गठन ।- बिहार तकनीकी कर्मचारी चयन आयोग का गठन निम्नलिखित को मिलाकर किया जाएगा :- (i) अध्यक्ष :- राज्य सरकार के सामान्य प्रशासन विभाग द्वारा नियुक्त भारतीय प्रशासनिक सेवा के अधिसमय वेतनमान से अन्यून पंक्ति का कोई पदाधिकारी जिसकी न्यूनतम तीन वर्ष सेवा शेष हो : परन्तु राज्य सरकार के सामान्य प्रशासन विभाग द्वारा समकक्ष पात्रता वाले सेवा-निवृत्त पदाधिकारी को भी अध्यक्ष के रूप में नियुक्त किया जा सकेगा। (ii) सदस्यः-राज्य सरकार के सामान्य प्रशासन विभाग द्वारा नियुक्त राज्य सेवा के पाँच अधिकारी जिनकी न्यूनतम एक वर्ष की सेवा शेष हो : परन्तु राज्य सरकार के सामान्य प्रशासन विभाग द्वारा समकक्ष पात्रता वाले सेवा-निवृत्त पदाधिकारियों को भी सदस्य के रूप में नियुक्त किया जा सकेगा ; इन पाँच सदस्यों में से न्यूनतम एक सदस्य का चयन क्रमशः बिहार अभियंत्रण सेवाओं, बिहार स्वास्थ्य सेवाओं से तथा बिहार प्रषासनिक सेवा से किया जाएगा। शेष दो अन्य सदस्यों का चयन उक्त तीनों सेवाओं में से किसी भी सेवा से किया जा सकेगा : परन्तु अभियंत्रण सेवा, स्वास्थ्य सेवा तथा बिहार प्रशासनिक सेवा के वैसे पदाधिकारी का ही सदस्य के रूप में चयन किया जा सकेगा जो राज्य सरकार के अधीन कम से कम रु0 8700/-(आठ हजार सात सौ) ग्रेड पे का अधिष्ठायी आधार पर पद धारण करते हों अथवा पहले ही पद धारित कर चुके हों 4. आयोग के अध्यक्ष एवं सदस्यों का कार्यकाल ।- आयोग के अध्यक्ष एवं सदस्यों का कार्यकाल सामान्य तौर पर तीन वर्षों का होगा ; परन्तु राज्य सरकार द्वारा विषेष परिस्थिति में, किसी सदस्य के कार्यकाल का विस्तार उस अवधि के लिए जो विनिष्चित किया जाय, किया जा सकेगा : परन्तु और यदि राज्य सरकार के सामान्य प्रशासन विभाग का युक्तियुक्त रूप से समाधान हो जाए कि अध्यक्ष अथवा किसी सदस्य अथवा सभी सदस्यों का आयोग में बने रहना लोक हित के विरूद्ध है अथवा उनके बने रहने से आयोग का सुविधाजनक कार्य-संपादन बाधित हो सकता है, तो राज्य सरकार (सामान्य प्रशासन विभाग) द्वारा अध्यक्ष या/और वैसे किसी अन्य सदस्य/सभी सदस्यों को तीन वर्षों का सामान्य कार्यकाल पूर्ण होने के पूर्व भी पदों से हटाया जा सकेगा। 5. आयोग के अध्यक्ष एवं सदस्यों की उम्र सीमा ।- आयोग के अध्यक्ष अथवा सदस्य की आयु-सीमा नियुक्ति के समय सेवा-निवृत्त पदाधिकारियों के मामले में अधिकतम 62 (बासठ) वर्ष होगी। 6. आयोग का मुख्यालय एवं प्रषासी विभाग ।- आयोग का मुख्यालय पटना में अवस्थित होगा एवं सामान्य प्रशासन विभाग आयोग का प्रशासी विभाग होगा। 7. अधीनस्थ पदाधिकारी एवं कर्मचारी ।- आयोग के कार्य संचालन हेतु अधीनस्थ पदाधिकारियों एवं कर्मचारियों का पदबल एवं उनकी सेवा-षर्त्तें, राज्य सरकार द्वारा इस अधिनियम के अधीन बनायी गयी नियमावली के अनुरूप होंगी।

