(2) यह संवग- रा#य (cid:12)तर1य संवग- होगा।

(3) इस संवग- के सद(cid:12)य(cid:24) के वेतनमान एवं सेवा शत[ का अवधारण (cid:7)व(cid:18)त (cid:7)वभाग एवं सामाVय (cid:9)शासन (cid:7)वभाग के परामश- से (cid:7)वभाग Yवारा `कया जाएगा।

4. Eरि(cid:22)तय(cid:24) क> अवधारणा एवं आयोग को इसक> सूचना ।- (cid:9)(cid:18)येक वष- (cid:7)वभाग उस वष- के राजक>य अ%भयंWण महा(cid:7)वYयालय(cid:24)/राजक>य पो%लटेक(नक/राजक>य म?हला पो%लटेक(नक सं(cid:12)थान(cid:24) हेतु सहायक (नबंधक, उप (नबंधक, (नबंधक के पद(cid:24) पर सीधी (नयुि(cid:22)त Yवारा भर1 जाने वाल1 Eरि(cid:22)तय(cid:24) क> गणना करेगी औरउसके अनुसार सीधी (नयुि(cid:22)तय(cid:24) Yवारा भर1 जाने वाल1 Eरि(cid:22)तय(cid:24) क> सूचना 30 अ(cid:9)ील तक आयोग को (cid:9)े(cid:7)षत करेगी।

5. सीधी (नयुि(cid:22)त ।- (1) संवग- के मूल पद या सहायक (नबंधक के पद पर सीधी (नयुि(cid:22)त आयोग क> अनुशंसा के आलोक म+ क> जायेगी।

(2) सीधी (नयुि(cid:22)त क> (cid:12)क>म पEर%शaट-1 म+ उपबंAधत है, िजसम+ सरकार Yवारा समय- समय पर संशोधन `कया जा सके गा।

(3) %ल/खत पर15ा समुह 'ख' सेवा के पद के %लए (नधा-Eरत पाठयcमनुसार होगी।3 ॢबह(cid:5)र गजट (cid:10)[स(cid:5)ध(cid:5)रण(cid:15)(cid:16) 20 अ(cid:22)तूबर 2016 6. पर1(cid:7)व5ा अवAध/(cid:7)वभागीय पर15ा/(cid:9)%श5ण ।- (1) (नयुि(cid:22)त के पNचात दो वष[ क> पर1(cid:7)व5ा अवAध होगी। उ(cid:22)त अवAध क> संतोष(cid:9)द सेवा एवं पर1(cid:7)व5ा अवAध क> सफलतापूव-क पूण-ता के उपरांत सेवा स.पुaट होगी।

(2) (नयु(cid:22)त _यि(cid:22)त को पर1(cid:7)व5ा अवAध म+ (cid:7)वभाग Yवारा (नधा-Eरत (cid:9)%श5ण अ(नवाय- fप से पुरा करना होगा।

7. आर5ण ।- इस सेवा म+ सीधी (नयुि(cid:22)त म+ सरकार Yवारा समय-समय पर अAधसूAचत आर5ण/रो(cid:12)टर के (cid:9)ावधान लागू रह+गे। आर5ण रो(cid:12)टर (cid:7)वषयवार संधाEरत होगा।

8. उh-सीमा ।- उh सीमा (cid:7)वNव(cid:7)वघालय/महा(cid:7)वघालय के (नबंधक सवंग- के %लए रा#य सरकार Yवारा (नधा-Eरत उh सीमा होगी।

9. वर1यता ।- (cid:7)वभाग (cid:9)(cid:18)येक वष- अ(cid:9)ैल माह म+ संवग- के (cid:9)(cid:18)येक पद के %लए (cid:7)वAधवत (नयु(cid:22)त एवं काय-रत (नबंधक(cid:24) क> वर1यता सूची (cid:9)का%शत करेगी।

10. (cid:9)ोVन(त ।- इस सेवा के सद(cid:12)य(cid:24) क> (cid:9)ोVन(त (cid:7)वभागीय (cid:9)ोVन(त स%म(त के Yवारा पEर%शaट-1 म+ उपबंAधत पद सोपान के अनुसार (नधाEरत कालावAध पूण- करने पर `कया जा सके गा। 11. (cid:12)थापना संबंधी काय[ का (नयंWण ।- इस सेवा के सद(cid:12)य(cid:24) क> (नयुि(cid:22)त, (cid:9)ोVन(त, पद(cid:12)थापना, (cid:12)थानाVतरण, सेवा स.पुिaट, वर1यता सूची का संधारण एवं (cid:12)थापना संबंधी सभी काय- (नयुि(cid:22)त (cid:9)ाAधकार के (नयंWणाधीन ह(cid:24)गे।

