7/मुक0-08-1/2015(खंड I)सा0प्र0 17283—भारत-संविधान के अनुच्छेद 234 द्वारा प्रदत्त शक्तियों सं॰ 7/मुक0-08-1/2015(खंड भारत-संविधान के अनुच्छेद 234 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए बिहार के राज्यपाल, उच्च न्यायालय, पटना एवं बिहार लोक सेवा आयोग के परामर्श के पश्चात्, का प्रयोग करते हुए बिहार के राज्यपाल, उच्च न्यायालय, पटना एवं बिहार लोक सेवा आयोग के परामर्श के पश्चात्, का प्रयोग करते हुए बिहार के राज्यपाल, उच्च न्यायालय, पटना एवं बिहार लोक सेवा आयोग के परामर्श के पश्चात्, विभागीय अधिसूचना संख्या-7/ए0-1-210/2000 का0 6067 2009 का अधिक्रमण करते हुए बिहार विभागीय अधिसूचना संख्या-7/ए0-1-210/2000 का0 6067 दिनांक 25.06.2009 का अधिक्रमण करते हुए बिहार असैनिक सेवा (न्याय शाखा) (भर्त्ती) नियमावली, 1955 का संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैंः- असैनिक सेवा (न्याय शाखा) (भर्त्ती) नियमावली, 1955 का संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैंः- असैनिक सेवा (न्याय शाखा) (भर्त्ती) नियमावली, 1955 का संशोधन करने हेतु निम्नलिखित नियमावली बनाते हैंः- बिहार असैनिक सेवा (न्याय शाखा) (भर्त्ती) (संशोधन) नियमावली, 2016 बिहार असैनिक सेवा (न्याय शाखा) (भर्त्ती) (संशोधन) नियमावली, 2016 बिहार असैनिक सेवा (न्याय शाखा) (भर्त्ती) (संशोधन) नियमावली, 2016
1. संक्षिप्त नाम एवं प्रारंभ।-
संक्षिप्त नाम एवं प्रारंभ।- (1)यह नियमावली बिहार असैनिक सेवा (न्याय शाखा) (भर्त्ती) (संशोधन) (न्याय शाखा) (भर्त्ती) (संशोधन) नियमावली, 2016 कही जा सकेगी।
(2) नियम-3(क) सामान्य प्रशासन विभाग, बिहार, पटना के पत्रांक-2702 दिनांक 25

02.2014 द्वारा बिहार जायेगी और अन्य सभी नियम लोक सेवा आयोग को अधियाचित रिक्तियों की तिथि 25.02.2014 से प्रभावी मानी जायेगी और अन्य सभी नियम लोक सेवा आयोग को अधियाचित रिक्तियों की तिथि 25 अधिसूचना निर्गत की तिथि से प्रभावी होगें। अधिसूचना निर्गत की तिथि से प्रभावी होगें।
बिहार असैनिक सेवा (न्याय शाखा) (भर्त्ती) संशोधित नियमावली, 1955 के बिहार असैनिक सेवा (न्याय शाखा) (भर्त्ती) संशोधित नियमावली 2. उक्त नियमावली बिहार असैनिक सेवा (न्याय शाखा) (भर्त्ती) संशोधित नियमावली नियम-3(क) को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगाः- नियम-3(क) को निम्नलिखित द्वारा प्रतिस्थापित किया जाएगाः-
3क- सीधी भर्ती में आरक्षणः- 3क- सीधी भर्ती में आरक्षणः- (i) सीधी भर्ती हेतु सभी रिक्तियाँ असैनिक न्यायाधीश (कनीय कोटि) के पद पर निम्न प्रकार भर्ती हेतु सभी रिक्तियाँ असैनिक न्यायाधीश (कनीय कोटि) के पद पर निम्न प्रकार भर्ती हेतु सभी रिक्तियाँ असैनिक न्यायाधीश (कनीय कोटि) के पद पर निम्न प्रकार भरी जायेगीः-
