सं0 100/बिहार-वि.परि./8/2014 - बिहार विधान परिशद के सिवान स्थानीय निकाय निर्वाचन क्षेत्र से उप-निर्वाचन अधिसूचित करने संबंधी भारत निर्वाचन आयोग की दिनांक 25.08.2014 की अधिसूचना संख्या 100/बिहार-वि.परि./8/2014 के अनुक्रम में, एतद्द्वारा सूचित किया है कि श्री मनोज कुमार सिंह बनाम बिहार विधान परिशद एवं अन्य द्वारा दाखिल सिविल रिट अधिकारिता मामला संख्या 2014 का 9361 में लैटर्स पेटन्ट अपील संख्या 2014 का 1170 में माननीय उच्च न्यायालय, पटना में दिनांक 26.08.2014 के अपने आदेष में निम्नानुसार टिप्पणी की है :-
आई.ए. संख्या 2014 की 6195 :
''इस तथ्य पर विचार करते हुए कि बिहार विधान परिशद के सीट, जो अपीलकर्ता द्वारा भरी हुई थी, को भरने संबंधी अधिसूचना, पहले से ही जारी की जा चुकी है और नामांकन आमंत्रित कर लिए गए हैं तो इस न्यायालय के लिए यह उचित नहीं होगा कि निर्वाचन प्रक्रिया को रोका जाए या निलंबित किया जाए।
तथापि, अपीलार्थी द्वारा व्यक्त की गई षिकायतों की प्रकृति तथा उसके द्वारा मांगी गई राहत की प्रकृति पर विचार करते हुए, एतद्द्वारा, यह निदेष दिया जाता है कि निर्वाचन के परिणाम सहित उसकी प्रक्रिया, ऐसे अगले या अन्य आदेष अथवा आदेषों जो कि इस अपील में पारित किए जाएंगे के अध्यधीन होगी और ये निदेष प्रतिवादी संख्या 5 अथात निर्वाचन आयोग, भारत सरकार द्वारा अधिसूचित किए जाएंगे ताकि निर्वाचन प्रक्रिया में भाग लेने वाले अभ्यर्थी पहले से दिए गए इस निदेष के बारे में अवगत रहें।
उपर्युक्त टिप्पणियों के संबंध में संषोधन हेतु इस न्यायालय में औपचारिक प्रार्थना-पत्र देने के लिए प्रतिवादी स्वतंत्र होंगे। आई ए संख्या 2014 की 6195 का तद्नुसार निपटान किया जाता है।
इस तथ्य के आलोक में कि इस अपील में बिना बारी के सुनवाई किए जाने व इसका शीघ्र निपटान किए जाने की आवष्यकता है, इसलिए हम न्याय के हित में यह निदेष देते हैं कि इस अपील को 10.09.2014, के 'सुनवाई हेतु' नामक शीर्शक के अधीन सूचीबद्ध किया जाए।'' तद्नुसार, यह स्पश्ट किया जाता है कि आयोग द्वारा अधिसूचित सिवान स्थानीय निकाय निर्वाचन क्षेत्र से उप-निर्वाचन के परिणाम सहित उसकी निर्वाचन प्रक्रिया, अगले ऐसे या अन्य आदेष अथवा आदेषों, जो कि इस अपील में पारित किए जायेगे, के अध्यधीन होगी। इसे निर्वाचन में अभ्यर्थियों तथा अन्य संबंधितों के सूचनार्थ अधिसूचित किया जाता हैं।

No. 100/BR-LC/8/2014- In continuation of the Election Commission's Notifications No. 100/BR-LC/8/2014, dated 25.08.2014, notifying the bye-election from the Siwan Local Authorities Constituency in the Bihar Legislative Council, it is hereby informed that in the Letters Patent Appeal No. 1170 of 2014 in the Civil Writ Jurisdiction Case No. 9361 of 2014 filed by Sh. Manoj Kumar Singh Vs. The Bihar Legislative Council & Others, the Honorable High Court of Judicature at Patna in its order, dated 26.08.2014 has observed as under,- I.A. No. 6195 of 2014: "Considering the fact that the notification for filling up the seat, in Bihar Legislative Council, which the appellant had been occupying, already stands issued and nominations have been invited, it would not be appropriate, on the part of this Court, to stay or suspend the process of election. Considering, however, the nature of the grievances, which the appellant has expressed, and the nature of reliefs, which he has sought for, it is hereby directed that the process of election, including the result thereof, shall be subject to such further or other order or orders, which may be passed in this appeal, and these directions shall be notified by respondent No. 5, namely, Election Commission, Government of India, so that the candidates, who may participate in the election process, remain aware of the direction given hereinbefore. The respondents shall remain at liberty to move this Court for modification of the order in items of the above observations.
1. A. No. 6195 of 2014 shall stand disposed of accordingly. In view of the fact that this appeal needs out of turn hearing and expeditious disposal, we , in the interest of justice, direct that this appeal be listed, under the heading "For hearing' on 10.09.2014."
