3. संवर्ग का गठन ।संवर्ग का गठन ।संवर्ग का गठन ।संवर्ग का गठन । यह संवर्ग बिहार सचिवालय भोजश् ााला, पटना तक सीमित रहेगा। इस नियमावली के लागू होने से पूर्व बेकर, मशालची, सहायक हलुवाई, सहायक रसोईया एवं टी-मेकर के पद पर कार्यरत कर्मी मूल कोटि ाालची, सहायक हलुवाई, सहायक रसोईया एवं टी-मेकर के पद पर कार्यरत कर्मी मूल कोटि ाालची, सहायक हलुवाई, सहायक रसोईया एवं टी-मेकर के पद पर कार्यरत कर्मी मूल कोटि ांग ब्वॉय, वियरर एवं हेड सर्विस ब्वॉय के पद पर कार्यरत कर्मी मूल कारीगर पद में, सर्विस ब्वॉय, वाशिंग ब्वॉय, वियरर एवं हेड सर्विस ब्वॉय के पद पर कार्यरत कर्मी मूल के सहायक कारीगर पद में, सर्विस ब्वॉय, वाश्ि ल्पर एवं टे्रजरी सरकार के पद पर कार्यरत कर्मी मूल कोटि के विक्रेता पद में, कोटि के बेटर पद में, विक्रेता, हेल्पर एवं टे्रजरी सरकार के पद पर कार्यरत कर्मी मूल कोटि के विक्रेता पद में, ल्पर एवं टे्रजरी सरकार के पद पर कार्यरत कर्मी मूल कोटि के विक्रेता पद में, आदेशपाल, चपरासी-सह-चौकीदार एवं गेट मेन के पद पर कार्यरत कर्मी मूल कोटि के चौकीदार पद में निहित माने आदेशपाल, चपरासी-सह-चौकीदार एवं गेट मेन के पद पर कार्यरत कर्मी मूल कोटि के चौकीदार पद में निहित माने आदेशपाल, चपरासी-सह-चौकीदार एवं गेट मेन के पद पर कार्यरत कर्मी मूल कोटि के चौकीदार पद में निहित माने जायेंगे।

ा अवधारित कर सकेगी तथा प्राधिकृत बल एवं वेतनमान ।प्राधिकृत बल एवं वेतनमान ।प्राधिकृत बल एवं वेतनमान ।प्राधिकृत बल एवं वेतनमान । सरकार इस संवर्ग में पदों की प्राधिकृत संख्या अवधारित कर सकेगी तथा इसके अतिरिक्त स्थायी या अस्थायी पद भी सृजित कर सकेगी, अथवा किसी पद को स्थगित या रिक्त रख सकेगी, इसके अतिरिक्त स्थायी या अस्थायी पद भी सृजित कर सकेगी, अथवा किसी पद को स्थगित या रिक्त रख सकेगी, इसके अतिरिक्त स्थायी या अस्थायी पद भी सृजित कर सकेगी, अथवा किसी पद को स्थगित या रिक्त रख सकेगी, जिसके कारण छॅटनीग्रस्त होने पर इस संवर्ग का कोई भी सदस्य क्षतिपूर्ति का हकदार नहीं होगा। स्वीपर का पद जिसके कारण छॅटनीग्रस्त होने पर इस संवर्ग का कोई भी सदस्य क्षतिपूर्ति का हकदार नहीं होगा। स्वीपर का पद जिसके कारण छॅटनीग्रस्त होने पर इस संवर्ग का कोई भी सदस्य क्षतिपूर्ति का हकदार नहीं होगा। स्वीपर का पद2 (cid:1)बहार गजट (असाधारण), 28 माच#माच#माच#माच# 2017 आउटसोर्सिंग से भरा जायेगा। स्वीपर पद पर कार्यरत कर्मी के सेवानिवृत्ति के पश्चात्‌ उक्त पद स्वतः समाप्त हो जायेगा।