(क) खुली गुणागुण कोटि से (ख) आरक्षित कोटि से
खुली गुणागुण कोटि से - 50 प्रतिशत आरक्षित कोटि से - 50 प्रतिशत
(ii) आरक्षित श्रेणी के विरूद्ध 50 प्रतिशत रिक्तियाें में अनुसूचित जाति के लिए 16 प्रतिशत, अनुसूचित आरक्षित श्रेणी के विरूद्ध 50 प्रतिशत रिक्तियाें में अनुसूचित जाति के लिए 16 प्रतिशत, अनुसूचित आरक्षित श्रेणी के विरूद्ध 50 प्रतिशत रिक्तियाें में अनुसूचित जाति के लिए 16 प्रतिशत, अनुसूचित जनजाति के लिए 1 प्रतिशत, अत्यंत पिछडा वर्ग के लिए 21 प्रतिशत, पिछड़ा वर्ग के लिए 12 जनजाति के लिए 1 प्रतिशत, अत्यंत पिछडा वर्ग के लिए 21 प्रतिशत, पिछड़ा वर्ग के लिए 12 जनजाति के लिए 1 प्रतिशत, अत्यंत पिछडा वर्ग के लिए 21 प्रतिशत, पिछड़ा वर्ग के लिए 12 ओं में आरक्षण अनुसूचित जाति/अनुसूचित जनजाति प्रतिशत यथा बिहार पदों एवं सेवाओं की रिक्तिओं में आरक्षण अनुसूचित जाति/ प्रतिशत यथा बिहार पदों एवं सेवाओं की रिक्ति2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 28 (cid:15)दस(cid:17)बर 2016 एवं अन्य पिछड़े वर्ग के लिए अधिनियम, 1991 (समय-समय पर यथा संशोधित) में परिभाषित की गई है।
(iii) महिलाओं के लिए 35 प्रतिशत तथा अस्थि विकलांगों के लिए 1 प्रतिशत क्षैतिज आरक्षण सभी श्रेणियों में होगी।
(iv) अनुसूचित जातियों और अनुसूचित जनजातियों से उनके लिये आरक्षित रिक्तियों में नियुक्ति के लिये सुयोग्य उम्मीदवारों की अनुपलब्धता की स्थिति में अगली चयन प्रक्रिया तक के लिए उन रिक्तियों को आरक्षित बनाये रखा जायेगा और यदि अगले वर्ष में भी सुयोग्य उम्मीदवार नहीं उपलब्ध हो तो अनुसूचित जाति और अनुसूचित जनजातियों के बीच रिक्तियों का विनिमय किया जायेगा और विनिमय पूरित रिक्तियाँ उस विशेष समुदाय के उम्मीदवार जो वस्तुतः नियुक्त किये जाते हैं, के लिए आरक्षित समझी जायेंगी।
(v) अत्यंत पिछड़ा वर्ग एवं पिछड़ा वर्ग के सुयोग्य उम्मीदवारों की अनुपलब्धता की स्थिति में अगली चयन प्रक्रिया तक के लिए उन रिक्तियों को आरक्षित बनाये रखा जायेगा और यदि अगले वर्ष में भी सुयोग्य उम्मीदवार नहीं उपलब्ध हो तो यह रिक्तियाँ अत्यंत पिछड़ा वर्ग एवं पिछड़ा वर्ग के उम्मीदवारों से विनिमय द्वारा भरी जायेंगी और विनिमय द्वारा पूरित रिक्तियाँ उस विशेष समुदाय के उम्मीदवार जो वस्तुतः नियुक्त किये जाते हैं, के लिए आरक्षित समझी जायेंगी।
(vi) यदि तृतीय चयन प्रक्रिया में अनुसूचित जाति, अनुसूचित जनजाति, अत्यंत पिछड़ा वर्ग और पिछड़ा वर्ग के सुयोग्य उम्मीदवारों की संख्या, विनिमय फॉर्मूला के बाद भी उनके लिये आरक्षित रिक्तियों की संख्या से कम है तो तृतीय चयन प्रक्रिया में शेष पूर्वागत (बैक लॉग) रिक्तियाँ, सामान्य वर्ग के सुयोग्य उम्मीदवारों से, उन्हें अनारक्षित करके भरी जा सकेंगी। किंतु वैसी अनारक्षित रिक्तियाँ अगली तीन चयन प्रक्रियाओं तक अग्रगणित (carry forward) रहेंगी।
