सं0 एल0जी0 1-1-04196 लेज-1681- बिहार सिंचाई अधिनियम 1997 की धारा 115 (1) एवं (2) के एल0जी0 1-1-04196 लेज-1681-बिहार सिंचाई अधिनियम 1997 की धारा 115 (1) एवं (2) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए राज्य सरकार के द्वारा बिहार सिंचाई, बाढ़ प्रबंधन एवं जल निस्सरण अधीन प्रदत्त शक्तियों का प्रयोग करते हुए राज्य सरकार के द्वारा बिहार सिंचाई, बाढ़ प्रबंधन एवं जल निस्सरण अधीन प्रदत्त शक्तियों का प्रयोग करते हुए राज्य सरकार के द्वारा बिहार सिंचाई, बाढ 13 में संशोधन प्रस्तावित है । संशोधन का प्रारूप आम जनता के .9.12 एवं 4.9.13 में संशोधन प्रस्तावित है । संशोधन का प्रारूप आम जनता के नियमावली की धारा 4.9.11, 4. सूचना एवं आपत्ति प्राप्त करने (अगर कोई) हेतु प्रकाशित किया जाता है । सूचना एवं आपत्ति प्राप्त करने (अगर कोई) हेतु प्रकाशित किया जाता है । कोई भी आपत्ति (अगर कोई) सचिव, जल संसाधन विभाग, सिं चाई भवन, हार्डिंग रोड, पटना के समक्ष कोई भी आपत्ति (अगर कोई) सचिव, जल संसाधन विभाग, सिंचाई भवन, हार्डिंग रोड, पटना के समक्ष राजपत्र में प्रकाशन के एक महीना के अन्दर समर्पित किया जा सकता है । प्राप्त आपत्तियों के निराकरण के राजपत्र में प्रकाशन के एक महीना के अन्दर समर्पित किया जा सकता है । प्राप्त आपत्तियों के निराकरण के राजपत्र में प्रकाशन के एक महीना के अन्दर समर्पित किया जा सकता है । प्राप्त आपत्तियों के निराकरण के 11, 4.9.12 एवं 4.9.13 में पश्चात्‌ बिहार सिंचाई, बाढ़ प्रबंधन एवं जल निस्सरण नियमावली की धारा 4.9.11, 4 पश्चात्‌ बिहार सिंचाई, बाढ़ प्रबंधन एवं जल निस्सरण नियमावली की धारा 4

न किया जाएगा ।

बिहार सिंचाई, बाढ़ प्रबंधन एवं जल निस्सरण नियमावली की धारा 4.9.11, 4

11, 4.9.12 एवं 4.9.13 में संशोधन का अन्तिम प्रकाशन किया जाएगा । बिहार सिंचाई, बाढ़ प्रबंधन एवं जल निस्सरण नियमावली की धारा 4 संशोधन का प्रारूप संलग्न है ।

vf/klwpuk izk:i सं0 एल0जी0 1-1-04196 लेज-1681-बिहार सिंचाई अधिनियम, 1997 की धारा-115 की उप-धारा (1) और (2) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार सरकार बिहार सिंचाई, बाढ़ प्रबंधन एवं जल निस्सरण नियमावली, 2003 का संशोधन करने हेतु निम्नलिखित नियमावली बनाती है :-

1- laf{kIr uke] foLrkj ,oa izkjEHkः—(1) यह नियमावली बिहार सिंचाई, बाढ़ प्रबंधन एवं जल निस्सरण (संशोधन) नियमावली, 2015 कही जा सकेगी ।

(2) उसका विस्तार संपूर्ण बिहार राज्य में होगा ।

(3) यह तुरत प्रवृत होगी । 2. उक्त नियमावली, 2003 को नियम 4.9.11 एवं 4.9.12 क्रमशः निम्नलिखित द्वारा प्रतिस्थापित किए जाएंगे और नियम 4.9.13 विलोपित किया जाएगा :-

"4-9-11 योजना समीक्षा समिति द्वारा चयनित योजनाओं पर कार्यान्वयन की प्रक्रिया प्रारंभ करने के क्रम में योजना एवं विकास विभाग तथा वित्त विभाग द्वारा निर्दिष्ट नियमावली के अनुरूप सक्षम स्तर से प्रशासनिक स्वीकृति प्राप्त करने की कार्रवाई की जायेगी । प्रशासनिक स्वीकृति प्राप्त होते ही समय अनुसार अल्पकालीन सूचना/ सामान्य सूचना के अधीन निविदा आमंत्रित कर कार्य आरम्भ किया जायेगा ।