संवर्ग के विभिन्न पदों/कोटि के कर्मियों का वेतनमान सरकार द्वारा, समय-समय पर, अवधारित वेतनमान के अनुरूप होगा।

5555.... आरक्षण । आरक्षण । आरक्षण । आरक्षण । नियुक्ति/प्रोन्नति में राज्य सरकार द्वारा, समय-समय पर, अवधारित आरक्षण नीति/रोस्टर का अनुपालन आवश्यक होगा। रिक्तियों का आकलन प्रत्येक वर्ष की पहली अप्रैल को करने के पश्चात्‌ ही वास्तविक एवं संभावित रिक्तियों के अनुसार रोस्टर पंजी क्लीयर करवाकर आरक्षण कोटिवार अनुशंसित पैनल से नियुक्ति की जा सकेगी।

6666.... भर्ती ।भर्ती ।भर्ती ।भर्ती । समूह 'घ' के पदों पर सीधी भर्ती मूल कोटि के पदों पर होगी। इस संवर्ग के अन्तर्गत अनुसूची 'क' में उल्लिखित पदाें पर नियुक्ति हेतु अनुशंसा प्राप्त करने के प्रयोजनार्थ एक चयन समिति का गठन निम्नवत किया जाएगा-

(i) श्रमायुक्त, बिहार ...................................................................................................................अध्यक्ष। (ii) संयुक्त श्रमायुक्त, बिहार .....................................................................................................सदस्य। (iii) अनु0 जाति/अनु0 जनजाति/अल्पसंख्यक एवं महिला कोटा के संयुक्त सचिव के स्तर से अन्यून एक पदाधिकारी .......................................................................................................सदस्य।

(iv) प्रबंधक, बिहार सचिवालय भोजशाला ....................................................................सदस्य सचिव।

चयन समिति जांॅचोपरान्त योग्य उम्मीदवारों की एक सूची तैयार कर प्रशासी विभाग को साैंपेगी। चयन की प्रक्रिया का अवधारण विभाग द्वारा किया जाएगा।

7777.... अहर्ता । अहर्ता । अहर्ता । अहर्ता । उम्मीदवारों की सीधी भर्ती हेतु योग्यता/शर्ते निम्नलिखित होंगी- (i) उम्मीदवारों की शैक्षणिक योग्यता मैट्रिक या समकक्ष उत्तीर्ण होगी। (ii) भारत सरकार/बिहार सरकार/अन्य राज्य सरकार द्वारा मान्यता प्राप्त संस्थान से वेटर/कुक/फुड एण्ड बेवरेज सर्विस/आतिथ्य एवं पर्यटन के लिए न्यूनतम छः माह का प्रशिक्षण प्रमाण-पत्र अथवा श्रम विभाग के दुकान एवं प्रतिष्ठान अधिनियम के अन्तर्गत 100 या उससे अधिक कर्मचारियों के लिए निबंधित/मान्यता प्राप्त होटल/रेस्तरॉ/गेस्ट हाउस/रेस्ट हाउस में पद के अनुरूप न्यूनतम तीन वर्षाें का अनुभव अथवा बिहार विधान मंडल के न्यूनतम 10 सत्रों में आकस्मिक मजदूर के रूप में कार्य करने का अनुभव।

(iii) उम्मीदवारों की न्यूनतम आयु 18 वर्ष और अधिकतम आयु वही होगी जैसा कि राज्य सरकार द्वारा समय-समय पर विनिष्चित किया जाएगा। नियमित नियुक्ति में वर्त्तमान में अथवा पूर्व में कार्य कर चुके आकस्मिक मजदूरों को वेटेज देते हुए उम्र सीमा में छूट दी जा सकेगी। सत्रावधि में कार्य अनुभव के आधार पर प्रत्येक सत्र के लिए 6 माह की दर से नियुक्ति की उम्र सीमा में छूट दी जा सकेगी। यह छूट अधिकतम 15 वर्षों की होगी किन्तु शैक्षणिक अर्हता में कोई शिथिलीकरण अनुमान्य नहीं होगा।

