इस अवकाष के दौरान श्रीमती परवीन जहाँ को वही छुट्‌टी वेतन प्राप्त होगा जो छुट्‌टी पर प्रस्थान करने के पहले प्राप्त कर रही थी।

सं॰ कौन/भी-116/2002-52/सी—चौक थाना कांड संख्या-69/02, दिनांक 17.04.2002 के अभियुक्त सुश्री अफशॉ अज़ीम, वाणिज्य-कर पदाधिकारी, मुख्यालय, बिहार, पटना को उक्त कांड में सिविल कोर्ट के माननीय अपर जिला एवं सत्र न्यायालय, पटना द्वारा दिनांक 14.09.2015 को दोष सिद्ध प्रमाणित पाये जाने के उपरांत तत्काल प्रभाव से न्यायिक हिरासत में लिए जाने के फलस्वरूप बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 के नियम 9(2)(ख) के तहत्‌ हिरासत में लिए जाने की तिथि 14.09.2015 के भूतलक्षी प्रभाव से निलंबित किया गया था।

2. Criminal Appeal (DB) No. 806/2015 अफशॉ अज़ीम बनाम बिहार राज्य में दिनांक 10.11.2015 को माननीय उच्च न्यायालय, पटना द्वारा पारित आदेश के आलोक में श्रीमती अज़ीम दिनांक 11.11.2015 के अपराह्‌न में जमानत पर कारावास से मुक्त होने के उपरान्त दिनांक 12.11.2015 के पूर्वाह्‌न में योगदान किया है। उन्हें बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 के नियम 9(3)(i) के तहत्‌ योगदान स्वीकार करते हुये दिनांक 12.11.2015 के पूर्वाह्‌न से निलंबन मुक्त किया जाता है एवं श्रीमती अफशॉ अज़ीम को माननीय अपर जिला एवं सत्र न्यायालय, पटना द्वारा दिनांक 14.09.2015 को दोष सिद्ध प्रमाणित पाये जाने के पश्चात्‌ उन्हें दिनांक 21.09.2015 को उम्रकैद की सजा तथा 10 (दस) हजार रुपये का जुर्माना की सजा अधिरोपित किये जाने के फलस्वरूप उन्हें बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 के नियम 9(3)(ii) के तहत्‌ दिनांक 12.11.2015 के पूर्वाह्‌न से पुनः निलंबित किया जाता है।

3. इन्हें निलंबन अवधि में बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 के नियम 10(1) के तहत्‌ अनुमान्य जीवन-निर्वाह भाा देय होगा।

प्रस्ताव पर सक्षम प्राधिकार का अनुमोदन प्राप्त है।

चूँकि बिहार-राज्यपाल को यह विश्वास करने का कारण है कि श्री प्रताप नारायण सिंह, बिहार कारा सेवा, तत्कालीन काराधीक्षक सम्प्रति प्रभारी पदाधिकारी (अ0रा0), कारा एवं सुधार सेवाएँ निरीक्षणालय, बिहार, पटना के मंडल कारा, जमुई में पदस्थापन के दौरान बंदी नरेष यादव की ईलाज में लापरवाही के फलस्वरूप दिनांक 11.04.2010 को सदर अस्पताल, जमुई में ईलाज के दौरान हुई मृत्यु की घटना उनकी लापरवाही, कर्त्तव्योपेक्षा एवं प्रषासनिक विफलता का द्योतक है।

2. साथ ही सी0डब्लू0जे0सी0 संख्या-13577/2010 सुनैना देवी बनाम राज्य सरकार एवं अन्य में माननीय उच्च न्यायालय, पटना द्वारा पारित न्यायादेष है कि मृत बंदी के मौलिक अधिकार का हनन राज्य सरकार के पदाधिकारियों द्वारा किया गया है। बंदी नरेष यादव की घातक रूप से पिटाई की गई जिसके फलस्वरूप उसकी मृत्यु हो गई। माननीय न्यायालय ने वादी श्रीमती सुनैना देवी को, उनके पति बंदी स्व0 नरेष यादव की अभिरक्षा में मंडल कारा जमुई में हुई अप्राकृतिक मृत्यु के फलस्वरूप मो0- 20,00000/- (बीस लाख) रूपया मुआवजा का भुगतान करने का आदेष पारित किया है तथा दोषी कर्मियों के विरूद्ध विभागीय कार्यवाही संस्थित करने का निदेश है।

3. श्री सिंह का यह कृत्य बिहार कारा हस्तक के विहित प्रावधानों के सर्वथा प्रतिकूल है, जैसा कि संलग्न आरोप पत्र में वर्णित है।

