द्वारा यथापारित का निम्नलिखित अधिनियम, जिसपर राष्ट्रपति दिनांक

बिहार राज्य में लागू करने के लिए बंगाल, आगरा एवं असम व्यवहार न्यायालय अधिनियम, 1887 (1887 का अधिनियम, 12) में संशोधन करने के लिए अधिनियम।
भारत गणराज्य के चौंसठवें वर्ष में बिहार राज्य विधान मंडल द्वारा निम्नलिखित रूप में यह अधिनियमित हो-
1. संक्षिप्त नाम, विस्तार एवं प्रारंभ।- (1) यह अधिनियम बंगाल, आगरा एवं असम व्यवहार न्यायालय (बिहार संशोधन) अधिनियम, 2013 कहा जा सकेगा।
(2) इसका विस्तार संपूर्ण बिहार राज्य में होगा। (3) यह राजपत्र में इसके प्रकाशन की तिथि से 30 दिनों के बाद प्रवृत्त होगा।
2. बंगाल, आगरा एवं असम व्यवहार न्यायालय अधिनियम, 1887 (1887 का अधिनियम 12) की धारा-3 का संशोधन।—बंगाल, आगरा एवं असम व्यवहार न्यायालय अधिनियम, 1887 (1887 का अधिनियम 12) (इसमें आगे उक्त अधिनियम के रूप में निर्दिष्ट) की धारा-3 के खण्ड (3) में शब्द ''अवर न्यायाधीश'' को शब्द एवं कोष्ठक ''असैनिक न्यायाधीश (वरीय कोटि)'' तथा खण्ड (4) में शब्द ''मुंसिफ'' को शब्द एवं कोष्ठक ''असैनिक न्यायाधीश (कनीय कोटि)'' द्वारा प्रतिस्थापित किया जायेगा।
3. 1887 का अधिनियम 12 का संशोधन।- उक्त अधिनियम में जहाँ कहीं भी शब्द ''अवर न्यायाधीश'' एवं शब्द ''मुंसिफ'' प्रयुक्त है को क्रमशः शब्द एवं कोष्ठक ''असैनिक न्यायाधीश (वरीय कोटि)'' एवं ''असैनिक न्यायाधीश (कनीय कोटि)'' द्वारा प्रतिस्थापित किया जायेगा।
4. 1887 का अधिनियम 12 की धारा-19 का संशोधन।- उक्त अधिनियम की धारा-19 में शब्द ''मुंसिफ की अधिकारिता का विस्तार वैसे सभी वादों तक है जिसका मूल्य तीस हजार रूपये से अधिक न हो'' को शब्द और अंक एवं कोष्ठक ''असैनिक न्यायाधीश (कनीय कोटि)'' की अधिकारिता को विस्तार वैसे सभी वादों तक है जिसका मूल्य 1,50,000/- (एक लाख पचास हजार रूपये) से अधिक न हो'' द्वारा प्रतिस्थापित किये जायेगें।
5. 1887 का अधिनियम 12 की धारा-21 का संशोधन।-उक्त अधिनियम की धारा-21 की उप-धारा (1) के खण्ड (क) में शब्द ''दो लाख रूपये'' को अंक, कोष्ठक एवं शब्द ''10,00,000/-(दस लाख रूपये)'' द्वारा प्रतिस्थापित किया जायेगा।
6. व्यावृति।- इस अधिनियम में किसी बात के होते हुए भी इस अधिनियम के प्रवृत्त होने की तिथि के सं0 एल0जी0-1-24/2014/103/लेजः।—बिहार विधान मंडल द्वारा यथापारित और राष्ट्रपति द्वारा दिनांक 25 जुलाई 2014 को अनुमत बंगाल, आगरा एवं असम व्यवहार न्यायालय (बिहार संशोधन) अधिनियम, 2013 का निम्नलिखित अंग्रेजी अनुवाद बिहार-राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जिसे भारतीय संविधान के अनुच्छेद 348 के खंड(3) के अधीन उक्त अधिनियम का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा। 3 (cid:1)बहार गजट (असाधारण), 25252525 अगःतअगःतअगःतअगःत 2014201420142014

To amend the Bengal, Agra and Assam Civil Courts Act, 1887 (Act, 12 of 1887) in its application to the State of Bihar. Be it enacted by the Legislature of the State of Bihar in the Sixty fourth year of Republic of India as follows:-
1. Short title, extent and Commencement.- (1) This Act may be called the Bengal, Agra and Assam Civil Courts (Bihar Amendment) Act, 2013. (2) It shall extend to the whole of the State of the Bihar. (3) It shall come into force 30 days after the date of its publication in the official Gazette.
2. Amendment in Section-3 of the Bengal, Agra and Assam Civil Courts Act, 1887 (Act 12 of 1887).- In Bengal, Agra and Assam Civil Courts Act 1887 (Act, 12 of 1887) (herein after referred to as the said Act) in Clause-(3) of Section-3 for the words "Subordinate Judge" words and bracket "Civil Judge (Senior Division)" and in Clause (4) for the words "Munsif " the words and bracket "Civil Judge (Junior Division)" shall be substituted"
3. Amendment in Act, 12 of 1887.- In the said Act, the word "Subordinate Judge" and the word "Munsif" wherever used shall be substituted by the words and bracket "Civil Judge (Senior Division)" and "Civil Judge (Junior Division)" respectively.
4. Amendment in Section-19 of the Act, 12 of 1887.- In the said Act in Section-19 the words " the Jurisdiction of Munsif extends to all like suits of which the value does not exceed Thirty thousand rupees" shall be substituted by the words, numbers and bracket "the Jurisdiction of Civil Judge (Junior Division) extends to all like suits of which the value does not exceed rupees 1,50,000/-(One lac fifty thousand rupees)" 5. Amendment in Section-21 of the Act, 12 of 1887.- In the said Act in Clause (a) of Sub-section (1) of Section-21 the words "Two lacs rupees" shall be substituted by the number, bracket and words "rupees 10,00,000/-(rupees Ten lacs)"
6. Savings.- Notwithstanding anything contained in this Act, the suits filed prior to the enforcement of this Act shall remain unaffected.
