र उत्पाद अधिनियम, 1915 की धारा-89 द्वारा प्रदा शराब के आयात, निर्यात, परिवहन, बिक्री एवं अनुज्ञप्ति हेतु शक्तियों का प्रयोग करते हुूए बिहार सरकार निम्न शक्ति शराब के आयात, निर्यात, परिवहन, बिक्री एवं अनुज्ञप्ति हेतु शक्तियों का प्रयोग करते हुूए बिहार सरकार निम्न शक्ति निम्नलिखित नियमावली बनाती है :- निम्नलिखित नियमावली बनाती है :-
1. संक्षिप्त नाम, विस्तार तथा प्रारम्भः-
संक्षिप्त नाम, विस्तार तथा प्रारम्भः- (1) यह नियमावली ''बिहार निम्न शक्ति शराब-आयात, निर्यात (1) यह नियमावली ''बिहार निम्न शक्ति शराब-आयात, निर्यात एवं बिक्री नियमावली 2015'' कही जा सकेगी। एवं बिक्री नियमावली 2015'' कही जा सकेगी।
से अभिप्रेत है, अधिनियम की धारा;
से अभिप्रेत है अधिनियम की धारा-7, के खंड (क) के अधीन नियुक्त पदाधिकारी;
से अभिप्रेत है, संविधान की सातवीं अनुसूची की सूची II की प्रविष्टि 51 (2) इसका विस्तार सम्पूर्ण बिहार राज्य में ह (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह बिहार राजपत्र में अधिसूचना की तिथि से प्रवृत होगी। (3) यह बिहार राजपत्र में अधिसूचना की तिथि से प्रवृत होगी। 2. परिभाषाएंः-इस नियमावली में जबतक विषय या संदर्भ में कोई बात विरूद्ध न हो- -इस नियमावली में जबतक विषय या संदर्भ में कोई बात विरूद्ध न हो- -इस नियमावली में जबतक विषय या संदर्भ में कोई बात विरूद्ध न हो- से अभिप्रेत है बिहार उत्पाद अधिनियम, 1915, (अधिनियम-II, (क) ''अधिनियम'' से अभिप्रेत है बिहार उत्पाद अधिनियम, 1915, (अधिनियम- 1915); (ख) ''धारा'' से अभिप्रेत है, अधिनियम की धारा; (ग) ''उत्पाद आयुक्त'' से अभिप्रेत है अधिनियम की धारा-7, के खंड (क) के अधीन नियुक्त पदाधिकारी; (ग) ''उत्पाद आयुक्त'' ''उत्पाद शुल्क'' या ''शुल्क'' से अभिप्रेत है, संविधान की सातवीं अनुसूची की सूची (घ) ''उत्पाद शुल्क'' या में यथोल्लिखित शुल्क; में यथोल्लिखित शुल्
से अभिप्रेत है उपहार से अन्यथा किसी भी प्रकार का हस्तान्तरण; से अभिप्रेत है राजस्व पर्षद;
(ड.) ''आयात'' से अभिप्रेत है निम्न शक्ति शराब बिहार राज्य में राज्य के बाहर से लाना से अभिप्रेत है निम्न शक्ति शराब बिहार राज्य में राज्य के बाहर से लाना; से अभिप्रेत है निम्न शक्ति शराब बिहार राज्य में राज्य के बाहर से लाना (च) ''बिक्री'' से अभिप्रेत है उपहार से अन्य (छ) ''पर्षद'' से अभिप्रेत है राजस्व पर्षद; (ज) ''निम्न शक्ति शराब'' से अभिप्रेत है कार्बनिकृत निम्न शक्ति की मदिरा जिसमें अल्कोहल की मात्रा (ज) ''निम्न शक्ति शराब'' से अभिप्रेत है कार्बनिकृत निम्न शक्ति की मदिरा जिसमें अल्कोहल की मात्रा या इससे न्यून एवं अधिकतम 8% v/v हो तथा जो la'kksfधत सुषव से निर्मित हो और जिसमें धत सुषव से निर्मित हो और जिसमें य से मिलाया गया हो ताकि इसे fof'kष्ट सुगंध दिया 5% या इससे न्यून एवं अधिकतम 8 सुगंध या विरंजक पदार्थ अथवा दोनों इस vk'kय से मिलाया गया हो ताकि इसे सुगंध या विरंजक पदार्थ अथवा दोनों इस जा सके;
(झ) ''बी॰एस॰बी॰सी॰एल॰'' से अभिप्रेत है, बिहार स्टेट बिवरेज dkWjiksjs'ku लि0, सभी प्रकार के शराबों के (झ) ''बी॰एस॰बी॰सी॰एल॰'' लि0, सभी प्रकार के शराबों के थोक व्यापार के लिए l'kDr राज्य सरकार का उपक्रम; थोक व्यापार के लिए2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 9999 ०सत(cid:19)बर 2015 (ञ) ''अनुज्ञप्ति'' से अभिप्रेत है बिहार उत्पाद अधिनियम की धारा-13 एव उसके अधीन बनायी गयी नियमावली के अधीन प्रदा अनुज्ञप्ति;