3. उक्त नियमावली में ''आयोग'' शब्द के स्थान पर ''उच्च न्यायालय, बिहार लोक सेवा आयोग के समन्वय से'' पढ़ा जायेगा।
4. बिहार असैनिक सेवा (न्याय शाखा) (भर्त्ती) नियमावली, 1955 के नियम-5 के (परन्तुक) का प्रतिस्थापन।-
''परंतु प्रारभिंक परीक्षा में आरक्षित श्रेणी के अभ्यर्थियों के लिए मुख्य परीक्षा में योग्य होने के लिए अर्हतांक सामान्य श्रेणी के अभ्यर्थियों से 5 प्रतिशत कम होेंगे।''
5. बिहार असैनिक सेवा (न्याय शाखा) (भर्त्ती) नियमावली, 1955 के नियम-6 के (परन्तुक) का प्रतिस्थापन।-
''परंतु आरक्षित श्रेणी के अभ्यर्थियाें के लिए (महिला एवं अस्थि विकलांग श्रेणी सहित) उक्त तिथि को उम्र 40 वर्ष से कम एवं 22 वर्ष से अधिक होनी चाहिए।
परंतु महिला एवं अस्थि विकलांग सहित आरक्षित श्रेणी से भिन्न अभ्यर्थियो को परीक्षा में बैठने हेतु पाँच (5) से अधिक अवसर नहीं प्राप्त होगे।''
6. बिहार असैनिक सेवा (न्याय शाखा) (भर्त्ती) नियमावली, 1955 के नियम-15 का प्रतिस्थापन।- ''(क) उच्च न्यायालय को यह अधिकार होगा कि आयोग की सहमति से लिखित परीक्षा हेतु किसी विषय का अर्हतांक या सभी विषयाें का अर्हतांक निर्धारित कर सकेगा।
(ख) महिला एवं अस्थि विकलांग अभ्यर्थियाें सहित आरक्षित श्रेणी के अभ्यर्थियाें, के लिए सामान्य वर्ग के अभ्यर्थियाें से प्रत्येक सिद्धांत विषय के लिए 5 प्रतिशत कम न्यूनतम अर्हतांक होंगे एवं कुल प्राप्तांक से 5 प्रतिशत कम न्यूनतम अर्हतांक होंगे।
7. उक्त नियमावली के नियम-17 के परन्तुक को विलोपित किया जाता है।
8. बिहार असैनिक सेवा (न्याय शाखा) (भर्त्ती) नियमावली, 1955 के नियम-18 का प्रतिस्थापन।- ''नियुक्ति प्रक्रियाएँ उच्च न्यायालय के नियंत्रण एवं पर्यवेक्षण में बिहार लोक सेवा आयोग के समन्वय से होगी।''

No.-7/Muk.-08-1/2015 (Part I)G.A 17283—In exercise of the powers conferred by Article 234 of the Constitution of India, and in supersession of Rules as amended and notified vide notification no. 7/a.1-210/2000 ka. 6067 dated 25.06.2009, the Governor of Bihar, after consultation with High Court of Judicature at Patna and the Bihar Public Service Commission, is pleased to make the following amendments in Bihar Civil Service (Judicial Branch) Recruitment Rules, 1955:
The Bihar Civil Service (Judicial Branch) (Recruitment) Amendment Rules, 2016
1. Short title and commencement.—(1) These rules may be called the Bihar Civil Service (Judicial Branch) (Recruitment) Amendment Rules, 2016.
