-5111—खाद्य उपभोक्ता संरक्षण अधिनियम, 1986 की धारा-30 की उप-धारा (2) 30 की उप-धारा (2) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल बिहार उपभोक्ता संरक्षण नियमावली, 1987 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल बिहार उपभोक्ता संरक्षण नियमावली, 1987 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल बिहार उपभोक्ता संरक्षण नियमावली, 1987 (समय-समय पर यथा संशोधित) में संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैंः-
संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैंः-
1. संक्षिप्त नाम तथा प्रारम्भ
संक्षिप्त नाम तथा प्रारम्भ (1) यह नियमावली बिहार उपभोक्ता संरक्षण (संशोधन) नियमावली, 2016 (1) यह नियमावली बिहार उपभोक्ता संरक्षण (संशोधन) नियमावली, 2016 कही जा सकेगी।
द्वारा बिहार राजपत्र में, अधिसूचना द्वारा, नियत इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा। यह उस तिथि से प्रवृत होगी जो राज्य सरकार द्वारा बिहार राजपत्र में, अधिसूचना द्वारा, नियत (3) यह उस तिथि से प्रवृत होगी जो राज्य सरकार की जाय।
2. उक्त नियमावली, 1987 के नियम-3 के उप
उक्त नियमावली, 1987 के नियम-3 के उप-नियम (1क) के बाद निम्नलिखित उप-
-नियम (1क) के बाद निम्नलिखित उप-नियम (1ख) जोड़ा जायेगा :-
(1ख) सदस्यों के चयन हेतु प्रक्रियाः- (1ख) सदस्यों के चयन हेतु प्रक्रियाः-
(i) खण्ड (ii) में यथाउपबंधित के सिवाय, किसी सदस्य की नियुक्ि त की प्रक्रिया, रिक्ति उत्पन्न होने से ) में यथाउपबंधित के सिवाय, किसी सदस्य की नियुक्ति की प्रक्रिया, रिक्ति उत्पन्न होने से कम से कम तीन माह पूर्व प्रारंभ की जाएगी। कम से कम तीन माह पूर्व प्रारंभ की जाएगी। (ii) यदि पद किसी सदस्य के इस्तीफा देने, सेवानिवृत्ति या मृत्यु या नये पद के सृजन के कारण रिक्त यदि पद किसी सदस्य के इस्तीफा देने, सेवानिवृत्ति या मृत्यु या नये पद के सृजन के कारण रिक्त यदि पद किसी सदस्य के इस्तीफा देने, सेवानिवृत्ति या मृत्यु या नये पद के सृजन के कारण रिक्त होता है तो पद को भरने की प्रक्रिया, यथास्थिति, पद रिक्त होने या सृजित होने के तुरंत पश्चात होता है तो पद को भरने की प्रक्रिया, यथास्थिति, पद रिक्त होने या सृजित होने के तुरंत पश् होता है तो पद को भरने की प्रक्रिया, यथास्थिति, पद रिक्त होने या सृजित होने के तुरंत पश् आरंभ की जायेगी। आरंभ की जायेगी। (iii) पात्र अभ्यर्थियों से आवेदन आमंत्रित करते हुए किसी रिक्ति के लिए विज्ञापन बिहार के प्रमुख पात्र अभ्यर्थियों से आवेदन आमंत्रित करते हुए किसी रिक्ति के लिए विज्ञापन बिहार के प्रमुख पात्र अभ्यर्थियों से आवेदन आमंत्रित करते हुए किसी रिक्ति के लिए विज्ञापन बिहार के प्रमुख समाचारपत्रों में या रिक्ति-परिपत्र या दोनों द्वारा, जो राज्य सरकार द्वारा विनिश्चित किये जाय, समाचारपत्रों में या रिक्ति-परिपत्र या दोनों द्वारा, जो राज्य सरकार द्वारा विनिश्चित किये जाय, समाचारपत्रों में या रिक्ति-परिपत्र या दोनों द्वारा, जो राज्य सरकार द्वारा विनिश्चित किये जाय, प्रकाशित किया जा सकेगा। प्रकाशित किया जा सकेगा।2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 23 अग(cid:22)त 2016 (iv) जिला स्तर पर निम्न लिखित को मिलाकर एक जिला स्क्रीनिंग समिति होगी :-
