(ख) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा।

ा निदेशक, उपयोगी अनुसंधान, बिहार।2 (cid:1)बहार गजट (असाधारण), 11111111 'दस)ब'दस)ब'दस)ब'दस)बर र र र 2014201420142014 3333.... संवर्ग का गठन ।संवर्ग का गठन ।संवर्ग का गठन ।संवर्ग का गठन ।....----(1) संवर्ग में कृषि प्रयोगशाला सहायक (मिट्टी जाँच, उर्वरक एवं कीटनाशी प्रयोगशाला) के पद होंगे। सरकार द्वारा समय-समय पर कृषि विभाग के अधीन अन्य प्रयोगशालाओं के प्रयोगशाला सहायकों का पद इस संवर्ग में सम्मिलित किया जा सकेगा।
(2) कृषि प्रयोगषाला सहायक का पद राज्य स्तर का होगा तथा कृषि विभाग इस संवर्ग का प्रशासी विभाग होगा।
(3) कृषि प्रयोगशाला सहायकों को सरकार द्वारा समय-समय पर स्वीकृत वेतनमान देय होगा। संवर्ग का मूल पद प्रयोगशाला सहायक का होगा।

(2) प्रति वर्ष 1 ली अप्रैल की रिक्ति के आधार पर संवर्ग में स्वीकृत पदों पर सीधी नियुक्ति के लिए रिक्त पदों की गणना की जाएगी और 30 अप्रैल तक आरक्षण कोटिवार अधियाचना नियुक्ति प्राधिकार द्वारा आयोग को भेज दी जायेगी।
¼3333½ शैक्षणिक योग्यता ः-शैक्षणिक योग्यता ः-शैक्षणिक योग्यता ः-शैक्षणिक योग्यता ः- इस संवर्ग में नियुक्ति के लिए शैक्षणिक योग्यता मान्यता प्राप्त बोर्ड/ विष्वविद्यालय से इन्टरमीडिएट (102) (विज्ञान) उर्त्तीण होगी।
5555.... सीधी नियुक्ति ।सीधी नियुक्ति ।सीधी नियुक्ति ।सीधी नियुक्ति ।....----(क) सीधी नियुक्ति :-सीधी नियुक्ति :-सीधी नियुक्ति :-सीधी नियुक्ति :- आयोग द्वारा संचालित प्रतियोगिता परीक्षा के आधार पर अनुषंसित अभ्यर्थियों के बीच से की जायेगी ।
(ख) mez lhek ।& आवेदन आमंत्रित करने वाले वर्ष के पहली अगस्त को न्यूनतम आयु 21 (इक्कीस) वर्ष होगी और अधिकतम उम्र सीमा वही होगी जो सामान्य प्रशासन विभाग द्वारा राज्य सरकार की सेवाओं में सीधी भर्ती के लिए समय-समय पर अवधारित की जायेगी, परन्तु विशेष परिस्थिति में उसका कारण अभिलिखित करते हुए विभाग इसे बढ़ा सकेगा।
(ग) आरक्षण ः- आरक्षण ः- आरक्षण ः- आरक्षण ः- सामान्य प्रषासन विभाग द्वारा राज्य सरकार की सेवाओं में सीधी नियुक्ति के लिए समय-समय पर अवधारित आरक्षण प्रावधान लागू होंगे ।
(घ) सीधी नियुक्ति हेतु विभाग द्वारा सामान्य एवं आरक्षण कोटिवार रिक्तियों की संख्या के साथ अधियाचना प्रत्येक वर्ष आयोग को भेजी जाएगी ।
(ड़) प्रतियोगिता परीक्षा आयोग द्वारा संचालित की जाएगी एवं सुयोग्य अभ्यार्थियों का मेघा क्रम मे चयन पर विभाग को अनुषंसा करेगी ।
(च) आयोग द्वारा उक्त प्रक्रिया के तहत आरक्षण रोस्टर के अनुसार तैयार किये गये मेधा सूची की प्रति नियुक्ति प्राधिकार को उपलब्ध करायी जाएगी, जहाँ नियुक्ति प्राधिकार द्वारा इस सेवा में नियुक्ति की जाएगी ।
6666.... परिवीक्षा।परिवीक्षा।परिवीक्षा।परिवीक्षा।....----(1) संवर्ग में सीधी भर्ती से नियुक्त प्रत्येक सदस्य पदग्रहण की तिथि से दो वर्षो की अवधि के लिए परिवीक्षाधीन होगा। किन्तु, विषेष परिस्थिति में कारण अभिलिखित करते हुए यह अवधि विभाग के द्वारा एक वर्ष तक बढ़ाई जा सकेगी। यदि बढ़ाई गयी अवधि में भी उसका कार्य संतोषप्रद नहीं हो तो उसकी सेवा सरकार द्वारा बिना कारण पृच्छा के समाप्त की जा सकेगी, परन्तु इसकी लिखित सूचना कारण सहित उसे दी जाएगी । 7777.... प्रषिक्षण ।प्रषिक्षण ।प्रषिक्षण ।प्रषिक्षण ।....----विभाग सेवाकालीन प्रषिक्षण की व्यवस्था करेगा तथा इस प्रयोजनार्थ समय-समय पर पाठ्यक्रम अवधारित करेगा ।
