-1027—भारत-संविधान के अनुच्छेद 309 के परन्तुक के अधीन प्रदत्त शक्तियों का भारत-संविधान के अनुच्छेद 309 के परन्तुक के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए बिहार-राज्यपाल बिहार राज्य अन्तर्गत लोक स्वास्थ्य अभियंत्रण विभाग के अंचलीय लिपिकीय संवर्ग में प्रयोग करते हुए बिहार-राज्यपाल बिहार राज्य अन्तर्गत लोक स्वास्थ्य अभियंत्रण विभाग के अंचलीय लिपिकीय संवर्ग में प्रयोग करते हुए बिहार-राज्यपाल बिहार राज्य अन्तर्गत लोक स्वास्थ्य अभियंत्रण विभाग के अंचलीय लिपिकीय संवर्ग में भर्ती एंव सेवा शर्तों को विनियमित करने हेेतु निम्नलिखित नियमावली बनाते हैः-

विनियमित करने हेेतु निम्नलिखित नियमावली बनाते हैः-

बिहार राज्य अन्तर्गत लोक स्वास्थ्य अभियंत्रण अंचलीय लिपिकीय संवर्ग (भर्ती एवं सेवाशर्तें) बिहार राज्य अन्तर्गत लोक स्वास्थ्य अभियंत्रण अंचलीय लिपिकीय संवर्ग (भर्ती एवं सेवाशर्तें) बिहार राज्य अन्तर्गत लोक स्वास्थ्य अभियंत्रण अंचलीय लिपिकीय संवर्ग (भर्ती एवं सेवाशर्तें) नियमावली, 2016

1. संक्षिप्त नाम, विस्तार एवं प्रारम्भ।-(

संक्षिप्त नाम, विस्तार एवं प्रारम्भ।-(1) यह नियमावली बिहार राज्य अन्तर्गत लोक स्वास्थ्य अभियंत्रण लोक स्वास्थ्य अभियंत्रण अंचलीय लिपिकीय संवर्ग (भर्ती एवं सेवाशर्तें)

य संवर्ग (भर्ती एवं सेवाशर्तें) नियमावली, 2016 कही जा सकेगी।

(2) इसका विस्तार संपूर्ण बिहार राज्य में होगा।

इसका विस्तार संपूर्ण बिहार राज्य में होगा।

(3) यह तुरंत प्रवृत होगी।

।- इस नियमावली में जब तक कि संदर्भ में अन्यथा अपेक्षित नहीं होः- ।- इस नियमावली में जब तक कि संदर्भ में अन्यथा अपेक्षित नहीं होः- 2. परिभाषाएँ ।- इस नियमावली में जब तक कि संदर्भ में अन्यथा अपेक्षित नहीं होः-

(i) 'संवर्ग' से अभिप्रेत है लोक स्वास्थ्य अ

; 'संवर्ग' से अभिप्रेत है लोक स्वास्थ्य अभियंत्रण अंचल के अधीन लिपिकीय संवर्ग;

(ii) 'आयोग' से अभिप्रेत है बिहार कर्मचारी चयन आयोग

'आयोग' से अभिप्रेत है बिहार कर्मचारी चयन आयोग;

(iii) 'नियुक्ति प्राधिकार' से अभिप्रेत है संबंधित अधीक्षण अभियंता

'नियुक्ति प्राधिकार' से अभिप्रेत है संबंधित अधीक्षण अभियंता;

(iv) 'नियत तिथि' से अभिप्रेत है इस नियमावली के प्रवृत्त होने की तिथि तथा 'नियत तिथि' से अभिप्रेत है इस नियमावली के प्रवृत्त होने की तिथि तथा2 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 23 माच(cid:17) 2017 (v) 'सदस्य' से अभिप्रेत है इस संवर्ग में नियुक्त कोई व्यक्ति तथा इसमें इस नियमावली के प्रवृत होने के पूर्व से लोक स्वास्थ्य अभियंत्रण अंचल के अधीन लिपिकीय पदों पर नियुक्त सभी व्यक्ति शामिल है।

3. संवर्ग की संरचना।- लिपिकीय संवर्ग की संवर्ग संरचना निम्नानुसार होगी-

टिप्पणी ।- निम्नवर्गीय लिपिक एवं उच्चवर्गीय लिपिक, प्रधान लिपिक तथा कार्यालय अधीक्षक को समय-समय पर सरकार द्वारा स्वीकृत वेतनमान देय होगा।