जिला एवं सत्र न्यायाधीश - अध्यक्ष अध्यक्ष, जिला उपभोक्ता फोरम - सदस्य जिला पदाधिकारी - सदस्य
जिला स्क्रीनिंग समिति प्रकाशित विज्ञापन के विरूद्ध प्राप्त सभी आवेदनों में से पात्र अभ्यर्थियोें के आवेदन, जो वांछित योग्यता धारित करते हो, की एक सूची, उनके आवेदन पत्रों सहित, उपभोक्ता संरक्षण अधिनियम 1986 की धारा-10 की उप-धारा (1क) के अधीन गठित चयन समिति को भेजेगी।
(v) चयन समिति निर्दिष्ट पात्र आवेदकों के सभी आवेदनों पर विचार करेगी। (vi) चयन समिति, खंड (vii) में उल्लेखित प्रावधानों के अधीन रहते हुए सदस्य के पद के लिए अभ्यर्थियों कीे उपयुक्तता का मूल्यांकन करेगी :
परंतु चयन समिति, यदि अभ्यर्थियों की संख्या को देखते हुए आवश्यक समझें, चयन हेतु ऐसे अभ्यर्थियों की तुलनात्मक मेधा और अनुभव के आधार पर, उनकी छंटनी कर सकेगी।
(vii) चयन समिति सदस्य पद के लिए छंटनी किये गये अभ्यर्थियों मेें से उपयुक्त अभ्यर्थियों का मूल्यांकन निम्नलिखित रीति से करेगी, यथा :-
(क) न्यायिक पृष्ठभूमि वाले अभ्यर्थियों के मामलाें में, उनके द्वारा दिए गए न्याय निर्णय या न्यायिक आदेशों के आधार पर मूल्यांकन द्वारा :
(ख) वैसे अभ्यर्थी का मूल्यांकन, जो केन्द्र सरकार या किसी राज्य सरकार या केन्द्र सरकार अथवा राज्य सरकार के उपक्रम में कार्य करने का अनुभव रखते हैं, उनकी वार्षिक गोपनीय अभियुक्ति एवं पद के निमित्त अनुभवों के आधार पर, करेगी।
(ग) अन्य मामलों में छंटनी किये गये अभ्यर्थियों की उपयुक्तता का मूल्यांकन चयन समिति द्वारा आयोजित व्यक्तिगत साक्षात्कार के आधार पर किया जायेगा :-
परन्तु इस उप-नियम में किसी बात के अंतर्विष्ट होने पर भी, किसी वर्ग या कोटि के अभ्यर्थियों की उपयुक्तता का मूल्यांकन करने के लिए, चयन समिति, यदि आवश्यक समझे, वैसे वर्ग या कोटि के अभ्यर्थियों को सदस्य-पद के उपयुक्तता के मूल्यांकन हेतु साक्षात्कार के लिए बुला सकेगी।
(viii) चयन समिति अपने द्वारा किए गए मूल्यांकन के आधार पर खण्ड (v) में निर्दिष्ट आवेदकों में से सदस्य के पद पर नियुक्ति के लिए अभ्यर्थियों के नाम मेघा के आधार पर एक पैनल, राज्य सरकार के विचारार्थ अनुशंसित कर सकेगी।
(ix) चयन समिति द्वारा अनुशंसित पैनल में से राज्य सरकार द्वारा चयनित अभ्यर्थियों की विश्वसनीयता एवं पूर्ववृत्त को राज्य सरकार सत्यापित कर सकेगी या सत्यापित करवा सकेगी एवं सदस्य के पद पर नियुक्ति हेतु ऐसे अभ्यर्थियों की उपयुक्तता का समाधान कर सकेगी।
(x) किसी भी सदस्य की नियुक्ति, असैनिक शैल्य चिकित्सक या जिला चिकित्सा पदाधिकारी द्वारा विनिर्दिष्ट प्रपत्र में हस्ताक्षरित स्वस्थता प्रमाण पत्र के आधार पर जो अध्यक्ष, जिला उपभोक्ता फोरम को समर्पित की जायेगी, होगी।
3. राज्य सरकार द्वारा पूर्व में निर्गत कोई आदेश या परिपत्र जो इस संशोधन नियमावली के विरूद्ध हो उसे निरसित समझा जाएगा।
बिहार-राज्यपाल के आदेश से, डॉ0 दीपक प्रसाद, प्रधान सचिव।3 (cid:24)बहार गजट (असाधारण), 23 अग(cid:22)त 2016 The 19th August 2016 No. P2B1-35/2015-5111 Food—In exercise of the powers conferred under sub-section (2) of Section 30 of the Consumer Protection Act, 1986, the Governor of Bihar is pleased to make the following rules to make amendment in "The Bihar Consumer Protection Rule 1987 (as amended from time to time)".
