सं. 100/ बिहार-एल.सी./6/2015(1)- यतः, बिहार राज्य की विधान-सभा के सदस्यों द्वारा विधान परिषद्‌ के लिए निर्वाचित श्री भीम सिंह का स्थान उनकी पदावधि, जो कि 6 मई 2018 सहित उस तारीख तक थी के समाप्त होने से पूर्व ही उनके त्यागपत्र देने के कारण, 23 अक्टूबर 2015 से रिक्त हो गया है, और

यतः इस प्रकार इुई रिक्ति को भरने के प्रयोजन से उप - चुनाव कराना है,

अतः अब लोक प्रतिनिधित्व अधिनियम 1951(1951 का 43) की धारा-151 धारा-39 की उप-धारा (1) और 56 के अनुसरण में भारत निर्वाचन आयोग एतद्‌द्‌वारा :-

(अ) बिहार राज्य के विधान-सभा के सदस्यों से यह अपेक्षा करता है कि वे 13 फरवरी 2016 (शनिवार) से पूर्व तथा उक्त अधिनियम और उसके तद्‌धीन बनाए गए नियमों और किए गए आदेशों के उपबंधो के अनुसार राज्य की विधान परिषद्‌ में उक्त रिक्ति को भरने के प्रयोजन से एक व्यक्ति निर्वाचित कर दे।

(क) नाम निर्देशन करने की अन्तिम तारीख - 1 फरवरी, 2016(सोमवार) (ख) नाम निर्देशन की समीक्षा की तारीख - 2 फरवरी, 2016(मंगलवार) (ग) अभ्यर्थिताए वापस लेने की अन्तिम तारीख - 4 फरवरी, 2016(गुरूवार) (ध) वह तारीख जिसको यदि आवश्यक हुआ तो मतदान होगा -11 फरवरी, 2016 (गुरूवार), और (ड़) वह तारीख जिसका पूर्व निर्वाचन समपन्न करा लिया जाएगा -13 फरवरी 2016,(शनिवार) नियत करता है और

(इ) 9.00 बजे पूर्वाह्‌न से 4.00 बजे अपराह्‌न तक का समय इस समय के रूप में नियत करता है जिसको यदि आवश्यक हुआ तो विनिदिष्ट तारीख को मतदान होगा।

सं. 100/ बिहार.एल.सी./6/2015(2) लोक प्रतिनिधित्व अधिनियम 1951 (1951 का 43) की धारा-21 के अनुसरण में और धारा 22 की उप-धारा (1) द्वारा प्रदत शक्तियों का प्रयोग करते हुए भारत निर्वाचन आयोग, बिहार राज्य सरकार के परामर्श से तारीख 25 जनवरी, 2016 को राज्य के शासकीय राजपत्र में प्रकाशित आयोग की अधिसूचना के अनुसरण में इस राज्य की विधान-सभा के सदस्यों द्वारा बिहार राज्य की विधान परिषद्‌ के लिए होने वाले उप-निर्वाचन के संबंध में एतदृदवाराः-

(i) नीचे की सारणी के स्तम्भ (1) में विनिदिष्ट अधिकारी को रिटर्निंग आफिसर के रूप में पदाभिहित करता है, और (ii) उक्त सारणी के स्तम्भ (2) में विनिदिष्ट अधिकारी को, रिटर्निंग आफिसर की उसके कृत्यों के पालन में सहायता के लिए सहायक रिटर्निंग आफिसर नियुक्त करता है।

No.100/BR-LC/6/2015 (1) : Whereas. the seat of Shri Bhim singh in the Legislative Council of the State of Bihar. elected by the members of the Legislative Assembly of the State, Has become vacant on 23th October 2015 by the reason of his resignation. before the expiration of his term of office which was up to and including the 6th May, 2018 and WHEREAS a bye-election is to be hold for the purpose of filling the vacancy so caused:

NOW. THEREFORE. in pursuance of section 151 sub-section(1) of section 39 and section 56 of the Representation of the People Act 1951 (43 of 1951), the Election commission of India hereby -

(A) Calls upon the members of the Legislative Assembly of the State of Bihar to elect. before 13th February. 2016 (Saturday) and in accordance with the provisions of the said Act and of the rules and orders made there under. a person for the purpose of filling the said vacancy in the Legislative Council of the State.

(B) appoints with respect to said election.

(a) The 1st February, 2016 (Monday) as the last date for making nominations:

(b) The 2 nd February, 2016 (Tuesday) as the date for the scrutiny of the nominations:

(d) The 11th February, 2016 ( Thursday) as the date on which a poill shall , if necessary be taken and

(e) The 13th February, 2016 ( Saturday) as the date before which the election shall be completed and

(C) fixes the hours from 9.00A.M. to 4.00P.M. as the hours during which the poll shall if necessary be taken on the date speofied above, for the election
