-सा0प्र0-16646—भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त राज्यपाल, राज्य के चयनित खेल विधाओं के उत्कृष्ट खिलाड़ियों की नियुक्ति हेतु क्तयों का प्रयोग करते हुए बिहार-राज्यपाल, राज्य के चयनित खेल विधाओं के उत्कृष्ट खिलाड़ियों की नियुक्ति हेतु सं0 9/नि0-18-1/2014- शक्तियों का प्रयोग करते हुए बिहार- निम्नांकित नियमावली बनाते हैं :- 1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ

संक्षिप्त नाम, विस्तार एवं प्रारम्भ :- (i) यह नियमावली ''बिहार उत्कृष्ट खिलाड़ियों की नियुक्ति नियमावली, 2014'' कही जा सकेगी । यह नियमावली ''बिहार उत्कृष्ट खिलाड़ियों की नियुक्ति नियमावली, 2014'' कही जा सकेगी । यह नियमावली ''बिहार उत्कृष्ट खिलाड़ियों की नियुक्ति नियमावली, 2014'' कही जा सकेगी । (ii) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा । इसका विस्तार सम्पूर्ण बिहार राज्य में होगा । (iii) यह तुरत प्रवृत्त होगी । यह तुरत प्रवृत्त होगी ।

2. परिभाषाएँ :- इस नियमावली में जब तक किसी संदभ्

मार्च तक;

इस नियमावली में जब तक किसी संदर्भ में अन्यथा अपेक्षित न हो :- ''नियमावली'' से अभिप्रेत है बिहार उत्कृष्ट खिलाड़ियों की नियुक्ति नियमावली, 2014; (i) ''नियमावली'' से अभिप्रेत है बिहार उत्कृष्ट खिलाड़ियों की नियुक्ति नियमावली, 2014 ''नियमावली'' से अभिप्रेत है बिहार उत्कृष्ट खिलाड़ियों की नियुक्ति नियमावली, 2014 ''सरकार'' से अभिप्रेत है बिहार सरकार; (ii) ''सरकार'' से अभिप्रेत है बिहार सरकार (iii) ''वर्ष'' से अभिप्रेत है वित्तीय वर्ष अथा ''वर्ष'' से अभिप्रेत है वित्तीय वर्ष अर्थात्‌ पहली अप्रैल से अगले वर्ष का 31 मार्च तक ''नियुक्ति प्राधिकार'' से अभिप्रेत है संबंधित सेवा/संवर्ग नियमावली में परिभाषित नियुक्ति प्राधिकार; (iv) ''नियुक्ति प्राधिकार'' से अभिप्रेत है संबंधित सेवा/संवर्ग नियमावली में परिभाषित नियुक्ति प्राधिकार ''नियुक्ति प्राधिकार'' से अभिप्रेत है संबंधित सेवा/संवर्ग नियमावली में परिभाषित नियुक्ति प्राधिकार (v) ''चयनित खेल विधा'' से अभिप्रेत है 1 में वर्णित खेल प्रतियोगिताओं में शामिल की ''चयनित खेल विधा'' से अभिप्रेत है अनुसूची-1 में वर्णित खेल प्रतियोगिताओं में शामिल की गयी खेल विधायें । उक्त खेल विधाओं में कला, संस्कृति एवं युवा विभाग, बिहार, पटना गयी खेल विधायें । उक्त खेल विधाओं में कला, संस्कृति एवं युवा विभाग, बिहार, पटना गयी खेल विधायें । उक्त खेल विधाओं में कला, संस्कृति एवं युवा विभाग, बिहार, पटना की अनुशंसा पर राज्य सरकार के द्वारा आवश्यकतानुसार समय-समय पर संशोधन किया की अनुशंसा पर राज्य सरकार के द्वारा आवश्यकतानुसार समय-समय पर संशोधन किया की अनुशंसा पर राज्य सरकार के द्वारा आवश्यकतानुसार समय-समय पर संशोधन किया जा सकेगा । (vi) ''प्रतियोगिता'' से अभिप्रेत है में वर्णित प्रतियोगिता । उक्त सूची में राज्य सरकार द्वारा ''प्रतियोगिता'' से अभिप्रेत है अनुसूची-1 में वर्णित प्रतियोगिता । उक्त सूची में राज्य सरकार द्वारा आवश्यकतानुसार समय-समय पर संशोधन किया जा सकेगा । आवश्यकतानुसार समय-समय पर संशोधन किया जा सकेगा । (vii) ''व्यक्तिगत स्पर्द्धा'' से अभिप्रेत है वैसी स्पर्द्धा, जिसमें उपलब्धि व्यक्तिगत प्रयास से प्राप्त की गई ''व्यक्तिगत स्पर्द्धा'' से अभिप्रेत है वैसी स्पर्द्धा, जिसमें उपलब्धि व्यक्तिगत प्रयास से प्राप्त की गई ''व्यक्तिगत स्पर्द्धा'' से अभिप्रेत है वैसी स्पर्द्धा, जिसमें उपलब्धि व्यक्तिगत प्रयास से प्राप्त की गई हो;

