यो0मो0-4(विविध)07-225/2015-568—बिहार सिंचाई अधिनियम, 1997 की धारा-115(1) एवं (2) बिहार सिंचाई अधिनियम, 1997 की धारा-115(1) एवं (2) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्य सरकार एतद् द्वारा बिहार सिंचाई, बाढ़ प्रबंधन एवं जल के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्य सरकार एतद् द्वारा बिहार सिंचाई, बाढ़ प्रबंधन एवं जल के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार राज्य सरकार एतद् द्वारा बिहार सिंचाई, बाढ़ प्रबंधन एवं जल 'ाोधन करने हेतु निम्नलिखित नियमावली बनाती हैः- निस्सरण नियमावली 2003 का सं' ''बिहार सिंचाई बाढ़ प्रबंधन एवं जल निस्सरण (संषोधन) नियमावली, 2015'' ''बिहार सिंचाई बाढ़ प्रबंधन एवं जल निस्सरण (सं ोधन) नियमावली, 2015''
संक्षिप्त नाम, विस्तार एवं प्रारंभ :-
1. संक्षिप्त नाम, विस्तार एवं प्रारंभ :- (1) यह नियमावली बिहार सिंचाई बाढ़ प्रबंधन एवं जल निस्सरण (la'kksधन) नियमावली 2015 धन) नियमावली 2015 (1) यह नियमावली बिहार सिंचाई बाढ़ प्रबंधन एवं जल निस्सरण ( (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा । (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा । (3) यह तुरंत प्रवृत होगी । (3) यह तुरंत प्रवृत होगी । 2. उक्त नियमावली 2003 के नियम 4
उक्त नियमावली 2003 के नियम 4.9.6 के अधीन गठित ''कोषी उच्चस्तरीय समिति''
ी उच्चस्तरीय समिति'' निम्नलिखित द्वारा 7 के पूर्व एक नया नियम 4.9.6 क के रूप में प्रतिस्थापित की जायेगी तथा इस नियम के बाद एवं नियम 4.9.7 के पूर्व एक नया नियम 4 प्रतिस्थापित की जायेगी तथा इस नियम के बाद एवं नियम 4 अंतःस्थापित किया जायेगा :-
'' कोषी उच्चस्तरीय समिति
- अध्यक्ष (i) अध्यक्ष, गंगा बाढ़ नियंत्रण आयोग, पटना (ii) सदस्य (बाढ़), केन्द्रीय जल आयोग, नई दिल्ली अथवा उनकी अनुपस्थिति
अध्यक्ष, गंगा बाढ़ नियंत्रण आयोग, पटना सदस्य (बाढ़), केन्द्रीय जल आयोग, नई दिल्ली अथवा उनकी अनुपस्थिति में मुख्य अभियन्ता, निचली गंगा बेसीन संगठन केन्द्रीय जल आयोग, पटना में मुख्य अभियन्ता, निचली गंगा बेसीन संगठन केन्द्रीय जल आयोग, पटना
(iii) निदे'ाक, सी.डब्ल्यू.पी.आर
- सदस्य - सदस्य आर.एस. (CWPRS), पूणे अथवा उनकी अनुपस्थिति में डब्ल्यू.पी.आर.एस. (CWPRS), पूणे

