सं0 3/4/आई.डी./2016/एसडीआर/खण्ड-।—1. यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा-61 में यह उपबंधित है कि निर्वाचकों के प्रतिरूपण का निवारण करने की दृष्टि से उक्त अधिनियम की धारा-62 के अधीन वास्तविक निर्वाचकों को उनके मत देने के अधिकार को और अधिक प्रभावी बनाया जा सके, उक्त अधिनियम के अधीन नियमों द्वारा मतदान के समय निर्वाचकों की पहचान सुनिश्चित करने के उद्देश्य से निर्वाचकों के लिए निर्वाचक फोटो पहचान पत्र के प्रयोग हेतु नियमों के द्वारा उपबंध को बनाया जा सकता है तथा
2. यतः, निर्वाचकों का रजिस्ट्रीकरण नियम, 1960 को नियम 28 निर्वाचन आयोग को इस दृष्टि से कि निर्वाचकों के प्रतिरूपण का निवारण हो सके तथा मतदान के समय उनकी पहचान को सरल बनाया जा सके। निर्वाचकों को राज्य की लागत पर फोटोयुक्त निर्वाचक फोटो पहचान पत्र जारी करने के लिए निर्देश देने की शक्ति प्रदान करता है, तथा
3. यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 49ज(3) तथा 49ट(2)(ख) में यह अनुबंधित है कि जहां किसी निर्वाचन क्षेत्र के निर्वाचकों का निर्वाचक रजिस्ट्रीकरण नियम, 1960 के नियम 28 के उक्त उपबंधों के अधीन निर्वाचक फोटो पहचान पत्र दिये जाते हैं, निर्वाचकों को मतदान केन्द्र में अपना निर्वाचक फोटो पहचान पत्र दिखाना होगा तथा उनके द्वारा निर्वाचक फोटो पहचान पत्रों को नहीं दिखाए जाने व असमर्थ होने पर उन्हें मत डालने की अनुमति देने से इनकार किया जा सकता है, तथा
4. यतः, उक्त अधिनियम तथा नियमों के उपर्युक्त उपबंधों को मिलाकर एवं सामंजस्यपूर्ण ढंग से उनके अध्ययन से यह स्पष्ट होता है कि यद्यपि मत देने का अधिकार निर्वाचक नामावली में नाम के होने पर ही होता है, यह निर्वाचन आयोग द्वारा राज्य की लागत पर, मतदान के समय उनकी पहचान सुनिश्चित करने के उद्देश्य से प्रदान करवाए गए निर्वाचक फोटो पहचान पत्र के प्रयोग पर भी निर्भर करता है, तथा दोनों को एक साथ प्रयोग करना होता है,
5. यतः, निर्वाचन आयोग ने समयबद्ध योजना के अनुसार सभी निर्वाचकों को निर्वाचक फोटो पहचान पत्र (ईपीआईसी) जारी करने के निर्देश देते हुए दिनांक 28 अगस्त, 1993 को एक आदेश जारी किया है, तथा
6. यतः, उारप्रदेश, मध्य प्रदेश, कर्नाटक, बिहार, तेलगांना, महाराष्ट्र, पंजाब और त्रिपुरा राज्यों के निर्वाचकों को काफी हद तक उच्च प्रतिशत में निर्वाचक फोटों पहचान पत्र जारी किए जा चुके हैं, तथा
7. यतः ,इसके अलावा, आयोग ने यह आदेश दिया है कि र्वामान उप-निर्वाचनों की मतदान तिथि से पूर्व मतदाताओं को 'प्रमाणिक फोटो मतदाता पर्ची' बाटी जाएगी।
8. अतः, अब सभी संबद्ध घटकों तथा विधिक एवं तथ्यात्मक स्थितियों को ध्यान में रखते हुए निर्वाचन आयोग एतद्द्वारा, यह निदेश देता है कि 20.01.2016 को अधिसूचित उारप्रदेश के 14-मुजफ्फर नगर, 274-बीकापुर एवं 5-देवबन्द विधान-सभा निर्वाचन क्षेत्रों, कर्नाटक के 56-देवदुर्ग (अ.ज.जा.), 50-बीदर एवं 158-हेब्बल विधान-सभा निर्वाचन क्षेत्रों, तेलगांना के 35-नारायण खेड विधान-सभा निर्वाचन क्षेत्र, मध्य प्रदेश के 65-मैहर विधान-सभा क्षेत्र, महाराष्ट्र के 130-पालघर (अ.ज.जा.) विधान-सभा क्षेत्र, पंजाब के 24-खाडूर साहिब विधान-सभा क्षेत्र, बिहार के 31-हरलाखी विधान-सभा क्षेत्र और त्रिपुरा के 42-अमरपुर के विधान-सभा क्षेत्र के उप-निर्वाचनों के लिए सभी मतदाता जिन्हें निर्वाचक फोटो पहचान पत्र जारी किए गए हैं मतदान स्थल पर मत डालने से पहले पहचान सुनिश्चित करते हुए अपना निर्वाचक फोटो पहचान पत्र दिखाएंगे। ऐसे निर्वाचक जो अपना निर्वाचक फोटो पहचान पत्र प्रस्तुत नहीं कर पाते हैं, उन्हें अपनी पहचान स्थापित करने के लिए निम्नलिखित वैकल्पिक फोटो पहचान दस्तावेजों में से कोई एक प्रस्तुत करना होगाः-