8888.... विभागीय परीक्षा ।विभागीय परीक्षा ।विभागीय परीक्षा ।विभागीय परीक्षा ।....----(1) कृषि विभाग प्रतिवर्ष विभागीय परीक्षा आयोजित करेगा ।3 (cid:1)बहार गजट (असाधारण), 11111111 'दस)ब'दस)ब'दस)ब'दस)बर र र र 2014201420142014 (2) इस सेवा संवर्ग में सम्पुष्टि, वार्षिक वेतनवृद्वि एवं प्रोन्नति आदि के लिए राजभाषा विभाग द्वारा आयोजित हिन्दी टिप्पणी-प्रारूपण, विभागीय दक्षता परीक्षा तथा कम्प्यूटर सक्षमता परीक्षा में उर्त्तीणता आवश्यक होगी ।
(3) मूल कोटि के वेतनमान् में द्वितीय वेतनवृद्वि विभागीय परीक्षा उर्त्तीणता एवं सेवा सम्पुष्टि के बाद ही देय होगी ।
(4) कर्मियों की वेतन वृद्वि में यह रूकावट असंचयात्मक होगी और परीक्षा में उर्त्तीणता के उपरान्त रोकी गयी वेतन वृद्वियाँ दे दी जाएगी ।
9999.... सेवा सम्सेवा सम्सेवा सम्सेवा सम्पुष्टि ।पुष्टि ।पुष्टि ।पुष्टि ।....----परिवीक्षा की समाप्ति, विभागीय परीक्षा में उत्तीर्णता कम्प्युटर सक्षमता जाँच परीक्षा में उत्तीर्णता तथा अवधारित प्रषिक्षण कार्यक्रम में सफलतापूर्वक पूर्ण किये जाने पर तथा सेवा स्वच्छ पाये जाने पर परिवीक्षाधीन प्रयोगशाला सहायको को सम्पुष्ट किया जा सकेगा।
10101010 वरीयता का अवधारण।वरीयता का अवधारण।वरीयता का अवधारण।वरीयता का अवधारण।....----वरीयता का अवधारण सामान्य प्रशासन विभाग द्वारा अवधारित नीति के आलोक में किया जायेगा।
11111111.... izdh.kZ & dfBukbZ dk fujkdj.kA-&(1) विभाग इस नियमावली के किसी नियम का निर्वचन सामान्य प्रशासन विभाग/विधि विभाग/वित्त विभाग के परामर्श से करने में सक्षम होगा।
(2) विभाग इस नियमावली के किसी नियम को लागू करने में आने वाली कठिनाई का निराकरण राजपत्र में समुचित आदेश, जो इस नियमावली के प्रावधानों से असंगत न हो, द्वारा कर सकेगा। (3) जिन विषयों या बिन्दुओं का प्रावधान इस नियमावली में नहीं है, उनके सम्बन्ध में राज्य सरकार द्वारा तत्समय प्रवृत संहिता/नियमावली/संकल्प/अनुदेश में किये गये प्रावधान इस सेवा के संदर्भ में भी लागू होंगे।
12- fujlu ,oa O;ko`frA-&(1) इस संवर्ग के कर्मियों की नियुक्ति/सेवा शर्त्त संबंधी पूर्व में निर्गत सभी परिपत्र/अनुदेश/संकल्प एतद द्वारा निरसित किए जाते है।
(2) ऐसे निरसन के होते हुए भी, पूर्व निर्गत परिपत्र/अनुदेश/संकल्प के अधीन किया गया कुछ भी या की गयी कोई कार्रवाई इस नियमावली के अधीन किया गया या की गयी समझी जायगी मानों यह नियमावली उसदिन प्रवृत थी जब वैसा कुछ किया या वैसी कार्रवाई की गयी थी।

No. 06/Est-13/2014-1274 Ag.—In exercise of power conferred under proviso of article 309 of the Constitution of India, the Governor of Bihar is hereby pleased to make the following rules to regulate the procedure of appointment and promotion on the post of Laboratory Assistant :-
1. Short title, Extent and commencement.—(a) These rules shall be called Bihar Agriculture Laboratory Assistant Cadre Rules 2014 .
(b) It shall extend to the whole of state of Bihar.

2 Definition :- In these Rules, unless other wise requires in the context. :-
(i) "Department" means Agriculture department of the Government of Bihar.
