1111.... संक्षिप्त नाम तथा प्रारम्भ्संक्षिप्त नाम तथा प्रारम्भ्संक्षिप्त नाम तथा प्रारम्भ्संक्षिप्त नाम तथा प्रारम्भ :-ा :-ा :-ा :- (i) यह आदेष निर्वाचन प्रतीक (आरक्षण तथा आबंटन) (संषोधन) आदेष, 2015 कहा जाएगा। (ii) यह तत्काल प्रभाव से प्रवृत होगा। 2222.... पैरा 10 ख का प्रतिस्थापनपैरा 10 ख का प्रतिस्थापनपैरा 10 ख का प्रतिस्थापनपैरा 10 ख का प्रतिस्थापन निर्वाचन प्रतीक (आरक्षण तथा आबंटन) आदेष, 1968 में विद्यमान पैरा 10ख के स्थान पर निम्नलिखित पैरा प्रतिस्थापित किया जाएगा, अर्थात :-

''10ख-रजिस्ट्रीकृत (अमान्यताप्राप्त) दलों और उन अमान्यताप्राप्त दलों जो 6 वर्श से अधिक पहले मान्यता प्राप्त दल थे, के द्वारा ''10ख-रजिस्ट्रीकृत (अमान्यताप्राप्त) दलों और उन अमान्यताप्राप्त दलों जो 6 वर्श से अधिक पहले मान्यता प्राप्त दल थे, के द्वारा ''10ख-रजिस्ट्रीकृत (अमान्यताप्राप्त) दलों और उन अमान्यताप्राप्त दलों जो 6 वर्श से अधिक पहले मान्यता प्राप्त दल थे, के द्वारा ''10ख-रजिस्ट्रीकृत (अमान्यताप्राप्त) दलों और उन अमान्यताप्राप्त दलों जो 6 वर्श से अधिक पहले मान्यता प्राप्त दल थे, के द्वारा किए गए अभ्यर्थियों के लिए रियायत। किए गए अभ्यर्थियों के लिए रियायत। किए गए अभ्यर्थियों के लिए रियायत। किए गए अभ्यर्थियों के लिए रियायत।

''पैरा 12 के उप-पैरा (3) के खंड (ख) के प्रावधानों की शर्त के अधीन, किसी रजिस्ट्रीकृत अमान्यताप्राप्त राजनैतिक दल द्वारा किसी राज्य की विधान सभा या लोक सभा के साधारण निर्वाचन में खड़े किए गए अभ्यर्थियों को एक समान प्रतीक आबंटित किए जा सकते हैं बषर्ते निम्नलिखित शर्तों की पूर्ति करते हों :-

(क) विधान सभा के साधारण नि(क) विधान सभा के साधारण नि(क) विधान सभा के साधारण नि(क) विधान सभा के साधारण निर्वाचन में -र्वाचन में -र्वाचन में -र्वाचन में -

(i) राजनीतिक दल राज्य में विधान सभा निर्वाचन-क्षेत्रों के कम से कम 5% (पांच प्रतिषत) विधान सभा निर्वाचन-क्षे़त्रों पर और यदि राज्य विधान सभा में चालीस या इससे कम सीटें हो, तो कम से कम 3 निर्वाचन क्षेत्रों मे अपने अभ्यर्थी खड़ा करेगा;

(ii) विधान सभा की सामान्य कार्य-अवधि पूरी होने पर निर्वाचन होने के मामले में उस दल द्वारा निर्वाचन लड़ने के अपने आषय की सूचना, उप खण्ड (i) के अधीन विधान सभा की कार्य अवधि पूरी होने की तारीख से छह महीने पहले शुरू होने वाली अवधि के दौरान कभी भी और अधिकतम निर्वाचन की अधिसूचना (या चरणबद्ध निर्वाचनों के मामले में पहली अधिसूचना) जारी किए जाने के लिए निर्धारित तारीख से पांच पूर्ण दिवस पहले, आयोग को दे दी जाती है;

(iii) अपने सामान्य कार्यकाल से पहले विधानसभा के भंग होने की दषा में दल द्वारा उप खण्ड (i) के अधीन अपने आषय के संबंध में सूचना विधानसभा के भंग होने की तिथि से किसी भी समय और अधिकतम उस तारीख से जिस तारीख से निर्वाचन की अधिसूचना (या चरणबद्ध निर्वाचनों के मामले में पहली अधिसूचना) जारी किए जाने के लिए निर्धारित हो, पांच पूर्ण दिवस पहले आयोग को सूचना दे दी जाती है;

