9/2015 में पारित आदेश दिनांक14.07.2016 का ऑपरेटिव अंश निम्न प्रकार हैः-

The arrears shall be paid within six months from the date of production of a copy of shall be paid within six months from the date of production of a copy of shall be paid within six months from the date of production of a copy of this order."2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 8 फरवर(cid:17) 2017 3333.... माननीय सर्वोच्च न्यायालय के सिविल रिट संॉ 1022/1989 में दायर आईॉएॉ संॉ 244 01.01.1996 के बाद और दिनांक 01.01.2006 के पहले सेवानिवृत्त न्यायिक पदाधिकारियों का पद्मनाभन समिति की अनुशंसा के क्रम में पुनरीक्षित पेंशन/पारिवारिक पेंशन दिनांक 01.01.2006 के बाद सेवानिवृत्त न्यायिक पदाधिकारियों की तुलना में कम हो जा रहा है।
4444.... उक्त आईॉएॉ संॉ-5/2009 का निष्पादन दिनांक 08.10.2012 को माननीय सर्वोच्च न्यायालय द्वारा किया गया, जिसका कार्यकारी अंश निम्न प्रकार हैः-
"The applicants in this I.A. are judicial Officers who retired after January 1, 1996, but prior to January 2006. They are aggrieved by the recommendation of Justice Padmnabhan Committee, as contained in paragraph 31 of its report. Paragraph 31 of the recommendations of the Committee, insofar as it is relevant, is as under:
Para 31: The recommendations of the First National Judicial Pay Commission with respect to past pensioners are given in paragraph 23.18 which are as under;
1. The revised pension of the retired judicial officers should be 50% of the minimum of the post held at the time of retirement, as revised from time to time.
Mr. P.P.Rao, learned senior advocate appearing for the applicants, pointed out that the Padmnabhan Committee, apparently due to oversight, fixed the revised pension of the concerned judicial officers at 50% of the minimum of the post held at the time of retirement, as revised from time to time, consequently, as a result of the revision, the concerned judicial officers are getting as pension an amount which is lower to what they earlier received before revision.
The grievance of the applicants appears to be justified and it is significant to note that both the High Court of Andhra Pradesh and The State Govt. of Andhra Pradesh in their respective responses, have supported the case of the applicants.
Mr. A.T.M. Sampath, learned amicus curiae, also submitted that there was evidently some error in the recommendation of the One Man Committee.
We, accordingly, accept the prayer of the applicants and allow this IA in terms of prayer clause (i) of the application,
IA No.-5 stands disposed of."
5555. उपर्युक्त आईॉएॉ संॉ 5/2009 के Prayer clause (i) निम्न प्रकार हैः-
"The existing pensions of the past pensioners who retired after 01- 01-1996 and the pensioners whose pensions were consolidated as per Karnataka Model shall be raised by 03.07 times on par with the other pensioners subject to minimum of 50% of the revised pay scale of pay of their respective post"
6666. कर्नाटक मॉडल में किए गए प्रावधान का सारांश यह है कि वैसे न्यायिक पदाधिकारी, जो दिनांक 01.01.2006 के पूर्व तथा 01.01.1996 के बाद सेवानिवृत्त हुए हैं, उसके पेंशन/पारिवारिक पेंशन का निर्धारण दिनांक 01.01.2006 से उनके सेवानिवृत्ति के समय धारित पद के पुनरीक्षित वेतनमान के आधार पर (50 प्रतिशत) अथवा सेवानिवृत्ति के समय निर्धारित पेंशन (With commutation)/पारिवारिक3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 8 फरवर(cid:17) 2017 पेंशन के 03.07 के गुणक के आधार पर, इनमें जो अधिक हो, को पेंशन/पारिवारिक पेंशन के रूप में अनुमान्य किया जाएगा।
दिनांक 01.01.1996 से 31.12.2005 तक सेवानिवृत्त राज्य के न्यायिक पदाधिकारियों के पेंशन पुनरीक्षण का विषय राज्य सरकार के समक्ष विचाराधीन था।
दिनांक 01.01.1996 के बाद एवं दिनांकः 01.01.2006 के पूर्व सेवानिवृत्त पदाधिकारी को निर्धारित पेंशन (With commutation)/पारिवारिक पेंशन के 03.07 के गुणक या उनके पद के लिए पुनरीक्षित वेतनमान् में निर्धारित पेंशन (Minimum 50%) में जो अधिक हो, पेंशन/पारिवारिक पेंशन के रूप में अनुमान्य किया जा सकता है। इस क्रम में मूल स्वीकृत पेंशन/पारिवारिक पेंशन को हीं देखा जाएगा तथा यदि वरीय न्यायिक पदाधिकारी का पेेंंशन, कनीय की तुलना में कम्यूटेशन के कारण कम हो रहा है तो वह इससे आच्छादित नहीं होगा।