(viii) ''टीम स्पर्द्धा'' से अभिप्रेत है वैसी स्पर्द्धा, जिसमें उपलब्धि एक से अधिक खिलाड़ियों के द्वारा एक खेल टीम के रूप में प्राप्त की गई हो;

(ix) ''राज्य के प्रतिनिधित्व'' से अभिप्रेत है बिहार राज्य का प्रतिनिधित्व करने वाले खिलाड़ी; (x) ''विश्वविद्यालय का प्रतिनिधित्व'' से अभिप्रेत है बिहार राज्य के अंतर्गत मान्यता प्राप्त विश्वविद्यालय का प्रतिनिधित्व करने वाले खिलाड़ी ।

3. अर्हताएँ :- इस नियमावली के अंतर्गत निम्नांकित अर्हता प्राप्त खिलाड़ी राज्य सरकार की सेवा में उत्कृष्ट खिलाड़ी की श्रेणी में नियुक्ति के पात्र होंगे :- (i) जो बिहार राज्य के निवासी हों एवं, (ii)(क) जिन्होंने नियमावली में अनुसूची-1 की ए-1 कोटि में उल्लिखित गेम्स/प्रतियोगिता में शामिल खेल विधाओं में भारत का प्रतिनिधित्व करते हुए प्रथम/द्वितीय/तृतीय पुरस्कार/अन्य पुरस्कार प्राप्त किया हो अथवा जिनकी भारत की तरफ से उक्त प्रतियोगिता में खिलाड़ी के रूप में सहभागिता रही हो, अथवा;

(ख) जिन्होंने नियमावली में अनुसूची-1 की ए-2 कोटि में उल्लिखित गेम्स/प्रतियोगिता में शामिल खेल विधाओं में भारत का प्रतिनिधित्व करते हुए प्रथम/द्वितीय/तृतीय पुरस्कार/अन्य पुरस्कार प्राप्त किया हो अथवा जिनकी भारत की तरफ से उक्त प्रतियोगिता में खिलाड़ी के रूप में सहभागिता रही हो, अथवा;

(ग) जिन्होंने नियमावली में अनुसूची-1 की ए-3 कोटि में उल्लिखित गेम्स/प्रतियोगिता में शामिल खेल विधाओं में भारत का प्रतिनिधित्व करते हुए प्रथम/द्वितीय/तृतीय पुरस्कार/अन्य पुरस्कार प्राप्त किया हो अथवा जिनकी भारत की तरफ से उक्त प्रतियोगिता में खिलाड़ी के रूप में सहभागिता रही हो, अथवा;

(घ) जिन्होंने नियमावली में अनुसूची-1 की ए-4, ए-5 कोटि में उल्लिखित गेम्स/प्रतियोगिता में शामिल खेल विधाओं में राज्य का प्रतिनिधित्व करते हुए प्रथम/द्वितीय/तृतीय पुरस्कार प्राप्त किया हो अथवा जिनकी लगातार तीन वर्षों तक बिहार राज्य की तरफ से उक्त खेल विधाओं में खिलाड़ी के रूप में सहभागिता रही हो, अथवा;

