फाई0(स्था0) 07/2014-933(11)—भारत का संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त भारत का संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, बिहार के राज्यपाल, स्वास्थ्य विभाग के अंतर्गत फाइलेरिया निरीक्षक संवर्ग में नियुक्ति एवं शक्तियों का प्रयोग करते हुए, बिहार के राज्यपाल, स्वास्थ्य विभाग के अंतर्गत फाइलेरिया निरीक्षक संवर्ग में नियुक्ति एवं शक्तियों का प्रयोग करते हुए, बिहार के राज्यपाल, स्वास्थ्य विभाग के अंतर्गत फाइलेरिया निरीक्षक संवर्ग में नियुक्ति एवं सेवा शर्तोंं के विनियमन हेतु निम्नलिखित नियमावली बनाते हैं :- सेवा शर्तोंं के विनियमन हेतु निम्नलिखित नि

1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ।-

(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरंत प्रवृत होगी।

यह नियमावली ''बिहार फाइलेरिया निरीक्षक संवर्ग नियमावली, संक्षिप्त नाम, विस्तार एवं प्रारम्भ।- (1) यह नियमावली ''बिहार फाइलेरिया निरीक्षक संवर्ग नियमावली, 2015'' कही जा सकेगी। 2015'' कही जा सकेगी। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह तुरंत प्रवृत होगी।

2. परिभाषाएँ।- जब तक विषय या संदर्भ में अन्यथा अ

जब तक विषय या संदर्भ में अन्यथा अपेक्षित न हो, इस नियमावली में :-

(i) 'सरकार' से अभिप्रेत है बिहार राज्य सरकार ; ) 'सरकार' से अभिप्रेत है बिहार राज्य सरकार ; (ii) 'विभाग' से अभिप्रेत है स्वास्थ्य विभाग ; ) 'विभाग' से अभिप्रेत है स्वास्थ्य विभाग ; (iii) 'आयोग' से अभिप्रेत है बिहार कर्मचारी चयन आयोग; ) 'आयोग' से अभिप्रेत है बिहार कर्मचारी चयन आयोग; ) 'नियुक्ति प्राधिकार' से अभिप्रेत है निदेशक प्रमुख, स्वास्थ्य सेवाएँ, बिहार; ) 'संवर्ग' से अभिप्रेत है बिहार फाइलेरिया निरीक्षक संवर्ग; तथा ) 'परिशिष्ट से अभिप्रेत है इस नियमावली के साथ संलग्न परिशिष्ट।

(iv) 'नियुक्ति प्राधिकार' से अभिप्रेत है निदेशक प्रमुख, स्वास्थ्य सेवाएँ, बि (v) 'संवर्ग' से अभिप्रेत है बिहार फाइलेरिया निरीक्षक संवर्ग; तथा (vi) 'परिशिष्ट से अभिप्रेत है इस नियमावली के साथ संलग्न परिशिष्ट।

3. संवर्ग का गठन।- फाइलेरिया निरीक्षक का संवर्ग राज्य स्तरीय होगा। इस संवर्ग में प्रत्येक कोटि के पदों ।- फाइलेरिया निरीक्षक का संवर्ग राज्य स्तरीय होगा। इस संवर्ग में प्रत्येक कोटि के पदों ।- फाइलेरिया निरीक्षक का संवर्ग राज्य स्तरीय होगा। इस संवर्ग में प्रत्येक कोटि के पदों ल पदों की संख्या उतनी होगी जितनी सरकार द्वारा समय-समय पर स्वीकृत की की संख्या तथा संवर्ग के कुल पदों की संख्या उतनी होगी जितनी सरकार द्वारा समय-समय पर स्वीकृत की की संख्या तथा संवर्ग के कु जाय।