अध्याय-III 8. सेवाएँ संवर्ग एवं पद जिनके लिए नियुक्ति हेतु आयोग अनुषंसा कर सकेगा।- आयोग, इस अधिनियम की अनुसूची में यथा-सम्मिलित, रु0 4800/- (चार हजार आठ सौ) ग्रेड पे अथवा समय-समय पर3 (cid:1)बहार गजट (असाधारण), 21212121 अगःतअगःतअगःतअगःत 2014201420142014 यथा-पुनरीक्षित ग्रेड पे से कम ग्रेड पे वाले राज्य सरकार के विभिन्न विभागों एवं क्षेत्रीय कार्यालयों में समूह 'ख' एवं 'ग के सभी तकनीकी सेवाओं/संवर्गों/पदों पर नियुक्ति हेतु चयन एवं अनुशंसा कर सकेगा। सामान्य प्रशासन विभाग द्वारा अनुसूची को समय-समय पर अधिसूचना द्वारा संशोधित किया जा सकेगा। 9. चयन की प्रक्रिया।- (1) आयोग, तकनीकी पदों हेतु संबंधित पदों की सेवा संवर्ग नियमावली के अधीन विहित प्रक्रिया के अनुसार, उम्मीदवारों का चयन कर सकेगा; परन्तु किसी तकनीकी पद हेतु सेवा संवर्ग नियमावली के नहीं होने की स्थिति में, राज्य सरकार की पूर्वानुमति से, आयोग द्वारा इस प्रयोजनार्थ बनायी गयी चयन-नियमावली में विहित प्रक्रिया के अनुसार तकनीकी पदों पर नियुक्ति हेतु उम्मीदवारों का चयन कर सकेगा। (2) आयोग सदृश अहर्ता वाले पदों के लिए संयुक्त प्रतियोगिता परीक्षा आयोजित कर सकेगा। 10. समूह 'ख' एवं 'ग' के तकनीकी पदों से संबंधित लंबित चयन कार्यों का अंतरण ।- इस अधिनियम की अनुसूची में यथा-सम्मिलित वैसे सभी तकनीकी पदों पर जिनके संबंध में बिहार कर्मचारी चयन आयोग द्वारा इस अधिनियम के आरंभ होने की तिथि तक विज्ञापन निर्गत अथवा प्रकाशित नहीं किया गया हो, नियुक्ति के लिए चयन की कार्रवाई बिहार तकनीकी कर्मचारी चयन आयोग द्वारा पूर्ण की जायेगी : परन्तु, इस अधिनियम की अनुसूची में यथा-सम्मिलित वैसे सभी तकनीकी पदों पर जिनके संबंध में बिहार कर्मचारी चयन आयोग द्वारा इस अधिनियम के आरंभ होने की तिथि तक विज्ञापन निर्गत अथवा प्रकाशित किया जा चुका हो, नियुक्ति के लिए चयन की कार्रवाई पूर्ववत बिहार कर्मचारी चयन आयोग द्वारा ही पूर्ण की जायेगी।

अध्याय-IV 11. वित्तीय प्रावधान ।-(1) आयोग के कार्यालय और आयोग के कार्य संपादन में होने वाला सम्पूर्ण व्यय राज्य सरकार द्वारा वहन किया जाएगा। (2) विभिन्न पदों पर नियुक्ति के लिए चयन हेतु आयोजित की जाने वाली प्रतियोगिता परीक्षाओं के लिए आयोग उम्मीदवारों से, राज्य सरकार द्वारा, समय-समय पर, अवधारित परीक्षा-शुल्क प्राप्त कर सकेगा जो आयोग द्वारा, राज्य कोषागार में उपयुक्त प्राप्ति-शीर्ष में जमा किया जाएगा। 12. लेखा एवं लेखा परीक्षण ।-(1) आयोग का वित्तीय वर्ष किसी कैलेण्डर वर्ष के एक अप्रील से प्रारंभ होकर अगले कैलेण्डर वर्ष के इक्तीस मार्च को समाप्त होगा। (2) आयोग द्वारा अपने जमा-व्यय का सम्यक्‌ अभिलेखीकरण किया जाएगा और आयोग के लेखा के सम्यक्‌ संधारण का विशिष्ट उत्तरदायित्व आयोग के सचिव का होगा। (3) आयोग के लेखा का सांविधिक लेखा परीक्षण भारत के महा लेखा परीक्षक द्वारा किया जाएगा।

