एल॰जी॰-01-08/2016/176-लेज—बिहार विधान मंडल द्वारा यथापारित का निम्नलिखित अधिनियम, बिहार विधान मंडल द्वारा यथापारित का निम्नलिखित अधिनियम, जिसपर महामहिम राज्यपाल दिनांक 01 सितम्बर 2016 को अनुमति दे चुके है, इसके द्वारा सर्वसाधारण की सूचना के जिसपर महामहिम राज्यपाल दिनांक 01 सितम्बर 2016 को अनुमति दे चुके है, इसके द्वारा सर्वसाधारण की सूचना के जिसपर महामहिम राज्यपाल दिनांक 01 सितम्बर 2016 को अनुमति दे चुके है, इसके द्वारा सर्वसाधारण की सूचना के लिये प्रकाशित किया जाता है।

[ÑÅÖâà=îÑLÑìXÉ=NUz=OMNS]= बिहार भूमि सुधार (अधिकतम सीमा निर्धारण तथा अधिशेष भूमि अर्जन) अधिनियम, 1961 का संशोधन करने के लिए अधिनियम।
भारत गणराज्य के सड़सठवें वर्ष में बिहार राज्य विधान मंडल द्वारा निम्नलिखित रूप में यह अधिनियमित होः- 1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ।-(1) यह अधिनियम बिहार भूमि सुधार (अधिकतम सीमा निर्धारण तथा अधिशेष भूमि अर्जन) (संशोधन) अधिनियम, 2016 कहा जा सकेगा।
(2) इसका विस्तार सम्पूर्ण राज्य में होगा।
(3) यह तुरन्त प्रवृत्त होगा।
2. अधिनियम, 1961 की धारा-30 में संशोधन।-उक्त अधिनियम, 1961 की धारा-30 की उप-धारा (2) के पश्चात् निम्नलिखित नई उप-धारा (3) एवं (4) जोड़ी जायगीः-
''(3) अपील का निष्पादन 6 माह की अवधि के भीतर किया जायेगा :
परन्तु, किसी कारणवश 6 माह की अवधि के भीतर निष्पादन नहीं, होने की स्थिति में, अपीलीय प्राधिकार के द्वारा कारणों को लिखित रूप में अभिलिखित किया जायेगा। (4)(i) जिले का समार्हाा नये सिरे से अधिनियम के अधीन कार्यवाही प्रारंभ कर सकता है, यदि अपने ज्ञान अथवा सूचना से उसका समाधान हो जाय कि भू-धारी ने अधिनियम के अधीन की जा रही कार्रवाई के क्रम में कपटपूर्वक अथवा तथ्यों में हेर-फेर कर उसके अधीनस्थ किसी प्राधिकार से अधिनियम के उद्देश्यों अथवा किसी प्रावधान के प्रतिकूल आदेश प्राप्त कर लिया है तथा भू-हदबंदी से अतिरेक भूमि धारित करता है। (ii) उपर्युक्त (i) की तरह ही किसी प्रमण्डल के प्रमण्डलीय आयुक्त जिले के समार्हाा के समान शक्तियों एवं प्राधिकार का प्रयोग करेगा जहाँ किसी भू-धारी ने समान परिस्थितियों में अपनी अधिकारिता के भीतर के जिले के समार्हाा से समरूप आदेश प्राप्त कर लिया हो :
परन्तु अधिनियम के अधीन कार्यवाही प्रारम्भ करने से पूर्व, यथास्थिति, जिले का समार्हाा अथवा प्रमण्डल के आयुक्त भू-धारी को कारण-पृच्छा नोटिस जारी करेगा कि नोटिस में उल्लेखित विन्दुओं/आधारों पर सीलिंग कार्यवाही क्यों नहीं प्रारंभ की जायः
परन्तु बिहार राजस्व पर्षद अथवा अन्य उच्चतर न्यायालयों के द्वारा निर्णित मामलों में नयी कार्यवाही प्रारम्भ नहीं की जायेगी।''
3. अधिनियम, 1961 की धारा-32 में संशोधन।-उक्त अधिनियम, 1961 की धारा 32 की उप-धारा (3) के पश्चात् निम्नलिखित नयी उप-धारा (4) जोड़ी जायेगीः-
''(4) पुनरीक्षण (revision) के मामलों को 3 माह की अवधि के भीतर निपटाया जायेगाः परन्तु, किसी कारणवश तीन माह की अवधि के भीतर निपटारा नहीं होने की स्थिति में पुनरीक्षण प्राधिकरण (Revisional Authority) के द्वारा कारणों को लिखित रूप में अभिलिखित किया जायेगा।''
4. अधिनियम, 1961 की धारा-45बी का निरसन।-उक्त अधिनियम, 1961 की धारा-45बी एतद् द्वारा निरसित की जाती है ।3 (cid:24)बहार गजट (असाधारण), 2 (cid:20)सत(cid:22)बर 2016 5. अधिनियम, 1961 की धारा-45ग के पश्चात् एक नयी धारा-45घ का जोड़ा जाना।-उक्त अधिनियम, 1961 की धारा-45ग के बाद निम्नलिखित नयी धारा 45घ जोड़ी जायगीः- ''45घ-इस अधिनियम की धारा-45बी के निरसन के पश्चात् राज्य सरकार अथवा बिहार भूमि न्यायाधिकरण में लंबित कार्यवाही उपशमित समझी जायेगी तथा निरसित धारा-45बी के अधीन प्रारम्भ की गई कार्यवाही तथा समाहर्त्ता के समक्ष लंबित कार्यवाही भी उपशमित हो जायेगी।''