1. Short title extent and commencement.– (1) These Rules may be called "The Bihar Consumer Protection (Amendment) Rules 2016"
(2) It shall extend to the whole of the State of Bihar. (3) It shall come into force on such date as may be appointed by the state Government, by notification, in the Bihar Gazette.
2. The following new Sub-Rule (1B) shall be added after sub-rule (1A) of Rule-3 of the said
Rule, 1987.
(1B) Procedure for selection of Members-
(i) Save as otherwise provided in clause (ii) the process of appointment of a Member shall be initiated at least three months before the vacancy arises.
(ii) If a post falls vacant due to resignation or death of a Member or creation of new post, the process for filling the post shall be initiated immediately after the post has fallen vacant or is created, as the case may be.
(iii) An advertisement of vacancy inviting applications from eligible candidates may be published in leading newspapers in Bihar or by vacancy circulars or both, as may be decided by the State Government.
(iv) At District level there shall be a District Screening Committee consisting of the following, namely
District & Session Judge - Chairman President, District Consumer Forum - Member District Magistrate - Member After receipt of applications against the published advertisement, the District Screening Committee shall send a list alongwith applications of all the eligible candidates who fulfill the qualifications for the post of members to the Selection Committee constituted under sub section (1-A) of section 10 of The Conusmer Protection Act 1986 .
(v) The Selection Committee shall consider all the applications of eligible applicants referred to it.
(vi) The Selection Committee shall, subject to the provisions of clause (vii), assess the suitability of the candidates for the post of Member.
Provided that the Selection Committee may, if it considers necessary, depending on the number of candidates, short list them on the basis of comparative merit and experience of such candidates for selection. (vii) The Selection Committee shall asses the suitability of the candidates and where short listing is done, from among the short-listed candidates, for the post of Member in the following manner, namely:-
(a) In the case of candidates having judicial background, by assessing them on the basis of the judgments and other judicial orders passed by such candidates; (b) In the case of candidates having experience of working under the Central Government or any State Government or an undertaking under the Central Government or a State Government, by assessing such candidates on the basis of their Annual Confidential Reports and their experience relevant to the post applied for;
(c) In other cases, the suitability of the short listed candidates shall be assessed by the Selection Committee on the basis of personal interview conducted by it:
Provided that notwithstanding anything contained in this sub-rule, the Selection Committee may, for assessing the suitability of candidates of a class or category. if it considers necessary, call such class or category of candidates for interview for assessing their suitability for the post of Member.
4ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 23 अग(cid:22)त 2016 (viii). The selection committee may, on the basis of its assessment made by it, recommend a panel of names of candidates for appointment as Members frorm amongst the applicants referred to in clause (v) in order of merit for the consideration of the State Government.
(ix). The State Government shall, verify or cause to be verified the credentials and antecedents of the candidates selected by the State Government from the panel recommended by the Selection Committee and satisfy the suitability of such candidates for appointment as Members.
(x). Every appointment of a member shall be subject to the submission of a certificate of physical fitness in the prescribed format, signed by a Civil Surgeon or District Medical Officer, to the President, District Consumer Forum.
3. Any circular or order made by the State Government earlier repugnant to this amendment shall be deemed repealed.