(ड.) जिन्होंने नियमावली में अनुसूची-1 की ए-6, ए-7 एवं ए-8 कोटि में उल्लिखित गेम्स/प्रतियोगिता में शामिल खेल विधाओं में राज्य का प्रतिनिधित्व करते हुए प्रथम/द्वितीय/तृतीय पुरस्कार प्राप्त किया हो एवं

(iii) जो समूह-'ख' के पदों पर नियुक्ति हेतु स्नातक, समूह-'ग' के पदों पर नियुक्ति हेतु इन्टरमीडियट एवं समूह-'घ' के पदों पर नियुक्ति हेतु मैट्रिक अथवा इनके समकक्ष स्तर की न्यूनतम शैक्षणिक योग्यता धारण करते हों।

4. चयन प्रक्रिया :-

(i) चयनित खेल विधा में उत्कृष्ट खिलाड़ियों की नियुक्ति किसी संवर्ग में कुल बल (मूल कोटि) के 10% के अन्तर्गत होगी ।

(ii) उत्कृष्ट खिलाड़ियों की नियुक्ति में क्षैतिज (Horizontal) आरक्षण (कोटा अंडर कोटा) का प्रावधान लागू होगा । चयनित खिलाड़ी आरक्षण की दृष्टि से जिस कोटि से संबंधित होंगे, उनकी गिनती उसी आरक्षण कोटि में की जायेगी, अर्थात्‌ आरक्षित कोटि के चयनित खिलाड़ियों की गणना संगत आरक्षित कोटि के विरुद्ध तथा गैर आरक्षित वर्ग के खिलाड़ियों की गणना गैर आरक्षित वर्ग में की जायेगी ।

(iii) चयनित खेल विधाओं में प्राप्त उपलब्धि एवं निर्धारित शैक्षणिक योग्यता/अर्हता के आधार पर बिहार सचिवालय लिपिकीय सेवा, समाहरणालय क्षेत्रीय लिपिकीय संवर्ग एवं राज्य सरकार के अधीन समूह-ग एवं घ के अन्य पदों पर की जायेगी । किसी खिलाड़ी के द्वारा अनुसूची-'1' पर वर्णित 'ए-1', 'ए-2' एवं 'ए-3' कोटि की प्रतियोगिता में प्रथम/द्वितीय/तृतीय पुरस्कार प्राप्त करने एवं निर्धारित शैक्षणिक योग्यता धारित करने की स्थिति में समूह 'ख' के पदों पर भी नियुक्ति की जा सकेगी, परन्तु ऐसी नियुक्ति के लिए राज्य सरकार की स्वीकृति आवश्यक होगी ।

(iv) सामान्य प्रशासन विभाग के द्वारा सभी विभागों/कार्यालयों से रिक्तियाँ प्राप्त कर विज्ञापन प्रकाशित की जायेगी ।

(v) सामान्य प्रशासन विभाग के द्वारा प्रकाशित विज्ञापन के आधार पर प्राप्त आवेदनों की स्क्रूटनी के उपरांत राज्य सरकार के द्वारा गठित चयन समिति के द्वारा साक्षात्कार के आधार पर आवेदकों के द्वारा चयनित खेल विधा में प्राप्त उपलब्धि एवं निर्धारित शैक्षणिक योग्यता के आधार पर मेधा सूची तैयार की जायेगी ।3 (cid:1)बहार गजट (असाधारण), 4444 (दस*ब(दस*ब(दस*ब(दस*बर र र र 2014201420142014 (vi) उत्कृष्ट खिलाड़ियों के चयन हेतु राज्य सरकार द्वारा गठित चयन समिति के निम्नांकित अध्यक्ष/सदस्य होंगेः- (क) प्रधान सचिव/सचिव, सामान्य प्रशासन विभाग ः- अध्यक्ष (ख) सचिव, कला, संस्कृति एवं युवा विभाग ः- सदस्य (ग) महानिदेशक, बिहार राज्य खेल प्राधिकरण ः- सदस्य (घ) कला, संस्कृति एवं युवा विभाग द्वारा मनोनीत खेल विशेषज्ञ ः- सदस्य (ङ) सामान्य प्रशासन विभाग द्वारा मनोनीत अनुसूचित जाति/जनजाति के उप-सचिव से अन्यून स्तर के पदाधिकारी ः- सदस्य