4. संवर्ग बल।-संवर्ग बल ऐसा होगा जो लोक स्वास्थ्य अभियंत्रण विभाग द्वारा समय-समय पर विनिश्चित किया जाय।

5. भर्ती।-

(1) निम्नवर्गीय लिपिक का 85 प्रतिशत पद सीधी भर्ती से भरा जायेगा और 15 प्रतिशत पद कम्प्यूटर संचालन एवं कम्प्यूटर टंकण ज्ञान के साथ इन्टरमीडियट(102) अथवा समकक्ष उत्तीर्ण अथवा योग्यताधारी सुपात्र समूह 'घ' कर्मचारियों में से भरा जायेगा। सीधी भर्त्ती के 85 प्रतिशत पदों के 10 प्रतिशत तक पद अनुकंपा के आधार पर नियुक्ति हेतु आरक्षित रहेंगे।

(2) सभी भर्तियाँ बिहार कर्मचारी चयन आयोग की अनुशंसा पर निम्नवर्गीय लिपिक की कोटि में की जायेंगी।

(3) नियुक्ति प्राधिकार प्रत्येक वर्ष की 1 अप्रील के आधार पर रिक्तियों की गणना करेगा और 30 अप्रील तक आयोग को अधियाचना भेज देगा।

(4) बिहार कर्मचारी चयन आयोग रिक्तियों को विज्ञापित करेगा और प्रतियोगिता परीक्षा के आधार पर सफल अभ्यर्थियों का चयन करने के बाद संबंधित नियुक्ति प्राधिकारों को मेधा क्रम में अभ्यर्थियों के नाम की अनुशंसा करेगा। मेधासूची की वैधता विभाग में अनुशंसा प्राप्ति की तिथि से एक वर्ष तक रहेगी।

(5) सम्यक छानबीन के बाद नियुक्ति प्राधिकार अभ्यर्थी की नियुक्ति परिवीक्षा पर दो वर्षो के लिए करेगा।

6. अहर्ता ।-(1) न्यूनतम शैक्षणिक अहर्ता कम्प्यूटर संचालन एवं कम्प्यूटर टंकण के ज्ञान के साथ इन्टरमीडीयेट (10+2) उत्तीर्ण या उसके समकक्ष होगी।

(2) भर्ती के लिए न्यूनतम उम्र 18 वर्ष हेागी और अधिकतम उम्र वही होगी जो राज्य सरकार (सामान्य प्रशासन विभाग) द्वारा समय-समय पर विनिश्चित की जाए।

7. आरक्षण ।- भर्ती एवं प्रोन्नति में, राज्य सरकार द्वारा, समय-समय पर, अधिसूचित आरक्षण/रोस्टर का अनुपालन आवश्यक होगा।3 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 23 माच(cid:17) 2017 8. प्रोन्नति द्वारा भर्ती ।-

(1) नियुक्ति प्राधिकार न्यूनतम शैक्षणिक अहर्ता कम्प्यूटरसंचालन एवं कम्प्यूटर टंकण के ज्ञान के साथ इन्टरमीडिएट (10+2) उत्तीर्ण या उसके समकक्ष समूह 'घ' कर्मचारियों की वरीयता सूची तैयार करेगा।

(2) प्रोन्नति वरीयतानुसार विभागीय प्रोन्नति समिति की अनुशंसा पर दी जाएगी।

9. परिवीक्षा।- प्रत्येक भर्ती दो वर्षाें की परिवीक्षा पर होगी और विशेष परिस्थितियों में इसका विस्तार एक वर्ष के लिए नियुक्ति प्राधिकार द्वारा किया जा सकेगा, यदि परिवीक्षा अवधि संतोषजनक नहीं हो। ऐसा अवधि विस्तार तभी होगा जब नियुक्ति प्राधिकार की राय में परिवीक्षाधीन व्यक्ति में सुधार की गुंजाइश हो। यदि विस्तारित अवधि में भी सेवा संतोषजनक नहीं पाया जाता है तो संबंधित व्यक्ति को सेवामुक्त कर दिया जायेगा।

10. विभागीय परीक्षा। विभागीय परीक्षा राजस्व पर्षद द्वारा संचालित की जायेगी।

11. सम्पुष्टि।-कोई परिवीक्षाधीन व्यक्ति परिवीक्षा अवधि की संतोषजनक समाप्ति तथा विभागीय परीक्षा की उत्तीर्णता के बाद सम्पुष्ट किया जायेगा।

12. वरीयता।-संवर्ग के सदस्य की आपसी वरीयता आयोग द्वारा निर्धारित उनकी मेधा स्थिति के अनुसार होगी:

परन्तु इस नियमावली के प्रवृत होने के पूर्व विनिश्चित आपसी वरीयता अपरिवर्तनीय रहेगी:

परन्तु यह भी किसी भर्ती वर्ष में प्रोन्नति द्वारा नियुक्त व्यक्ति संबंधित भर्त्ती वर्ष में प्रतियोगिता परीक्षा द्वारा नियुक्त व्यक्ति से वरीय होंगे।

13. प्रोन्नति।-मूल कोटि से उच्चतर कोटि में प्रोन्नति सामान्य प्रशासन विभाग द्वारा समय-समय पर निर्धारित कालावधि के पूरा होने पर और विभागीय प्रोन्नति समिति की अनुशंसा पर दी जा सकेगी।

14. संवर्ग का स्तर।-यह संवर्ग अंचल स्तरीय होगा परन्तु अचानक जरूरत होने पर या किसी अंचल में लिपिक संवर्ग के अभाव जैसी अत्यावश्यकता होने पर सवंर्ग के किसी कर्मचारी को दूसरे अचंल में, सेवा में उसके प्रवेश के आधार पर उसकी वरीयता को अक्षुण्ण रखते हुए स्थानान्तरित करने की शक्ति क्षेत्रीय मुख्य अभियंता/अभियंता प्रमुख-सह-विशेष सचिव, लोक स्वास्थ्य अभियंत्रण विभाग, बिहार, पटना को होगी।

15. अवशिष्ट मामले।-ऐसे मामले के संबंध में जो इस नियमावली द्वारा विशिष्ट रूप से आच्छादित नहीं है, संवर्गो के सदस्य राज्य सरकार के समुचित स्तर के पदाधिकारियों/कर्मचारियो के लिए लागू नियमावली/ विनियमावली या आदेशों से शासित होंगे।

16. कठिनाई का निराकरण।-राज्य सरकार (लोक स्वास्थ्य अभियंत्रण विभाग) सामान्य प्रशासन विभाग/विधि विभाग के परामर्श के पश्चात्‌ समय-समय पर ऐसा सामान्य या विशेष निदेश जारी कर सकेगा जो इस नियमावली के प्रावधानों में से किसी के कार्यान्वयन में आ रही कठिनाई के निराकरण के लिए आवश्यक हो। 17. निर्वचन।-जहाँ इस नियमावली के प्रावधानों में से किसी के निर्वचन के संबंध में कोई शंका उत्पन्न हो वहाँ मामला लोक स्वास्थ्य अभियंत्रण विभाग द्वारा/सामान्य प्रशासन विभाग एवं विधि विभाग के परामर्श के पश्चात्‌ विनिश्चित किया जायेगा और उसका निर्णय अंतिम होगा।4 ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 23 माच(cid:17) 2017 18. निरसन एवं व्यावृति।-

(1) इस संवर्ग के संबंध में पूर्व में निर्गत सभी संकल्प एवं अनुदेश निरसित किये जाते है। (2) ऐसे निरसन के होते हुए भी, ऐसे संकल्प, अनुदेश के अधीन किया गया कोई कार्य या की गयी कोई कार्रवाई इस नियमावली के अधीन किया गया कार्य या की गई कार्रवाई समझी जायेगी मानो यह नियमावली उस दिन प्रवृत थी जिस दिन ऐसा कार्य या कार्रवाई की गयी थी।

No. 3/विविध-1098/13-1027— In exercise of powers conferred by proviso to Article 309 of the constitution of India, the Governor of Bihar is pleased to make the following Rules to regulate the recruitment and service conditions in the clerical Cadre at circle level of the Public Health Engineering Department within the State of Bihar:-

BIHAR PUBLIC HEALTH ENGINEERING CIRCLE LEVEL CLERICAL CADRE

(RECRUITMENT & SERVICE CONDITIONS) RULES, 2016

1. Short title, extent & commencement.— (1) These Rules may be called the Bihar Public Health Engineering Circle level Clerical cadre (Recruitment & service conditions) Rules, 2016 (2) It will extend to the whole state of Bihar.

(3) It will come into force at once.

2. Definitions.—In these Rules, unless otherwise required in the context:-

(i) 'Cadre' means Clerical Cadre under the Public Health Engineering Circle.

(ii) 'Commission' means Bihar Staff Selection Commission ,

(iii) 'Appointing Authority' means Concerned Suprintending Engineer;

(iv) 'Appointed Date' means the date of coming into force of these Rules; and (v) 'Member' means a person appointed in the cadre and it includes all the persons appointed to the clerical posts under the Public Health Engineering Department prior to the commencement of these Rules.