4. संवर्ग का पदसोपान।- इस संवर्ग की विभिन्न कोटियाँ अर्थात्‌ पदसोपान परिशिष्ट-1 के अनुसार होंगे। ।- इस संवर्ग की विभिन्न कोटियाँ अर्थात्‌ पदसोपान परिशिष्ट-1 के अनुसार होंगे। ।- इस संवर्ग की विभिन्न कोटियाँ अर्थात्‌ पदसोपान परिशिष्ट-1 के अनुसार होंगे। 5. भर्ती।- इस संवर्ग में नियुक्ति मूल कोटि ( फाइलेरिया निरीक्षक ) के पद पर सीधी भर्ती, से इस संवर्ग में नियुक्ति मूल कोटि ( फाइलेरिया निरीक्षक ) के पद पर सीधी भर्ती, से आयोग की इस संवर्ग में नियुक्ति मूल कोटि ( फाइलेरिया निरीक्षक ) के पद पर सीधी भर्ती, से अनुशंसा के आधार पर, होगी। अनुशंसा के आधार पर, होगी।

6. अर्हताएँ।- (1) मूल कोटि के पद पर सीधी भर्ती द्वारा नियुक्ति के लिए न्यूनतम शैक्षणिक अर्हता (1) मूल कोटि के पद पर सीधी भर्ती द्वारा नियुक्ति के लिए न्यूनतम शैक्षणिक अर्हता (1) मूल कोटि के पद पर सीधी भर्ती द्वारा नियुक्ति के लिए न्यूनतम शैक्षणिक अर्हता इन्टरमीडियट /102 (विज्ञान) में उाीर्णता होगी। इन्टरमीडियट /102 (विज्ञान) में उाीर्णता होगी। सीमा 21 वर्ष होगी और अधिकतम (2) फाइलेरिया निरीक्षक संवर्ग में सीधी भर्ती के लिए न्यूनतम आयु-सीमा 21 वर्ष होगी और अधिकतम (2) फाइलेरिया निरीक्षक संवर्ग में सीधी भर्ती के लिए न्यूनतम आयु-

आयु-सीमा वही होगी जो सरकार द्वारा, समय - समय पर, आरक्षण कोटिवार, विनिश्चित की जाय। आयु-सीमा वही होगी जो सरकार द्वारा, समय - समय पर, आरक्षण कोटिवार, विनिश्चित की जाय। आयु-सीमा वही होगी जो सरकार द्वारा, समय - समय पर, आरक्षण कोटिवार, विनिश्चित की जाय।2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 1 (cid:22)दस(cid:24)बर 2015 (3) संबंधित वर्ष की 1 ली अगस्त को, उम्र के निर्धारणार्थ, कट ऑफ डेट माना जायेगा। 7. भर्ती की प्रक्रिया।- (i) नियुक्ति प्राधिकार, वर्ष की 1 ली अप्रैल की स्थिति के आधार पर रिक्ति की गणना कर एवं रोस्टर क्लीयरेन्स कराकर, आरक्षण कोटिवार अधियाचना आयोग को 30 अप्रैल तक भेजेगा। (2) अधियाचना के आलोक में आयोग रिक्तियों को विज्ञापित कर आवेदन-पत्र आमंत्रित करेगा और बिहार कर्मचारी चयन आयोग परीक्षा संचालन नियमावली, 2010 के प्रावधानों के अनुसार इन्टर/2 स्तरीय परीक्षा के आधार पर अभ्यर्थियों का चयन करेगा।

(3) उप-नियम (2) के आधार पर मेधासूची तैयार करने के पश्चात्‌, आयोग के द्वारा नियुक्ति प्राधिकार के सहयोग से, प्रमाणपत्र की प्रारम्भिक जाँच एवं स्वास्थ्य जाँच करायी जायेगी और तत्पश्चात्‌ अधियाचित रिक्तियों के अनुरूप कोटिवार आरक्षण का अनुपालन करते हुए अंतिम अनुशंसा नियुक्ति प्राधिकार को भेजी जायेगी। नियुक्ति प्राधिकार के स्तर पर भी प्रमाणपत्रों की जाँच के पश्चात्‌ अनुशंसित अभ्यर्थियों के पूर्ववृा का सत्यापन करा लिया जायेगा।

(4) आयोग की अनुशंसा के उपरांत नियुक्ति की प्रक्रिया के संबंध में सरकार द्वारा समय-समय पर निर्गत अनुदेश का अनुपालन आवश्यक होगा।

