भारत संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों सं0 कारा/प्रो0 (स्था0)-10-26/14 ान कार्यालयाें के लिपिकीय संवर्ग में भर्त्ती का प्रयोग करते हुए बिहार-राज्यपाल राज्य के प्रोबेशन निदेशालय एवं प्रोबेशन कार्यालयाें के लिपिकीय संवर्ग में भर्त्ती का प्रयोग करते हुए बिहार-राज्यपाल राज्य के प्रोबेश् एवं सेवा शर्त्तों को विनियमित करने हेतु निम्नलिखित नियमावली बनाते हैंः- एवं सेवा शर्त्तों को विनियमित करने हेतु

''बिहार प्रोबेषन लिपिकीय संवर्ग (भर्त्ती एवं सेवाशर्त्तें) नियमावली, 2014''। ''बिहार प्रोबेषन लिपिकीय संवर्ग (भर्त्ती एवं सेवाशर्त्तें) नियमावली, 2014''। ''बिहार प्रोबेषन लिपिकीय संवर्ग (भर्त्ती एवं सेवाशर्त्तें) नियमावली, 2014''।

1. संक्षिप्त नाम एवं प्रारम्भ ।-

संक्षिप्त नाम एवं प्रारम्भ ।- (1) यह नियमावली ''बिहार प्रोबेशन लिपिकीय संवर्ग (भर्त्ती एवं सेवाशर्त्तें) ान लिपिकीय संवर्ग (भर्त्ती एवं सेवाशर्त्तें) नियमावली, 2014'' कही जा सकेगी।

सम्पूर्ण बिहार राज्य में होगा ।

यह तुरन्त के प्रभाव से प्रवृत्त होगी ।

(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा । (3) यह तुरन्त के प्रभाव से प्रवृत्त होगी । 2. परिभाषाएँ ।- इस नियमावली में, जब तक कि संदर्भ में अन्यथा अपेक्षित नहीं होः-

'संवर्ग'' से अभिप्रेत है प्रोबेशन निदेशालय सहित प्रोबेशन कार्यालयों के लिपिकीय संवर्ग;

ान कार्यालयों के लिपिकीय संवर्ग;

(i) 'संवर्ग'' से अभिप्रेत है प्रोबेशन निदेशालय सहित प्रोबेश् (ii) ''आयोग'' से अभिप्रेत है बिहार कर्मचारी चयन आयोग; ''आयोग'' से अभिप्रेत है बिहार कर्मचारी चयन आयोग; (iii) ''नियुक्ति प्राधिकार'' से अभिप्रेत है महानिरीक्षक, कारा एवं सुधार सेवाएँ, बिहार; ''नियुक्ति प्राधिकार'' से अभिप्रेत है महानिरीक्षक, कारा एवं सुधार सेवाएँ, बिहार; (iv) ''समूह ''घ'' के नियमित नियुक्त कार्मिक'' से अभिप्रेत है समूह ''घ'' के वैसे कार्मिक जिनकी सेवा ''समूह ''घ'' के नियमित नियुक्त कार्मिक'' से अभिप्रेत है समूह ''घ'' के वैसे कार्मिक जिनकी सेवा ''समूह ''घ'' के नियमित नियुक्त कार्मिक'' से अभिप्रेत है समूह ''घ'' के वैसे कार्मिक जिनकी सेवा सम्पुष्टि की जा चुकी हो; तथा सम्पुष्टि की जा चुकी हो;

(v) ''सदस्य'' से अभिप्रेत है संवर्ग में नियुक्त कोई व्यक्ति तथा इसमें इस नियमावली के प्रवृत्त होने के पूर्व ''सदस्य'' से अभिप्रेत है संवर्ग में नियुक्त कोई व्यक्ति तथा इसमें इस नियमावली के प्रवृत्त होने के पूर्व ''सदस्य'' से अभिप्रेत है संवर्ग में नियुक्त कोई व्यक्ति तथा इसमें इस नियमावली के प्रवृत्त होने के पूर्व से नियमित रूप से नियुक्त सभी व्यक्ति शामिल हैं । से नियमित रूप से नियुक्त सभी व्यक्ति शामिल हैं ।