(I) पासपोर्ट (II) ड्राइविंग लाइसेंस (III) राज्य/केन्द्र सरकार, सार्वजनिक क्षेत्र के उपक्रमों/पब्लिक लिमिटेड कम्पनियों द्वारा अपने कर्मचारियों को जारी किए गए फोटोयुक्त सेवा पहचान पत्र
(IV) बैंकों/डाकघरों द्वारा जारी किए गए फोटोयुक्त पासबुक (V) पैन कार्ड (VI) आरजीआई एवं एनपीआर द्वारा जारी किए गए स्मार्ट कार्ड (VII) मनरेगा जॉव कार्ड (VIII) श्रम मंत्रालय की योजना के अन्तर्गत जारी स्वास्थ्य बीमा स्मार्ट कार्ड (IX) फोटोयुक्त पेंशन दस्तावेज (X) निर्वाचन तंत्र द्वारा जारी प्रमाणिक फोटो मतदाता पर्ची, एवं (XI) सांसदों, विधायकों/विधान परिषद् सद्स्यों को जारी किए गए सरकारी पहचान पत्र। 9. ईपीआईसी के संबंध में, लेखन अशुद्धि, वर्तनी की अशुद्धि इत्यादि को नजरअंदाज कर देना चाहिए बशर्ते मतदाता की पहचान ईपीआईसी से सुनिश्चित की जा सके। यदि कोई मतदाता फोटो पहचान पत्र प्रदर्शित करता है, जो कि किसी अन्य सभा निर्वाचन क्षेत्र के निर्वाचन रजिस्ट्रीकरण ऑफिसर द्वारा जारी किया गया है, ऐसे ईपीआईसी भी पहचान स्थापित करने हेतु स्वीकृत किए जाएंगें बशर्ते निर्वाचक का नाम जहां वह मतदान करने आया है उस मतदान स्थल से संबंधित निर्वाचक नामावली में उपलब्ध होना चाहिए। यदि फोटोग्राफ इत्यादि के वेमेल होने के कारण मतदाता की पहचान सुनिश्चित करना संभव न हो तब मतदाता को उपर्युक्त पैरा 8 में वर्णित किसी एक वैकल्पिक फोटो दस्तावेज को प्रस्तुत करना होगा।3 (cid:27)बहार गजट (असाधारण), 10 फरवर(cid:21) 2016 10. उक्त पैरा 8 में किसी बात के होते हुए भी, प्रवासी निर्वाचक जो अपने पासपोर्ट में विवरणों के आधार पर लोकप्रतिनिधित्व अधिनियम, 1950 की धारा-20क के अधीन निर्वाचक नामावलियों में पंजीकृत हैं, उन्हें मतदान केन्द्र में उनके केवल मूल पासपोर्ट (तथा कोई अन्य पहचान दस्तावेज नहीं) के आधार पर ही पहचाना जाएगा।

ELECTION COMMISSION OF INDIA —————— ORDER NirvachanSadan, AshokaRoad, New Delhi – 110001 Dated: 2nd February, 2016 No. 3/4/ID/2016/SDR/Vol.1—1. Whereas. Section 61 of the Representation of the People Act, 1951 provides that with a view to preventing impersonation of electors. so as to make the right of genuine electors to vote under section 62 of that Act more effective, provisions may be made by rules under that Act for use of Electors Photo Identity Card for electors as the means of establishing their identity at the time of polling: and
2. Whereas, Rule 28 of the Registration of Electors Rules, 1960 empowers the Election Commission to direct, with a view to preventing impersonation of electors and facilitating their photographs at State cost: and
3. Whereas, Rules 49H(3) and 49R(b) of the Conduct of Elections Rules, 1961, stipulate than where the electors of a Constituency have been supplied with Electors Photo Identity Card under the said provisions of Rule28 of the Registration of Electors Rules, 1960, the electors shall produce their Electors Photo Identity Card at the polling station and failure or refusal on their part to produce those Electros Photo Identity Card may result in the denial of permission to vote. and
4. Whereas, a combined and harmonious reading of the aforesaid provisions of the said Act and the Rules, makes it clear that although the fight to vote arises by the existence of the name in the electoral roll, it is also dependent upon the use of the Electors Photo Identity Card, wherever it has been provided by the Election Commission at State cost, as the means of establishing their identity at the time of polling and that both are to be used together: and