8888.... परिवीक्षा अवधि/सम्पुष्टि ।परिवीक्षा अवधि/सम्पुष्टि ।परिवीक्षा अवधि/सम्पुष्टि ।परिवीक्षा अवधि/सम्पुष्टि । नवनियुक्त कर्मी की परिवीक्षा अवधि नियुक्ति की तिथि से दो वर्षो की होगी। परिवीक्षा अवधि सफलतापूर्वक पूरा करने और उक्त अवधि में सेवा संतोषप्रद होने पर, नियुक्ति प्राधिकार सेवा सम्पुष्ट करेंगे। यदि परिवीक्षा अवधि में सेवा संतोषप्रद नहीं हो तो परिवीक्षा अवधि लिखित रूप में अभिलिखित किए जाने वाले कारणों से, एक वर्ष के लिए बढ़ाई जा सकेगी, परन्तु परिवीक्षा की कुल अवधि तीन वर्षो से अधिक की नहीं होगी। विस्तारित अवधि मे भी सेवा संतोषप्रद नहीं होने पर उन्हें सेवामुक्त किया जा सकेगा।

9999.... प्रश्प्रिश्प्रिश्प्रिशिक्षण । ाक्षण । ाक्षण । ाक्षण । विभाग द्वारा अपेक्षित समय-समय पर निर्धारित प्रशिक्षण प्राप्त करना आवश्यक होगा। प्रशिक्षणोपरान्त उत्तीर्णता के आधार पर क्रमशः समूह 'घ' के मूल कोटि-3 से कोटि-2 एवं कोटि-2 से कोटि-1 पर प्रोन्नति दी जा सकेगी।

10101010.... प्रोन्नति । (प्रोन्नति । (प्रोन्नति । (प्रोन्नति । (1)))) अनुसूची- 'क' में उल्लेखित कोटि के पदों पर प्रोन्नति, विभागीय प्रोन्नति समिति की अनुशंसा के आधार पर की जा सकेगी।

((((2)))) विभिन्न कोटि में प्रोन्नति की अनुशंसा हेतु विभागीय प्रोन्नति समिति का गठन निम्नलिखित को मिलाकर किया जाएगा :-

(क) श्रमायुक्त, बिहार, पटना.........................................................................................................अध्यक्ष। (ख) श्रम संसाधन विभाग के संयुक्त सचिव के स्तर से अन्यून पदाधिकारी ........................सदस्य। (ग) श्रम संसाधन विभाग में उपलब्ध अनु0 जाति/अनु0 जनजाति/अल्पसंख्यक एवं महिला कोटा के एक पदाधिकारी.......................................................................................................सदस्य। (घ) संयुक्त श्रमायुक्त, बिहार-सह-वरीय प्रभारी पदाधिकारी भोजशाला.....................सदस्य सचिव। (ड.) प्रबंधक, बिहार सचिवालय भोजशाला...........................................................................सदस्य।

((((3)))) प्रोन्नति में आरक्षण अधिनियम/कालावधि संबंधी नियम/अनुदेशों के प्रावधानों का अनुपालन अनिवार्य होगा।3 (cid:1)बहार गजट (असाधारण), 28 माच#माच#माच#माच# 2017 ((((4)))) समूह 'घ' के कर्मी जो निम्नवर्गीय लिपिक के पद पर नियुक्ति की अर्हता रखते हैं, वे श्रमायुक्त, बिहार के अधीन के पद पर, सामान्य प्रशासन विभाग, बिहार सरकार द्वारा विहित प्रकिया के अनुरुप प्रोन्नति पा सकेंगे। 11111111.... वरीयता ।वरीयता ।वरीयता ।वरीयता । समूह 'घ' के मूल कोटि के सभी पदों की संयुक्त वरीयता सूची सामान्य प्रशासन विभाग द्वारा अवधारित मानदण्डों के अनुसार श्रमायुक्त, बिहार द्वारा तैयार की जाएगी।

