अल्पसंख्यक कल्याण विभाग ------------- अधिसूचना 8 फरवरी 2017 0सं0क0-01-56/2016-408—भारत के संविधान के अनुच्छेद 309 के परन्तुक में प्रदत्त शि भारत के संविधान के अनुच्छेद 309 के परन्तुक में प्रदत्त शक्तियों का प्रयोग सं0 अ0सं0क0-01-56/2016-408 राज्यपाल बिहार अल्पसंख्यक कल्याण सेवाओं में भर्ती की प्रक्रिया एवं सेवा शर्तों को विनियमित करने के लिए करते हुए बिहार-राज्यपाल बिहार अल्पसंख्यक कल्याण सेवाओं में भर्ती की प्रक्रिया एवं सेवा शर्तों को विनियमित करने के लिए राज्यपाल बिहार अल्पसंख्यक कल्याण सेवाओं में भर्ती की प्रक्रिया एवं सेवा शर्तों को विनियमित करने के लिए निम्नलिखित नियमावली बनाते हैं :-

संक्षिप्त नाम, विस्तार एवं प्रारम्भ :- यह नियमावली ''बिहार अल्पसंख्यक कल्याण सेवा नियमावली 2017'' कही जा सकेगी । इसका विस्तार सम्पूर्ण बिहार राज्य में होगा ।

ः- जब तक संदर्भ में अन्यथा अपेक्षित न हो, इस नियमावली में -

ा सेवा में नियुक्त/सम्मिलित व्यक्ति;

1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ (1) यह नियमावली ''बिहार अल्पसंख्यक कल्याण सेवा नियमावली 2017'' कही जा सकेगी । (2) इसका विस्तार सम्पूर्ण बिहार राज्य में होगा । (3) यह तुरन्त प्रवृत होगी । 2. परिभाषाएँ :- जब तक संदर्भ में अन्यथा अपेक्षित न हो, इस (i) ''सेवा'' से अभिप्रेत है बिहार अल्पसंख्यक कल्याण सेवा ; ''सेवा'' से अभिप्रेत है बिहार अल्पसंख्यक कल्याण सेवा ; (ii) '' राज्य सरकार'' से अभिप्रेत है बिहार राज्य सरकार ; '' राज्य सरकार'' से अभिप्रेत है बिहार राज्य सरकार ; (iii) ''विभाग'' से अभिप्रेत है अल्पसंख्यक कल्याण विभाग, बिहार ; ''विभाग'' से अभिप्रेत है अल्पसंख्यक कल्याण विभाग, बिहार ; (iv) ''आयोग'' से अभिप्रेत है बिहार लोक सेवा आयोग ; ''आयोग'' से अभिप्रेत है बिहार लोक सेवा आयोग ; (v) ''राज्यपाल'' से अभिप्रेत है ''राज्यपाल'' से अभिप्रेत है बिहार राज्यपाल ; (vi) ''सदस्य'' या ''सेवा के सदस्य'' से अभिप्रेत है बिहार अल्पसंख्यक कल्याण् ''सदस्य'' या ''सेवा के सदस्य'' से अभिप्रेत है बिहार अल्पसंख्यक कल्याण सेवा में नियुक्त/सम्मिलित व्यक्ति (vii) ''अनुसूची'' से अभिप्रेत है इस नियमावली के साथ संलग्न अनुसूची ; ''अनुसूची'' से अभिप्रेत है इस नियमावली के साथ संलग्न अनुसूची ; (viii) ''वर्ष'' से अभिप्रेत है वित्तीय वर्ष अर्थात 01 अप्रैल से प्रारम्भ होकर अगले वर्ष 3 1 मार्च को समाप्त होने ''वर्ष'' से अभिप्रेत है वित्तीय वर्ष अर्थात 01 अप्रैल से प्रारम्भ होकर अगले वर्ष 31 मार्च को समाप्त होने वाला वर्ष ; तथा (ix) ''वर्ष के दौरान रिक्ति'' से अभिप्रेत है एक वर्ष में बिहार अल्पसंख्यक कल्याण सेवा के नए पदों के सृजन ''वर्ष के दौरान रिक्ति'' से अभिप्रेत है एक वर्ष में बिहार अल्पसंख्यक कल्याण सेवा के नए पदों के सृजन ''वर्ष के दौरान रिक्ति'' से अभिप्रेत है एक वर्ष में बिहार अल्पसंख्यक कल्याण सेवा के नए पदों के सृजन या किसी सदस्य की सेवा निवृति या मृत्यु अथवा सेवा से हटाए जाने अथवा पदच्युत किये जाने अथवा या किसी सदस्य की सेवा निवृति या मृत्यु अथवा सेवा से हटाए जाने अथवा पदच्युत किये जाने अथवा या किसी सदस्य की सेवा निवृति या मृत्यु अथवा सेवा से हटाए जाने अथवा पदच्युत किये जाने अथवा उपलब्ध रिक्तियाँ अथवा पूर्व वर्ष की ऐसी रिक्तियाँ जो भरी नहीं जा सकी त्यागपत्र दिये जाने के फलस्वरूप उपलब्ध रिक्तियाँ अथवा पूर्व वर्ष की ऐसी रिक्तियाँ जो भरी नहीं जा सकी त्यागपत्र दिये जाने के फलस्वरूप हो ।