3. संवर्ग की संरचना ।-

संवर्ग की संरचना ।- (1) लिपिकीय संवर्ग की संवर्ग संरचना निम्नवत्‌ होगी-

(i) निम्नवर्गीय लिपिक - मूल कोटि (ii) उच्चवर्गीय लिपिक - प्रथम प्रोन्नति स्तर (iii) प्रधान लिपिक - द्वितीय प्रोन्नति स्तर

- द्वितीय प्रोन्नति स्तर

(2) संवर्ग का प्राधिकृत बल, पदों की संख्या एवं वेतनमान वही होगा जो सरकार द्वारा समय-समय पर (2) संवर्ग का प्राधिकृत बल, पदों की संख्या एवं वेतनमान वही होगा जो सरकार द्वारा समय-समय पर (2) संवर्ग का प्राधिकृत बल, पदों की संख्या एवं वेतनमान वही होगा जो सरकार द्वारा समय-समय पर अंतःस्थापन या विलोपन या अन्यथा अधिसूचित की जाएगी और जो समय-समय पर प्रश् की जाएगी और जो समय-समय पर प्रशासनिक हित में किसी पद का अंतःस्थापन या विलोपन या अन्यथा द्वारा स्वतः पुनरीक्षित या उपांतरित समझी जाएगी । द्वारा स्वतः पुनरीक्षित या उपांतरित समझी जाएगी ।2 (cid:1)बहार गजट (असाधारण), 21212121 नव(बनव(बनव(बनव(बर र र र 2014201420142014 4. संवर्ग बल ।- (1) संवर्ग बल ऐसा होगा जो प्रोबेशन प्रभाग, कारा एवं सुधार सेवाएँ निरीक्षणालय, गृह विभाग द्वारा समय-समय पर सामान्य प्रशासन विभाग एवं वित्त विभाग के परामर्श के पश्चात्‌ अवधारित किया जाय । (2) उक्त संवर्ग के सदस्यों पर परिचालनात्मक नियंत्रण महानिरीक्षक, कारा एवं सुधार सेवाएँ, बिहार का होगा।

5. भर्त्ती ।- (1) निम्नवर्गीय लिपिक का 85 प्रतिशत पद सीधी भर्त्ती से भरा जाएगा और 15 प्रतिशत पद प्रोबेशन निदेशालय एवं प्रोबेशन कार्यालयों में कार्यरत्‌ समूह ''घ'' के वैसे सुयोग्य कर्मियों से वरीयता के आधार पर प्रोन्नति द्वारा भरा जायेगा जो निम्नवर्गीय लिपिक के पद पर नियुक्ति की अर्हता रखते हों ।

(2) सभी सीधी भर्त्तियाँ आयोग की अनुशंसा पर निम्नवर्गीय लिपिक की कोटि में की जाएगी । (3) नियुक्ति प्राधिकार प्रत्येक वर्ष की 1ली अप्रैल के आधार पर रिक्तियों की गणना करेगा और 30 अप्रैल तक आयोग को अधियाचना भेज देगा ।

(4) आयोग रिक्तियों को विज्ञापित करेगा और प्रतियोगिता परीक्षा के आधार पर सफल अभ्यर्थियों का चयन करने के बाद नियुक्ति प्राधिकार को मेधाक्रम में अभ्यर्थियों के नामों की अनुशंसा करेगा। मेधासूची की वैधता अनुशंसा प्राप्ति की तिथि से एक वर्ष तक रहेगी।

6. अर्हता।ः- (1) न्यूनतम शैक्षणिक अर्हता कम्प्यूटर संचालन एवं कम्प्यूटर टंकण के ज्ञान के साथ इण्टरमीडिएट (102) उत्तीर्ण या उसके समकक्ष होगी । (2) भर्त्ती के लिए न्यूनतम एवं अधिकतम उम्र-सीमा वही होगी जो राज्य सरकार द्वारा समय-समय पर निर्धारित की जाय ।