8. परिवीक्षा अवधि।- नियुक्ति के उपरान्त अभ्यर्थी परिवीक्षाधीन रहेंगे। परिवीक्षा अवधि दो वर्षों की होगी। परिवीक्षा अवधि में सेवा संतोषजनक नहीं पाये जाने की दशा में परिवीक्षा अवधि का विस्तार एक वर्ष के लिए किया जा सकेगा। यदि विस्तारित अवधि में भी सेवा संतोषजनक नहीं पायी जायेगी तो नियुक्ति प्राधिकार ऐसे फाइलेरिया निरीक्षक को बिना किसी सूचना के सेवामुक्त कर सकेगा।

9. प्रशिक्षण।- परिवीक्षा अवधि में परीक्ष्यमान फाइलेरिया निरीक्षक को ऐसे प्रशिक्षण को सफलतापूर्वक पूर्ण करना होगा, जो विभाग द्वारा विनिश्चित किया जाय।

10. विभागीय परीक्षा।- फाइलेरिया निरीक्षक को विभाग द्वारा आयोजित विभागीय परीक्षा उाीर्ण करनी होगी। विभागीय परीक्षा का पाठ्‌यक्रम विभाग द्वारा विनिश्चित किया जायेगा।

11. सम्पुष्टि।- परिवीक्षा अवधि में संतोषजनक सेवा होने, प्रशिक्षण सफलतापूर्वक पूरा करने और विभागीय परीक्षा उत्तीर्ण करने पर फाइलेरिया निरीक्षक को सेवा में सम्पुष्ट किया जा सकेगा।

12. वरीयता।- फाइलेरिया निरीक्षकों की आपसी वरीयता आयोग के द्वारा निर्धारित मेधासूची के अनुसार अवधारित की जायेगी।

13. प्रोन्नति के सोपान।- (1) सेवा में सम्पुष्ट फाइलेरिया निरीक्षकों को, रिक्ति की उपलब्धता के अधीन रहते हुए, योग्यता-सह-वरीयता के अनुसार, परिशिष्ट में उल्लिखित प्रोन्नति के सोपान के पदों पर प्रोन्नति दिये जाने पर विचार किया जा सकेगा। (2) प्रोन्नति के लिए सरकार द्वारा समय-समय पर निर्गत 'कालावधि' संबंधी अनुदेश का अनुपालन आवश्यक होगा।

(3) सरकार द्वारा समय-समय पर निर्गत प्रोन्नति संबंधी और चारित्री या पी0ए0आर0 संबंधी, आरोप, विभागीय कार्यवाही/आपराधिक कार्यवाही आदि संबंधी अनुदेशों का, प्रोन्नति पर विचार के समय, अनुपालन करना अपेक्षित होगा।

14. विभागीय प्रोन्नति समिति।- प्रोन्नतियाँ विभागीय प्रोन्नति समिति की अनुशंसा के आधार पर हाेंगी। विभागीय प्रोन्नति समिति का गठन विभाग द्वारा किया जायेगा।

15. आरक्षण।- सरकार के आरक्षण अधिनियम और सरकार द्वारा समय-समय पर सीधी भर्ती एवं प्रोन्नति हेतु निर्गत आरक्षण रोस्टर का अनुपालन करना अनिवार्य होगा।

16. परिशिष्ट-1 में उल्लिखित पदसोपान, सरकार के अनुमोदन के पश्चात्‌ ही प्रभावी होगा। यदि अनुमोदन पर विचार के क्रम में सरकार द्वारा परिशिष्ट में अंकित पदसोपान में कोई परिवर्तन या संशोधन किया जाता है तो परिशिष्ट-1 तदनुसार परिवर्तित या संशोधित समझा जायेगा और ऐसा परिवर्तित/संशोधित पद-सोपान इस नियमावली का अंग माना जायेगा।

17. परिशिष्ट-1 में उल्लिखित इस संवर्ग के पदों पर, इस नियमावली के प्रवृत्त होने के पूर्व से नियुक्त/प्रोन्नत एवं कार्यरत कर्मी इस संवर्ग में स्वतः शामिल समझे जायेंगे।