:-

3. सेवा की संरचना2 (cid:1)बहार गजट (असाधारण), 8 फरवर! 2017 (1) यह सेवा अल्पसंख्यक कल्याण विभाग के प्रशासनिक नियंत्रणाधीन होगी । इस सेवा में पदों की संरचना

(2) राज्य सरकार, समय-समय पर, सेवा के पदों का स्वीकृत बल विनिश्चित कर सकेगी और सेवा में स्थायी/अस्थायी पदों के सृजन की स्वीकृति दे सकेगी ।

(3) इस सेवा के विभिन्न पदों का वेतनमान राज्य सरकार द्वारा, समय-समय पर, अवधारित किया जायेगा । (4) इस नियमावली की प्रवृत होने की तिथि से पूर्व से इस सेवा के विभिन्न पदों पर नियुक्त एवं कार्यरत व्यक्ति स्वतः इस सेवा में सम्मिलित समझे जायेंगे ।

4. भर्ती का स्रोत :- इस सेवा के मूल कोटि, जिला अल्पसंख्यक कल्याण पदाधिकारी, के पद पर नियुक्ति, सीधी भर्ती द्वारा, की जायेगी ।

5. आरक्षण ः- राज्य सरकार द्वारा, समय-समय पर, विहित नियम एवं प्रक्रिया के अनुसार नियुक्ति/प्रोन्नति में आरक्षण/रोस्टर का अनुपालन आवश्यक होगा ।

6. रिक्तियों का अवधारण एवं आयोग को संसूचना :- विभाग प्रत्येक वर्ष की पहली अप्रैल को रिक्तियों की संख्या अवधारित करेगा तथा इस प्रकार अवधारित आरक्षण कोटिवार रिक्तियों हेतु प्रत्येक वर्ष 30 अप्रैल तक आयोग को अधियाचना भेजेगी ।

7. संयुक्त प्रतियोगिता परीक्षा द्वारा भर्ती :- आयोग अधियाचित रिक्तियों के विरूद्ध विज्ञापन निकालकर संयुक्त प्रतियोगिता परीक्षा द्वारा बिहार अल्पसंख्यक कल्याण सेवा के मूल कोटि के पदों पर नियुक्ति हेतु अनुशंसा उपलब्ध करायेगी । 8. पात्रता :- सेवा में भर्ती के लिए उम्मीदवारों की उम्र, शैक्षणिक योग्यता आदि राज्य सरकार एवं आयोग द्वारा समय-समय पर यथा अवधारित रीति एवं विहित प्रावधानों के अनुसार होगी ।

9. वरीयता :- इस नियमावली के अधीन नियुक्त सदस्यों की आपसी वरीयता आयोग के अनुशंसा के मेधाक्रमानुसार अवधारित की जायेगी ।