7. आरक्षण ।- भर्त्ती एवं प्रोन्नति में, राज्य सरकार द्वारा समय-समय पर अधिसूचित आरक्षण/रोस्टर का अनुपालन आवश्यक होगा ।

8. प्रोन्नति द्वारा भर्त्ती ।- (i) नियुक्ति प्राधिकार इण्टरमीडिएट उत्तीर्ण समूह ''घ'' कर्मचारियों की वरीयता सूची तैयार करेगा ।

(ii) प्रोन्नति वरीयतानुसार विभागीय प्रोन्नति समिति की अनुशंसा पर दी जायेगी । 9. परिवीक्षा ।- प्रत्येक भर्त्ती परिवीक्षा पर दो वर्ष के लिए होगी परन्तु परिवीक्षा अवधि संतोषजनक नहीं रहने पर विशेष परिस्थितियों में इसका विस्तार एक वर्ष तक के लिए नियुक्ति प्राधिकार द्वारा किया जा सकेगा। ऐसा अवधि विस्तार तभी होगा जब नियुक्ति प्राधिकार की राय में परिवीक्षाधीन व्यक्ति में सुधार की कोई गुंजाइश हो । यदि विस्तारित अवधि में भी सेवा संतोषजनक नहीं पाया जाता है तो संबंधित व्यक्ति को बिना सूचना सेवामुक्त किया जा सकेगा ।

10. विभागीय परीक्षा ।- (1) विभागीय परीक्षा राजस्व पर्षद द्वारा संचालित की जाएगी ।

(2) विभागीय परीक्षा में दो पत्र होंगे और प्रत्येक पत्र में उत्तीर्ण होने के लिए 40 प्रतिशत अंक प्राप्त करना आवश्यक होगा ।

(क) प्रथम पत्र- सेवा नियमावली- बिहार सेवा संहिता, पेंशन नियमावली, वरीयता एवं प्रोन्नति के विधि, टिप्पणी एवं प्रारूपण। (ख) द्वितीय पत्र- वित्तीय नियमावली- कोषागार संहिता, वित्तीय नियमावली, प्रैक्टिस एंड प्रोसिडियोर, बोर्ड प्रकीर्ण नियमावली, सामान्य भविष्य निधि नियमावली, यात्रा भत्ता नियमावली, बीमा नियमावली।

11. सम्पुष्टि ।- कोई परिवीक्षाधीन व्यक्ति परिवीक्षा अवधि की संतोषजनक समाप्ति, विभागीय परीक्षा एवं कम्प्यूटर दक्षता जाँच परीक्षा की उत्तीर्णता के बाद समपुष्ट किया जाएगा।

12. वरीयता ।- संवर्ग के सदस्य की आपसी वरीयता आयोग द्वारा विनिश्चित उनकी मेधा स्थिति के अनुसार होगी;

परन्तु इस नियमावली के प्रवृत्त होने के पूर्व विनिश्चित उनकी वरीयता अपरिवर्तनीय रहेगीः परन्तु और कि अनुकम्पा के आधार पर नियुक्त व्यक्ति उन व्यक्तियों से कनीय होंगे जो संबंधित भर्त्ती वर्षों में प्रतियोगिता परीक्षा के आधार पर नियुक्त किए गए हों :

परन्तु और भी कि किसी भर्त्ती वर्ष में प्रोन्नति द्वारा नियुक्त व्यक्ति संबंधित भर्त्ती वर्ष में प्रतियोगिता परीक्षा द्वारा नियुक्त व्यक्ति से वरीय होंगे।

13. प्रोन्नति ।- (1) मूल कोटि से उच्चत्तर कोटि में प्रोन्नति सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्धारित कालावधि के पूरा होने पर और विभागीय प्रोन्नति समिति की अनुशंसा पर दी जा सकेगी। (2) विभागीय प्रोन्नति समिति का गठन विभाग द्वारा किया जायेगा । 14. संवर्ग का स्तर ।- यह संवर्ग राज्य स्तरीय होगा और स्थानान्तरण एवं पदस्थापन करने की शक्ति महानिरीक्षक, कारा एवं सुधार सेवाएँ, गृह विभाग, बिहार, पटना में निहित होगी ।

