Amendment to Bihar Electricity Supply Code, 2007

Short title and commencement:-

1. Short title and commencement:

(i) This code may be called the "Bihar Electricity Supply Code (5th This code may be called the "Bihar Electricity Supply Code (5 Amendment), 2016. Amendment), 2016. Clause 4.11

The format of the application form as provided in Annexure-1 (L.T. Connection) shall be replaced by the format of the application form provided in Annexure 1 (Hindi version) and Annexure-1A (English version).

4. Amendment in chapter 7

(i) Addition of new sub clause 7.4 (i)

A new sub clause 7.4 (i) shall be added at the end of existing sub clause 7.4 (h) of the code. "7.4(i) If the actual recorded demand of a consumer having demand based tariff exceeds 110% of the contracted demand, consecutively for three months, the licensee shall issue a notice informing the consumer to get additional contract demand sanctioned as per the tariff or to limit their drawl as per their contract. In case the consumer does not respond to the notice within 30 days of issue of notice to get additional demand sanctioned as per the tariff or limit their drawal as per the contract, the licensee may disconnect the supply to the consumer, after serving fifteen days notice. However, the distribution licensee may revise and enhance the contract demand as per the tariff of the consumer to the extent of highest demand recorded in the past three months of the violation, provided the consumer agrees for the same."

(ii) Addition of new sub clause 7.4 (j)

A new sub clause 7.4(j) shall be added at the end of sub clause 7.4(i)

"7.4(j) If on inspection of premises of a consumer having connected load based tariff, the connected load is found to be in excess over the contracted/ sanctioned load, the licensee shall issue a notice and inform the consumer to get additional connected load sanctioned as per the tariff or limit the drawl as per sanctioned load.

In case the consumer does not respond to the notice within 30 days of issue of notice to get additional load sanctioned as per the tariff or limit drawl as per sanctioned load, the licensee may disconnect the supply to the consumer after serving fifteen days notice,

However the distribution licensee may revise and enhance the sanctioned load as per the tariff of the consumer to the extent of connected load found on inspection provided the consumer agrees for the same."

(iii) Sub clause 7.11(3)

The sub Clause 7.11 (3) shall be substituted by the following:- "The application for enhancement of the contract demand shall not be rejected on the ground of any arrears of payment of the licensee's dues, if the electricity connection of the consumer is running."3 BIHAR GAZETTE (EXTRA), 26TH FEBRUARY 2016

(iv) Sub clause 7.15(3)

The following portion appearing after 'previous 12 months' in sub clause 7.15(3) of the code shall be deleted:- "For LT consumer and half yearly on the basis of consumption during the previous six months for HT/EHT consumers."

The following shall be added at the end of clause 9.15 of the code:- "However non filing of report or abnormality report, if any filed by the meter reader shall not over rule the Meter Reading Instrument (MRI) report and/or the report of National Accreditation Board of Testing and Calibration Laboratory (NABAL) accredited Laboratory."

(iii) Addition of new sub clause 9.20 (cc)

A new sub clause 9.20(cc) shall be added as stated below:- "9.20(cc) Total hours of supply during billing cycle shall be indicated/mentioned in the bill. However this provision shall apply to such consumers only where energy meter has facility of recording total hours of supply during billing cycle."

(iv) Clause 9.23

The following shall be added at the end of Clause 9.23:- "However, if sought by the consumer(s), the licensee shall have an obligation to provide the details of arrears and DPS indicating clearly the period and amount of the same."

आवेदकाें के लिए सामान्य अनुदेश

1. सिंगल फेज कनेक्शन के लिए संबंधित कनीय विद्युत अभियंता को तथा थ्री फेज लोड के लिए सहायक विद्युत अभियंता को आवेदन करें।

2. आवेदक इस आवेदन के साथ देय आवेदन शुल्क प्रतिभूति राशि, प्राक्कलित राशि आदि का आकलन संलग्न तालिका से करते हुए इन सभी का भुगतान तथा अनुलग्नकों के साथ कंपनी के स्थानीय कलेक्शन काउन्टर पर जमा करें।

3. आवेदन करने के लिए कनीय विद्युत अभियंता या सहायक विद्युत अभियंता के हस्ताक्षर या पृष्ठांकन की आवश्यकता नही है।

4. आवेदक तत्काल संबंध के लिए आवेदन कर सकता है जिसके तहत आवेदक को सामान्य दर की दोगुणी राशि या समय-समय पर आयोग द्वारा निर्धारित राशि जमा करनी होगी तथा आधे समय में आवेदक को विद्युत संबंध दे दिया जायेगा।

5. उपभोक्ता द्वारा आवेदन के समय विभिन्न मदों में जमा की जाने वाली राशि (दर प्रति वर्ष बिहार विद्युत विनियामक आयोग द्वारा निर्गत टैरिफ आदेश के द्वारा पूर्ण निर्धारित होती है। प्रभावी दर समय-समय पर परिवर्तनीय है। आवेदक प्रभावी दर की जानकारी ले लें)।

जमा करनी है। लेकिन लोक उपक्रम तथा स्थानीय निकायों को प्रतिभूति राशि जमा करनी होगी। 7. विभिन्न कोटि के आवेदकों द्वारा आवेदन शुल्क प्रतिभूति राशि मजदूरी, पर्यवेक्षण एवं स्थापना शुल्क का अग्रिम भुगतान किया जायेगा।

8. नये विद्युत संबंध में लिए समस्त सामग्री (मीटर छोड़कर) आवेदक द्वारा उपलब्ध कराया जायेगा। विशेष परिस्थिति में मीटर आवेदक द्वारा उपलब्ध कराने पर मीटर जाँच शुल्क (सिंगल फेज-100 रू0, थ्री फेज, सी0टी0 के साथ 300 रू) आवेदक द्वारा देय होगा।

9. उपरोक्त राशि शुल्क समय-समय पर निर्गत टैरिफ आदेश के अनुसार परिवर्तनीय होगी। 10. उन मामलों में जहाँ आवेदक को नये विद्युत संंबंध देने के लिए लाईसेन्सी को अपने डिस्ट्रीब्यूशन मेन्स के विस्तार करने की आवश्यकता है, लाईसेन्सी विद्युत्‌ आर्पूाि संहिता 2007 की कंडिका 4.21 तथा 4.22 के अधीन आवेदक को अतिरिक्त कार्य हेतु प्राक्कलन समर्पित किया जायेगा। ऐसे अतिरिक्त प्राक्कलित राशि का भुगतान आवेदक द्वारा नियत अवधि के अंदर किया जायेगा।

11. अगर उक्त मद में आवेदक द्वारा जमा की गई राशि वास्तविक राशि से कम होगी तब अंतर की राशि उनके अगले विपत्र में भारित कर दी जायेगी।10 BIHAR GAZETTE (EXTRA) 26TH FEBRUARY 2016 12. घरेलू उपभोक्ता के लिए कुलर/पंखा या रूम हीटर में जिसका भार अधिक हो उसे ही कुल भार में आंकलित किया जायेगा।

13. घरेलू उपभोक्ता के मामले में दिसम्बर, जनवरी तथा फरवरी में रूम हीटर तथा गीजर के भार तथा अप्रील से सितम्बर माह तक एयर कंडिशनर (बिना हीटर) का भार आकलित होगा।

14. अपने परिसर के विद्युत भार की गणना के लिए निम्नलिखित तालिका का प्रयोग करे।