अध्याय-V 13. षक्तियों का प्रत्यायोजन ।-(1) प्रशासनिक एवं वित्तीय मामलों में, आयोग के सचिव को राज्य सरकार के विभागाध्यक्षों को प्रदत्त शक्तियों, के समकक्ष शक्तियों का प्रयोग करने की शक्ति होगी। (2) आयोग के अध्यक्ष, आयोग के सदस्यों में से एक सदस्य को परीक्षा नियंत्रक का कर्त्तव्य एवं दायित्व तथा अन्य सदस्यों में से किसी एक अन्य सदस्य को आयोग के प्रशासनिक शाखा का कर्त्तव्य एवं दायित्व सौंप सकेंगे। 14. नियमावली/विनियमावली बनाने की षक्तियाँ।-(1) इस अधिनियम के प्रावधानों को कार्यान्वित करने हेतु राज्य सरकार को नियमावली/विनियमावली बनाने की षक्ति होगी। (2) आयोग राज्य सरकार के अनुमोदन से, कार्य-प्रक्रिया संचालन नियमावली, विज्ञापनों के प्रकाशन, लिखित परीक्षाओं के संचालन, परीक्षाफलों के प्रकाशन, व्यक्तित्व जाँच/मौखिक परीक्षाओं, अन्य चयन प्रक्रिया, यदि कोई हो तो, आदि के संचालन एवं अन्य कार्यान्वयन हेतु विनियमावली बना सकेगा। 15. नियमावली/विनियमावली का विधान मंडल के समक्ष रखा जाना।- प्रत्येक नियमावली/विनियमावली बनाये जाने के बाद यथाशीघ्र बिहार विधान मंडल के समक्ष आगामी सत्र अथवा अनुवर्त्ती सत्रों में, जो न्यूनतम कुल चौदह दिनों के लिए हो, रखी जायेगी। 16. कठिनाईयों का निराकरण एवं निर्वचन।-(1) इस अधिनियम के आरंभ के बाद एक वर्ष के भीतर, इस अधिनियम के सुसंगत प्रावधानों के यथोचित कार्यान्वयन में आने वाली कठिनाइयों के निराकरण हेतु, राज्य सरकार, अधिसूचना द्वारा, ऐसा प्रावधान कर सकेगी जो अधिनियम के प्रावधानों से संगत हो। (2) इस अधिनियम के आरंभ के बाद एक वर्ष के भीतर, इस अधिनियम के किसी प्रावधान के निर्वचन के संबंध में यदि कोई शंका उत्पन्न हो तो उसका निराकरण राज्य सरकार अधिसूचना द्वारा, विधि विभाग के परामर्श से कर सकेगी। (3) इस अधिनियम के हिंदी एवं अँग्रेजी पाठ में कोई अन्तर प्रकट हो तो हिंदी पाठ का अभिभावी प्रभाव होगा। 17. अवषिष्ट मामले।-इस अधिनियम से संबंधित सभी/कोई भी अवशिष्ट मामला राज्य सरकार (सामान्य प्रशासन विभाग) द्वारा इस अधिनियम के प्रावधानों के अनुसार निस्तारित किया जाएगा। 18. निरसन एवं व्यावृत्ति ।- (1) इस अधिनियम की धारा-10 केे अधीन आयोग को अंतरित मामलों तथा इस अधिनियम द्वारा आयोग को सौंपे गए तकनीकी पदों हेतु चयन संबंधी मामलों की सीमा तक, बिहार कर्मचारी चयन4 (cid:1)बहार गजट (असाधारण), 21212121 अगःतअगःतअगःतअगःत 2014201420142014 आयोग अधिनियम, 2002 (समय-सयम पर यथा संशोधित) के संगत प्रावधान इस अधिनियम के आरंभ की तिथि से निरसित किये जाते हैं। (2) ऐसे निरसन के होते हुए भी, बिहार कर्मचारी चयन आयोग अधिनियम, 2002 (समय-समय पर यथा- संशोधित) के अधीन बिहार कर्मचारी चयन आयोग द्वारा की गयी चयन की कोई भी कार्रवाई वैध मानी जायेगी मानों उक्त कार्रवाई इस अधिनियम के अधीन की गयी हो।