15. अवषिष्ट मामले ।- ऐसे मामलों के संबंध में जो इस नियमावली द्वारा विशिष्ट रूप से आच्छादित नहीं हैं, संवर्गों के सदस्य राज्य सरकार के समुचित स्तर के पदाधिकारियों/कर्मचारियों के लिए लागू नियमावली, विनियमावली या आदेशों से शासित होंगे ।3 (cid:1)बहार गजट (असाधारण), 21212121 नव(बनव(बनव(बनव(बर र र र 2014201420142014 16. कठिनाईयों का निराकरण ।- सरकार (कारा एवं सुधार सेवाएँ, गृह विभाग) समय-समय पर ऐसा सामान्य या विशेष निदेश, जो इस नियमावली के प्रावधानों से असंगत न हो, विधि विभाग के परामर्श के पश्चात्‌ इस नियमावली के प्रावधानों में से किसी के कार्यान्वयन में आ रही कठिनाई के निराकरण के लिए आवश्यक हो, जारी कर सकेगी ।

17. निर्वचन ।- जहाँ इस नियमावली के प्रावधानों में से किसी के निर्वचन के संबंध में कोई शंका उत्पन्न हो वहाँ मामला कारा एवं सुधार सेवाएँ निरीक्षणालय, गृह विभाग द्वारा विधि विभाग के परामर्श के पश्चात्‌ विनिश्चित किया जाएगा और उसका निर्णय अंतिम होगा ।

18. निरसन एवं व्यावृत्ति ।- (1) इस संवर्ग के संबंध में पूर्व में निर्गत सभी संकल्प एवं अनुदेश एतद्‌द्वारा निरसित किये जाते हैं ।

(2) ऐसा निरसन के होते हुए भी, ऐसे संकल्प अनुदेश के अधीन किया गया कोई कार्य या की गई कार्रवाई इस नियमावली के अधीन किया गया या की गई समझी जाएगी मानों यह नियमावली उस दिन प्रवृत्त थी जिस दिन ऐसा कार्य या कार्रवाई की गई थी ।

No. Kara/Pro.(Shtha)-10-26/14-325—In exercise of the powers conferred by proviso to Article-309 of the Constitution of India, the Governor of Bihar is pleased to make the following Rules for regulating the recruitment and service conditions of the Clerical Cadre of the Probation Directorate and Probation offices of the State :-

Bihar Probation Clerical Cadre (Appointment and Service Conditions) Rules, 2014.

1. Short title, extent and commencement.- (1) These Rules shall be called the "Bihar Probation Clerical Cadre (Appointment and Service Conditions) Rules, 2014." (2) It shall extend to whole of the State of Bihar. (3) It shall come into force with immediate effect. 2. Definitions.- In these Rules, unless otherwise requires in the context- (i) "Cadre" means the clerical cadre of the Probation Directorate and the Probation Offices of Bihar;

(ii) "Commission" means the Bihar Staff Selection Commission; (iii) "Appointing Authority" means the Inspector General, Prisons and Correctional Services, Bihar;

(iv) "Regular employee of Group-D'' means such employee of 'Group-D' whose service has been confirmed;

(v) "Member" means a person appointed in the cadre and it includes all the persons already appointed on regular basis in the cadre before the commencement of these Rules.

(2) Authorized strength of the Cadre, number of posts and Pay Scale shall be the same as may notified by the State Government, from time to time, and which will be automatically revised or modified by insertion or deletion or otherwise of any post in the administrative interest, from time to time.

4. Cadre strength.- (1) The cadre strength shall be such as may be determined by the Probation section of the Inspectorate of Prisons and Correctional Services, Home Department, from time to time after consultation of the General Administration Department and Finance Department .

(2) Inspector General, Prisons and Correctional Services, Bihar shall have the operational control over members of the said cadre.

