/2014-799—भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल श्रम संसाधन विभाग के कर्मचारी राज्य बीमा योजना के अधीन परिचारिका का प्रयोग करते हुए बिहार के राज्यपाल श्रम संसाधन विभाग के कर्मचारी राज्य बीमा योजना के अधीन परिचारिका का प्रयोग करते हुए बिहार के राज्यपाल श्रम संसाधन विभाग के कर्मचारी राज्य बीमा योजना के अधीन परिचारिका (नर्स) श्रेणी 'ए' की भर्त्ती प्रोन्नति एवं सेवा शर्तों को विनियमित करने के लिए निम्नलिखित नियमावली बनाते (नर्स) श्रेणी 'ए' की भर्त्ती प्रोन्नति एवं सेवा शर्तो 1111.... संक्षिप्त नाम, विस्तार एवं प्रारंभ।संक्षिप्त नाम, विस्तार एवं प्रारंभ।संक्षिप्त नाम, विस्तार एवं प्रारंभ।संक्षिप्त नाम, विस्तार एवं प्रारंभ।

ं को विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैं :- - (1) यह नियमावली ''बिहार कर्मचारी राज्य बीमा योजना परिचारिका संक्षिप्त नाम, विस्तार एवं प्रारंभ।संक्षिप्त नाम, विस्तार एवं प्रारंभ।संक्षिप्त नाम, विस्तार एवं प्रारंभ।संक्षिप्त नाम, विस्तार एवं प्रारंभ।- (1) यह नियमावली ''बिहार कर्मचारी राज्य बीमा योजना परिचारिका श्रेणी 'ए' (भर्त्ती, प्रोन्नति एवं सेवा शर्त्त) संवर्ग नियमावली, 2016'' कही जा सकेगी। श्रेणी 'ए' (भर्त्ती, प्रोन्नति एवं सेवा शर्त्त) संवर्ग नियमावली, 2016'' कही जा सकेगी।

से अभिप्रेत है बिहार सरकार; से अभिप्रेत है श्रम संसाधन विभाग;

से अभिप्रेत है निदेषक, चिकित्सा सेवायें, कर्मचारी राज्य बीमा योजना बिहार;

से अभिप्रेत है जेनरल नर्सिंग एण्ड मिडवाइफरी;

से अभिप्रेत है बिहार कर्मचारी चयन आयोग;

से अभिप्रेत है बिहार कर्मचारी राज्य बीमा योजना जेनरल नर्सिंग एण्ड मिडवाइफरी संवर्ग

र्चारी राज्य बीमा योजना जेनरल नर्सिंग एण्ड मिडवाइफरी संवर्ग;

से अभिप्रेत है इस नियमावली के साथ संलग्न परिषिष्ट;

समय पर अधिसूचित अस्पताल;

3333. संवर्ग संवर्ग संवर्ग संवर्ग का गठनका गठनका गठनका गठन।---- बिहार कर्मचारी राज्य बीमा योजना जी॰एन॰एम॰ का संवर्ग राज्य स्तरीय, होगा। इस संवर्ग में प्रत्येक कोटि के पदों की संख्या संवर्ग के कुल पदों की संख्या उतनी होगी जितनी सरकार द्वारा स्वीकृत की गयी हो।

4444.... संवर्ग का पदसोपानसंवर्ग का पदसोपानसंवर्ग का पदसोपानसंवर्ग का पदसोपान।- - - - इस संवर्ग की विभिन्न कोटियाँ एवं पदो ंके सोपान परिषिष्ट-1 के अनुसार होंगे। संवर्ग के पदों पर इस नियमावली के प्रवृत होने के पूर्व से नियमित रूप से नियुक्त एवं कार्यरत कर्मी इस संवर्ग में स्वतः शामिल समझे जायेंगे।

परिषिष्ट 1 में उल्लिखित पद सोपान सरकार के अनुमोदन के उपरांत हीं प्रभावी होगा। यदि अनुमोदन पर विचार के क्रम में सरकार द्वारा पदसोपान में कोई परिवर्तन किया जाता है, तो परिषिष्ट-1 तदनुसार संषोधित समझा जायेगा और ऐसा संषोधित पद सोपान इस नियमावली का अंग माना जायेगा।

5555.... भर्तीभर्तीभर्तीभर्ती।- इस संवर्ग में नियुक्ति मूल कोटि जी॰एन॰एम॰ के पद पर सीधी भर्त्ती से आयोग की अनुषंसा के आधार पर होगी।