(vii) निर्धारित शैक्षणिक अर्हता तथा चयनित खेल विधाओं संबंधी अर्हता प्राप्त उत्कृष्ट खिलाड़ी की नियुक्ति हेतु खिलाड़ियों की मेधा सूची निम्न प्रकार तैयार की जायेगी :-

(क) अनुसूची-1 के 'ए-1' एवं 'ए-2' पर वर्णित खेल प्रतियोगिताओं में शामिल खेल विधाओं में प्रथम/द्वितीय/तृतीय पुरस्कार/अन्य पुरस्कार प्राप्त करने वाले अथवा भारत की तरफ से उक्त प्रतियोगिता में सहभागी रहने वाले खिलाड़ियों को प्राथमिकता के आधार पर मेधा सूची में सबसे ऊपर रखा जायेगा ।

(ख) अनुसूची-1 के 'ए-3', 'ए-4', 'ए-5', 'ए-6', 'ए-7' एवं 'ए-8' में वर्णित खेल प्रतियोगिताओं के खिलाड़ियों की मेधा सूची अनुसूची-2 में निर्धारित अंकों के आधार पर प्राप्त कुल अंको के आधार पर तैयार की जायेगी।

(viii) किसी एक खिलाड़ी के द्वारा कई उपलब्धियाँ प्राप्त किए जाने की स्थिति में विज्ञापन प्रकाशन की तिथि से पॉंच वर्षों पूर्व तक की उनके तीन सर्वश्रेष्ठ उपलब्धि के आधार पर प्राप्त कुल अंकों के आधार पर चयन किया जायेगा।

(ix) उपर्युक्त खेल उपलब्धियों के आधार पर दो या दो से अधिक खिलाड़ियों के द्वारा धारित योग्यता/अंक समान रहने की स्थिति में चयन हेतु निम्नांकित प्राथमिकता विधि अपनाई जायेगी :- (क) नये रिकार्ड बनाने की स्थिति में संबंधित खिलाड़ी को प्राथमिकता दी जायेगी। (ख) व्यक्तिगत उपलब्धि टीम उपलब्धि से बड़ी मानी जायेगी। (ग) अनुसूची-1 में उल्लिखित क्रम में उच्चस्तरीय प्रतियोगिता की उपलब्धि को प्राथमिकता दी जायेगी।

(घ) चालू वर्ष में प्राप्त उपलब्धि को प्राथमिकता दी जायेगी। (ङ) उपर्युक्त प्रक्रिया के अपनाए जाने के बावजूद योग्यता/अंक के समान रहने पर जन्म तिथि को वरीयता दी जायेगी।

(च) यदि कंडिका-4(ix)(क), (ख), (ग), (घ) एवं (ड.) द्वारा अपनायी गयी प्रक्रिया के बावजूद दो या दो से अधिक खिलाड़ियों के द्वारा धारित योग्यता/अंक समान रह जाता है तो विहित शैक्षणिक योग्यता के अंक प्रतिशत के आधार पर चयन किया जायेगा। (x) टीम प्रतिस्पर्द्धा में अर्हता प्राप्त टीम के सभी सदस्यों के द्वारा नियुक्ति हेतु आवेदन दिये जाने की स्थिति में उपर्युक्त कंडिका 4(ix) में वर्णित शर्त्तों के अनुसार चयन की प्रक्रिया अपनायी जायेगी। (xi) किसी एक खेल विधा में, एक वर्ष में पाँच से अधिक उत्कृष्ट खिलाड़ियों की नियुक्ति नहीं की जायेगी ।