यदि कार्यकारी समय कम हो तो स्थायी संचालन समिति/विभाग योजनाओं पर अनुमोदन देते हुए यह निदेश देगा की प्रशासनिक स्वीकृति की प्रत्याशा में, इन योजनाओं के प्रति कार्यारम्भ आदेश निर्गत किया जाय । ऐसी स्थिति में विभाग द्वारा प्रशासनिक स्वीकृति प्रत्याशा में कार्य आरम्भ आदेश निर्गत किया जा सकेगा । क्षेत्रीय पदाधिकारी इस आदेश के आलोक में निविदा सूचना निर्गत कर निविदा आमंत्रित कर सकेंगे एवं कार्य का निष्पादन करायेगें । इस बीच इन योजनाओं पर पूर्व में वर्णित प्रक्रियानुसार प्रशासनिक स्वीकृति प्रदान करने की कार्रवाई की जायेगी :

परन्तु 30 करोड़ से अधिक (या भविष्य में भारत सरकार के संबंधित संस्थान द्वारा निश्चित की जाने वाली जो भी राशि हो) की लागत की योजनाओं की प्रशासनिक स्वीकृति एवं कार्यान्वयन की प्रक्रिया राज्य बाढ़ नियंत्रण पर्षद्‌ की एक स्थायी संचालन समिति के अनुमोदनोपरान्त ही प्रारंभ की जायेेगी । स्थायी संचालन समिति निम्नलिखित सदस्यों को मिलाकर गठित होगी :-

1. माननीय मंत्री, जल संसाधन विभाग, बिहार - अध्यक्ष 2. प्रधान सचिव, जल संसाधन विभाग, बिहार - सदस्य 3. सचिव, वित्त विभाग, बिहार - सदस्य 4. अध्यक्ष, गंगा बाढ़ नियंत्रण आयोग, पटना - सदस्य 5. अभियंता प्रमुख (उ0), जल संसाधन विभाग,पटना - सदस्य 6. संयुक्त सचिव, आपदा प्रबंधन विभाग, पटना - सदस्य 7. मुख्य अभियंता, केन्द्रीय रूपांकण एवं शोध - सदस्य 8. मुख्य अभियंता, योजना एवं मोनिटरिंग, जल संसाधन विभाग,पटना - सदस्य-सचिव स्थायी संचालन समिति द्वारा भारत सरकार के संबंधित संस्थान के अनुदेश के आलोक में 30 करोड़ से अधिक (या भविष्य में भारत सरकार के संबंधित संस्थान द्वारा निश्चित की जाने वाली जो भी राशि हो) की योजनाओं के अनुमोदन पर निर्णय लिया जाएगा तथा समिति द्वारा लिये गये निर्णयों से राज्य बाढ़ नियंत्रण पर्षद्‌ को इसकी आगामी बेैठक में अवगत कराया जायेगा ।

पर्षद निम्नलिखित सदस्यों को मिलाकर गठित होगा :- 1. मुख्यमंत्री, बिहार - अध्यक्ष 2. वित्त मंत्री, बिहार - सदस्य 3. मंत्री, जल संसाधन विभाग, बिहार - सदस्य 4. मंत्री, योजना एवं विकास विभाग, बिहार - सदस्य 5. मंत्री, राजस्व एवं भूमि सुधार विभाग, बिहार - सदस्य 6. मुख्य सचिव, बिहार - सदस्य3 (cid:28)बहार गजट (असाधारण), 21 (cid:23)दस(cid:25)बर 2015 7. प्रधान सचिव, वित्त विभाग, बिहार - सदस्य 8. विकास आयुक्त, बिहार - सदस्य 9. अभियंता प्रमुख (उत्तर) जल संसाधन विभाग, बिहार - सदस्य 10. अध्यक्ष, गंगा बाढ़ नियंत्रण आयोग, पटना - सदस्य 11. मुख्य अभियंता, पूर्वी रेलवे, कलकत्ता - सदस्य 12. मुख्य अभियंता, पूर्व-मध्य रेलवे, हाजीपुर - सदस्य 13. मुख्य अभियंता, पूर्वोत्तर रेलवे, गोरखपुर - सदस्य 14. प्रधान सचिव, जल संसाधन विभाग, बिहार - सदस्य सचिव 4-9-12 योजना समीक्षा समिति की बैठक के पूर्व यदि बाढ़ प्रक्षेत्र में उपलब्ध होने वाली निधि का स्पष्ट संकेत मिल जाय तो विभागीय योजना समीक्षा समिति, तकनीकी एवं वित्तीय स्थिति के मद्दे-नजर योजनाओं का चयन करेगी, अन्यथा पूर्व वर्ष में उपलब्ध की गई राशि के अन्तर्गत ही प्राथमिकता प्राप्त योजनाओं की प्रशासनिक स्वीकृति प्रदान करने की कार्रवाई की जायेगी ।"