(iV) दल इस आदेष के पैरा 17 के अन्तर्गत आयोग द्वारा अधिसूचित मुक्त प्रतीकों की सूची में से, वरीयता क्रम में, दस प्रतीकों के नाम देगाः

बशर्ते कि कोई दल, यदि ऐसी इच्छा व्यक्त करता है, अपने अभ्यर्थियों के आबंटन के लिए प्रतीक के नामों तथा सुस्पश्ट डिजाइन एवं आरेखों के साथ अपने पसंद के तीन नए प्रतीकों का भी, वरीयता क्रम में, प्रस्ताव करे जिस पर आयोग एक ही प्रतीक आबंटित करने पर विचार कर सकता है जब उसका यह अभिमत हो जाए कि ऐसे प्रतीक को आबंटित करने में उसे कोई आपत्ति नहीं है :

बषर्ते यह भी कि दलों द्वारा प्रस्तावित प्रतीकों का मौजूदा आरक्षित प्रतीकों या मुक्त प्रतीकों से न तो कोई सादृष्य हो और न ही कोई धार्मिक या सांप्रदायिक स्वगुणार्थ हो या किसी पक्षी या पशु का वर्णन करता हो;

बषर्ते यह भी कि नए प्रतीक के लिए किसी भी प्रस्ताव पर आयोग द्वारा तब तक कोई विचार नहीं किया जाएगा जब तक उसे संबंधित विधानसभा की कार्य अवधि समाप्त होने की तिथि से कम से कम तीन महीने पहले या विधानसभा के समय-पूर्व भंग किए जाने के एक महीने के भीतर, जैसा भी मामला हो, न दिया गया हो;

(V) दल यह वचन-पत्र भी दे कि यदि दल उपर शर्त (i) में यथा-विहित निर्वाचन-क्षेत्रों की न्यूनतम संख्या में अभ्यर्थियों को खड़ा नहीं करता है तो उसके अभ्यर्थी प्रतीकों के आबंटन की तिथि के दिन उन्हें एक ही प्रतीक आबंटित किए जाने के हकदार नहीं होंगे; और, इसके अतिरिक्त दल आयोग द्वारा उपयुक्त समझी जाने वाली दण्डात्मक कार्रवाई का भागी भी बनेगा।

(Vi) दल जिन निर्वाचन-क्षेत्रों में अभ्यर्थी खड़े कर रहा है उनकी क्रम संख्याओं और नामों वाली सूची आयोग को उस तिथि से जिस तिथि से निर्वाचन की अधिसूचना (या चरणबद्ध निर्वाचनों के मामले में पहली अधिसूचना) जारी किए जाने के लिए निर्धारित हो, पांच पूर्ण दिवस पहले प्रस्तुत की जाए।

(ख) लोक सभा के सामान्य निर्वाचन में-(ख) लोक सभा के सामान्य निर्वाचन में-(ख) लोक सभा के सामान्य निर्वाचन में-(ख) लोक सभा के सामान्य निर्वाचन में-

(i) दल उस राज्य में कम से कम न्यूनतम दो संसदीय निर्वाचन-क्षेत्रों में अभ्यर्थी खड़े करे जिसमें वह अपने अभ्यर्थियों के लिए एकसमान प्रतीक का आबंटन चाहता है;

(ii) एकल संसदीय निर्वाचन-क्षेत्र वाले राज्यों में कोई दल जो उपर्युक्त खंड (i) के अनुसार दूसरे राज्य में एक समान प्रतीक के लिए आवेदन करता है, एकल संसदीय निर्वाचन-क्षेत्र वाले वैसे राज्यों में उसी प्रतीक के आबंटन के लिए भी आवेदन कर सकता है;

(iii) लोक सभा की सामान्य कार्य अवधि पूरी होने पर निर्वाचन होने के मामले में उस दल द्वारा निर्वाचन लड़ने के अपने आषय की सूचना, उप खण्ड (i) के अधीन लोक सभा की कार्य अवधि पूरी होने की तारीख से छह महीने पहले शुरू होने वाले अवधि के दौरान कभी भी और अधिकतम उस तारीख से जिस तारीख से निर्वाचन की अधिसूचना (या चरणबद्ध निर्वाचनों के मामले में पहली अधिसूचना) जारी किए जाने के लिए निर्धारित हो, पांच पूर्ण दिवस पहले आयोग को सूचना दे दी जाती है;