4. अतः यह निर्णय लिया गया है कि श्री प्रताप नारायण सिंह, तत्कालीन काराधीक्षक, मंडल कारा, जमुई सम्प्रति प्रभारी पदाधिकारी (अ0र0) कारा एवं सुधार सेवाएँ निरीक्षणालय, बिहार, पटना के विरूद्ध संलग्न प्रपत्र में अंकित आरोपों की जाँच के लिए बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 के सुसंगत प्रावधानों के आलोक में विभागीय कार्यवाही संचालित की जाय।

5. इस विभागीय कार्यवाही के संचालन के लिए बिहार सरकारी सेवक (वर्गीकरण, नियंत्रण एवं अपील) नियमावली, 2005 के नियम 17(2) के तहत्‌ विभागीय जाँच आयुक्त, बिहार, पटना को संचालन पदाधिकारी तथा अधीक्षक, मंडल कारा, जमुई को उपस्थापन पदाधिकारी नियुक्त किया जाता है।

6. श्री सिंह से अपेक्षा की जाती है कि वे अपने बचाव के संबंध में अपना पक्ष रखने हेतु, जैसा कि संचालन पदाधिकारी अनुमति दें, उनके समक्ष स्वयं उपस्थित हों।

7. विभागीय कार्यवाही के संचालन के प्रस्ताव में माननीय मुख्य (गृह) मंत्री का अनुमोदन प्राप्त है। 8. संचालन पदाधिकारी विभागीय कार्यवाही का जाँच प्रतिवेदन निर्धारित अवधि के अन्दर समर्पित करेंगे। आदेशः- आदेश दिया जाता है कि इस संकल्प की प्रति बिहार राजपत्र के अगले अंक में प्रकाशित की जाय तथा इसकी प्रति सभी संबंधित को भेज दी जाय।

Vi. /Stha (Vi.Nya.)-09/2015-642—WHEREAS, It is alleged that Sri Vijay Kumar Sinha, the then Assistant Engineer, Ganga Sone Flood Protection Division, Digha, Patna, Water Resource Department, Bihar, Patna, the then deputed at Kusha Barrage, Birpur, Supaul. S/o Sri Laxmi Prasad Sinha, Present Address : House No. E-4, Savitri Sadan, Road No.-6/D, Sadhanapuri, Gardanibagh, Patna-800001, while holding the post of Sri Vijay Kumar Sinha, the then Assistant Engineer, Ganga Sone Flood Protection Division, Digha, Patna, Water Resource Department, Bihar, Patna, the then deputed at Kusha Barrage, Birpur, Supaul and serving in different capacitiesNबहार गजट, 2 माच# 2016 6 under Bihar Government, committed the offence of criminal misconduct defined under clause (e) of sub- section (1) of Section 13 of the Prevention of Corruption Act, 1988 and that the matter is being investigated in Vigilance investigation Bureau Vide Vig. AND WHEREAS, on scrutiny of relevant materials available on record, the State Government is of the opinion that there is prima facie case of Commission of above mentioned criminal misconduct by said Sri Vijay Kumar Sinha, the then Assistant Engineer, Ganga Sone Flood Protection Division, Digha, Patna, Water Resource Department, Bihar, Patna, the then deputed at Kusha Barrage, Birpur, Supaul, who has accumulated properties disproportionate to his known sources of income by resorting to corrupt means.

AND WHEREAS, it is felt necessary and expedient by the Government that the said offender should be tried for confiscation of the properties mentioned in the application by the Special Court Established under sub-section (1) of Section 3 of Bihar Special Courts Act, 2009;

NOW, THEREFORE, in exercise of the powers conferred by sub-section (1) of Section 5 of Bihar Special Courts Act, 2009, the State Government do hereby declare that the said offence be dealt with under the provision of Special Courts Act, 2009.

The then deputed at Kusha Barrage, Birpur, Supaul, and serving in different capacities under Bihar Government, committed the offence of criminal misconduct defined under clause (e) of sub-section (1) of Section 13 of the Prevention of Corruption Act, 1988 and that the matter is being investigated in Vigilance investigation Bureau Vide Vig. P.S. Case No. 01/2014/SVU/Patna dated 23.01.2014.

AND WHEREAS, on scrutiny of relevant materials available on record, the State Government is of the opinion that there is prima facie case of Commission of above mentioned criminal misconduct by said the Chief Engineer (Retd.), Water Resources Department, Govt. of Bihar, Darbhanga who has accumulated properties disproportionate to his known sources of income by resorting to corrupt means.

AND WHEREAS, it is felt necessary and expedient by the Government that the said offender should be tried for confiscation of the properties mentioned in the application by the Special Court Established under sub-section (1) of Section 3 of Bihar Special Courts Act, 2009;