6666.... अहर्ताएँअहर्ताएँअहर्ताएँअहर्ताएँ।-

(1) शैक्षणिक योग्यता।शैक्षणिक योग्यता।शैक्षणिक योग्यता।शैक्षणिक योग्यता।- - - - मूल कोटि के पद पर सीधी भर्ती द्वारा नियुक्ति के लिए न्यूनतम अनिवार्य शैक्षणिक योग्यता भारतीय नर्सिंग परिषद्‌ द्वारा मान्यता प्राप्त किसी संस्थान से समय-समय पर, अनुमोदित, अपेक्षित अवधि का जी0एन0एम0 प्रषिक्षण कोर्स में अहर्त्ता प्राप्त करना एवं तत्‌संबंधी प्रमाण पत्र प्राप्त करनी होगी।

(2) आयुआयुआयुआयु।- ।- ।- ।- सीधी भर्ती के लिए न्यूनतम आयु सीमा 21 वर्ष होगी और अधिकतम आयु सीमा वही होगी जो सरकार द्वारा समय-समय पर, आरक्षण कोटिवार, अवधारित की जाय। संबंधित वर्ष की 1ली अप्रैल को आयु के अवधारण के लिए कट ऑफ डेट माना जायेगा।

7777.... भर्ती की प्रक्रियाभर्ती की प्रक्रियाभर्ती की प्रक्रियाभर्ती की प्रक्रिया ।।।।----

((((1) नियुक्ति प्राधिकार, वर्ष की 1 अप्रैल की स्थिति के आधार पर रिक्ति की गणना कर और रोस्टर क्लीयरेन्स कराकर, आरक्षण कोटिवार अधियाचना आयोग को अंततम 30 अप्रैल तक भेजेगा। (2) अधियाचना के आलोक में आयोग रिक्तियों को विज्ञापित कर आवेदन पत्र आमंत्रित करेगा और निम्नलिखित के आधार पर मेधा सूची तैयार करेगा :- (क) जी0एन0एम0 कोर्स की परीक्षा में प्राप्तांक के लिए - 50 अंक (ख) उच्चतर डिग्री के लिए - 20 अंक (ग) बिहार राज्य के सरकारी अस्पतालों में कार्य का अनुभव - 30 अंक (प्रति वर्ष के लिए 5 अंक, अधिकतम 30 अंक)

कुल - कुल - कुल - कुल - 100 अंक 100 अंक 100 अंक 100 अंक टिप्पणी - जी0एन0एम0 कोर्स में प्राप्त अंकों के लिए किसी अभ्यर्थी को प्रदान किये जाने वाले अंकों का अवधारण उक्त कोर्स की परीक्षा में प्राप्त कुल अंकों के प्रतिषत को 0.5 के गुणक से गुणा कर करना होगा। यथा, यदि किसी अभ्यर्थी द्वारा 50 प्रतिषत अंक प्राप्त किया गया हो तो उसे 50 % x 0.5 = 25 अंक दिये जायेंगे।

(3) आयोग आरक्षण कोटिवार विज्ञापित रिक्तियों तथा उपर्युक्त उप-नियम (2) के अनुसार तैयार मेधा सूची के आधार पर अपनी अनुषंसा नियुक्ति प्राधिकार को भेजेगा, जिसके आधार पर नियुक्ति पर विचार किया जायेगा।

8888.... परिवीक्षा अवपिरिवीक्षा अवपिरिवीक्षा अवपिरिवीक्षा अवधि।ध।ध।ध।---- नियुक्ति के उपरांत परिवीक्षा अवधि दो वर्षों की होगी। परिवीक्षा अवधि में सेवा संतोषजनक नहीं पाये जाने की दषा में यदि नियुक्ति प्राधिकार की राय में सुधार की गुंजाइस हो तो परिवीक्षा अवधि का विस्तार एक वर्ष के लिए किया जा सकेगा। यदि विस्तारित अवधि में भी सेवा संतोषजनक नहीं पायी जायेगी तो नियुक्ति प्राधिकार ऐसी परिचारिका की सेवा समाप्त कर सकेगा।

9999.... विभागीय परीक्षाविभागीय परीक्षाविभागीय परीक्षाविभागीय परीक्षा ।।।।---- श्रेणी ((((ग्रेड) 'ए' नर्स को विभाग द्वारा आयोजित विभागीय परीक्षा में उतीर्ण होना आवष्यक होगा। विभागीय परीक्षा के विषय और पाठ्‌यक्रम विभाग द्वारा विनिष्चत किये जायेंगे।

11110000.... सम्पुष्टिसम्पुष्टिसम्पुष्टिसम्पुष्टि।।।।- - - - परिवीक्षा अवधि को संतोषजनक पूरा करने और विभागीय परीक्षा में उतीर्ण होने पर ग्रेड 'ए' नर्स की सेवा में सम्पुष्ट की जा सकेगी।

