सं॰ 389 नि0—दण्ड प्रक्रिया संहिता, 1973 की धारा-11 की उप-धारा (3) के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए उच्च न्यायालय, निम्न तालिका के स्तम्भ-2 में निहित पदाधिकारियों को उनके अपने क्षेत्राधिकारों के लिए प्रथम श्रेणी के न्यायिक दंडाधिकारी की शक्तियाँ प्रदान करता है जिन्हें उच्च न्यायालय की अधिसूचना संख्या 382 नि0 दिनांक 27.08.2016 के द्वारा असैनिक न्यायाधीश (वरीय कोटि) के रूप में प्रोन्नत किया गया है को भारतीय रेलवे अधिनियमों के अंतर्गत, उन वादों को जिन्हें वे दण्ड प्रक्रिया संहिता, 1973 (अधिनियम-2, 1974) के अंतर्गत क्षमतापूर्वक निष्पादित कर सकते हैं, के निष्पादन हेतु तालिका स्तम्भ-4 में निहित रेलवे न्यायालय में अपर मुख्य न्यायिक दंडाधिकारी, रेलवे नियुक्त किया जाता है।
उन्हें उक्त संहिता की धारा-260 के अंतर्गत भारतीय रेलवे अधिनियम में वर्णित वादों के संक्षिप्त विचारण के लिए प्रथम श्रेणी के न्यायिक दंडाधिकारी की शक्तियाँ भी प्रदान की जाती है।
उन्हें अपने क्षेत्राधिकार के अंतर्गत ऐसे वादों में जिनका निष्पादन करने के लिए उन्हें प्राधिकृत किया गया है, संज्ञान

No. 389 A—In exercise of Powers conferred under Sub-Section 3 of Section 11 of the Code of Criminal Procedure, 1973, the High Court are pleased to confer upon the Officers named below the powers of a Judicial Magistrate of the 1st Class for the territorial Jurisdictions mentioned against their names in column no. 3 of the table below, who have been promoted to the cadre of Civil Judge (Senior Division) as per Court's Notification no. 382A dated 27.08.2016 and appointed as A.C.J.M, Railway; to try cases under the Indian Railways Act at the Railway Court mentioned in column no. 4 within the territorial Jurisdiction mentioned against their names in column no. 3 of the table, which they are competent to try under the Code of Criminal Procedure, 1973 (Act 2 of 1974).
They are also vested with the powers conferrable on a Judicial Magistrate of the 1st Class to try summarily the cases under the Indian Railways Act, as are covered under Section 260 of the Code of Criminal Procedure, 1973.
They are also conferred with the powers to take cognizance of such case as they are authorized to try within their territorial Jurisdiction.

No. 398 A—The judicial officer of the rank of Civil Judge (Junior Division) named in column no. 2 of the table given below is appointed as Munsif (Civil Judge, Jr. Div.) in the judgeship and station mentioned in the column no. 3.
As mentioned in column no. 4, the officer is also vested with the powers under Sub-section (2) of Section-19 of the Bengal, Agra and Assam Civil Courts Acts, 1887, (act XII of 1887) as amended by the Bengal, Agra and Assam Civil Courts Bihar Amendment Act, 2013 (Act 14 of 2014) to try under ordinary procedure original suits of Pecuniary and Territorial Jurisdiction.

सं॰ 419 नि0—दण्ड प्रक्रिया संहिता 1973 (अधिनियम 2, 1974) की धारा-11 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उच्च न्यायालय श्रीमति अनुपम कुमारी, अवर न्यायाधीश-सह-अपर मुख्य न्यायिक दण्डाधिकारी/विशेष न्यायाधीश, सी0बी0आई0, मुजफ्फरपुर को छपरा, सीवान, गोपालगंज, मुजफ्फरपुर, सीतामढ़ी, वैशाली, शिवहर, पूर्वी चम्पारण, प0 चम्पारण, दरभंगा, मधुबनी एवं समस्तीपुर जिला क्षेत्रों के लिए जिसका मुख्यालय मुजफ्फरपुर रहेगा को विधि विभाग के अधिसूचना संख्या 2218/जे0, दिनांक 1.7.2005 द्वारा स्थापित न्यायिक दंडाधिकारी (मुंसिफ) के मुजफ्फरपुर में स्थित एक अतिरिक्त विशेष न्यायालय का दण्डाधिकारी-सह-पीठासीन पदाधिकारी नियुक्त करता है और दिल्ली स्पेशल पुलिस इस्टेवलिसमेन्ट ऐक्ट 1946 की धारा-3 के अन्तर्गत डी0 एस0 पी0 ई0 मुजफ्फरपुर शाखा के द्वारा जाँच किये गये वादों के निष्पादन या निष्पादन हेतु सुपूर्द करने के शक्तियाँ प्रदान करता है।
इन्हें उक्त संहिता की धारा-190 की उप-धारा (1) के खण्ड (ब) के अधीन डी0 एस0 पी0 ई0 मुजफ्फरपुर शाखा के द्वारा उपरोक्त जिला क्षेत्रों में जाँच किए गए वैसे वादों को जिसका निष्पादन या निष्पादन हेतु सुपूर्द करने में वे सक्षम है, संज्ञान लेने की शक्तियाँ भी प्रदान की जाती है।
श्रीमति अनुपम कुमारी अनन्य रूप से सप्ताह में सिर्फ दो दिन विशेष न्यायिक दण्डाधिकारी, सी0बी0आई0, कोर्ट मुजफ्फरपुर का कार्य करेंगी तथा सप्ताह के बाकि दिनों में वे अवर न्यायाधीश-सह-अपर मुख्य न्यायिक दण्डाधिकारी, मुजफ्फरपुर के रूप में कार्य करेंगी और दीवानी तथा अपराधिक मुकदमों का निष्पादन करेंगी।

