CORAM : HONOURABLE MR. JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 10 19-09-2016 In spite of repeated calls, no one has appeared on behalf of the election petitioner. Mr. Subodh Kumar Jha for the respondent no. 1 is present. He has drawn attention of the Court ot the order dated 30.06.2016 when the following order was passed:- "No one appears on behalf of the election petitioner. Perused the service report as well as the4 (cid:1)बहार गजट (असाधारण), 16 !दस#बर 2016 marginal notes. Notice has been received by the

father of the respondent no. 1.

Let affidavit of jointness of the father with the respondent no. 1 be filed on or before 15th July, 2016. List this matter on 21st July, 2016."

Again on 21.07.2016, no body appeared on behalf of the election petitioner. The Court also noticed that the previous order passed by the Court was not complied with by the election petitioner. Today also, no one has appeared.

In view of the above, the Court has reasons to understand that the petitioner has lost interest in pursuing the present election petition. Same is dismissed for want of prosecution.