11111111.... वरीयतावरीयतावरीयतावरीयता ।।।।---- ग्रेड 'ए' नर्स की आपसी वरीयता आयोग द्वारा अंतिम रूप से तैयार मेधासूची के अनुसार अवधारित की जायेगी।

12121212.... प्रोन्नति के सोपानप्रोन्नति के सोपानप्रोन्नति के सोपानप्रोन्नति के सोपान ।।।।----

(1) परिषिष्ट-1 में यथा उल्लिखित 'वार्ड सिस्टर' के प्रोन्नति वाले पद पर किसी गे्रड 'ए' को प्रोन्नति देने पर विचार किया जायेगा जब उसकी सेवा सम्पुष्ट हो और जब वह पद की उपलब्धता के अध्यधीन वरीयता -सह- योग्यता के आधार पर प्रोन्नति के दायरे में आए।

(2) वार्ड सिस्टर से सहायक मैट्रन/सहायक नर्सिंग अधीक्षक के पद पर प्रोन्नति हेतु विचार के लिए 2 वर्षों का बी0एस0सी नर्सिंग पाठ्‌यक्रम पूर्ण करना अनिवार्य होगा।3 ॢबह(cid:5)र गजट (cid:10)[स(cid:5)ध(cid:5)रण(cid:15)(cid:16) 7 अ(cid:23)तूबर 2016 (3) दो वर्षों का बी0एस0सी0 नर्सिंग पाठ्‌यक्रम पूरा नहीं करने की स्थिति में वार्ड सिस्टर की प्रोन्नति पद की उपलब्धता के अध्यधीन वरीय वार्ड सिस्टर के पद पर वरीयता -सह- योग्यता के आधार पर की जायेगी।

(4) सहायक मेट्रन/सहायक नर्सिंग अधीक्षक की वरीय मेट्रन/उप नर्सिंग अधीक्षक के पद प्रोन्नति पद की उपलब्धता के अध्यधीन वरीयता-सह-योग्यता के आधार पर की जायेगी।

(5) वरीय मेट्रन/उप नर्सिंग अधीक्षक की नर्सिंग अधीक्षक/सहायक निदेषक (नर्सिंग) के पद प्रोन्नति पद की उपलब्ध की अध्यधीन वरीयता-सह-योग्यता के आधार पर की जायेगी।

(6) वरीय वार्ड सिस्टर की वार्ड सिस्टर पर्यवेक्षिका के पद पर प्रोन्नति पद की उपलब्धता के अध्यधीन वरीयता-सह-योग्यता के आधार पर की जायेगी।

(7) प्रोन्नति पर विचार करते समय, सामान्य प्रषासन विभाग द्वारा समय-समय पर, प्रोन्नति और चारित्री/कार्य मूल्यांकन प्रतिवेदन (पी0ए0आर0)/आरोप/विभागीय कार्यवाही/आपराधिक कार्यवाही न्यूनतम कालावधि आदि संबंधी अनुदेषों का अनुपालन आवष्यक होगा।

(1) प्रोन्नति, विभागीय प्रोन्नति समिति की अनुषंसा के आधार पर होगी। (2) विभागीय प्रोन्नति समिति का गठन विभाग द्वारा किया जायेगा।

11114444.... आरक्षणआरक्षणआरक्षणआरक्षण ।।।।- - - - सरकार के आरक्षण नियमों के उपबंधोंं और सरकार द्वारा समय-समय पर सीधी भर्ती एवं प्रोन्नति हेतु निर्गत आरक्षण रोस्टर का अनुपालन करना अनिवार्य होगा।

11115555.... वर्दी (यूनिफार्म)वर्दी (यूनिफार्म)वर्दी (यूनिफार्म)वर्दी (यूनिफार्म) ।।।।- - - - परिचारिकाओं के लिए कर्तव्य के दौरान विभाग द्वारा विनिष्चत वर्दी पहनना अनिवार्य होगा।

11116666.... इस नियमावली में जिन विषयों का उपबंध नहीं किया गया है, उनके लिए सरकार की सुसंगत संहिता/नियमावली/संकल्प/अनुदेष के उपबंध लागू होंगे।

11117777.... शंकाओं का निराकरणशंकाओं का निराकरणशंकाओं का निराकरणशंकाओं का निराकरण ।।।।- - - - यदि इस नियमावली के किसी उपबंध के निर्वचन के संबंध में कोई शंका उत्पन्न हो तो इसे विभाग को निर्दिष्ट किया जायेगा और इस संबंध में विभाग का विनिष्चय विधि विभाग के परामर्ष के पश्चात्‌, अन्तिम होगा।