14141414.... निरसन एवं व्यावृत्ति ।निरसन एवं व्यावृत्ति ।निरसन एवं व्यावृत्ति ।निरसन एवं व्यावृत्ति । (1) इस नियमावली के लागू होने के पूर्व इस संवर्ग के प्रसंग में निर्गत सभी संकल्प/अनुदेश एतद्‌द्वारा निरसित किए जाते हैं।

(2) ऐसे निरसन के होते हुए भी उक्त संकल्प/अनुदेश के अधीन किया गया कुछ भी या कोई कार्रवाई इस नियमावली के अधीन किया गया या की गयी समझी जायेगी मानो यह नियमावली उस दिन प्रवृत्त थी जिस दिन वैसा कुछ किया गया था या वैसी कार्रवाई की गई थी।

एस0ओ0 19, एस0ओ0 18, दिनांक 28 मार्च 2017 का अंग्रेजी में निम्नलिखित अनुवाद बिहार-राज्यपाल के प्राधिकार से इसके द्वारा प्रकाशित किया जाता है, जो भारत के संविधान के नियम-348 के खण्ड (3) के अधीन अंग्रेजी भाषा में उसका प्राधिकृत पाठ समझा जायगा।

The 27th March 2017

S.O. 18, dated the 28th March 2017—In exercise of powers conferred under

proviso to Article- 309 of the Constitution of India, the Governor of Bihar, is pleased to

make the following Rules for the posts of Group 'D', The Bihar Secretariat Canteen:-

1. Short title, extent and commencement- (1) These Rules may be called as "Bihar Secretariat Canteen Group 'D' Rules, 2017."

(2) It shall extend to the Bihar Secretariat Canteen, Patna. (3) It shall come into force immediately.

2. Definitions- In these rules, unless otherwise requires in the context-

(i) 'State Government' means, Bihar State Government; (ii) 'Appointing Authority' means, the Labour Commissioner, Bihar, Patna; (iii) 'Department' means, the Labour Resource Department, Bihar; (iv) 'Cadre' means, the Group 'D' Cadre of Bihar Secretariat Canteen under the control of Labour Commissioner, Bihar;

(v) 'Cadre Controlling Authority' means, the Labour Commissioner, Bihar, Patna;

(cid:1)बहार गजट (असाधारण), 28 माच#माच#माच#माच# 2017 (vi) 'Selection Committee' means the Selection Committee constituted under the rule-6 of these Rules.

3. Cadre Structure - This cadre shall be confined to the Bihar Secretariat Canteen. the employee working as Baker, Mashalchi, Assistant Halwai, Assistant Cook and Tea- Maker before the implementation of these Rules will deemed be rested in the post of 'Assistant Karigar' of basic category the employee working as Service Boy, Washing Boy, Bearer and Head Service Boy will deemed to be rested in the post of 'Waiter' of basic category the employee working as Salesman, Helper and Treasury Sarkar will be rested in the post of 'Salesman' of basic category the employee working as orderly, Peon-cum- Choukidar and Gateman will be deemed to be rested in the post of 'Choukidar' of Basic Category.

4. Authorized Strength and Pay Scale- The Government may determine the authorised number of posts in this cadre and also create the permanent and temporary posts besides this, or put any post under suspension or vacant, due to which no member of this cadre will be entitle to claim compensation on retrenchment. The post of 'Sweeper' will be filled up by outsourcing. The post of sweeper will come to an end automatically with the retirement of the employee working on the post of sweeper.

The pay scale of the employee working on different categories posts of this cadre will be in confirmity with the pay scale determined by the government from time-to-time.

