10101/13-1134—भारत-संविधान के अनुच्छेद 309 के परन्तुक के अधीन प्रदा शक्तियों भारत-संविधान के अनुच्छेद 309 के परन्तुक के अधीन प्रदा शक्तियों ायन के पदों पर भर्ती एवं सेवा र्शाों को विनियमित का प्रयोग करते हुए बिहार-राज्यपाल पम्प ऑपरेटर/इलेक्ट्रीशियन के पदों पर भर्ती एवं सेवा र्शाों को विनियमित का प्रयोग करते हुए बिहार-राज्यपाल करने हेतु निम्नलिखित नियमावली बनाते हैंः-
बनाते हैंः-
1. नाम विस्तार एवं प्रारंभ।- (1) यह नियमावली लोक स्वास्थ्य अभियंत्रण विभाग के अंचलीय स्तर पर नाम विस्तार एवं प्रारंभ।- (1) यह नियमावली लोक स्वास्थ्य अभियंत्रण विभाग के अंचलीय स्तर पर पम्प ऑपरेटर/इलेक्ट्रीशियन (र्भाी एवं सेवा शर्तें) नियमावली 2014 कही जा सकेगी।

) इसका विस्तार सम्पूर्ण बिहार राज्य में लागू होगा।

(2) इसका विस्तार सम्पूर्ण बिहार राज्य में लागू होगा। (3) यह तुरंत के प्रभाव से प्रवृा होगी। 2. परिभाषाएँ।- इस नियमावली में, जबतक संदर्भ में अन्यथा अपेक्षित नहीं हों-
इस नियमावली में, जबतक संदर्भ में अन्यथा अपेक्षित नहीं हों- (i) 'संवर्ग' से अभिप्रेत है अंचल ) 'संवर्ग' से अभिप्रेत है अंचलीय स्तर पर पम्प ऑपरेटर/इलेक्ट्रीशियन संवर्ग; (ii) 'आयोग' से अभिप्रेत है बिहार कर्मचारी चयन आयोग; ) 'आयोग' से अभिप्रेत है बिहार कर्मचारी चयन आयोग; (iii) 'नियुक्ति प्राधिकार' से अभिप्रेत ह ) 'नियुक्ति प्राधिकार' से अभिप्रेत है संबंधित अंचल का अधीक्षण अभियंता; (iv) 'नियत तिथि' से अभिप्रेत है इस नियमावली के प्रवृत होने की तिथि; तथा ) 'नियत तिथि' से अभिप्रेत है इस नियमावली के प्रवृत होने की तिथि; तथा (v) 'सदस्य' से अभिप्रेत है र्वामान नियमावली के अधीन संवर्ग में नियुक्त कोई व्यक्ति तथा इसमें ) 'सदस्य' से अभिप्रेत है र्वामान नियमावली के अधीन संवर्ग में नियुक्त कोई व्यक्ति तथा इसमें ) 'सदस्य' से अभिप्रेत है र्वामान नियमावली के अधीन संवर्ग में नियुक्त कोई व्यक्ति तथा इसमें र्वामान नियमावली के प्रवृत होने के पूर्व संवर्ग में नियुक्त सभी व्यक्ति शामिल हैं। र्वामान नियमावली के प्रवृत होने के पूर्व संवर्ग में ि नयुक्त सभी व्यक्ति शामिल हैं।
3. संवर्ग की संरचना।-
(1) पम्प ऑपरेटर संवर्ग की संवर्ग संरचना निम्नलिखित के अनुसार होगी :-