(iV) अपने सामान्य कार्यकाल से पहले लोक सभा के भंग होने की दषा में दल द्वारा उप खण्ड (i) के अधीन अपने आषय के संबध में सूचना लोक सभा के भंग होने की तिथि से किसी भी समय और अधिकतम उस तारीख से जिस तारीख से निर्वाचन की अधिसूचना (या चरणबद्ध निर्वाचनों के मामले में पहली अधिसूचना) जारी किए जाने के लिए निर्धारित हो, पांच पूर्ण दिवस पहले आयोग को सूचना दे दी जाती है;

(v) दल इस आदेष के पैरा 17 के अन्तर्गत आयोग द्वारा अधिसूचित मुक्त प्रतीकों की सूची में से, वरीयता क्रम में, दस प्रतीकों के नाम देगाः

बशर्ते कि कोई दल, यदि ऐसी इच्छा व्यक्त करता है, अपने अभ्यार्थियों के आबंटन के लिए प्रतीक के नामों तथा सुस्पश्ट डिजाइन एवं आरेखों के साथ अपने पसंद के तीन नए प्रतीकों का भी, वरीयता क्रम में, प्रस्ताव करे जिस पर आयोग एक ही प्रतीक आबंटित करने पर विचार कर सकता है जब उसका यह अभिमत हो जाए कि ऐसे प्रतीक को आबंटित करने में उसे कोई आपत्ति नहीं है :

बषर्ते यह भी कि दलों द्वारा प्रस्ताविक प्रतीकों का मौजूदा आरक्षित प्रतीकों या मुक्त प्रतीकों से न तो कोई सादृष्य हो और न ही कोई धार्मिक या सांप्रदायिक स्वगुणार्थ हो या किसी पक्षी या पशु का वर्णन करता हो;

बषर्ते यह भी कि नए प्रतीक के लिए किसी भी प्रस्ताव पर आयोग द्वारा तब तक काई विचार नहीं किया जाएगा जब तक उसे संबंधित लोक सभा की कार्य अवधि समाप्त होने की तिथि से कम से कम तीन महीने पहले या लोक सभा के समय-पूर्व भंग किए जाने के एक महीने के भीतर, जैसा भी मामला हो, न दिया गया हो;

(Vi) दल यह वचन-पत्र भी दे कि यदि दल उपर शर्त (i) में यथा-विहित निर्वाचन-क्षेत्रों की न्यूनतम संख्या में अभ्यार्थियों को खड़ा नहीं करता है तो उसके अभ्यर्थी प्रतीकों के आबंटन की तिथि के दिन उन्हें एक ही प्रतीक आबंटित किए जाने के हकदार नहीं होगे, और इसके अतिरिक्त दल आयोग द्वारा उपर्युक्त समझी जाने वाली दण्डात्मक कार्रवाई का भागी भी बनेगा।

(Vii) दल जिन निर्वाचन-क्षेत्रों में अभ्यर्थी खड़े कर रहा है उनकी क्रम संख्याओें और नामों वाली सूची आयोग को उस तिथि से जिस तिथि से निर्वाचन की अधिसूचना (या चरणबद्ध निर्वाचनों के मामले में पहली अधिसूचना) जारी किए जाने के लिए निर्धारित हो, पांच पूर्ण दिवस पहले प्रस्तुत की जाए।

संदेह के निराकरण के लिए एतद्‌द्वारा यह स्पश्ट किया जाता है कि - (i) इस पैरा के अंतर्गत किसी पंजीकृत अमान्यताप्राप्त दल के अभ्यर्थियों को एक समान प्रतीक के आबंटन की छूट लोक सभा के किन्हीं भी दो साधारण निर्वाचनों में, या किसी राज्य विधान सभा के किन्हीं दो साधारण निर्वाचनों में, या लोक सभा के एक सारधारण निर्वाचन में और दूसरे एक राज्य विधान सभा के साधारण निर्वाचन में, दल जो भी विकल्प चुने, उपलब्ध होगी।

