सं॰ 70 नि0—दण्ड प्रक्रिया संहिता, 1973 की धारा 13 की उपधारा (1) अधिनियम 2(1974) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उच्च न्यायालय निम्न तालिका के स्तंभ-2 में उल्लिखित कार्यपालक पदाधिकारी को न्यायालय की अधिसूचना की तिथि से एक वर्ष के लिए बिहार परीक्षा संचालन अधिनियम 1981 के अधीन उन वादों को जिन्हें वे दंड प्रक्रिया संहिता 1973 के अंतर्गत क्षमतापूर्वक निष्पादित कर सकते हैं के निष्पादन हेतु तालिका के स्तंभ-3 में उल्लिखित क्षेत्राधिकार के लिए द्वितीय श्रेणी का विशेष न्यायिक दंडाधिकारी नियुक्त करता है।
उन्हें यथाकथित संहिता की धारा 261 के अंतर्गत बिहार परीक्षा संचालन अधिनियम, 1981 में वर्णित वादों के संक्षिप्त विचारण के लिए द्वितीय श्रेणी के न्यायिक दंडाधिकारी की शक्तियाँ भी प्रदान की जाती है।

No. 70 A—In exercise of powers conferred upon the High Court under Sub Section (1) of Section 13 of the Code of Criminal Procedure 1973 (Act 2 of 1974) the executive Officers named in column no. 2 of the table given below are appointed as Special Judicial Magistrate 2nd Class for a period of one year with effect from the date of notification within the territorial jurisdiction mentioned against their names in column no. 3 of the table to try the cases under the BIHAR CONDUCT OF EXAMINATION ACT, 1981. No. 132A—In exercise of powers conferred upon the High Court under Sub-Section (1) of Section 13 of the Code of Criminal Procedure 1973 (Act 2 of 1974) the executive Officers named in column no. 2 of the table given below are appointed as Special Judicial Magistrate 2nd Class for a period of one year with effect from the date of notification within the territorial jurisdiction mentioned against their names in column no. 3 of the table to try the cases under the BIHAR CONDUCT OF EXAMINATION ACT, 1981. Which they can competently try under the code of Criminal Procedure, 1973.
These Officers are also vested with the powers conferrable on a Judicial Magistrate 2nd Class to try summarily the cases under the BIHAR CONDUCT OF EXAMINATION ACT, 1981, as are covered by Section 261 of the Cr.P.C. They are also conferred with the powers to take cognizance of such cases which they have been authorized to try in their respective Territorial Jurisdiction.

सं॰ 138 नि0—निम्न तालिका के स्तम्भ-2 में उल्लिखित न्यायिक पदाधिकारी (असैनिक न्यायाधीश, कनीय कोटि) को तालिका के स्तम्भ-3 में निर्देशित जजी एवं स्थान पर एवं स्तम्भ-4 में दी गई स्थानांतरण श्रृंखला में न्यायिक दण्डाधिकारी नियुक्त किया जाता है। पुनः दंड प्रक्रिया संहिता, 1973 (अधिनियम 2, 1974) की धारा-11 की उप-धारा (3) के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए उच्च न्यायालय द्वारा न्यायिक पदाधिकारी को निम्न तालिका के स्तंभ-5 में उनके नाम के सामने अंकित जिला के लिए प्रथम श्रेणी के न्यायिक दंडाधिकारी की शक्तियाँ प्रदान की जाती है, और उसी दण्ड प्रक्रिया की धारा 12 की उप-धारा (3) (अ) के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए पदाधिकारी को इसी तालिका के स्तंभ-6 में उनके नाम के सामने उल्लिखित अनुमंडल के लिए अनुमंडल न्यायिक दंडाधिकारी भी पदांकित किया जाता है। क्र॰ संं॰