(ट) ''पारक'' से अभिप्रेत है निम्न शक्ति शराब के उठाव के लिए बिहार उत्पाद अधिनियम एवं उसके अधीन बनायी गयी नियमावली के अधीन प्रदा प्राधिकारण;
(ठ) ''अधिकाम फुटकर कीमत'' से अभिप्रेत है वह अधिकाम खुदरा बिक्रय मूल्य जिसपर अन्तिम उपभोक्ताओं को निम्न शक्ति शराब बेची जाएगी और जिसमें सभी प्रकार के कर, भाड़ा, परिवहन खर्च, बिहार स्टेट बिवरेज dkWjiksjs'ku लि0 को भुगतेय deh'ku या व्यापारिक अतिरिक्त jkf'k और वितरण की बाबत सभी प्रभार सम्मिलित होंगे।
3. कोई भी व्यक्ति/कम्पनी/फर्म राज्य में निम्न शक्ति शराब का आयात तबतक नहीं करेगा जबतक कि वह उत्पाद आयुक्त से 19C वितरकता अनुज्ञप्ति प्राप्त न कर ले।
4. आयातक या वितरकता अनुज्ञप्तिधारी किसी निम्न शक्ति शराब का आयात तबतक नहीं करेगा जब तक कि उत्पाद सहायक आयुक्त/उत्पाद अधीक्षक के माध्यम से लिखित अनुरोध पर उत्पाद आयुक्त से आयात vkns'k प्राप्त नहीं कर लेता।
ऐसे आयात vkns'k के आधार पर सहायक आयुक्त उत्पाद/उत्पाद अधीक्षक, अपेक्षित फीस के पूर्व भुगतान पर आयातक के पक्ष में अनुज्ञापत्र निर्गत करेंगे।
5. आयातक या वितरकता अनुज्ञप्तिधारी अपने भंडागार से ऐसी आयातित निम्न शक्ति शराब की आपूर्ति विधिमान्य अनुज्ञप्तियों के विरूद्ध बिहार स्टेट बिवरेज dkWjiksjs'ku लि0 को एवं बिहार स्टेट बिवरेज dkWjiksjs'ku लि0 उसकी आपूर्ति खुदरा विक्रेताओं या अनुज्ञृप्ति प्राप्त होटलों/रेस्टोरेंटों/'kjkc घरों (बार) को विधिमान्य अनुज्ञा पत्रों के विरूद्ध करेेगा।
6. निम्न शक्ति शराब पर 90/-(नब्बे) रूपये प्रति एल.पी.एल. की दर से उत्पाद कर की देयता होगी। 7. बिहार राज्य में इसका आयात 5/-(पांच) रूपये प्रति एल.पी.एल. की दर से अग्रिम आयात शुल्क का भुगतान कर किया जा सकेगा।
लेबल निबंधन फीस
8. बिहार राज्य में निम्न शक्ति शराब के किसी ब्राण्ड का आयात एवं बिक्री तबतक नहीं की जाएगी जबतक कि उसका लेबल बिहार उत्पाद अधिनियम, 1915 की धारा-90 के अधीन fof'kष्ट रूप से बनाए गए नियम 42ख के अधीन यथा विहित वार्षिक निबंधन/नवीकरण फीस के पूर्व भुगतान पर उत्पाद आयुक्त द्वारा उसका लेबल अनुमोदित एवं रजिस्ट्रीकृत नहीं हो जाता हैं।
9. भंडागार से हटाये जाने के पूर्व निम्न शक्ति शराब पर राजस्व पर्षद द्वारा यथा विहित संचलन फीस का भुगतान वितरकता अनुज्ञप्तिधारक द्वारा किया जायगा।
10. निम्न शक्ति शराब के प्रत्येक बोतल के लेबल पर लाल स्याही से वैधानिक चेतावनी ''मद्यपान स्वास्थ्य के लिए हानिकारक है'' एवं उसका अधिकाम खुदरा मूल्य मुद्रित किया जाएगा।
11. किसी भी बिक्री केन्द्र पर निम्न शक्ति शराब के पैक साईज एवं शक्ति में किसी भी परिवर्तन की अनुमति नहीं होगी।

सं0 10/नीति (fu0'kfDr'k0)-23/2012—2743 के तहत निर्गत ''निम्न शक्ति शराब'' के आयात, निर्यात एवं बिक्री नियमावली 2015'' का निम्नलिखित अंग्रेजी अनुवाद बिहार-राज्यपाल के प्राधिकार से एतद द्वारा प्रकाशित किया जाता है, जिसे भारत-संविधान के अनुच्छेद-348 के खंड-3 के अधीन उक्त नियमावली का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा।

The 8th September 2015 Rules for import, export and sale of Low Alcoholic Beverage- 2015
No. 10/नीति (fu0'kfDr'k0)-23/2012—2743—In exercise of powers conferred by Section-89 of the Bihar Excise Act, 1915, the Government of Bihar makes the following rules for import, export, transport, sale and licence of Low Alcoholic Beverage.