3. Structure of the cadre.— The cadre structure of the clerical cadre shall be according to the following:-

Note :- The pay scale sanctioned by the Government, from time to time, shall be payable to Lower Division Clerk, Upper Division Clerk, Head Clerk and office suprintendent.

4. Cadre strength.— The cadre strength shall be such as may be determined by the Public Health Engineering Department, from time to time.

5. Recruitment.—

(1) 85% posts of Lower Division Clerk shall be filled by direct recruitment and 15% posts shall be filled from amongst eligible Group 'D' employees passed intermediate (10+2) or equivalent with knowledge of computer operation and computer typing according to seniority. 10% posts from 85% posts of direct recruitment will be reserved for appointment on compassionate ground.

(2) All recruitments shall be made in the category of Lower Division Clerk on the recommendation of Bihar Staff Selection Commission.

(3) The Appointing Authority shall calculate vaccancies on the basis of position as on 1st April each year and shall send requisition to the Commission by 30th April.

(4) The Commission shall advertise vaccancies, and after selecting successful candidates on the basis of Competitive Examination, shall recommend names of the candidates in order of merit to the concerned Appointing Authorities. The merit list shall remain valid for one year from the date of receipt of recommendation in the department.

(5) After due scrutiny, the Appointing Authority shall appoint the candidate on probation.

6. Qualification.—

(1) The minimum educational qualification shall be Intermediate (10+2) or its equivalent with knowledge of computer operation and computer typing.

(2) For recruitment, the minimum age shall be 18 years and maximum age shall be the same as may be determined by the State Government (General Adiministration Department), from time to time.

ॢबह(cid:4)र गजट (cid:10)[स(cid:4)ध(cid:4)रण(cid:15)(cid:16) 23 माच(cid:17) 2017 7. Reservation.— It shall be necessary to comply reservation/roster in the recruitment and promotion, notified by the State Government, from time to time.

8. Recruitment by Promotion.—

(1) The Appointing Authority shall prepare seniority list of Group 'D' employees having educational qualification of Intermediate (10+2) passed with knowledge of Computer operation and Computer typing.

(2) Promotion shall be given according to seniority on the reommendation of the Departmental Promotion Committee.

9. Probation.— The probation period shall be of two years and in special circumstances, if the probation period is not satisfactory it may be extended for one year by the Appointing Authority.

Such extension of period will be made only when in the opinion of the Appointing Authority, there is chance of improvement in the probationer. If the service is not found satisfactory in the extended period also, then the service of concerned person shall be terminated.

10. Departmental Examination.— The Departmental Examination shall be conducted by the Board of Revenue.

11. Confirmation.— The person under probation shall be confirmed after satisfactory completion of probation period and passing of Departmental Examination.

12. Seniority.— The inter-seniority of members of the cadre shall be according to their merit position determined by the Commission:

Provided that the inter-seniority determined before coming into force of these Rules shall remain unchangeable:

Provided further that the person appointed by promotion in a recruitment year shall be senior to the person appointed by the Competitive Examination in the concerned recruitment year.

13. Promotion.— The promotion from basic category to higher category shall be given on completion of 'KALAWADHI' determined by the General Adminstration Department, from time to time, and on recommendation of the Departmental Promotion Committee.

14. Level of the cadre.— This cadre shall be at circle level, but in case of sudden necessity or exigencies like shortage of staff in a circle, the concerned zonal Chief Engineer/Engineer-in- Chief-cum-Special Secretary shall have powers to transfer an employee maintaining his seniority on the basis of his entry into the service.

15. Residue matters.— With respect to such matters which are not specially covered by these Rules, the member of the cadre shall be governed by The Rules/The Regulations or Orders, applicable to the officers/employee of appropriate level of the Government.

16. Removal of difficulties.— The State Government (Public Health Engineering Department, Bihar) may issue such general or special directions, from time to time, which is necessary for removal of difficulties arising in the implementaion of any of the provision of these Rules after consultation with The General Administration Department and Law Department. 17. Interpretation.— Where any doubt arises with respect to interpretation of any provision of these Rules, the matter shall be determined by the Public Health Engineering Department after consultation with The General Administration Department and Law Department and its decision shall be final.

18. Repeals & Savings.—

(1) All Resolution and Instructions issued earlier with respect to this cadre are hereby repeated.

(2) Not withstanding such repeal, any work done or any action taken under such Resolutions and Instructions shall be deemed to be done or taken under these Rules, as if these Rules were in force on the day when it was done or taken.