Recruitment.- (1) 85% posts of Lower Division Clerk shall be filled up by direct recruitment and 15% posts shall be filled up by promotion, on the basis of seniority from amongst such eligible Group "D" employees working in Probation Directorate and Probation Offices who possess qualification for appointment to the post of Lower Division Clerk.

(2) All direct recruitments shall be made to the categary of Lower Division Clerk on the recommendation of the Commission.

(3) The Appointing Authority shall calculate the vacancies on the basis of 1st April of every year and shall send the requisition to the Commission by the 30th April.

(4) The Commission shall advertise the vacancies and after selection of successful candidates on the basis of Competitive Examination, shall recommend the names of the candidates in order of merit to the Appointing Authority. The validity of the merit list shall be one year from the date of receipt of recommendation.

6. Qualification.- (1) The minimum educational qualification shall be Intermediate (10+2) Pass or equivalent with knowledge of computer operation and computer typing.

(2) Minimum age for recruitment shall be eighteen years and maximum age shall be the same as may be determined by the State Government, from time to time.

7. Reservation.- Compliance of reservation/roster as notified by the State Government, from time to time, in recruitment as well as in promotion, shall be necessary.

8. Recruitment by promotion.- (1) The appointing authority shall prepare the seniority list of Group "D" employees having qualifications for the appointment to the post of Lower Division Clerk.

(2) The promotion shall be given according to seniority on the recommendation of the Departmental Promotion Committee.

9. Probation.- Each recruitment shall be on probation for two years and it may be extended for one year in special circumstances by the Appointing Authority, if the probation period is not satisfactory. Such extension shall be made only if the Appointment Authority is of the opinion that the probationer has a chance to improve. If the service is not found satisfactory even in the extended period, the person concerned may be removed from the service without any notice.

10. Departmental Examination.- (1) Departmental Examination shall be conducted by the Board of Revenue.

(2) There shall be two papers in the Departmental Examination and it shall be necessary to obtain 40% marks in each paper for passing the examination.

Paper-1-Service Rules- Bihar Service Code, Pension Rules, Laws of seniority and promotion, Noting and Drafting.

Paper-2-Financial Rules- Treasury Code, Financial Rules, Practice and Procedure, Board Miscellaneous Rules, General Provident Fund Rules, Travelling Allowances Rules, Insurance Rules.

11. Confirmation.- A probationer shall be confirmed after completion of satisfactory probation period and passing of the Departmental Examination and Computer Ability Test Examination.

12. Seniority.- Seniority of members of the cadre shall be according to their merit position determined by the Commission.

Provided that inter-se the seniority determined before coming in to force of these Rules shall remain unchangeable :

Provided further that the person appointed on the basis of compassionate ground shall be junior to such persons who have been appointed on the basis of the Competitive Examination in the concerned recruitment year:

Provided further also that the person appointed by promotion in any recruitment year shall be senior to the person appointed by the Competitive Examination in the concerned recruitment year.

13. Promotion.- (1) Promotion from basic grade to higher grade may be given on completion of KALAWADHI as determined by the General Administration Department from time to time and on the recommendation of Departmental Promotion Committee.

(2) The Departmental Promotion Committee shall be constituted by the Department. 14. Cadre Level.- This will be a state level cadre and power of transfer and posting shall vest in the Inspector General of Prisons and Correctional Services, Bihar, Patna.

15. Residual Matters.- With regard to matters not specifically covered by these Rules, the members of the cadre shall be governed by the Rules, Regulations or Orders applicable to the officers/ employees of the State Government at appropriate level.

16. Removal of difficulties.- The Government (Home Department ) may, from time to time, issue such general or special direction which is not inconsistent with the provision of these Rules, after consultation with the Law Department to remove the difficulty coming in the implementation of any of the provisions of these Rules, as may be necessary.

17. Interpretation.- Where any doubt arises as to the interpretation of any of the provisions of these Rules, the matter shall be decided by the Department whose decisions shall be final.

18. Repeal and Savings.- (1) All resolutions and instructions issued earlier with respect to this cadre are hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under such resolutions, instructions shall be deemed to be done or taken under these Rules as if these Rules were come to in force on the day on which such thing or action was done or taken.