(ii) कोई दल जिसने दो अवसरों पर इस छूट का लाभ उठा लिया है, किसी अनुवर्ती साधारण निर्वाचन में भी छूट के लिए इस शर्त के अधीन पात्र होगा कि पिछले अवसर पर जब दल ने इस सुविधा का लाभ उठाया था तो संबंधित राज्य में साधारण निर्वाचन में उस दल द्वारा खड़े किए गए निर्वाचन लड़ने वाले सभी अभ्यर्थियों को मिले मतों की संख्या उस राज्य में डाले गए विधिमान्य मतों की कुल संख्या के एक प्रतिषत से कम न हो।

(iii) इस पैरा के अधीन किसी दल के अभ्यर्थियों को एक ही प्रतीक के रूप में आबंटित मुक्त प्रतीक अन्य दलों द्वारा खड़े किए गए अभ्यर्थियों या ऐसे निर्वाचन क्षेत्रों जिनमें उस दल ने अपने अभ्यर्थी खड़ें नहीं किए है, के निर्दलीय उम्मीदवारों को आबंटन के लिए उपलब्ध रहेगें;

(iV) इस पैरा के अधीन एक समान प्रतीक का आबंटन 'पहले आओ पहले पाओ' आधार पर किया जाएगाः बशर्ते कि यदि आयोग में एक ही तारीख को एक ही प्रतीक को अधिमान देते हुए दो या अधिक आवेदन प्राप्त होते हैं तो ऐसे दलों में से किसी एक को प्रतीक के आबंटन के प्रष्न का निर्णय आयोग के निदेषानुसार 'ड्रा' जैसी किसी विधि द्वारा किया जाएगा;

बषर्ते यह भी कि यदि एक ही प्रतीक जिसके लिए ऐसे दो से अधिक दलों ने अधिमान दिया है और एक ही तिथि को उनके आवेदन प्राप्त हुए हैं और इन दलों में से एक दल ऐसा है जिसे संबंधित राज्य में पिछले अवसर पर उक्त प्रतीक आबंटित किया गया था और दूसरा दल ऐसा है जिसे पिछले निर्वाचन में उक्त प्रतीक आबंटित नहीं किया गया था तो प्रतीक पूर्ववर्ती दल को आबंटित किया जाएगा; बषर्ते कि, इसके अतिरिक्त यदि समान प्रतीक के लिए अधिमान देने वाले दो या अधिक ऐसे दलों के एक ही तारीख को आवेदन प्राप्त हुए हैं, तथा दोनों और सभी ऐसे दलों को वह चुनाव प्रतीक जो पूर्व में सम्बन्धित राज्य में आवंटित किया गया था और उनमें से एक दल ऐसा है जिसके द्वारा अधिमान दिए गए प्रतीक पर लोक सभा या संबंधित राज्य की विधानसभा में निर्वाचित सदस्य हैं, तो अन्य दलों को छोड़ कर उस दल को वह प्रतीक आबंटित कर दिया जाएगा;

ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 25 अग(cid:29)त 2015 (V) यदि आयोग के लिए किसी कारणवष दल के अभ्यर्थियों को उन प्रतीकों की सूचि में से एक ही प्रतीक प्रदान करना संभव न हो जिसके लिए उन्होंने इस पैरा के अंतर्गत अपनी प्राथमिकता दी है तो वह उस पार्टी के परामर्ष से मुक्त प्रतीकों की सूची में से उस दल को कोई अन्य प्रतीक आबंटित कर सकता है।

(Vi) पैरा 10क में निहित किसी बात के होते हुए भी, कोई राजनैतिक दल जो पहले मान्यता प्राप्त राजनैतिक दल था तथा जिसने 6 से अधिक वर्श पहले अपनी मान्यता गंवा दी थी इस पैरा के अधीन उस प्रतीक, जो दल के मान्यता गंवा देने के छह वर्श पूरे होने के उपरान्त आयोजित लोक सभा या किसी राज्य की विधान सभा के साधारण निर्वाचन में उस दल के लिए आरक्षित था, के आबंटन की एक-बारगी छूट का पात्र होगा बषर्ते कि खण्ड (क) और (ख) के अन्तर्गत निर्दिश्ट शर्तो में से प्रत्येक शर्त, जैसा भी मामला हो, खण्ड (क) के उप खण्ड (iV) और खण्ड (ख) के उप खण्ड (V) में दी गई शर्त के सिवाय, पूरी की गई हों''।