10. परीवीक्षा अवधि एवं संपुष्टि :-

(1) नव-नियुक्ति जिला अल्पसंख्यक कल्याण पदाधिकारी नियुक्ति की तिथि से परीक्ष्यमान घोषित किए जाऐंगे । परीक्ष्यमान अवधि दो वर्षो की होगी। परीक्ष्यमान अवधि सफलतापूर्वक पूरा करने, उक्त अवधि में सेवा संतोषप्रद होने तथा विहित विभागीय परीक्षा में उतीर्ण होने पर इनकी सेवा सम्पुष्ट की जा सकेगी । परीक्ष्यमान अवधि में सेवा संतोषप्रद नहीं होने पर लिखित रूप में अभिलिखित किए जाने वाले कारणों से, परीक्ष्यमान अवधि एक वर्ष के लिए विस्तारित की जा सकेगी । परन्तु परीक्ष्यमान की कुल अवधि तीन वर्ष से अधिक की नहीं होगी ।

(2) प्रथम वार्षिक वेतन वृद्धि के बाद अगली वेतन वृद्धि विहित विभागीय परीक्षा में उतीर्ण होने के बाद अनुमान्य होगी ।

11. प्रशिक्षण :- इस सेवा के विभिन्न ग्रेड के पदाधिकारियों को सरकार द्वारा विनिश्चित प्रशिक्षण प्राप्त करना होगा जिसमें व्यवहारिक प्रशिक्षण भी सम्मिलित रहेगा ।

12. प्रोन्नति :-

(1) इस सेवा के मूल कोटि के पद (जिला अल्पसंख्यक कल्याण पदाधिकारी) से भिन्न सभी पद प्रोन्नति द्वारा भरे जायेंगे ।

(2) प्रोन्नति के लिए राज्य सरकार द्वारा समय-समय पर निर्धारित कालावधि सम्बन्धी प्रावधान लागू होंगे । (3) सेवा के उच्चतम पद पर प्रोन्नति आयोग के अध्यक्ष/सदस्य की अध्यक्षता में गठित विभागीय प्रोन्नति समिति की अनुशंसा पर की जायेगी । अन्य पदों पर प्रोन्नति सरकार द्वारा गठित विभागीय प्रोन्नति समिति की अनुशंसा पर की जायेगी ।

13. अवशिष्ट मामले :- इस नियमावली या इसके अधीन जारी किए गए आदेशों से अनाच्छादित मामलों के संदर्भ में इस सेवा के सदस्य राज्य सरकार के समुचित स्तर के कार्मिकों के संबंध में लागू विनियमों और आदेशों द्वारा शासित होंगे । 14. विनियमावली बनाने की शक्ति ः- इस नियमावली में विहित प्रावधानों को क्रियान्वित करने के लिए राज्य सरकार द्वारा विनियमावली का गठन किया जा सकेगा ।

15. इस सेवा के प्रोन्नति के पदों पर पदाधिकारियों के उपलब्ध नहीं होने की स्थिति में राज्य सरकार उन पदों पर बिहार प्रशासनिक सेवा के पदाधिकारियों को पदस्थापित कर सकेगी ।3 (cid:1)बहार गजट (असाधारण), 8 फरवर! 2017 16. निरसन एवं व्यावृति :-

(1) अल्पसंख्यक कल्याण सेवा (भर्ती एवं सेवाशर्तें) नियमावली, 2012 एतद्‌ द्वारा निरसित की जाती है । (2) ऐसे निरसन के होते हुए भी 'अल्पसंख्यक कल्याण सेवा (भर्ती एवं सेवाशर्तें) नियमावली, 2012' के अधीन शक्तियों का प्रयोग करते हुए किया गया कोई कार्य या की गई कोई कार्रवाई इस नियमावली द्वारा या इसके अधीन प्रदत्त शक्ति का प्रयोग करते हुए किया गया कोई कार्य या की गई कोई कार्रवाई समझी जायेगी, मानो यह नियमावली उस तिथि को प्रवृत थी जिस तिथि को ऐसा कोई कार्य किया गया था या ऐसी कोई कार्रवाई की गयी थी ।

The 8th February 2017 No. M.W.D-01-56/2016-408—In exercise of the power conferred by proviso to Article-309 of the Constitution of India, the Governor of Bihar is pleased to make the following Rules for the regulating the process of recruitment and service conditions of Bihar Minority Welfare Service.

1. Short title, extent and commencement-

(1) These rules may be called the "Bihar Minority Welfare Service Rules, 2017". (2) It shall extend to the whole of the State of Bihar. (3) It shall come into force at once.