निःशक्त खिलाड़ियों के लिए आयोजित मान्यता प्राप्त सभी खेल विधाओं को एक ही खेल विधा मानते हुए नियुक्ति के लिए समेकित रूप से विचार किया जायेगा एवं कुल रिक्तियों की अधिकतम तीन प्रतिशत उत्कृष्ट खिलाड़ियों की नियुक्ति पर विचार की जायेगी।

(xii) नियमावली के तहत विभिन्न प्रतियोगिताओं में प्राप्त उपलब्धि के आलोक में परिशिष्ट-2 में प्रतियोगिता की कोटि के अनुसार निर्धारित अंकों के आधार पर तैयार औपबंधिक मेधा सूची प्रकाशित की जायेगी। किसी प्रकार की आपत्ति मेधा सूची के प्रकाशन के 15 दिनाें के अंदर प्रधान सचिव/सचिव सामान्य प्रशासन विभाग को समर्पित किया जा सकेगा। प्राप्त आपत्तियों की जाँच कंडिका 4(vi) के द्वारा गठित समिति के द्वारा की जाएगी एवं जाँच के पश्चात्‌ प्रत्येक कोटि एवं पद के लिए अंतिम मेधा सूची जारी की जायेगी, जिसके आधार पर वरीयता क्रम से नियुक्ति की जायेगी। अंतिम मेधा सूची, जारी किये जाने की तिथि से अगले एक वर्ष तक के लिए मान्य होगी । (xiii) चयन समिति के द्वारा उत्कृष्ट खिलाड़ियों की नियुक्ति हेतु तैयार की गयी मेधा सूची को सामान्य प्रशासन विभाग, बिहार, पटना को भेजा जायेगा । सामान्य प्रशासन विभाग के द्वारा प्रमाण पत्रों के सत्यापन के उपरान्त प्राप्त रिक्तियों की अधियाचना के आधार पर मेधा सूची में अंकित उत्कृष्ट खिलाड़ियों की सूची संबंधित नियुक्ति प्राधिकारों को भेजी जायेगी ।(cid:1)बहार गजट (असाधारण), 4444 (दस*ब(दस*ब(दस*ब(दस*बर र र र 2014201420142014 4 5. उम्र सीमा :-

नियुक्ति हेतु राज्य सरकार (सामान्य प्रशासन विभाग) द्वारा समय-समय पर निर्धारित उम्र सीमा का प्रावधान लागू होगा ।

6. सेवा शर्त्तें :-

इस नियमावली के प्रावधानों के आलोक में नियुक्त उत्कृष्ट खिलाड़ियों पर बिहार सरकारी सेवकों के लिए निर्धारित सेवा शर्त्तें लागू होंगी।

7. निरसन एवं व्यावृति :-

तत्कालीन कार्मिक एवं प्रशासनिक सुधार विभाग के पत्रांक 3792 दिनांक 14.03.1973, संकल्प संख्या 1086 दिनांक 20.01.1979 एवं बिहार उत्कृष्ट खिलाड़ियोें की नियुक्ति नियमावली, 2009 (वर्ष 2012 तक यथासंशोधित) में उत्कृष्ट खिलाड़ी की नियुक्ति से संबंधित सभी अनुदेश निरसित समझे जायेंगे। ऐसा निरसन के होते हुए भी उपर्युक्त परिपत्र/संकल्प/नियमावली के अधीन इस नियमावली के लागू होने के पूर्व की गयी कार्रवाई या किये गये किसी कार्य पर कोई प्रतिकूल प्रभाव नहीं पड़ेगा। 8. प्रकीर्ण :- किसी अन्य नियमावली में इस नियमावली के प्रतिकूल किसी बात के होने पर भी इस नियमावली के प्रावधानों का अभिभावी प्रभाव पड़ेगा।

9. कठिनाईयों का निराकरण :-

इस नियमावली के किसी उपबन्धों के कार्यान्वयन में होनेवाली कठिनाईयों के निराकरण के लिए समय-समय पर सरकार यथावश्यक सामान्य या विशेष निर्देश जारी कर सकेगी।

No. 9/Ni -18-01/2014-GAD-16646—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor of Bihar makes the following rules for appointment of outstanding sportsperson --- 1. Short title, extent and commencement:-

(i) These Rules may be called as the Bihar Outstanding Sportsperson Appointment Rules, 2014

(ii) It shall extend to the whole state of Bihar; (iii) It shall come into force at once.