| (ग) | इलेक्ट्रीशियन ग्र ड-I े | द्वितीय प्रोन्नति स्तर |
(3) पम्प ऑपरेटर एवं इलेक्ट्रीशियन का वेतनमान वही होगा जो सरकार द्वारा, समय-समय पर, मंजूर किया जाय।
4. संवर्ग बल।- संवर्ग बल ऐसा होगा जो विभाग द्वारा, समय-समय पर, अवधारित किया जाए। 5. र्भाी की प्रक्रिया।- (1) सभी नयी भर्ती बिहार कर्मचारी चयन आयोग की अनुशंसा पर, पम्प ऑपरेटर एवं इलेक्ट्रीशियन की मूल कोटि में की जायेंगी।
(2) नियुक्ति प्राधिकार प्रत्येक वर्ष की 1 अप्रील के आधार पर रिक्ाियों की गणना करेगा और 30 अप्रील तक आयोग को अधियाचना भेज देगा।
(3) आयोग रिक्तियों को विज्ञापित करेगा और प्रतियोगिता परीक्षा के आधार पर सफल अभ्यर्थियों का चयन करने के बाद संबंधित नियुक्ति प्राधिकारों को मेधाक्रम के अभ्यर्थियों के नामों की अनुशंसा करेगा। मेधासूची विभाग में अनुशंसा प्राप्ति की तिथि से एक वर्ष के लिए वैध रहेगी।
(4) सम्यक छानबीन के बाद नियुक्ति प्राधिकार अभ्यर्थी की नियुक्ति परिवीक्षा पर करेगा। 6. अहर्ता।- (1) मान्यता प्राप्त औधोगिक प्रशिक्षण संस्थान (आई0टी0आई0) से पम्प ऑपरेटर के लिए मशीनिस्ट अथवा फीटर टे्रड में तथा इलेक्ट्रीशियन के लिए इलेक्ट्रीशियन अथवा वायर मैन टे्रड की परीक्षा उाीर्ण के साथ न्यूनतम शैक्षणिक अहर्ता दसवीं (मैट्रिक) उाीर्ण होगी।
(2) र्भाी के लिए न्यूनतम उम्र 18 वर्ष होगी और अधिकतम उम्र वही होगी जो राज्य सरकार (सामान्य प्रशासन विभाग) द्वारा, समय-समय पर, अवधारित की जाए।
7. आरक्षण।- र्भाी एवं प्रोन्नति में, राज्य सरकार द्वारा, समय-समय पर, अधिसूचित आरक्षण/रोस्टर का अनुपालन आवश्यक होगा।
8. परिवीक्षा।- परिवीक्षा अवधि दो वर्षाें की होगी। परिवीक्षा अवधि में सेवा संतोषजनक नहीं रहने पर नियुक्ति प्राधिकार द्वारा परिवीक्षा अवधि को अधिकतम एक वर्ष के लिए विस्तारित किया जा सकेगा। ऐसा अवधि विस्तार तभी होगा जब नियुक्ति प्राधिकार की राय में परिवीक्षाधीन व्यक्ति में सुधार की गुंजाइश हो।
यदि विस्तारित अवधि में भी सेवा संतोषजनक नहीं पाया जाता है तो संबंधित व्यक्ति को सेवामुक्त कर दिया जायेगा।
9. सम्पुष्टि।- परिवीक्षाधीन व्यक्ति की सेवा परिवीक्षा अवधि की संतोषजनक समाप्ति के बाद नियुक्ति प्राधिकारी द्वारा सम्पुष्ट की जायगी।
10. वरीयता।- संवर्ग के सदस्य की आपसी वरीयता आयोग द्वारा अवधारित उनकी मेधा-स्थिति के अनुसार होगी;
परन्तु इस नियमावली के प्रवृत होने के पूर्व संवर्ग में नियुक्त व्यक्तियों की बीच आपसी वरीयता अपरिवर्तित रहेगी।
11. प्रोन्नति।- मूल कोटि से उच्चतर कोटि में प्रोन्नति, सामान्य प्रशासन विभाग द्वारा, समय-समय पर, अवधारित कालवधि के पूरा होने पर और विभागीय प्रोन्नति समिति की अनुशंसा पर, दी जा सकेगी।
12. संवर्ग का स्तर।- यह संवर्ग यांत्रिक अंचलीय स्तरीय होगा किन्तु अचानक जरूरत होने पर या किसी यांत्रिक अंचल में पम्प ऑपरेटर/इलेक्ट्रीशियन के आभाव जैसी अत्यावश्यकता होने पर यांत्रिक अंचल संवर्ग के किसी कर्मचारी को, सेवा में उसके प्रवेश के आधार पर उसकी वरीयता को बनाए रखते हुए अपने नियंत्रणाधीन एक अंचल से दूसरे अंचल में स्थानान्तरित करने की शक्ति संबंधित क्षेत्रीय मुख्य अभियंता, लोक स्वास्थ्य अभियंत्रण विभाग को होगी। अभियंता प्रमुख-सह-विशेष सचिव, लोक स्वास्थ्य अभियंत्रण विभाग ऐसे कर्मियों का विशेष परिस्थिति में राज्य स्तरीय या अन्तरजोनल स्थानान्तरण कर सकेंगे।
13. अवषिष्ट मामले।- ऐसे मामलों के संबंध में, जो इस नियमावली द्वारा विशिष्ट रूप से आच्छादित नहीं हैं, संवर्ग के सदस्य राज्य सरकार के समूह 'ग' स्तर के पदाधिकारियों/कर्मचारियों के लिए लागू विनियमावली या आदेशों से शासित होंगे।
14. कठिनाईयों का निराकरण।- लोक स्वास्थ्य अभियंत्रण विभाग, बिहार, पटना/सामान्य प्रशासन विभाग, समय-समय पर, ऐसा सामान्य या विशेष निदेश जारी कर सकेगा जो इस नियमावली के प्रावधानों में से किसी के कार्यान्वयन में आ रही कठिनाई के निराकरण के लिए आवश्यक हो और जो इस नियमावली के प्रावधानों से असंगत न हों।3 (cid:1)बहार गजट (असाधारण), 23232323 िसत*बिसत*बिसत*बिसत*बरररर 2014201420142014 15. निर्वचन।- जहाँ इस नियमावली के प्रावधानों में से किसी के निर्वचन के संबंध में कोई शंका उत्पन्न हो वहाँ मामला लोक स्वास्थ्य अभियंत्रण विभाग/सामान्य प्रशासन विभाग द्वारा विनिश्चित किया जायेगा और उसका निर्णय अंतिम होगा।
16. निरसन एवं व्यावृाि।- (1) इस संवर्ग के संबंध में पूर्व में निर्गत सभी संकल्प एवं अनुदेश एतद् द्वारा निरसित किये जाते हैं।
(2) ऐसा निरसन के होते हुए भी, ऐसे संकल्प, अनुदेश के अधीन किया गया कोई कार्य या की गयी कोई कार्रवाई इस नियमावली के अधीन किया गया कार्य या की गयी कार्रवाई समझी जायेगी मानो यह नियमावली उस दिन प्रवृा थी जिस दिन ऐसा कार्य या कार्रवाई की गयी थी।