1. Short Title, Extent and Commencement:- (1) These rules may be called " The Bihar Low Alcoholic Beverage import, export and sale Rules, 2015".
(2) It shall extend to the whole of the State of Bihar,3 (cid:29)बहार गजट (असाधारण), 9 ०सत(cid:19)बर 2015 (3) It shall come into force from the date of its notification in the Official Gazette of Bihar.
2. Definitions:-In these rules, unless there is anything repugnant in the subject or the context-
(a) "The Act " means the Bihar Excise Act, 1915 ; (Act – ii, 1915); (b) "Section" means a section of the Act; (c) "Excise Commissioner" means the officer appointed under clause (a) of section-7, of the Act ;
(d) "Excise Duty" or "Duty" means duty as mentioned in Entry 51 of list II of the Seventh Schedule to the Constitution;.
(e) "Import" means bring Low Alcoholic Beverage into the State of Bihar from outside of the State;
(f) "Sale" means any transfer otherwise than by way of gift; (g) " Board" means Board of Revenue; (h) " LAB (Low Alcoholic Beverage)." means carbonated low strength alcoholic beverage having alcohol up to 5% or below to maximum 8% v/v manufactured from rectified spirit and sophisticated by addition of flavoring of colouring matter or both and any other material so as to give it a special flavour;
(j) "B.S.B.C.L." means Bihar State Beverages Corporation Limited, the State Government undertaking empowered for wholesale trading of all kinds of liquors;
(j) " License" means a license granted under section-13 of the Bihar Excise Act and rules made there under;
(k) "Permit" means an authorization granted under Bihar Excise Act and rules made there under for the removal of Low Alcoholic Beverage;
(l) "M.R.P" means the maximum retail price at which Low Alcoholic Beverage will be sold to the ultimate consumer and shall include all taxes, freight, transport charges, Commission or trade margin payable to B.S.B.C.L. and all charges towards delivery etc. ;.
3. No person/Company/Firm shall import Low alcoholic beverage in the state unless he obtains 19C distribution licence by the approval of Excise Commissioner. 4. The importer or the holder of distributorship licensee shall not import any Low alcoholic beverage unless he obtains on written request through the Assistant Commissioner of Excise /Superintendent of Excise, the import order from the Excise Commissioner. On the basis of such import order, The Assistant Commissioner of Excise/ Superintendent of Excise shall issue permit in favour of the importer or the holders of distributorship license on prepayment of the requisite fee.
5. The importer or the holder of distributorship licensee shall supply such imported India made wine from his warehouse to B.S.B.C.L. against valid permits and the B.S.B.C.L. shall supply the same to the retailers or to licensed Hotels/ Restaurants/ Bars against valid permits.
6. The excise duty chargeable on Low Alcoholic Beverage will be at the rate of Rs. 90/- (Ninety) per L.P.L
7. Low Alcoholic Beverage may be imported in Bihar State after payment of Rs. 5/- (Five) as import duty in advance.
Label Registration Fee:-
8. No brand of Low alcoholic beverage shall be imported and sold in the State of Bihar unless its label is approved and Registered by the Excise Commissioner on pre 4 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 9999 ०सत(cid:19)बर 2015 payment of annual Registration/Renewal fee as prescribed under Rule 42-B made specifically under section-90 of the Bihar Excise Act,1915.
9. A movement fee as prescribed by the Board shall be paid by the holders of distributorship licensee on Low alcoholic beverage before its removal from the warehouse.
10. Each bottle of Low alcoholic beverage shall be pasted label on which statutory warning "Drinking Liquor is injurious to health" in red ink and its maximum retail price shall be printed.
11. No change in pack-size and strength of Low alcoholic beverage shall be allowed at any sale point.