(2) Rule 3A shall be deemed to have come into force with effect from the date 25.02.2014 when the vacancies were requisitioned to the Bihar Public Service Commission vide General Administration Department, Government of Bihar, letter no. 2702 dated 25.02.2014 and all remaining rules shall take effect from the date of this notification and shall apply to future selection processes.
2. In the Bihar Civil Service (Judicial Branch) Recruitment Rules, 1955, Rule 3A shall be
substituted by the following:-
"3A -Reservation for Direct Recruitment:-
(i) All vacancies for direct recruitment to the post of the civil judge (Junior Division) shall be filled up:- (a) from open merit category – 50% (b) from reserved category – 50%
(ii) Against the reserved 50% vacancies, there shall be reservation of 16% for Scheduled Castes, 1% for Scheduled Tribes, 21% for Extremely Backward Class, 12% for Backward Class candidates as defined under the Bihar Reservation of Vacancies in Post and Services (for Scheduled Caste, Scheduled Tribe and other Backward Classes) Act, 1991 as amended from time to time.
(iii) There shall be 35% horizontal reservation for women and 1% horizontal reservation for orthopedically disabled candidates in all categories.
(iv) In case of non-availability of suitable candidates from the Scheduled Castes and Scheduled Tribes for appointment in vacancies reserved for them, the vacancies shall continued to be reserved for them for next selection process, and if suitable candidates are not available even in the second process, the vacancies shall be filled by exchange between the candidates of Scheduled Castes and Scheduled Tribes and the vacancies so filled will be treated as reserved for the candidates for that particular community who are actually appointed.
(v) In case of non-availability of suitable candidates from the Extremely Backward Class and Backward Class for appointment in vacancies reserved for them, the vacancies shall continued to be reserved for them for the next selection process, and if suitable candidates are not available even in the second process the vacancies shall be filled by exchange between the candidates of Extremely Backward Class and Backward Class and the vacancies so filled by exchange shall be treated as reserved for the candidates of that particular community who are actually appointed.
(vi) If in the third selection process, the number of suitable candidates of Scheduled Castes, Scheduled Tribes, Extremely Backward Class and Backward Class are less than the number of vacancies reserved for them even after exchange formula, the remaining backlog vacancies may be filled by suitable general candidates after de- reserving them but the vacancies so de-reserved shall be carried forward for next three selection process."4 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 28 (cid:15)दस(cid:17)बर 2016
3. The word "Commission" wherever appearing in the Rules shall be read as "High
Court in co-ordination with the Bihar Public Service Commission."
4. The Proviso to the existing Rule 5 shall be substituted by as hereunder:-
"Provided that the qualifying marks in the preliminary test to be eligible for main examination for the reserved category candidates would be 5% less than the cut-off marks for general category candidates."
5. The Proviso to the existing Rule 6 shall be substituted by as hereunder:-
"Provided that a candidate belonging to a reserved category including women and orthopedically disabled category must be under 40 years and over 22 years of age on the said date.
Provided further that, no candidate who does not belong to reserved category, including women and orthopedically disabled category, shall be allowed to take more than five chances at the examination."
6. The existing Rule 15 shall be substituted by as hereunder:-
a) The High Court shall have the discretion to fix the qualifying marks in any or all the subjects at the written examination, in consultation with the Commission.
b) The minimum qualifying marks shall be relaxed by 5% marks in each theory paper and by 5% lower marks in the aggregate than the general category candidates in respect of all reserved category candidates including women and orthopedically disabled category candidates."
7. The Proviso to the existing Rule 17 shall be deleted.
8. The existing Rule 18 shall be substituted by as hereunder:- "The recruitment processes shall be under the control and supervision of the High Court with the co-ordination of the Bihar Public Service Commission."