सं॰ एल॰जी॰-01-08/2016/177-लेज—बिहार विधान मंडल द्वारा यथापारित और महामहिम राज्यपाल द्वारा दिनांक 1 सितम्बर 2016 को अनुमत बिहार भूमि सुधार (अधिकतम सीमा निर्धारण तथा अधिशेष भूमि अर्जन) (संशोधन) अधिनियम, 2016 का निम्नलिखित अंग्रेजी अनुवाद बिहार-राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जिसे भारतीय संविधान के अनुच्छेद-348 के खंड (3) के अधीन उक्त अधिनियम का अंग्रेजी भाषा में प्राधिकृत पाठ समझा जायेगा ।

To amend The Bihar Land Reforms (Fixation of ceiling and Acquisition of Surplus
Land) 1961.
Be it enacted by the Legislature of the State of Bihar in the sixty seventh year of the Republic of India as follows:-
1. Short title, extent and Commencement.—(1) This Act may be called The Bihar Land Reforms (Fixation of ceiling and Acquisition of Surplus Land) (Amendment) Act, 2016. (2) It shall extend to the whole of the State of Bihar. (3) It shall come into force immediately.
2. Amendment in Section-30 of the Act, 1961.— After sub-section(2) of Section-30 of the said Act, 1961 the following new sub-sections (3) and (4)shall be added:-
"(3) An appeal shall be disposed of within the period of six months:"
Provided that if for any reason it is not disposed of within the period of six months, the reasons shall be recorded in writing by the Appellate Authority.
(4) (i) The Collector of a district may initiate a fresh proceeding under the Act if, upon his own knowledge or information, he is satisfied that a land holder, in a proceeding under the Act, by fraudulently or by misrepresentation of facts or law, has managed to obtain an order from any of his subordinate authority with a view to defeat the objects of the Act or any provision there of and retains land in excess of the ceiling area. (ii) The Commissioner of a division shall exercise the similar power & authority as the collector of a district where a land holder has obtained similar order from the Collector of a district falling with his Jurisdiction under similar circumstances: Provided that before initiating such proceeding under the Act, the Collector of a district or the Commissioner of a division, as the case may be, shall issue a notice to the land holder to show cause as to why land ceiling proceeding may not be initiated on the ground mentioned in the notice: Provided further that no such proceedings shall be initiated in the cases decided by Board of Revenue or other Higher Courts."
3. Amendment in Section-32 of the Act, 1961.— After sub-section (3) of Section-32 of the said Act, 1961 the following new sub-section (4) shall be added:-
"(4) A revision shall be disposed of within the period of three months:"4 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 2 (cid:20)सत(cid:22)बर 2016 Provided that if for any reason it is not disposed of within the period of three months, the reasons shall be recorded in writing by the revisional authority."
4. Repeal of section 45B of the Act, 1961.—Section-45B of the said Act, 1961 is here by repealed.
5. Addition of a new section-45 D after section-45C of the Act, 1961.—After section-45C a new section-45D shall be added: "45D.-After repeal of section-45 B of this Act, proceedings pending before the State Government or the Bihar Land Tribunal shall be deemed to be abated and the proceeding reopened earlier under deleted section-45 B and pending before the collector shall also stand abated.