2. Definitions:- In these rules unless the context otherwise requires:-

(i) 'Rules' means the Bihar Outstanding Sportsperson Appointment Rules, 2014; (ii) 'Government 'means the Government of Bihar; (iii) 'Year' means the financial year i.e. from 1st April to 31st March of next year; (iv) 'Appointing Authority' means Appointing authority as defined in the concerned Service/Cadre Rules;

(v) 'Selected sports discipline' means Sports discipline of the sports competition as described in the schedule 1. Time to time, necessary amendments in the said sports disciplines may be done by the State Government on the recommendation of Arts, Culture and Youth department of Bihar, Patna; (vi) 'Competition' means competitions described in schedule 1. Time to time, necessary amendments may be done in the said list by the State Government; (vii) 'Personal Competition' means such competitions in which the achievement has been due to the personal efforts;

(viii) 'Team Competition' means such competition in which achievement has been due to efforts of more than one sportsperson as a sports team;

(ix) 'Representation of State' means the sportsperson representing the state of Bihar.

(x) 'Representation of Universities' means sportsperson representing the recognised university recognized in the State of Bihar.

3. Qualifications:- Under these rules the sportsperson having the following qualifications shall be suitable for appointment in the category of outstanding sportsperson under the services of the state government, who (i) is the resident of Bihar State ,and (ii) (a) has obtained first/second/third/ other prize or has participated in the said competition as a player representing India in the games competition of the sports discipline in category A1 as described in schedule 1 of the Rules, (b) has obtained first/second/third/other prize or has participated as a player in the said competitions representing India in the games competition of the sports disciplines in the category A2 as described in the schedule 1 of the Rules, or

(c) ) has obtained first/second/third/other prize or has participated as a player in the said competitions representing India in the games/ competition of the sports disciplines in the category A3 as described in the schedule 1 of the Rules, or

(d) has obtained first/second/third prize or has participated as a player in three consecutive years as state representative in the games/ competitions of the sports disciplines in category A4, A5 as described in schedule 1 of the Rules, or

(e) has obtained first/second/third prize in games/competitions of the sports disciplines in category A6, A7 and A8 as described in schedule 1 of the Rules, and

(iii) has the minimum educational qualification or equivalent to graduation for appointment in group 'B', Intermediate for appointment in group 'C' and Matriculation for appointment in group 'D'.

4. Selection procedure:-

(i) Appointment in selected sports discipline of the outstanding sports persons shall be done within 10% of total strength (basic grade) of any cadre.

(ii) Provisions of the horizontal reservation (quota under quota) shall be applied in the appointment of outstanding sportspersons. The selected sportspersons shall be counted in the same category of reservation from which category they belong, i.e. selected sportsperson of the reserved category shall be counted in the relevant reservation category and those of unreserved category shall be counted under unreserved category.

(iii) On the basis of the achievement in the selected sports disciplines and prescribed educational qualification appointment shall be made in the Bihar Secretariat Clerical service, Collectorate regional Clerical cadre and on the other posts of group 'C' and 'D' under the state government. In a case of obtaining First/Second/Third prize in games competition of A-1, A-2 and A-3 described in Annexure-1 and having required educational qualification by a sportsperson, appointment may be made on Group B posts also, but sanction of State Government shall be necessary for such appointments.

(iv) Advertisement shall be published by the General Administration Department after obtaining vacancies from all the departments/offices.

(v) After scrutiny of the applications received on the basis of the advertisement published by the General Administration Department, merit list of candidates shall be prepared by the selection committee constituted by the state government on the basis of interview, achievement of the candidate in the selected sports discipline and prescribed educational qualification.