3- O;ko`fr - ऐसे संशोधन के होते हुए भी, पूर्व प्रावधानों के अधीन किया गया कुछ भी या की गयी कोई कार्रवाई नये प्रावधानो के अधीन किया गया या की गयी समझी जाएगी मानो नये प्रावधान उस दिन प्रवृत थे जिस दिन वैसा कुछ किया गया या वैसी कोई कार्रवाई की गयी थी ।

No. L.G. 1-1-04196 laze-1681—In exercise of powers conferred by The Bihar irrigation Act, 1997 under section 115 (1) and (2), The Government of Bihar has proposed to amend section 4.9.11, 4.9.12 and 4.9.13 of The Bihar irrigation, Flood management and drainage rule, 2003, the draft of which is here by published for information of general public and inviting objections, if any. Objections, if any may be filed before the secretary, Water Resources Department, Government of Bihar , Sinchai Bhawan, Harding Road, Patna within one month of its publication in the official gazette. After disposal of the objection, if any, final publication of amendment in section 4.9.11, 4.9.12 and 4.9.13 of The Bihar irrigation, Flood management and drainage rule, 2003, may be made. Draft of amendment in section 4.9.11, 4.9.12 and 4.9.13 of The Bihar irrigation, Flood management and drainage rule, 2003 is here by annexed.

DRAFT NOTIFICATION

No. L.G.-1-1-04196 laze-1681- In exercise of the powers conferred under sub- section (1) and (2) of section 115 of The Bihar Irrigation Act, 1997 the Government of Bihar is hereby pleased to make the following Rules to amend The Bihar Irrigation Flood Management and Drainage Rules, 2003 :-

1. Short title, extent and commencement :—(1) These Rules may be called The Bihar Irrigation, Flood Management and Drainage (amendment) Rules, 2015.

(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force at once. 2. Rule 4.9.11 and 4.9.12 of the said Rules, 2003 shall be substituted by the following respectively and Rule 4.9.13 shall be deleted. :-

ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 21 (cid:23)दस(cid:25)बर 2015 "4.9.11 The schemes recomended for execution by the Departmental Scheme Review Committee shall be administratively approved by the competent authority as per the rule laid down by the Planning and Development Department and Finance Department, GOB. Once the administrative approval is accorded, tender invitation by means of Emergent/ General Notice will be called for and execution of work will be started.

If the working time is less, the Standing Steering Committee/Department while giving approval to the scheme shall give directive to issue work order to start the work in anticipation of administrative approval. In this situation "work order" may be issued by the department in anticipation of administrative approval . In the light of this order, field officers shall invite tender by issuing tender notice and get the work executed. In the meantime action shall be initiated as per laid down procedure mentioned above to accord administrative approval :

Provided that the process of administrative sanction and execution of work of schemes having cost more than 30 crores (or amount fixed by concerned Institution of Government of India in future) shall be started only after the approval of Standing Steering Committee of State Flood Control Board. Standing Steering Committee shall be constituted consisting of the following members-

Member Secretary The decision will be taken on the approval of the schemes costing more than 30 crores (or amount fixed by concerned Institution of Government of India in future) by the Standing Steering Committee in the light of Guidelines of the concerned Institution of Government of India and the decisions taken by the committee will be communicated to the State Flood Control Board in next meeting.

the technical and financial position, otherwise, the action to give administrative sanction for schemes getting preference within the budgetary provision of the preceding year."

3. Savings- Notwithstanding such amendments anything done or any action taken under the previous provisions shall be deemed to be done or taken under the new provisions as if these were come into force on the day on which such thing was done or such action was taken.