18. अवशिष्ट मामले।- इस नियमावली में जिन विषयों का प्रावधान नहीं हो सका है उनके लिए सरकार की प्रासंगिक संहिताएँ/नियमावली/ संकल्प/अनुदेश के प्रावधान लागू होंगे।

19. निर्वचन।- यदि इस नियमावली के किसी उपबंध के निर्वचन में कोई शंका उत्पन्न हो तो विभाग को निर्देशित किया जायेगा और इस संबंध में विभाग का विनिश्चय विधि विभाग के परामर्श के पश्चात्‌ अन्तिम होगा।

20. कठिनाई का निराकरण।- यदि इस नियमावली के उपबंधों के कार्यान्वयन में कोई कठिनाई उत्पन्न हो तो विभाग ऐसी किसी कठिनाई का निराकरण विधि विभाग के परामर्श के पश्चात्‌, किसी ऐसे सामान्य या विशेष आदेश द्वारा, कर सकेगा जो इस नियमावली के प्रावधानों से असंगत न हो।

21. निरसन एवं व्यावृति।- (1) इस संवर्ग के संबंध में विभाग द्वारा पूर्व में समय - समय पर निर्गत नियमावली और सभी संकल्प, आदेश, अनुदेश आदि एतद्‌ द्वारा किए जाते हैं।(cid:28)बहार गजट (असाधारण), 1 (cid:22)दस(cid:24)बर 2015 3 (2) ऐसा निरसन के होते हुए भी उपर्युक्त नियमावली, संकल्प, आदेश, अनुदेश आदि के अधीन किया गया कोई कार्य या की गयी कोई कार्रवाई इस नियमावली के अधीन किया गया या की गयी समझी जायेगी, मानो यह नियमावली उस तिथि को प्रवृा थी जिस तिथि को ऐसा कोई कार्य किया गया था या ऐसी कोई कार्रवाई की गयी थी।

नोट :- उपर्युक्त सभी कोटियों का वेतन बैंड एवं ग्रेड-पे वही होगा जो सरकार द्वारा समय-समय पर निर्धारित किया जाय।

No 11/फाई0(स्था0) 07/2014-933(11)—In exercise of powers conferred by proviso to Article -309 of the Constitution of India, the Governor of Bihar is pleased to make the following Rules to regulate the appointment and service conditions in the Filaria Inspector cadre under the Health Department:- 1. Short title, extent & commencement. - (1) These Rules may be called as the " Bihar Filaria Inspector Cadre Rules, 2015."

(2) It will extend to the whole State of Bihar. (3) It will come into force at once. 2. Definitions. - In these Rules, unless otherwise requires in the subject or context: (i) ' Government' means Bihar State Government ; (ii) ' Department' means Health Department ; (iii) 'Commission ' means Bihar Staff Selection Commission; (iv) 'Appointing Authority' means Director-in-Chief, Health Services, Bihar; (v) "Cadre" means Bihar Filaria Inspector Cadre; and (vi) "Appendix" means appendix-1 appended to these Rules. 3. Constitution of cadre. - The Cadre of Filaria Inspector shall be State Level. In this cadre, number of posts in every category and total number of posts in the cadre shall be such as may be sanctioned by the Government, from time to time. 4. Chain of Posts of the cadre. - Different categories and chain of posts of this cadre shall be according to Appendix-1,4 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 1 (cid:22)दस(cid:24)बर 2015 5. Recruitment. - Appointment in this cadre shall be by direct recruitment to the posts of basic category (Filaria Inspector) on the basis of recommendation of the Commission.

6. Qualifications. - (1) For the appointment by direct recruitment to the post of basic category posts, minimum educational qualification shall be Intermediate/10+2 pass in (Science).

(2) For direct recruitment in the Bihar Filaria Inspector Cadre, minimum age limit shall be 21 years and maximum age limit shall be the same as may be determined reservation categorywise, from time to time, by the Government.

(3) 1st August of the concerned year shall be deemed to be the cut off date for determination of age.