5. Reservation-It will be compulsory to follow the provisions of reservation policy/roster determined by the government, from time-to-time in the appointment and promotions. The appointment may be made from the panel recommended reservation wise according to the clearance of roster Register of the actual and possible vacancies after calculation of vacancies on 1st April of every year.

6. Recruitment- (1) Direct appointment to the posts of Group 'D' will be on the posts of basic categories.

A selection committee will be constituted as follows for the purpose obtaing recommendation for appointment to the posts of this cadre mentioned in schedule 'A' (i) Labour Commissioner, Bihar....................................................Chairman (ii) Joint Labour Commissioner.................................................................Member (iii) One representative from the SC/ST. minority and woman quota, not below the rank of Joint Secretary.................................................Member

(iv) Manager, Bihar Secretariat Canteen ..................................................Member Secretary

The selection committee will hand over a list after verifying the suitable candidates to the department. The process of selection will be determined by the department.

7. Qualifications–For direct appointment of the candidates, qualifications/conditions will be the following :-

(i) Minimum educational qualifications of the candidates will be matric pass or equivalent;

(ii) Minimum six months training certificate from any recognized institute of Indian Government/Bihar Government/any State Government for the post of Waiter/Cook/Food and Beverage Service/Hospitality and Tourism; or minimum three years of work experience in any registered/recognized hotels/restaurants/guest house/rest house for 100 or more employees under the Shops and Establishment Act of Labour Department, or Minimum Working experience of ten sessions of Bihar Legislature for the casual labours.

(iii) Minimum age of the candidates will be 18 years and the maximum age will be the same as may be determined by the government, from time-to-time. Age relaxation may be given in direct appointment to the casual labours who are working or had worked earlier during sessions. Age relaxation may be given at the rate of six (6) months for every session to those who have worked during sessions. This relaxation will be maximum for 15 years but no relaxation will be allowed in educational qualification.

8. Probation Period/Confirmation- The probation period will be for two years from the date of appointment for the newly appointed employee. The appointing authority will confirm the appointment after the successful completion of probation period and satisfactory service period. If the Service is not satisfactory in the probation period. The probation period may be extended for another one year for the reasons to be , recorded in writing Total probation period can not be more than three years. He may be removed from service , if his service is not satisfactory in the extended period.

9. Training- It will be essential to participate in the training programme held by the department from time-to-time. Promotion may be given from the post of basic category-3 to category-2 and from category to category-1 respectively of Group 'D' on the basis of passing of the training.

10. Promotion- (1) Promotion may be given to the posts of the categories mentioned in schedule 'A' on the basis of recommendation of Departmental Promotion Committee.

(2) Departmental promotion committee will be constituted for the recommendation of the promotion in the different categories consisting of the following :-

(4) The employee of Group 'D' who have the qualifications for the appointment to the

post of Lower Division Clerk, may get promotion in confirmity with the process prescribed by General Administration Department of Bihar Government, to the posts under the control of Labour Commissioner, Bihar.

11.Seniority- Joint seniority list of all posts of basic categories of Group 'D' will be prepared by the Labour Commissioner according to the criterion determined by the General Administration Department.

12. Residuary Matters- All rules, instructions etc forced will be applicable in respect of Service-conditions, discipline, leave, modified career progression given to other employees of the state government shall be applicable equally to the members of this cadre.

13. Removal of Difficulties– Where any doubt arises as to the interpretation of any of the provision of these rules, the decision of the Labour Commissioner, Bihar, after consultation with The Law Department shall be final on this matter.

14. Repeal and Savings- (1) All resolutions and instructions issued earlier before the implementation of these Rules are hereby repealed.

(cid:1)बहार गजट (असाधारण), 28 माच#माच#माच#माच# 2017 (2) Notwithstanding such repeal, anything done or any action taken under the said resolutions, instructions shall be deemed to have been done or taken under these rules as if these Rules were in force on the day on which such things or action was done or taken.