18181818.... कठिनाइयों का निराकरण ।कठिनाइयों का निराकरण ।कठिनाइयों का निराकरण ।कठिनाइयों का निराकरण ।- - - - यदि इस नियमावली के किसी उपबंध के कार्यान्वयन में कोई कठिनाई उत्पन्न हो तो विभाग को ऐसी कठिनाई का निराकरण सामान्य प्रषासन विभाग एवं विधि विभाग के परामर्ष के पश्चात्‌ सामान्य या विषेष आदेष द्वारा कर सकेगा।

19191919.... निरसन एवं व्यावृत्तिनिरसन एवं व्यावृत्तिनिरसन एवं व्यावृत्तिनिरसन एवं व्यावृत्ति ।।।।----

(1) इस संवर्ग के संबंध में विभाग द्वारा पूर्व में समय-समय पर निर्गत नियमावली और सभी संकल्प, आदेष, अनुदेष आदि एतद्‌ द्वारा निरसित किए जाते हैं।

(2) ऐसे निरसन के होते हुए भी, उपर्युक्त नियमावली, संकल्प, अनुदेष, आदेष आदि के अधीन किया गया कुछ भी या की गयी कोई कार्रवाई इस नियमावली के अधीन किया गया या की गयी समझी जायेगी, मानो यह नियमावली उस तिथि को प्रवृत थी, जिस तिथि को ऐसा कोई कार्य किया गया था या ऐसी कोई कार्रवाई की गयी थी।

No. ESIS-01/NI-28/2014-799— In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor of Bihar is pleased to make following Rules to regulate recruitment, promotion and service conditions of Nurse Grade-'A' cadre under the Employees State Insurance Scheme of the Department of Labour Resources :-

1. Short title extent & commencement.—(1) These 'Rules' may be called as the "Bihar Employees State Insurance Scheme Nurse Grade-'A' (Recruitment, Promotion and Service conditions) Cadre Rules, 2016"

(2) It shall extend to the whole of the state of Bihar. (3) It shall come into force at once.

2. Definitions. - In these Rules, unless otherwise requires in the subject or context,:-

(i) 'Government' means the Government of Bihar ; (ii) 'Department' means the Labour Resources Department; (iii) 'Appointing Authority' means the Director, Medical Services, Employees State Insurance Scheme, Bihar;

(iv) 'G.N.M.' means General Nursing and Midwifery; (v) 'Commission' means the Bihar Staff Selection Commission; (vi) 'Cadre' means the Bihar Employees State Insurance Scheme General Nursing and Midwifery (G.N.M.) Cadre ;

(vii) 'Appendix' means appendix appended to these Rules; (viii) 'Super-speciality Hospital' means the Hospital notified by the department as super- speciality hospital time to time;

(ix) 'Attached offices' means the offices notified by the department as regional office and dispensaries;

(x) 'Recognized Institution' means the Institute recognized from Nursing Council of Indian for the course of G.N.M..

(xi) 'Cadre controlling Authority' means Director, Medical Services, Employees State Insurance Scheme, Bihar.

3. Constitution of Cadre.—The Cadre of Bihar Employees State Insurance Scheme General Nursing and Midwifery (G.N.M.) shall be State level. In this cadre, number of posts in every grade and total number of posts of the cadre shall be at par with number of posts sanctioned by the Government.

4. Hierarchy of posts of cadre.—The hierarchy of different grades and posts of this cadre shall be in accordance with the Appendix-1. The personals having regular appointment and working on the posts of this cadre prior to coming into force of these Rules, shall be deemed to be automatically included in this cadre.

The hierarchy mentioned in the Annexure shall be effective only after approval of the Government. If during course of consideration any amendment is made in the hierarchy of post if this cadre , then the Annexure would be deemed to be amended accordingly, and the amended Annexure shall be part of this Rules.

5. Recruitment.—The Appointment in this Cadre shall be made by direct recruitment to the basic grade of General Nursing and Midwifery (G.N.M.) post, on the basis of and in the order of recommendation of the Commission. 6. Qualification.—

(1) Educational qualification—The essential minimum educational qualification for appointment by direct recruitment to the basic grade post, shall be G.N.M. Training qualifying the course of requisite period and Certificate thereto, approved time to time, from an Institute recognized by the Nursing Council of India .

(2) Age—The minimum age limit for direct recruitment shall be 21 years and maximum age limit shall be the same as may be determined by the government from time to time with reservation category wise. The cut off date for determination of age shall be deemed to be 1st April of the concerned year.

