सं0 576/एक्जिट/2015/एस.डी.आर.-खण्ड-I—यतः बिहार राज्य विधान-सभा के लिए साधारण निर्वाचन के कार्यक्रम की घोशणा आयोग के दिनांक 09 सितम्बर, 2015 के प्रेस नोट संख्या ईसीआई/पीएन/53/2015 के द्वारा की जा चुकी है;
2. और यतः लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 126क के प्रावधानों के अनुसार इस संबंध में निर्वाचन आयेग द्वारा यथा अधिसूचित इस अवधि के दौरान किसी भी प्रकार के एग्जिट पोल के संचालन और उसके परिणामों तथा ऐसे पोल के परिणााम के प्रसार पर प्रतिबंध होगा।
3. यतः अब, इसलिए, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 126क की उप-धारा (1) के अधीन शक्तियों का प्रयोग करते हुए भारत निर्वाचन आयोग, उक्त धारा की उप-धारा (2) के उपबंधों के संबंध में एततद्वारा दिनांक 12.10.2015 (सोमवार) को पूर्वाहन 07070707....00000000 बजे से अपराह्न 05050505....30303030 बजे के बीच की अवधि को, ऐसी अवधि के रूप में अधिसूचित करता है जिसके दौरान आयोग के प्रेस नोट संख्या ईसीआई/पीएन/53/2015 दिनांक 09 सितम्बर, 2015 के द्वारा घोशित बिहार राज्य विधान सभा के लिए चालू साधारण निर्वाचन के संबंध में किसी भी प्रकार के एग्जिट पोल का संचालन तथा प्रिंट या इलेक्ट्रोनिक मीडिया द्वारा इसका प्रकाषन या प्रचार अथवा किसी भी अन्य तरीके से उसके प्रसार पर प्रतिबंध रहेगा।
4. इसके अतिरिक्त यह भी स्पश्ट किया जाता है कि लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 126(1)(ख) के अधीन उपर्युक्त साधारण निर्वाचन के संबंध में संबंधित मतदान क्षेत्रों में मतदान की समाप्ति के लिए नियत समय के साथ समाप्त होने वाले 48 घंटों की अवधि के दौरान किसी भी प्रकार के निर्वाचन संबंधी मामले का, किसी भी ओपीनियन पोल या अन्य किसी पोल सर्वें के परिणामों सहित प्रदर्षन किसी भी इलेक्ट्रोनिक मीडिया से करने पर प्रतिबंध रहेगा।

सचिव।3 !बहार गजट (असाधारण), 1 अ(cid:27)तूबर 2015 ELECTION COMMISSION OF INDIA ————— NOTIFICATION Nirvachan Sadan, Ashoka Road, New Delhi-110001 Date: 28th September, 2015/ 6 Asvin, 1937 (Saka) No. 576/EXIT/2015/SDR-Vol.I—Whereas, the schedules for the General Election to the State Legislative Assembly of Bihar was announced by the Commission vide Press Note bearing No. ECI/PN/53/2015, dated 9th September, 2015.
2. And whereas, as per the provisions of Section 126A of the Representation of the People Act, 1951, there shall be restrictions on conduct of any exit poll and publication and dissemination of result of such exit poll during such period, as may be notified by the Election Commission in this regard;
3. Now, therefore, in exercise of the powers under sub-Section (1) of section 126A of the Representation of the People Act, 1951, the Election Commission, having regard to the provisions of sub-Section (2) of the said Sections, hereby notifies the period between 07.00 A.M. on 12-10-2015 (Monday) and 05.30 P.M. on 05-11-2015 (Thursday), as the period during which conducting any exit poll and publishing or publicizing by means of the print or electronic media or dissemination in any other manner whatsoever, the result of any exit poll in connection with the current General Election to the Legislative Assembly of Bihar announced vide the Commission's Press Note No. ECI/PN/53/2015, dated 09-09- 2015 shall be prohibited.
4. It is further clarified that under Section 126(1)(b) of the R.P. Act, displaying any election matter including results of any opinion poll or any other poll survey, in any electronic media, would be prohibited during the period of 48 hours ending with the hours fixed for conclusion of poll in connection with aforesaid General Election.