12. (cid:9)(त(नयुि(cid:22)त ।- इस संवग- के सद(cid:12)य(cid:24) का पद(cid:12)थापन (cid:9)(त(नयुि(cid:22)त के आधार पर (cid:7)वभाग/(नदेशालय के अधीन(cid:12)थ/संब) काया-लय(cid:24) के उपयु(cid:22)त गैर संवगbय पद(cid:24) पर अAधकतम 3 वष[ क> अवAध के %लए `कया जा सके गा।

13. अनुशास(नक कार-वाई ।-सेवा के सद(cid:12)य(cid:24) के (cid:7)वf) अनुशास(नक कार-वाई के (cid:9)योजनाथ- !बहार सरकार1 सेवक (वगbकरण, (नयंWण एवं अपील1य) (नयमावल1, 2005 (समय-समय पर यथा संशोAधत) के (cid:9)ावधान लागू ह(cid:24)गे।

14. (cid:7)व(cid:7)वध ।- िजन (cid:7)वषय(cid:24) या (cid:7)वVदुओं का (cid:9)ावधान इस (नयमावल1 म+ नह1ं है उसके संबंध म+ रा#य सरकार के क%म-य(cid:24) के %लए त(cid:18)समय (cid:9)वृत (नयम/अनुदेश लागू ह(cid:24)गे।

15. (नव-चन ।- जहॉ इस (नयमावल1 के `कसी (नयम के संबंध म+ कोई संदेह उ(cid:18)पVन हो, वहॉ इस (cid:7)वषय पर (cid:7)वभाग का (नण-य (cid:7)वAध (cid:7)वभाग से परामश- के पNचात अं(तम होगा।

16. क?ठनाइय(cid:24) का (नराकरण ।- (नयमावल1 से संबंAधत `कसी भी क?ठनाई का अं(तम (नराकरण रा#य सरकार Yवारा सामाVय (cid:9)शासन (cid:7)वभाग एवं (cid:7)वAध (cid:7)वभाग से परामश- के पNचात `कया जायेगा।

17. (नरसन एवं _यावृि(cid:18)त ।- (1) इस (नयमावल1 के (नग-मन के पूव- इस संबंध म+ (नग-त संकmप/पEरपW एतY Yवारा (नर%सत `कये जाते ह2।

(2) ऐसे (नरसन के होते हुए भी, उ(cid:22)त पूव- (नग-त संकmप/पEरपW के तहत क> गई (नयुि(cid:22)तयॉ या (नग-त `कए गए आदेश (cid:9)वृत और (cid:7)वAधमाVय बने रह+गे, मान(cid:24) वे इस (नयमावल1 के समुAचत उपबंध(cid:24) के अधीन (नग-त `कए गए ह(cid:24)।

2. इस संवग- के काय- एवं दा(य(cid:18)व /- (नबंधन, पर15ा, बजट से संबंAधत काय- एवं (cid:7)वभाग तथा (cid:9)ाचाय- Yवारा सौपा गया अVय (cid:9)शास(नक काय-।

The 5th September 2016

No- (cid:7)व0(cid:9)ा0(।)(cid:12)था0- 94/07-2321—In exercise of powers conferred by proviso to Article 309 of the Constitution of India, the Governor of Bihar hereby makes the following Rules for the recruitment, promotion to the posts of Registrar Cadres in The Govt. Engineering Colleges/Govt. Polytechnics Institutes and to regulate their service conditions:-

1. Short title, extent and commencement.— (1) These Rules may be called the "Bihar Government Engineering and Polytechnic Registrar Service Rules, 2016".

(2) It shall extend to all the Government Engineering Colleges/Institutes and Govt. Polytechnics/Government Women's Polytechnics under the Department of Science and Technology, Government of Bihar, in the whole state of Bihar. (3) It shall come into force from the date of issue of the Notification. 2. Definitions /- In these Rules, unless otherwise requires in the context-

(i) "Cadre" means The Engineering and Polytechnic Registrar Service Cadre as described in Rule 3;

(ii) "Government" means the Government of Bihar; (iii) "Commission" means 'Bihar Public Service Commission; (iv) "Directorate" means the 'Directorate of Science and Technology'; (v) "Department" means the 'Department of Science and Technology'; (vi) "Committee" means the 'Departmental Promotion Committee' constituted by the Department.