(vi) For selection of outstanding sportspersons, the following shall be the Chairman/members of the selection committee constituted by the state government:- (a) Principal Secretary/Secretary, - Chairman General Administration Department

(b) Secretary, Art, Culture and youth Department - Member (c) Director General, Bihar Sports Authority - Member (d) Sports specialist nominated by the - Member Art, Culture and youth Department

(e) An officer not below the rank of Deputy - Member Secretary belonging to SC/ST nominated by the General Administration Department

(vii) For the appointment of outstanding sportspersons having prescribed educational qualification and sports qualification in the selected sports discipline, merit list shall be prepared in the following manner:- (a) Sportsperson having obtained first/second/third/other prize or having participated as a player in those competition representing India in the sports competition described in A-1 and A-2 of schedule-1 shall be placed at the top of the merit list.

(b) Merit list of sportspersons of sports discipline of sports competition described in A-3, A-4, A-5, A-6, A-7 and A-8 of schedule-1, shall be prepared on the basis of total marks obtained on the basis of marks determined in schedule-2.

(viii) In case of having obtained several achievements by a sportspersons, selection shall be made on the basis of his/her best three achievements during the prior five years from the date of the publication of the advertisement.

(ix) In case of two or more than two sportspersons having the same marks on the basis of the said sports achievements, the following priority shall be adopted for selection:- (a) Priority shall be given to the concerned sportspersons making new record,

(b) The personal achievement shall be treated as larger against the team achievement ,

(c) Priority shall be given to the high level competition described serially in schedule-1.

(d) The achievement of current year shall be given priority, (e) Qualification/marks remaining the same despite adopting the above said process, seniority shall be given to the date of birth,8 (cid:1)बहार गजट (असाधारण), 4444 (दस*ब(दस*ब(दस*ब(दस*बर र र र 2014201420142014 (f) Despite adopting the processes of para 4(ix)(a)(b)(c)(d)(e) If qualifications/marks of two or more than two sportspersons remain the same then selection shall be made on the basis of the percentage of marks of the prescribed educational qualification.

(x) In case of all the members of a Team qualified in Team Event, apply for appointment, selection procedure shall be adopted as described in the above mentioned para 4(ix).

(xi) Not more than five outstanding sportspersons in any one sports disciplines shall be appointed in one year. All recognized sports disciplines organized for physically handicapped sportspersons shall be treated as one sports discipline collectively for the purpose of appointment and appointment shall be made on maximum of three percent of the total vacancy.

(xii) Provisional merit list prepared on the basis of achievements in different competition as per the prescribed marks of the category of competitions in schedule 2 of the rules, shall be published. Any objection may be submitted to the Principal Secretary/Secretary of the General Administration Department within 15 days of the publication of the merit list. Received objections shall be examined by the committee constituted under para 4(vi) and the final merit list of every category and post shall be issued after the scrutiny, on the basis of which appointment shall be made on seniority basis. The final merit list shall be valid for one year from date of its publication.

(xiii) Merit list prepared by the selection committee for appointment of outstanding sportspersons shall be sent to the General Administration Department. After verification of the certificates, list of the outstanding sportspersons shall be sent by the General Administration Department to the concerned appointing authority on the basis of the vacancies as per their requisitions.

5. Age limit:-

Provisions of the age limit for appointment as prescribed by the state government (General Administration Department) shall be applicable.

6. Service Conditions:-

Service conditions for the Bihar Government Servants shall be applicable to the outstanding sportspersons appointed under the provisions of the Rules.

7. Repeal and Savings:-

Letter no 3792 dated 14.03.1973, resolution no 1086 dated 20.01.1979 and all directions regarding appointment of outstanding sportspersons in "The Bihar Outstanding Sportspersons Appointment Rules, 2009 (as amended up to year 2012) shall be deemed to be repealed. Notwithstanding such repeal, anything done or any action taken under the said circular/resolution/rules/instructions prior to coming into force of these rules shall have no adverse effect.

8. Miscellaneous:-

Notwithstanding contained anything contrary to these Rules in any other Rules, provision of these Rules shall have overriding effect.

9. Removal of difficulties:-

The Government may, from time to time, issue such general or special directions as may be necessary to remove difficulties in the operation of any of the provisions of these Rules.