अभियन्ता, जल संसाधन विभाग, दरभंगा ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 9 (cid:24)सत(cid:26)बर 2015 2 (x) उप महानिदे'ाक, सिंचाई विभाग, नेपाल - सदस्य (xi) मुख्य अभियन्ता, जल संसाधन विभाग, वीरपुर - सदस्य सचिव '' '' 4.9.6 क नियम 4.9.6 के अधीन गठित समिति द्वारा बाढ़ से सुरक्षा कार्य को सर्वोच्च प्राथमिकता दी जायेगी। उक्त समिति विभिन्न विभागों/संगठनों के संबंधित वि'ोषज्ञों को सम्मिलित कर Hierarchical approach के आधार पर वरिष्ठ सदस्यों द्वारा दिये गये सुझाव को मात्र मानने हेतु नहीं बल्कि बाढ़ से सुरक्षा जैसे सर्वोपरि महत्वपूर्ण कार्य में पूर्णतः तकनीकी तथा वैज्ञानिक दृष्टिकोण के आधार पर एक समूह के रूप में कार्य करने के उद्दे'य से गठित की गई है।
उपर्युक्त समिति का निर्णय साधारण बहुमत के आधार पर होगा। कोरम की पूर्ति न्यूनतम छः (6) सदस्यों की उपस्थिति से होगी ।
इस नियम के अधीन अधिसूचित अध्यक्ष अधिरचित अध्यक्ष/सदस्य/सदस्य सचिव समिति के कार्य कलापों में स्वयं भाग लेंगे और किसी अन्य समकक्ष अथवा न्यून पदाधिकारियों को समिति में भाग लेने हेतु प्राधिकृत नहीं करेंगे। बिहार सिंचाई, बाढ़ प्रबंधन एवं जल निस्सरण नियमावली, 2003 के नियम 4.9.4 के अधीन गठित उप-समिति द्वारा सभी स्थलों का निरीक्षण कर की गई अनु'ांसाओं को कार्यवाही का अं'ा बनाया जायेगा। यदि क्षेत्रीय पदाधिकारी द्वारा प्रस्तावित योजना में किसी भी प्रकार का सं'ाोधन/निरसन अनु'ांसित किया जाता है, तो संक्षिप्त रूप से उसका कारण दिया जाना अनिवार्य होगा ।
उक्त समिति द्वारा योजना के कार्यान्वयन में मानसून प्रारंभ होने के पूर्व न्यूनतम दो बार स्थल निरीक्षण किया जाना अनिवार्य होगा, जिससे अनु'ांसित कार्य ससमय और गुणवत्ता के साथ कार्यान्वित हो सके ।
नेपाल सरकार के पदाधिकारी, जो इस समिति के सदस्य हैं, केवल नेपाली क्षेत्रों में किए जाने वाले कार्यों हेतु सम्मिलित किए जायेंगे''।

No. Yo.Mo.- 4 (Vividh) 07 – 225 / 2015 -568—In exercise of the power conferred by Bihar Irrigation Act 1997, under Section – 115(1) & (2) the Government of Bihar is pleased to modify Bihar Irrigation, Flood Management and Drainage Rules, 2003 and make the following rules to amend the Bihar Irrigation, Flood Management and Drainage Rules, 2003 :-
1. Short name, extent & commencement :- (1) This rule will be known as Bihar Irrigation, Flood Management and Drainage (Amendment) Rule, 2015.
(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force at once. 2. Kosi High Level Committee constituted under Rule 4.9.6 of the said Rules, 2003 will be substituted by the following and a new Rule 4.9.6 (a) will be inserted after this rule and before Rule 4.9.7 :-

(i) Chairman, Ganga Flood Control Commission, Patna - Chairman (ii) Member (Flood) Central Water Commission, New Delhi, or in
his absence - Member CE, Lower Ganga Basin Organization, CWC, Patna

Officer CWPRS, Pune - Member (iv) Engineer-in-Chief, (North), Water Resources Deptt. Top priority will be given by the Committee constituted under Rule 4.9.6 to the Flood Protection Work. This committee has been constituted involving specialists from different departments/organizations, shall function as a group adopting scientific and technical approach and it shall not simply obey the suggestions of Senior Members of the committee on hierarchical basis.
The decisions of this committee shall be based on general majority. The quorum will be present with the presence of minimum six (6) numbers.
The Chairman / Members / Member Secretary notified under this rule will themselves take part in the activities of the committee and can not authorize equivalent or Junior Level Officers to attend the meetings.
The recommendations made by sub committee constituted under Rule 4.9.4 of Bihar Irrigation, Flood Management and Drainage Rules, 2003 after inspections of the sites, shall be treated as part of proceedings. If any amendment or repeal is made in the proposals by the field officers, it will be compulsory to give reason in brief for the same.
It will be compulsory for the Committee to make at least two site inspections before the start of monsoon so that the recommended works can be completed maintaining good quality within stipulated time frame.
The officers of Government of Nepal, who are members of the committee will be included for the works within Nepal territory only" .