(vii) "Service" means 'The Engineering and Polytechnic Registrar Service'; (viii) "Direct Appointment" means appointment to be made on the recommendation of Bihar Public Service Commission;

(ix) "Cadre-Member" means the person appointed and included/ absorbed in the Bihar Engineering and Polytechnic Registrar Service under the provisions of these Rules;

(x) "Appointing Authority" means the Principal Secretary/Secretary Department of Science and Technology;

(xi) "Vacancies of the year" means the vacancies occurring in a particular year by virtue of creation of new posts, superannuation, death and dismissal;

(xii) "Year" means Financial Year, i.e.,the period from April 01 to March 31 of the next year;

3. Cadre Structure for The Bihar Engineering and Polytechnic Registrar Service Cadre.—

(1) The persons appointed on Contract will not be deemed to be member of this cadre. (2) The Cadre shall be state level. (3) The pay scales and service conditions for the members of this service shall be determined by the Department in consultation with the General Administrative Department & Finance Department.

4. Calculation of Vacancies and its intimation to the Commission.— Every year, the Government shall calculate the vacancies for direct appointment to the posts of Assistant Registrar for the Govt. Engineering Colleges/Institutes and Govt. Polytechnics/Govt. Women's Polytechnics and shall accordingly send intimation of vacancies to be filled up by direct recruitment to the Commission up to 30th April.

5. Direct Appointment.—

(1) Direct appointment to the basic post, or Assistant Registrar shall be made in the light of the recommendation of the Commission.

(2) The scheme of direct appointment is provided in Appendix-1 in which the amendment may be made by the Government, from time to time.

(3) The Written Examination shall be held as per the determined syllabus for the posts of Service of Group- 'B';

6. Probation Period/Departmental Examination/Training.—

(1) There shall be Probation Period of two years after the appointment. The service shall be confirmed on successful completion of probation period and satisfactory service of the said period.

(2) The appointed person shall have to essentially complete the training determined by the Department in the probation period.

7. Reservation.—The provisions of Reservation/Roster notified by the Government from time to time in Direct Appointments in this service, shall remain applicable.

8. Age–limit.—The age–limit shall be the same as it will be determined by State Government for Registrar Cadre of university/college.

9. Seniority.—The Department shall publish every year a seniority–list of all the legally appointed and working Registrars for each post of the cadre in the month of April.

10. Promotion.—Promotion of the members of this cadre may be made by the Departmental Promotion Committee according to the ladder of post provided in Appendix-I on completion of determined Kalawadhi.

11. Control of the Matters relating to Establishment.—Appointment, promotion, posting, transfer, confirmation of service, maintenance of seniority–list of the members of this service and all matters related to establishment shall be under the control of the Appointing Authority.

12. Deputation.—Posting of the member of this cadre may be made to the suitable non cadre posts for a maximum period of three years on deputation basis in the Department /Subordinate/affiliated offices of the Directorate.

13. Disciplinary action.—The provisions of The Bihar Government Servant (Classification, Control and Appeal) Rules, 2005 (as amended from time to time), shall apply for the purpose of disciplinary action against the members of the service.

14. Miscellaneous.—Such subjects or points for which provisions are not made in these Rules, the rules/instructions enforced for the time being in respect of the State Government employees, shall apply.

15 Interpretation.—Wherever any doubt arises in respect of Provisions of these Rules, the decision of the Department on this subject shall be final after consultation with the Law Department. 16. Removal of Difficulty.—Final removal of any difficulty relating to these Rules shall be made by the State Government after consultation of the General Administration Department and the Law Department.

17. Repeal.—

(1) All resolutions/circulars issued before the commencement of these Rules are hereby repealed.

(2) Notwithstanding such repeal, the appointments made under the said Resolution/ Circulars already issued or orders issued shall remain in force and valid as if they were issued under the proper provisions of these Rules.

Appendix-I

Registrar Cadre

(See Rule-3)

1. Conditions recommended by the Govt. of Bihar relating to Pay scale, Grade Pay, Age for the University/ College officers will remain applicable.

2. Duties and responsibilities of this cadre/- Worked related to registration, examination, budget & other administrative work assigned by department or principal.

3. Posts of Basic category will be filled up by direct appointment. 4. The members already appointed/absorbed in this cadre prior to this rules will be deemed to be absorbed automatically against the post of Registrar, as one time measure on holding determined qualification and completion of Kalawadhi. 5. In case of above mentioned posts being vacant, the teachers of engineering colleges/ Polytechnic Institutions having minimum qualification may be posted to the above mentioned posts till the fulfillment of these posts by regular appointment or through promotion.