अनुसूची बिहार तकनीकी कर्मचारी चयन आयोग द्वारा आयोजित की जाने वाली परीक्षाओं से संबंधित पदों की सूचीः-

नोटः-राज्य सरकार द्वारा नये पद अनुसूची में सम्मिलित हो सकेंगे एवं पद अनुसूची से हटाये भी जा सकेंगे।

संख्या-एल0जी0-1-08/2014/94/लेजः।—बिहार विधान मंडल द्वारा यथापारित और महामहिम राज्यपाल द्वारा दिनांक 14 अगस्त 2014 को अनुमत बिहार तकनीकी कर्मचारी चयन आयोग अधिनियम, 2014 का निम्नलिखित अंग्रेजी अनुवाद बिहार-राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जिसे भारतीय संविधान के अनुच्छेद 348 के खंड(3) के अधीन उक्त अधिनियम का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा।

सरकार के सचिव। Bihar Technical Staff Selection Commission Bill 2014 [Bihar act 13, 2014] AN ACT Preamble :- to constitute the Bihar Technical Staff Selection Commission for selection of Candidates to the post of Group 'B' and 'C' under State Government of Bihar. Be it enacted by the Legislature of the State of Bihar in the Sixty fifth year of the Republic of India as follows :-

Chapter I

1. Short title, Extent and Commencement I- (1) This Act may be called The Bihar Technical Staff Selection Commission Act, 2014. (2) It shall extend to the whole of the State of Bihar. (3) It shall come in to force at once. 2. Definitions I- In this Act, unless any thing is repugnant to the subject or context;

(i) ''Act ''means The Bihar Technical Staff Selection Commission Act, 2014.

(ii) ''Commission'' means, Bihar technical Staff Selectioin Commission constituted under this Act;

(iii) ''State Government'' means The State Government of Bihar. (iv) ''Shedule'' means Shedule inclosed with this Act.

Chapter II 3. Constitution of Commission I- The Bihar Technical Staff Selection Commission shall be constituted consisting of the followings :- (i) Chairman- Any officer belonging to Indian Administrative Service not below the rank of super time scale appointed by the General Administration Department of the State Government whose minimum three years of service remains : Provided that retired officer of the equivalent eligibility also may be appointed as Chairman by the General Administration Department of the State Government. (ii) Members- Five Officers of the State Services appointed by the General Administration Department of the State Government whose minimum one year of Service remains : Provided that retired officers of the equivalent eligibility also may be appointed as Member by the General Administration Department of the State Government.

Among these five members minimum one member shall be selected from Bihar Engineering Services, Bihar Health Services and Bihar Administrative Services respectively. Rest two other members will be selected from any services from the said three services : Provided that only such officers of Bihar Engineering Serivce, Bihar Health Service and Bihar Administrative Service shall be Selected as the members who holds post on permanent basis not less than grade pay of Rs. 8700/- (Eight thousand Seven hundred) or have already held the post under the State Government . 4. Tenure of Chairman and Members of the Commission I- The tenure of the Chairman and Members of the Commission shall be Generally for three years. provided that, in special circumstances, the tenure of a Member shall be further that extended for that period as it may be determined by the State Government. Provided further that if General Administration Department of the State Government is reasonablly Satisfied that continuance of Chairman or any Member or all Members in the Commission is against the public interest or convenient work performance of the Commission may be obstructed by their continuance, then Chairman or/ and such any other Member/ all Members may be discharged from their posts by the State Government (General Administration Department) before the completion of their general tenure of three years. 5. Age limit of Chairman and Members of the Commission I- The maximum age limit of the Chairman or Members of the Commission at the time of appointment shall be 62 (sixty two) years in the matter of retired officers. 6. Headquarter and Administrative Department of the Commission I- The Headquarter of the Commission shall be Situated in Patna and General Administration Department shall be Administrative Department of the Commission. 7. Subordinate officers and Employees I- For conduct of business of the Commission, post strength of subordinate officers and employees and their service conditions will be in conformity with the rules made by The State Government under this Act.