7. Procedure of recruitment .—

(1) The appointing authority, after calculating the vacancy on the basis of position as on 1st April of the year and after getting roster cleared, shall send a requisition reservation category wise to the Commission latest by 30th April.

(2) In the light of requisition, the Commission shall invite applications after advertising the vacancies and shall prepare merit list on the basis of following :- (i) For marks obtained in the examination of G.N.M. course - 50 Marks (ii) For higher degree in nursing - 20 Marks (iii) For work experience in government hospitals of the State of Bihar (5 marks for each year, maximum 30 marks) - 30 Marks Total 100 Marks Note – The marks to be given to a candidate for marks obtained in G.N.M. course Examination shall be determined by multiplying the percentage of total marks obtained in the examination of the said course by multiple of 0.5. For example, if a candidate has obtained 50 % marks he will be given 50% x 0.5=25 marks. (3) The Commission shall send its recommendation to appointing authority on the basis of merit list prepared as per sub-rule (2) above in accordance with advertised vacancies reservation category wise, on the basis of which consideration shall be made for appointment.

8. Probation period.—The probation period shall be of two years after appointment (If the appointing Authority satisfied that there is chance of improving). Probation period may be extended for a period of one year. If the service is not found satisfactory even in the extended period also, then the Appointing Authority may terminate the service of such Nurse.

9. Departmental examination.—The General Nursing and Midwifery (G.N.M.)shall be required to pass the departmental examination conducted by the Department. The subjects and syllabus of departmental examination will be prescribed by the Department.

10. Confirmation.—The services of the Grade 'A' nurse would be confirmed after satisfactory completion of probation period and passing of Departmental Examination.

11. Seniority.—The inter-se seniority of Grade 'A' nurse shall be determined according to the merit list finally prepared by the Commission.

12. Hierarchy of Promotion.—

(1) Consideration would be made to promote a Grade 'A' nurse to the promotional post of 'ward sister' as mentioned in Appendix-1, whose services are confirmed, and who come under the zone of promotion on the basis of seniority cum- eligibility subject to availability of post.

(2) It would be essential to complete two-years B.Sc. Nursing course for being considered for promotion from the post of 'Ward Sister' to 'Asstt Matron/ Asstt Nursing Superintendent' .

(3) In the event of non-completion of two-years B.Sc. Nursing course, a Ward Sister would be promoted to the post of Senior Ward sister on the basis of seniority cum- eligibility subject to availability of post.

(4) An 'Asstt Matron / Asstt Nursing Superintendent' would be promoted to the post of Senior Matron / Deputy Nursing Superintendent on the basis of seniority cum- eligibility subject to availability of post.

(5) Senior Matron / Deputy Nursing Superintendent would be promoted to the post of Nursing Superintendent / Asstt. Director (Nursing) on the basis of seniority cum- eligibility subject to availability of post.

(6) Senior Ward Sister would be promoted to the post of Ward Sister Supervisor on the basis of seniority cum- eligibility subject to availability of post.

(7) It shall be necessary to comply with instructions issued by the General Administration Department, from time to time, with respect to promotion, and character Roll/ or P.A.R.(Performance Appraisals Report) / allegation/ departmental proceedings/criminal proceedings, minimum KALAWADHI etc at the time of consideration of promotion.

13. Departmental Promotion. –

(1) Promotions shall be made on the basis of recommendations of the Departmental Promotion Committee.

(2) The Departmental Promotion Committee shall be constituted by the Department. 14. Reservation.—It shall be essential to comply with the provisions of the reservation rules of the Government and reservation roster for direct recruitment as well as promotion, as issued by the Government from time to time.

15. Uniform.—It shall be mandatory for the Nurse to wear the uniform decided by the department during service period.

16. The provisions of relevant Codes/ Rules/ Resolutions/ Instructions of the Government shall apply to such subjects for which no provision is made in these Rules.

17. Removal of doubts.—If any doubt arises with respect to interpretation of any provision of these Rules, it shall be referred to the Department and in this respect decision of the Department after consultation with Law Department shall be final.

18. Removal of difficulties.—If any difficulty arises in implementation of provisions of these Rules, the Department may remove such difficulty after consultation with the General Administration Department and Law Department by general or special order.

19. Repeals & Savings.—

(1) The Rules, and all resolutions, orders, instructions etc. issued earlier, from time to time, by the Department with respect to this cadre, are hereby repealed .

(2) Notwithstanding such repeal, any thing done or any action taken under aforesaid Rules, Resolution, Instruction, Orders, etc, shall be deemed to be done or taken under these Rules, as if these Rules were in force on the date on which such a work was done or such an action was taken.
