सं॰ 8प॰/वि॰-4-09/2015-1433—बिहार पंचायत राज अधिनियम, 2006 की धारा-146 द्वारा प्रदत शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल एतद् द्वारा बिहार पंचायत निर्वाचन नियमावली, 2006 का संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैंः-
1. संक्षिप्त नाम, विस्तार और प्रारंभ।-(1) यह नियमावली बिहार पंचायत निर्वाचन (संशोधन) नियमावली, 2016 कही जा सकेगी।
(2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (3) यह भूतलक्षी प्रभाव से, दिनांक 09.09.2009 से प्रवृत होगी।
2. नियमावली के नियम 11 में संशोधन।-(1) उक्त नियमावली, 2006 के नियम 11 का उप-नियम (1) निम्नलिखित द्वारा प्रतिस्थापित किया जायेगाः- ''(1) पंचायतों मेें अनुसूचित जाति, अनुसूचित जनजाति, पिछड़ा वर्ग एवं अन्य कोटि के लिए निर्वाचन क्षेत्रों का आवंटन।- विभिन्न कोटियों को अनुमान्य संख्या में चक्रानुक्रम में यथासंभव वही निर्वाचन क्षेत्र आवंटित किये जायेंगे, जिनमें जिला दण्डाधिकारी द्वारा अवरोही क्रम में उस कोटि की निकाली गयी जनसंख्या अन्य निर्वाचन क्षेत्रों में उस कोटि की जनसंख्या से अपेक्षाकृत अधिक पाई जायेः पिछड़ा वर्ग कोटि को अनुमान्य संख्या में चक्रानुक्रम में नियम 9 के उप-नियम (3) में विहित शेष निर्वाचन क्षेत्रों से यथासंभव वे निर्वाचन क्षेत्र आवंटित किये जायेंगे, जो उनकी (शेष निर्वाचन क्षेत्रों की) कुल जनसंख्या के अवरोही क्रम मेें पहले आते होंः प्रथम चक्र में विभिन्न कोटियों को अनुमान्य आरक्षित निर्वाचन क्षेत्रों के आवंटन हेतु अनुसूचित जनजाति, अन्य एवं अनुसूचित जाति के क्रम में निर्वाचन क्षेत्र आवंटित किये जायेंगे तथा शेष निर्वाचन क्षेत्रों को आवंटित करने के लिए इसी क्रम की पुनरावृाि की जायेगीः द्वितीय चक्र में विभिन्न कोटियों को अनुमान्य आरक्षित निर्वाचन क्षेत्राें के आवंटन हेतु अन्य, अनुसूचित जाति एवं अनुसूचित जनजाति के क्रम में निर्वाचन क्षेत्र आवंटित किये जायेंगे तथा शेष निर्वाचन क्षेत्रों को आवंटित करने के लिए इसी क्रम की पुनरावृाि की जायेगीः2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 26 फरवर(cid:15) 2016 तृतीय चक्र में विभिन्न कोटियों को अनुमान्य आरक्षित निर्वाचन क्षेत्राें के आवंटन हेतु अनुसूचित जाति, अनुसूचित जनजाति एवं अन्य के क्रम में निर्वाचन क्षेत्र आवंटित किये जायेंगे तथा शेष निर्वाचन क्षेत्रों को आवंटित करने के लिए इसी क्रम की पुनरावृाि की जायेगी।'' बाद के चुनावों में निर्वाचन क्षेत्रों को आवंटित करने के लिए इसी क्रम की पुनरावृत्ति की जायेगी।
(2) उक्त नियमावली, 2006 के नियम 11 के उप-नियम (2) में प्रयुक्त शब्द ''पिछड़ा वर्ग'' एतद् द्वारा विलोपित किया जाता है।
(3) उक्त नियमावली, 2006 के नियम 11 के उप-नियम (3) के पश्चात् निम्नलिखित नया उप-नियम (4) अन्तःस्थापित किया जायेगाः-
''(4) अनुसूचित जाति, अनुसूचित जनजाति, पिछड़ा वर्ग एवं इन कोटियों की महिलाओं तथा अनारक्षित श्रेणी की महिलाओं के पदों में आरक्षण के प्रयोजनार्थ चक्रानुक्रम सिद्धान्त बिहार पंचायत राज अधिनियम, 2006 के प्रारंभ होने के पश्चात् हुए प्रथम निर्वाचन से प्रारंभ होगा।''
3. बिहार पंचायत निर्वाचन नियमावली, 2006 के प्रपत्र-1 का संशोधन।- प्रपत्र-1 के स्तम्भ ''3'' में जनसंख्या के स्थान पर ''कुल जनसंख्या'' पढ़ा जायेगा, एवं दो अतिरिक्त स्तम्भ 4 एवं 5 जोड़कर उनमेें क्रमशः ''अनुसूचित जाति की जनसंख्या'' एवं ''अनुसूचित जनजाति की जनसंख्या'' के लिए प्रावधान किया जायेगा। तदनुरूप वर्तमान स्तम्भ ''4'' को स्तम्भ ''6'' के रूप में पुनर्संख्यांकित समझा जायेगा।
4. बिहार पंचायत निर्वाचन नियमावली, 2006 के प्रपत्र-2, भाग-एक, भाग-दो एवं भाग-तीन का संशोधन।- (क) उक्त नियमावली, 2006 के प्रपत्र-2, भाग-एक में स्तम्भ ''3'' को विलोपित किया जायेगा एवं स्तम्भ 4, 5, 6, 7, 8, 9 एवं 10 को क्रमशः स्तम्भ 3, 4, 5, 6, 7, 8 एवं 9 के रूप में पुनर्संख्यांकित समझा जायेगा। (ख) उक्त नियमावली, 2006 के प्रपत्र-2, भाग-दो में स्तम्भ ''5'' को विलोपित किया जायेगा, एवं स्तंभ ''6'' को स्तंभ ''5'' के रूप में पुनर्संख्यांकित किया जायेगा। स्तंभ ''7'' को स्तंभ ''6'' के रूप में पुनर्संख्यांकित समझा जायेगा।
(ग) उक्त नियमावली, 2006 के प्रपत्र-2, भाग-तीन के स्तंभ ''6'' एवं स्तंभ ''7'' (खंड III) को विलोपित किया जायेगा। स्तंभ ''8'' (खंड IV) को स्तंभ ''6'' (खंड III) के रूप में पुनर्संख्यांकित समझा जायेगा तथा स्तंभ ''9'' (खंड IV) को स्तंभ ''7'' (खंड III) के रूप में पुनर्संख्यांकित समझा जायेगा।

No. 8प॰/वि॰-4-09/2015-1433—In exercise of the powers conferred by Section 146 of the Bihar Panchayat Raj Act, 2006 (Bihar Act 6, 2006), the Governor of Bihar is pleased to make the following Rules to amend the Bihar Panchayat Election Rules, 2006:-