Chapter III 8. Services, Cadre and Posts for Which the Commission May Recommend for Appointment I- The Commission may select and recommend for appointment to all Technical Services/ Cadres / Posts of Group 'B' and 'C' of Grade pay less than Rupees 4800/-or corresponding Grade Pay as revised from time to time in the different Departments of State Government and Field Offices as included in the Schedule of this Act. The Schedule may be amended time to time by the General Administration Department by Notification. 9. Selection Procedure I- (1) Commission shall select the candidates for appointment on Technical posts according to prescribed procedure under the Service Cadre Rules of respective posts; Provided that in absence of Service Cadre Rules for any Technical post, The Commission shall select the candidates for that post according to the Prescribed Procedure in the selection rules made for this perposes by the Commission with prior permission of the State Government. (2) The Commission hold the Combind Competivtive Examination for the posts of similar qualifications.

10. Transfer of pending Selection works Related to Technical posts of Group 'B' and 'C' :- The Selection works shall be completed by the Bihar Technical staff Selection Commission for the appointment to all such Technical posts as included in the schedule of this Act, in respect of which the advertisement has not been issued or published by the Bihar Staff Selection Commission till the date of commencement of this Act : Provided that the Selection work shall be completed by the Bihar Staff Selection Commission for appointment to such all Technical posts as included in the Schedule of this Act, in respect of which the advertisement has been issued or published by the Bihar Staff Selection Commission till the date of enforcement of this Act .

Chapter IV 11. Financial Provisions I- (i) All expences of the Commission office and work execution of the Commission shall be bore by the State Government . (ii) The Commission shall received the examination fee from the Candidates determined by the State Government, time to time for the Competitive Examinations conducted for selection for the appointment of the different posts, which will be deposited in the appropriate receipt Head in State Treasury by the Commission. 12. Accounts and Audit I- (i) Financial year of the Commission shall begins from 1st April of a Calander year and shall end on 31st March of the next Calendar year. (ii) Due recording of all due credit and expenditure shall made by the commission and the Secretary of the Commission shall be particularly responsible of duly maintenance of the accounts of the Commission : (iii) The statutory audit of the accounts of the Commission shall be made by Accountant General of India.

Chapter V 13. Delegation of Powers I- (i) The Secretary of the Commission shall have the powers to exercise the powers similar to the Head of the Departments of the State Government in cases of the Administrative and Financial matters . (ii) The Chairman of the Commission shall entrust the duties and responsibilities of Examination Controller of the Commission to one member among the members and duties and responsibilities of Administrative Branch to another one member among the rest members. 14. Powers to Make Rules/Regulations I- (i) The State Government shall have power to make the Rules/ Regulations for implementing the provisions of this Act. (ii) The Commission may make The work Procedure Conduct Rules and Regulations for Conduct of Publication of Advertisements, Conduct of Written Examinations, Publication of results, personality test/Viva-voce Test and other selection procedure, if any other functions, with the prior approval of State Government. 15. Lay dwon Rules/Regulations before the Legislature I- Each Rules/ Regulations after it is made shall be layed as soon as possible before the Legislation in the Coming Session or Subsequent Sessions which is for total minimum for fourteen days. 16. Removal of Difficulties and Interpretation I-(i) Within one year after the commencement of this Act, the State Government may make such Provisions by Notification for the removing the difficulties coming in appropriate implementation, of relevant provisions of this Act which not in consistent with provisions of the Act.

(ii) if any doubt arises in respect of interpretation of any provision of the Act within one year after the commencement of this Act, The State Gorvernment may remove the same by Notification in consultation with the Law Department.. (iii). If any difference appears in Hindi Version and English Version of this Act, the Hindi Version shall has overriding effect. 17. Resedue Matters I- All/any resedue matters related to this Act shall be disposed off by the State Government (General Administration Department) according to the provisions of this Act. 18. Repeal and Savings I- (1) Relevant Provisions of Bihar Staff Selection Commission Act, 2002 (As amended from time to time) are hereby repealed from the date of commencement of this Act till the limit of the matters transfered by section 10 of this Act and giving the matters related to the selection to Technical posts by this Act to the Commission. (2) Notwithstanding this repeal any action of selection taken by The Bihar Staff Selection Commission under The Bihar Staff Selection Commission Act, 2002 (As amended from time to time) shall be legal and that shall be deemed to be legal as if the said action was taken under this Act.

Schedule - List of Posts for which Examination is to be Conduted by Bihar Technical Staff Selection

Note :- New Posts may be included and deleted in the Schedule by the State Government .