The 16th September, 2016 No. 419 A— In exercise of powers conferred under section 11 of the code of Criminal Procedure, 1973 (Act 2 of 1974) the Court have been pleased to appoint Smt. Anupam Kumari, Sub Judge-cum- A.C.J.M., Muzaffarpur as the Special Magistrate-cum-P.O. of the Additional Special Court of Judicial Magistrate (Munsif) at Muzaffarpur established vide Law Department's Notification No. 2218/J, dated 01.07.2005 for the entire State of Bihar with headquarters at Muzaffarpur to try and if necessary to commit for trial the cases investigated by the Delhi Special Police Establishment of other Branches also besides the Muzaffarpur Branch, with respect to the offences covered under Section 3 of the Delhi Special Police Stablishment Act, 1946 for the area of Jurisdiction of the Districts of Chapra, Siwan, Gopalganj, Muzaffarpur, Sitamarhi, Vaishali, Sheohar, East Champaran, West Champaran, Darbhanga, Madhubani and Samastipur as mentioned in law (J) Deptt. Notification No. 1534/J dated 13.05.2006.
The Court have further been pleased to confer upon the said Magistrate the powers to take cognizance of such cases investigated by the Delhi Special Police Establishment of the Muzaffarpur Branch under Sub-Section (1) (b) of Section 190 of the Criminal Procedure Code, 1973 and to try or commit for trial of the cases investigated by the Delhi Special Police Establishment of the Muzaffarpur Branch.
Smt. Anupam Kumari would be designated as C.B.I. Judicial Magistrate-cum-Special Judge, C.B.I. Court, Muzaffarpur, for two days exclusively in the week and the rest of the days she would function as Sub Judge-cum-A.C.J.M., Muzaffarpur and shall take up other Criminal and Civil cases within her Jurisdiction.

पदाधिकारी को आवश्यकतानुसार, बंगाल, आगरा एवं आसाम सिविल कोर्ट बिहार एमेंडमेंट ऐक्ट-2013 (ऐक्ट XIV, 2014) द्वारा संबोधित बंगाल, आगरा एवं आसाम सिविल कोर्टस ऐक्ट, 1887 (ऐक्ट XII,1887) की धारा 19 की उपधारा (2) के अन्तर्गत उक्त तालिका के स्तम्भ-4 में यथानिर्देशित आर्थिक एवं प्रादेशिक क्षेत्राधिकार के भीतर होने वाले मौलिक वादों की साधारण प्रक्रिया के अधीन निष्पादन की शक्तियाँ प्रदान की जाती है।

As mentioned in column no. 4, the officer is also vested with the powers under Sub-section (2) of Section-19 of the Bengal, Agra and Assam Civil Courts Acts, 1887, (act XII of 1887) as amended by the Bengal, Agra and Assam Civil Courts Bihar Amendment Act, 2013 (Act 14 of 2014) to try under ordinary procedure original suits of Pecuniary and Territorial Jurisdiction.

No. 459 A— The Judicial Officers of the rank of Civil Judge (Junior Division) named in column no. 2 of the table given below are appointed as Munsif / Execution Munsif / Judicial Magistrates in the Judgeship and station mentioned in column no. 3 of the table.
As mentioned in column no. 4, the officers who are transferred and posted as Munsif / Execution Munsif are also vested with the powers under Sub-section (2) of Section-19 of the Bengal, Agra and Assam Civil Courts Acts, 1887, (act XII of 1887) as amended by the Bengal, Agra and Assam Civil Courts Bihar Amendment Act, 2013 (Act 14 of 2014) to try under ordinary procedure original suits of Pecuniary and Territorial Jurisdiction.
As mentioned in column no. 4, the officers are also vested with powers of the Court of small causes for the trial of suits cognizable by such a Court with the necessary Pecuniary and Territorial Jurisdiction.
The powers vested as per column no. 4, should not, however, be exercised by the officer concerned unless it is published in the Bihar Gazette or in the District Gazette.