7. Procedure of Recruitment. - (1) The appointing authority, after calculating vacancies on the basis of position as on 1st April of the year and getting roster cleared, shall send reservation categorywise requisition to the Commission latest by 30th April.

(2) In light of requisition, The Commission shall invite applications after advertising the vacancies and shall select candidates on the basis of Inter/10+2 level examination according to provisions of the Bihar Staff Selection Commission Conduct of Examination Rules, 2010.

(3) After preparation of merit list on the basis of sub-rule(2), preliminary scrutiny of the certificates and medical check up shall be conducted by the Commission with the co-operation of the Appointing Authority, and thereafter following the reservation categorywise, final recommendation in accordance with the requisitioned vacancies shall be sent to the Appointing Authority. At the level of the Appointing Authority also, antecedents of candidates shall be caused to be verified after scrutiny of certificates.

(4) After recommendation of the Commission, it shall be necessary to comply the instructions issued by the Government, from time to time, with respect to procedure of appointment, shall be necessary.

8. Probation period. - After appointment the candidate will be on probation. Probation period will be of two years. In case, the service during probation period is not found satisfactory, the probation period will be extended for one year. If the service is not found satisfactory in extended period also, then the Appointing Authority may terminate service of such Filaria Inspector without any notice.

9. Training. - During probation period, the probationer Filaria Inspector shall have to complete such training as successfully may be determined by the Department. 10. Departmental Examination. - The Filaria Inspector shall have to pass the Departmental Examination conducted by the Department. The syllabus of Departmental Examination will be determined by the Department.

11. Confirmation. - On satisfactory completion of probation period, successful completion of training and passing of departmental examination, a Filaria Inspector may be confirmed in the service.

12. Seniority. - The inter-se seniority of Filaria Inspectors shall be determined according to the merit list prepared by the Commission.

13. Chains of Promotion. - (1) Subject to availability of vacancy, confirmed Filaria Inspector may be considered to be promoted to the promonanal post of the chain of posts mentioned in Appendix-1, according to merit-cum-seniority.

(2) For promotion, it shall be necessary to comply instructions with respect to "KALAWADHI" issued by the Government, from time to time.

(3) Compliance of instructions issued by the Government, from time to time, with respect to the promotion and Character Roll/P.A.R., allegation/departmental proceedings/ criminal proceedings etc., shall be required at the time of consideration of promotion.

14. Departmental Promotion Committee. - Promotions will be on the basis of recommendations of the Departmental Promotion Committee. The Departmental Promotion Committee shall be constituted by the Department.

15. Reservation. – It shall be necessary to comply the Reservation Act of the Government and reservation roster for direct recruitment and promotion, issued by the Government, from time to time.

16. The chain of posts mentioned in Appendix-1 shall be effective only after approval of the Government. If, in course of consideration of approval, any modification or amendment is made by the Government in the chain of posts mentioned in Appendix-1, the Appendix-1 shall be deemed to be modified or amended accordingly and such modified/amended chain of posts shall be deemed to be the part of these Rules.

17. The personnel already appointed/promoted and working on the posts of a sub-cadre mentioned in Appendix-1, before coming into force of these Rules, shall be deemed to be automatically included in the concerned sub- cadre.

18. Residue matters. - For the subjects which have not been provided in these Rules, provisions of concerned Codes/Rules/Resolutions/ Instructions of the Government shall apply.

19. Interpretation. - If any doubt arises with respect to interpretation of any provision of these Rules, it shall be referred to the Department and in this respect decision of the Department shall be final, after consultation with the Law Department.

20. Removal of difficulties. - If any difficulty arises in implementation of provisions of these Rules, the Department may remove such difficulty after consultation with the Law Department by general or special order which is not in consistent with the provisions of these rules.

21. Repeal & Savings. - (1) The Rules and all Resolutions, Orders, Instructions etc. issued earlier, from time to time, by the Department, with respect to this cadre, are hereby repealed. (2) Notwithstanding such repeal, any work done or any action taken under aforesaid Rules, Resolutions, Orders, Instructions etc shall be deemed to be done or taken under these Rules, as if these Rules, were in force on the date on which such a work was done or such an action was taken.