No. 3/विविध-10101/13-1134—In exercise of powers conferred by proviso to Article 309 of the Constitution of India, the Governor of Bihar is pleased to make the following Rules to regulate the recruitment and service conditions on the posts of Pump Operator/Electrician :-
1. Short title, extent & commencement.— (1) These Rules may be called as Bihar Public Health Engineering Circle Level Pump Operator/Electrician (Recruitment & Service Conditions) Rules, 2014;
(2) It will extend to the whole of the State of Bihar; (3) It will come into force with immediate effect. 2. Definitions.- In these Rules, unless otherwise required in the context - (i) 'Cadre' means Circle level Pump Operator/ Electrician cadre; (ii) 'Commission' means Bihar Staff Selection Commission; (iii) 'Appointing Authority' means Superintending Engineer of concerned circle;
(iv) 'Appointed Date' means the date of coming into force of these Rules; and (v) 'Member' means a person appointed in the cadre under the present Rules it includes all persons appointed in the cadre prior to coming into force of present Rules.
3. Structure of the Cadre.- (1) The cadre structure of the Pump Operator cadre shall be according to following:-

4. Cadre Strength.- The cadre strength shall be such as is determined by the Department, from time to time.
5. Process of Recruitment.- (1) All fresh recruitments shall be made in the basic category of Pump Operator/Electrician separately, on the recommendation of the Commission.
(2) The Appointing Authority shall calculate the vacancies on the basis of position as on 1st April each year and shall send requisition to the Commission by 30th April.
(3) The Commission shall advertise vacancies, and after selecting successful candidates on the basis of Competitive Examination, shall recommend names of candidates of the merit list to the concerned Appointing Authorities. The merit list shall remain valid for one year from the date of receipt of recommendation in the Department. Syllabus of the competitive Examination will be determined by the Commission in Consultation with the Department.
(4) After thorough scrutiny, the Appointing Authority shall appoint the candidate on probation.
6. Qualification.- (i) The minimum educational qualification shall be 10th (Matric) pass with pass in Machinist or Fitter trade examination for Pump Operator and Electrician or Wireman trade examination for Electrician from recognized Industrial Training Institute (I.T.I).
(ii) For recruitment, the minimum age limit shall be 18 years and maximum age limit shall be the same as determined by the State Government (General Administration Department), from time to time.
7. Reservation.- It shall be necessary to comply reservation/roster in recruitment as well as promotion, notified by the State Government, from time to time.
8. Probation.- The probation period shall be of two years. If the service is not found satisfactory during the probation period, the probation period may be extended for a maximum period of one year by the Appointing Authority. Such extension of period will be made only when, in the opinion of the Appointing Authority, there is chance of improvement in the probationer person. If the service is not found satisfactory in the extended period also, the concerned person shall be terminated from the service.
9. Confirmation.- Service of the person under probation shall be confirmed by the Appointing Authority after satisfactory completion of probation period.
10. Seniority .- The inter-se-seniority of members of the cadre shall be according to their merit position determined by the Commission:
Provided that the inter-se-seniority amongst the persons appointed in the cadre prior to coming into force of these Rules shall remain unchanged.
11. Promotion.- The promotion from basic category to higher category shall be given on completion of 'KALAWADHI' determined by the General Administration Department, from time to time, and on recommendation of the Departmental Promotion Committee.
12. Level of the cadre.- This cadre shall be at mechanical circle level. But in case of sudden necessity or exigencies like shortage of Pump Operator/Electrician in a mechanical circle, the concerned Zonal Chief Engineer, Public Health Engineering Department shall have power to transfer an employee of mechanical circle cadre from one circle to another circle under his jurisdiction, maintaining his seniority on the basis of his entry into the service. 13. Residue Matters.- With respect to such matters which are not specially covered by these Rules, the members of the cadre shall be governed by the Regulations or Orders, for the time being in force, for officers/employees of Group 'C' Level of The State Government.
14. Removal of difficulties.- The Public Health Engineering Department, Bihar, Patna/General Administration Department may issue such general or special directions, from time to time, which may be necessary for removal of difficulties coming in implementation of any of the provisions of these Rules and which is not inconsistent with provisions of these Rules.
15. Interpretation.- Where any doubt arises with respect to interpretation of any provision of these Rules, the matter shall be determined by the Public Health Engineering Department/General Administration Department and its decision shall be final.
16. Repeal & Savings.- (1) All Resolutions and Instructions issued earlier with respect to this cadre are hereby repealed.
(2) Notwithstanding such repeal, any work done or any action taken under such Resolutions and Instructions shall be deemed to be done or taken under these Rules, as if these Rules were in force on the date such work was done or action was taken.