1. Short title, extent and commencement.– (1) Those Rules may be called the Bihar Panchayat Election (Amendment) Rules, 2016.
(2) It shall extend to the whole of the State of Bihar; (3) It shall come into force, with retrospective effect, from the date 09.09.2009.
2. Amendment in Rule 11 of the said Rules, 2006:- (1) Sub-rule (1) of Rule 11 of the said Rules, 2006 shall be substituted by the following:-
"(1) Allotment of constituencies for Scheduled Castes, Scheduled Tribes, Backward Classes and Other Categories in Panchayats.– As far as possible only such constituencies shall be allotted to different categories in admissible number and in rotation whose population, on the basis of calculation in the descending order by the District Magistrate, is found comparatively higher than other constituencies:
As far as possible, those constituencies out of the remaining constituencies as prescribed in sub-rule (3) of Rule 9, shall be allotted to the Backward Classes category, in admissible number and on rotational basis, whose population comes first in descending order of their (of the remaining constituencies) total population.
In the first round, for the purpose of allotment of reserved electoral constituencies admissible to different categories, allotment of constituency shall be made in the order of Scheduled Tribes, Others and Scheduled Castes and for the allotment of the remaining constituencies the same order will be repeated:
In the second round, for the purpose of allotment of reserved electoral constituencies admissible to different categories, allotment of constituency shall be made in the order of Others,3 (cid:29)बहार गजट (असाधारण), 26 फरवर(cid:15) 2016 Scheduled Castes and Scheduled Tribes and for the allotment of the remaining constituencies the same order will be repeated:
In the third round, for the purpose of allotment of reserved electoral constituencies admissible to different categories, allotment of constituency shall be made in the order of Scheduled Castes, Scheduled Tribes and Others and for the allotment of the remaining constituencies the same order will be repeated."
The same rotation shall be followed for the allotment of electoral constituencies in subsequent elections.
(2) The words "Backward Classes" used in sub-rule (2) of rule-11 of the said Rules, 2006 is hereby deleted.
(3) The following new sub-rule (4) shall be inserted after sub-rule (3) of rule 11 of the said Rules, 2006:-
"(4) The principle of rotation for the purpose of reservation of offices for Scheduled Castes, Scheduled Tribes, Backward Classes and women of this categories and women of unreserved category shall commence from the first election held after the commencement of the Bihar Panchayat Raj Act, 2006"
3. Amendment of Form-1 of the Bihar Panchayat Election Rules, 2006.— In column "3" of Form-1 "total population" shall be read in place of "population" and two additional columns 4 and 5 shall be added making provisions of population of "Scheduled Castes" and "Scheduled Tribes" respectively. Accordingly the existing column-4 shall be deemed to have been renumbered as Column "6"
4. Amendment of Form-2, Part 1, Part Two and Part Three of the Bihar Panchayat
Election Rules, 2006.-
(a) Column "3" of Part One, Form 2 of the Rules shall be deleted and columns 4, 5, 6, 7, 8, 9 and 10 shall be deemed to have been renumbered as Column 3, 4, 5, 6, 7, 8 and 9 respectively.
(b) Column "5" of Part Two, Form 2 of the said Rules, 2006 shall be deleted and Column "6" will be deemed to have been renumbered as Column 5. The Column "7" will be deemed to have been renumbered as Column "6".
(c) Column "6" and Column "7" (Section III) of Part III, Form-2 of the said Rules, 2006 shall be deleted. Column 8 (Section IV) will be deemed to have been renumbered as Column 6 (Section III) and Column 9 (Section IV) will be deemed to have been renumbered as Column 7 (Section III).