आदेश से, वरिन्दर कुमार,वरिन्दर कुमार,वरिन्दर कुमार,वरिन्दर कुमार, सचिवसचिवसचिवसचिव,,,, भारत निर्वाचन आयोगभारत निर्वाचन आयोगभारत निर्वाचन आयोगभारत निर्वाचन आयोग।।।। ELECTION COMMISSION OF INDIA ——————— NOTIFICATION Nirvachan Sadan, Ashoka Road, New Delhi- 110001, Dated: 26th June, 2015/5 Asadha, 1937 (Saka) No.56/2015/PPS-II—In exercise of the powers conferred by Article 324 of the Constitution of India read with Rules 5 and 10 of the Conduct of Election Rules, 1961, the Election Commission of India hereby makes the following Order to further amend the Election Symbols (Reservation and Allotment) Order, 1968, namely:-

1. Short title and commencement

(i) This Order shall be called the Election Symbols (Reservation and Allotment) (Amendment) Order, 2015. (ii) It shall come into force with immediate effect.

2. Substitution of paragraph 10B

In the Election Symbols (Reservation and Allotment) Order, 1968, for the existing paragraph 10B, the following paragraph shall be substituted, namely:- "10B- Concession to candidates set up by registered (unrecognized) parties and to unrecognized parties which were earlier recognized parties more than 6 years back.

"Subject to the provisions of clause (b) of sub-paragraph (3) of paragraph 12, the candidates set up by a registered unrecognized political party at the general election to the Legislative Assembly of a State or to the House of the People, may be allotted a common symbol, subject to fulfilment of the following conditions :-

(A) At a general election to the Legislative Assembly-

(i) The party sets up candidates at least in 5% (five percent) of the assembly constituencies in the State, subject to a minimum of three constituencies in States having forty of less seats;

(ii) In the case of election on expiry of the normal term of the Legislative Assembly, the intimation with regard to its intention to contest election under sub-clause (i) is given by the party to the Commission at any time during the period commencing from the date six months prior to the date of expiry of the term of the Assembly and latest by five clear days before the date on which the notification (or the first of the notification in the case of a phased election) of the election is scheduled to be issued;

(iii) In the case of dissolution of the Legislative Assembly before the expiration of its normal term, the intimation with regard to its intention under sub- clause (i) is given by the party to the Commission at any time from the date of dissolution of the Legislative Assembly and latest by five clear days before the date on which the notification (or the first of the notifications in the case of a phased election) of the election is scheduled to be issued;

(iv) The party shall give the names of ten symbols, in order of preference, from out of the list of free symbols notified by the Commission under paragraph 17 of this Order:

Provided that a party may, if it so desires, also propose three new symbols of their choice, with the names and clear design and drawings of symbol, in the order of preference, for allotment to its candidates, which the Commission may consider for allotment as its common symbol it there is, in its opinion, no objection in allotting such symbol:

Provided further that the symbols proposed by the parties shall have no resemblance to the existing reserved symbols or free symbols, nor shall have any religious or communal connotation or depict any bird or animal:

Provided also that no proposal for a new symbol shall be entertained by the Commission unless it is made at least three before the date of expiry of term of the Assembly concerned, or within on month of the premature dissolution of the Assembly, as the case may be;

(v) The party also gives an undertaking that if the party does not set up candidates in the minimum number of the constituencies as prescribed in condition (i) above, its candidates shall not be entitled to allotment of a common symbol on the date of allotment of symbols to them; and, in addition, the party shall be liable for such punitive action as the Commission may consider appropriate;

(vi) The list containing the serial numbers and names of the constituencies where the party is setting up candidates is submitted to the Commission latest by 5 clear days before the date on which the notification (or first of the notifications in the case of a phased election) of the election is scheduled to be issued.