(ii) "Cadre" means cadre of Agriculture Laboratory Assistant.
(iii) "Commission" means Bihar Staff Selection Commission.
(iv) "Appointing Authority means Joint Agriculture Director, Adaptive Research Bihar, Patna.
(v) "Cadre Controlling Authority" means Joint Agriculture Director, Adaptive Research, Bihar.
3. Constitution of Cadre .—(1) The post of Agriculture Laboratory Assistant ( Soil Testing, Fertilizer and Insecticide Laboratory) shall be in the cadre . The Government may time to time include the post of Laboratory Assistant of other Elaborative under the Agriculture Department.
(2) The post of Agriculture Laboratory Assistant shall be a state level post and Agriculture department shall be the administrative department of the cadre.
(3) Agriculture Laboratory Assistant shall be given the pay scale as allowed by the State Govt. time to time.
Laboratory Assistant shall be the basic post of the cadre.
4. Appointment in basic category.—(1) Post of basic cadre shall be filled up by direct appointment.
(2) The calculation of vacant posts for direct appointment against the sanctioned posts of cadre, shall be made on the basis of 1th April every year and by 30th of April, the appointing authority shall send requisition reservation category wise to the Commission.
(3) Academic Qualification- To be appointed in this cadre, the required academic qualification will be Intermediate (10+2) science, from a recognized Board/University
5. (a) Direct appointment.—Direct appointment shall be made from amongst the candidates recommended on the basis of Competitive Examination conducted by the Commission.
(b) Age limit – minimum age shall be 21 ( twenty one) years on 1st August of the year inviting the application and the maximum age limit shall be the same as may be determined from time to time, by the Department of General Administration for5 (cid:1)बहार गजट (असाधारण), 11111111 'दस)ब'दस)ब'दस)ब'दस)बर र र र 2014201420142014 direct appointment in the services of the state but in special circumstances, the department may increase it recording reasons for the same.
(c ) Reservation- The provisions for reservation determined by the Department of General Administration, from time to time for direct appointment in the services of state, shall apply .
(d) For direct appointment, requisition along with number of general and category wise vacancies shall be sent to the commission every year by the Department.
(e) The competitive examination shall be conducted by the commission and the commission shall recommend the suitable candidates to the department on the basis of merit list.
(f) The merit list prepared by the commission as per reservation roster under the aforesaid procedure , shall be made available to the appointing authority by it, whereas the appointing authority shall make appointments in this service.
6. Probation.—(1) Every member appointed by direct recruitment in the cadre , shall be on probation for the period of 2 years from the date of his Joining but in special circumstances, this period may be extended up-to one year recording the reasons. If in the said extended period also his performance is not satisfactory, he may be terminated from his services, by the Government, without asking any show cause , but he shall be given its written notice with reasons.
7 Training :- The department shall organize training during the service period and for this purpose, at regular interval it shall determine syllabus for training .
8. Departmental Examination.—(1) The Agriculture department shall conduct departmental examination every year.
(2) For confirmation of service, annual increment and promotion in this service cadre, the employees shall have to pass Hindi noting and drafting examination conducted by Rajbhasha department, departmental efficiency test, and computer competency test compulsorily.
(3) Second increment in the pay scale of basic grade shall be admissible only after passing examination and getting services confirmed.
(4) This held- up increment of the employees shall be non cumulative and shall be payable after passing in the examination.
9. Confirmation of service.—The services of the probationer laboratory assistant appointed directly , shall be confirmed against permanent post of basic category in6 (cid:1)बहार गजट (असाधारण), 11111111 'दस)ब'दस)ब'दस)ब'दस)बर र र र 2014201420142014 the cadre, only after completing probation period, passing in the Departmental Examination, computer competency test and completing the prescribed training successfully and their services being found untainted.
10. Determination of seniority.—The seniority of a member shall be determined in the light of policy determined by the Department of General Administration.
11 Miscellaneous – Removal of difficulties.—(1) The department shall be competent to interpret any rule of these rules in consultation with the Department of General Administration/ Law Department/ Finance Department.
(2) The department may remove the difficulty, in implementation of any of these rules, by publication of appropriate order in the official Gazette which is not inconsistent with these Rules.
(3) In respect of such subjects or points for which the provisions are not made in these rules, the provisions laid down in Code/ Rules / resolutions/ instruction, into force for the time being by the State Government shall apply in the context of this service also.
12. Repeals and savings.—(1) All circulars/instructions/resolutions in respect of the appointment/service conditions of the employees of this cadre, are hereby repealed.
(2) Notwithstanding such repeal, any thing done or any action taken under any circular/ instruction/ resolution, issued earlier shall be deemed to be done or taken under these Rules as if these Rules were in force when such thing was done or such action was taken.