5. Whereas, the Election Commission made an Order on the 28th August, 1993, directing the issue of Electors Photo Identity Card (EPIC) to all electors, according to a time bound programme: and
6. Whereas, Electors Photo Identity Card have been issued to substantially high percentage of the electors in the States of Uttar Pradesh, Madhya Pradesh, Karnataka, Bihar, Telangana, Maharashtra, Punjab and Tripura
7. Whereas, in addition the Commission has directed that 'Authenticated Photo Voters Slip shall be distributed to the electors before the date at poll for the current bye – election,
8. Now,therefore after taking into account all relevant factors and the legal and factual position, the Election Commission hereby directs that for the current by election from 14-Muzaffar Nagar 274-Bikapur and 5-Deoband Assembly Constituencies in Uttar Pradesh. 56-devadurga (ST), 50-Bidar, 158-Hebbal Assembly Constituencies in Karnataka, 35-Narayankhed Assembly Constituency in Telangana, 65-Maihar Assembly Constituency in Madhya Pradesh, 130-Palghar (ST) Assembly Constituency in Maharashtra, 24-Khadoor Sahib Assembly Constituency in Punjab, 31-Harlakhee Assembly Constituency in Bihar and 42-Amarpur Assembly Constituency in Tripura, which have been notified on 20.01.2016, all electors who have been issued EPIC, shall produce the EPIC for their identification at the polling station before casting their votes. Those electors who are not able to produce the 4 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 10 फरवर(cid:21) 2016 EPIC shall produce one of the following alternative photo identity documents for establishing their identity:-
(i) Passport; (ii) Driving License; (iii) Service Identity Cards with photograph issued to employees by Central/State Govt. PSUs/Public Limited Companies;
(iv) Passbooks with photograph issued by Bank/Post Office; (v) PAN Card; (vi) Smart Card issued by RGI under NPR; (vii) MNREGAJob Card; (viii) Health insurance Smart Card issued under the scheme of Ministry of Labour;
(ix) Pension document with photograph; (x) Authenticated Photo Voter Slip issued by the election machinery, and (xi) OfficialIdentity cards issued to MPs/MLAs/MLCs. 9. In the case of EPIC, clerical errors, spelling mistakes, etc, should be ignored, provided the identity of the electors can be established by the EPIC, if an elector produces an Electors Photo Identity Card, which has been issued by the Electoral Registration Officer of another Assembly Constituency, such EPICs shall also be accepted for identification, provided the name of that elector finds place in the electoral poll pertaining to the polling station where the elector has turned up for voting. If it is not possible to establish the identity of the elector on account of mismatch of photograph, etc, the elector shall have to produce one of the alternative photo documents mentioned in para & above.
10. Notwithstanding anything in Para 8 above, overseas electors who are registered in the electoral rolls under Section 20A of the Representation of the People Act. 1950 based on the particulars in their Passport, shall be identified on the basis of their original passport only (and no other identity document) in the polling station.