2. Definitions:- In these rules, unless in the context otherwise requires :-

(i) "Service" means Bihar Minority Welfare Service; (ii) "The State government" means the State Government of Bihar; (iii) "Department" means Minority Welfare Department, Bihar; (iv) "Commision" means the Bihar Public Service Commision; (v) "Governor" means the Governor of Bihar; (vi) "Member" or "Members of service" means a person appointed/included in Bihar Minority Welfare Service;

(vii) "Schedule" means Schedule appended to these rules; (viii) "Year" means financial year, i.e., Year Commenceing from 1st April and ending on year 31st March of Coming year. and

(ix) "Vacancies during a year" means the available vacancies during a year due to creation of new posts in Bihar Minority Welfare Service or due to retirement or death or removal or dismissal or resignation from service of a member or such vacancies of previous year which could not have been filled up. 3. Structure of Service :-

(1) This service will be under the Administraive control of Minority Welfare Department.

(2) The State Government, from time to time may determine the sanctioned strength of the post in service and may allow the creation of permanent/temporary posts in the service.

(3) The pay scales of different posts in this service shall be determined by the State government from time to time.

(4) All the persons appointed and working on different posts of this service prior to coming into force of these rules, shall automatically be deemed to be included in this service Rules.

4. Source of recruitment:- The recruitment to the post of basic category of District Minority Welfare Officer shall be made by direct recruitment.

5. Reservations:- It shall be essential to follow the rules and the procedures regarding Reservation/roster in recruitment/promotion as prescribed by the state Government from time to time.

6. Determination of vacancies and communication to the Commission- On the first April of each calendar year the State Government shall determine the vacancies to be filled up and send requisition for so determined reservation categorywise vacancies to the Commission by 30th April every year.

7. Recruitment by the combined competitive examination – The Commission shall make available recommendation for the appointment to the post of basic category of The Bihar Minority Welfare service by the Combined Competitive Examination by publishing advertisement against the requisitioned vacancies.

8. Eligibility – The age, educational qualifications etc of the candidates for recruitment in the service shall be in accordance with the manner and provisions as determined and prescribed by the State Government and Commission, from time to time.

9. Seniority – The inter se seniority of the members recruited in this service under these Rules shall be determined according to the merit list recommended by the Commission.

10. Probation Period and confirmation – (1) The newly appointed District Minority Welfare Officer shall remain on probation from the date of appointment. The probation period shall be of two years. On successful completion of probation period, service being found satisfactory during this period and after passing the prescribed Departmental Examination, their services may be confirmed. If the service is found unsatisfactory during the probation period, probation period may be extended for further one year with reasons to be recorded in writing but the total period of probation shall not exceed three years.

(2) After first annual increment of pay, the next increment of pay shall be admissible after passing prescribed Departmental Examination.

11. Training-The Officers appointed in the different grades of this service shall have to undergo training determined by the government in which the practical training also shall be included.

12. Promotions – (1) All the posts except the post of basic category in this service (District Minority Welfare Officer) shall be filled by promotion.

(2) For the promotion, provisions regarding KalaAwadhi determined by the State Government, from time to time shall apply.

(3) The promotion to the highest post of this service shall be made on the recommendation of Departmental Promotion Committee headed by the Chairman/Member of Bihar Public Service Commission. For other posts promotions shall be made on the recommendation of Departmental promotion committee constituted by the Government.

13. Residuary matter – With regard to matters not specifically covered by these rules or orders issued under these rules, the members of this service shall be governed by the regulations and orders applicable to the employees of the state government at appropriate level.

14. Power to make regulation – For Implementation of the provisions prescribed under these Rules Regulations may be constituted by the state government.

15. In the case of non availability of officers of this service for the appointment to the promotional posts, the state government may post officers of the Bihar Administrative Service to those posts.

16. Repeal and Saving – (1) 'Bihar Minority Welfare service (Recruitment & Service Conditions) Rules 2012' is hereby repealed.

(2) Notwith standing of such repeal any act done or any action taken in exercise of the powers conferred under Bihar Minority Welfare (Recruitment & service) Rules, 2012' shall be deemed to be done or taken under these rules as if these rules were in force on the date on which such act was done or such action was taken.