(B) At a general election to the House of the People-

(i) The party sets up candidates at least in a minimum of two parliamentary constituencies in the State, in which it seeks allotment of a common symbol to its candidates;

(ii) In the case of States with single parliamentary constituency, a party which applies for common symbol in terms of clause (i) above in another State, may also apply for allotment of the same symbol in such States with single parliamentary constituency;

(iii) In the case of election on expiry of the normal term of the House of the People, the intimation with regard to its intention to contest election under sub-clauses (i) and (ii) is given by the party to the Commission at any time during the period commencing from the date six months prior to the date of expiry of the term of the House of the People and latest by five clear days before the date on which the notification (or the first of the notifications in the case of phased election) of the election is scheduled to be issued;

(iv) In the case of dissolution of the House of the People before the expiration of its normal term, the intimation with regard to its intention under sub-clauses (i) and (ii) is given by the party to the Commission at any time from the date of dissolution of the House of the People and latest by five clear days before the date on which the notification (or the first of the notifications in the case of a phased election) of the election is scheduled to be issued;

ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 25 अग(cid:29)त 2015 (v) The party shall give the names of ten symbols, in order of preference, from out of the list of free symbols notified by the Commission under paragraph 17 of this Order;

Provided that a party may, if it so desires, also propose three new symbols of their choice, with the names and clear design and drawings of symbol, in the order of preference, for allotment to its candidates, which the Commission may consider for allotment as its common symbol if there is, in its opinion, no objection in allotting such symbol;

Provided also that no proposal for a new symbol shall be entertained by the Commission unless it is made at least three months before the date of expiry of term of the House of the People, or within one month of the premature dissolution of the House, as the case may be:

(vi) The party also given an undertaking that if the party does not set up candidates in the minimum number of the constituencies as prescribed in condition (i) above, its candidates shall not be entitled to allotment of a common symbol on the date of allotment of symbols to them; and, in addition, the party shall be liable for such punitive action as the Commission may consider appropriate

(vii) The list containing the serial numbers and names of the constituencies where the party is setting up candidates is submitted to the Commission latest by 5 clear days before the date on which the notification (or first of the notifications in the case of a phased election) of the election is scheduled to be issued.

Explanation-

For the removal of doubt, it is hereby clarified that- (i) The concession of allotment of common symbol to the candidates of a registered unrecognized party under this paragraph shall be available to a party at any two general elections to the House of the People, or any two general elections to a State Legislative Assembly or at one general election to the House of the People and the other at a general election to a State Legislative Assembly, as the party may choose.

(ii) A party that has availed of this concession on two occasions shall, however, be eligible for the concession in any subsequent general election subject to the condition that on the previous occasion when the party availed of the facility, the votes polled by all the contesting candidates set up by the party at the general election in the State concerned was not less than one percent of the total valid votes polled in the State.

(iii)The free symbol allotted as a common symbol to the candidates of a party under this paragraph shall be available for allotment to candidates set up by the other parties or independent candidates in those other constituencies in which that party has not set up its candidates.

(iv) Allotment of common symbol under this paragraph shall be done on 'first-come- first- served' basis: Provided that if applications of two or more parties giving preference for the same symbol are received in the Commission on the same date, then the question of allotment of the symbol to one of such parties shall be decided by draw of lots in such manner as may be directed by the Commission:

Provided further that if out of the two or more such parties giving preference for the same symbol whose applications are received on the same date, on party is such that it has been allotted the said symbol in the previous occasion in the State concerned and the other was not allotted that symbol in the previous election, then the symbol shall be allotted to the former: Provided also that if out of the two or more such parties giving preference for the same symbol whose applications are received on the same date, both or all such parties had been allotted the said symbol on the previous occasion in the State concerned, and one among the parties is such that it has Member (s) elected to the House of the People or the Legislative Assembly of the State concerned on the symbol for which preference has been given by the party, then the symbol shall be allotted to the party to the exclusion of the other parties; (v) If it is not possible for the Commission for any reason to allot a common symbol to the candidates of a party from out of the list of symbols for which it has given its preference under this paragraph, some other symbol from the list of free symbols may be allotted to that party in consultation with that party; (vi) Notwithstanding anything contained in paragraph 10A, a political party which was earlier a recognized political party and which lots its recognition more than 6 years back will also be eligible under this paragraph to the concession of allotment of the symbol which was earlier reserved for the party, at a general election to the House of the People or to the Legislative Assembly of a State, held after expiry of six years since the party lost its recognition, subject to the fulfillment of each of the conditions specified under clause (A) or (B), as the case may be, except the condition in sub-clause (iv) of clause (A) and sub- clause (v) of clause (B)."
